Stopping Federal Anti-Gun Law at the State Level

Houston, Tx –-(Ammoland.com)- A proposal to existing Wyoming law is causing a stir in Texas.

HB 104 is an amendment to a tenuous existing Wyoming law which is currently being decided in the courts.

HB104 says “AN ACT relating to firearms; providing that any federal law which attempts to ban a semi-automatic firearm or to limit the size of a magazine of a firearm or other limitation on firearms in this state shall be unenforceable in Wyoming; providing a penalty; and providing for an effective date.”

Is this an admirable public policy statement or a tool to stop an aggressive federal intrusion?

If Wyoming HB 104 is a “usable tool” as intended, the Texas Legislature will certainly follow.

In the meantime, others have stepped forward. Lt. Governor David Dewhurst was recently asked if a remedy was available in the state of Texas to stop firearm confiscations and other serious attacks on 2nd Amendment rights.

Dewhurst answered that he could be named as the plaintiff in a lawsuit on behalf of the State of Texas against the Federal Government. A temporary restraining order would halt the onerous action. The suit would likely go to the U.S. Supreme Court which could take 2 years. Our lawyer? Why, Texas Attorney General Greg Abbott, of course!

While the Wyoming law might work against a federal assault, remember the Texas Legislature is still organizing for legislative session with 138 days to go. Final passage for most legislation takes about half that time to cycle through the entire process.

We might need quicker action. It’s good to know we have friends in high places. watching.

I don't think it will come to a Lexington II at this time. I think more owners will bury them for a while before raising up.

I'm just glad all my guns were stolen in a recent break-in, now just gotta wait for that insurance check to come in

There are many states ,all the southeast, some of the midwest and most of the west that are watching this issue closely. So many now feel this will be the cause for Lexington Green 1775 all over again. This is exactly why so much ammo and so many guns especially in these states are selling rapidly out everywhere. Resistance to tyranny is our duty.

If these states pass a law protecting our gun rights then my home will go up for sale the same day. I live in Oregon which shiould be called northern California.

I hope the state legislatures of Montana, Wyoming, Utah, Idaho, Arizona, and Texas (and any others) pass laws like the one that will hopefully pass this month in Wyoming. The west coast states are too liberal to do this unfortunately.
