Washington DC - -( For decades, gun-grabbers have been using the “gun show loophole” to push their gun control agenda.

This so-called loophole has a become a boogeyman for pushing everything from bans on gun shows to bans on private firearm sales to every conceivable facet of gun control a shameless politician can use in a sentence with “gun show loophole.”

But here’s the problem — there is no such thing as a gun show loophole. Read that again – there is no such thing as a gun show loophole. To talk of one is like talking about a progressive flat tax or a square circle: it’s senseless.

However, there is a loophole that needs to be addressed — the gun control loophole.

This is a hole in an already flawed system of gun controls that give criminals the upper hand by denying arms to law abiding citizens while doing nothing to affect the gun market criminals enjoy.

It’s really a frightening scheme if you think about it. Politicians who make hay by pointing fingers at gun shows argue that gun show attendees get around federal law by  buying their guns without a background check. What they never tell you is that there is no federal law requiring a background check on secondary gun sales, and there never has been.

In other words — it’s not illegal to buy a gun from your neighbor, your father, or your friend.


It is an affront to thinking people, and particularly to free people.

If we want to fix something in this country, let’s fix the governmental overreach that already exists in the area of firearms. As Chicago proves on a daily basis, the gun control loophole is far more dangerous than the fictitious “gun show loophole” ever has been.

      Let me begin by saying I am a Life Member of the NRA. Have been for 25+ years. Personally I have no problem with background checks. Of course there is currently no way for me to do that. But the truth I would feel more comfortable selling a gun to a stranger if I could do a background check.

    2. Everyone, even you, knows that the expression “close the gun show loophole” means prohibit private sales without background checks. It’s tedious as well as dishonest to pretend otherwise.

    3. Kent; You must understand that to the banners, every step is just one more step. They have made no secret that the goal is a UK level gun ban.

      I’ve learned from my anti gun friends,(yes, at least 60% of my friends are) are afraid. Pure and simple fear. They don’t have guns. They don’t understand them. And they fear those that do. They believe that you, Kent, and I, are just one tantrum or drunk away from Aurora or Sandy Hook. And, and this is the big AND, they are just as afraid of a 5-6 shot revolver as a 17 shot Glock. Just as afraid of a double barrel shotgun as an AR-15. One friend said in all seriousness he wants to ban all but single shot rifles and shotguns. Another all handguns period. These two are not raging liberals. They are both politicly conservative. There is NO middle ground because the goal is not in the middle. It’s a total ban!

    4. Oh yes Kent. I usually sell guns through an FFL dealer. And I always worry about private sales too.

    5. There IS one huge gun show loophole that needs closing , that is the one that insures there are always more FEDS in the place than regular customers .

    6. 40% of all guns are sold at gun shows – many without any record, which makes solving murders difficult for law enforcement. Many sales at gun shows don’t involve a background check, which is the technical definition of the gun show loophole. The loophole allows criminals and crazy people to have guns.

      @Larry as a so called lawyer you of all people, should be used to using facts, your number of 40% is made up, where did you get that number, no one keeps track of that kind of info, saying that criminal and crazy people are buying guns is a bold face lie, what you fail to say is that all the people at these gun shows and no one is doing anything wrong or breaking the law. I would call your state bar and tell them they made a mistake calling you a lawyer.
