California – -(Ammoland.com)- Ninth Circuit Issues Historic Pro-Gun Ruling ..! It is something that gun owners in California can’t often claim.

But The Calguns Foundation, alongside California Association of Federal Firearms Licensees and the Second Amendment Foundation, scored an important victory in the Ninth Circuit Court of Appeals earlier today!

The opinion, issued this morning in the case of Teixeira, et al. v. County of Alameda, held that the Second Amendment right of gun purchasers extends to protect gun retailers from being shut out of an area.

Under the challenged Alameda County ordinance, a new gun store must be located at least 500 feet away from any residentially zoned district, elementary, middle or high school, pre-school or day care center, another firearms sales business, or places where liquor is sold or served.

But, according to a scientific study conducted by the plaintiff, which included a geographic study of the entirety of Alameda County, there are no parcels within the county that meet the ordinance’s requirements.

Writing for the majority, Judge O’Scannlain held that the “right of law-abiding citizens to keep and to bear arms is not a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees…

“If the right of the people to keep and bear arms is to have any force, the people must have a right to acquire the very firearms they are entitled to keep and to bear. Indeed, where a right depends on subsidiary activity, it would make little sense if the right did not extend, at least partly, to such activity as well….Alameda County has offered nothing to undermine our conclusion that the right to purchase and to sell firearms is part and parcel of the historically recognized right to keep and to bear arms.”

This is such an integral case to our fundamental rights, and we are winning!

That said, we can’t continue to do it without your support.

If you’d like to see California ‘s anti-gun laws keep losing, please chip in a tax-deductible donation to support this and other gun rights cases.

All you California voters out there please DO NOT vote for Democrat Kamala Harris for State Senate, she is as anti-gun as they come. She is the one that’s appealing the ruling of the Peruta vs. San Diego case.
Please vote for any other Republican Candidate that is running for that seat.

I want to reiterate what Rob wrote. DO NOT VOTE FOR DEMOCRAT KAMALA HARRIS.

If she gets in …. She’ll be there for decades. She’ll be an old gun control hag like Fienstein.

Only the top two vote getters advance to the November election. So I’m thinking Thomas Del Beccaro (R).

Wild Bill

This case makes the next presidential election even more important because this case is sure to go to the SCOTUS. And the next S.CT. justice will be nominated by Donald or hiLIARy.

MontieR, And most of these loons are a product of the California State university system.

I couldn’t agree more! Think about it: real FACTS and DATA show entirely different statistics than those espoused by anti-gunners. However, they still pursue the tactic of shocking the public with lies and innuendo aimed not at the criminal element responsible for drive-by shootings, robberies, break-ins, muggings and murder, but rather targeting law abiding citizens. Although it COULD be said that these anti-gunners are concerned about violence and tragic loss of life, I believe their agenda is much more sinister. Liberals have never let actual facts and truth get in the way of their purposes.

MontieR

Every aspect of the anti gun NUTS agenda is based on outright lies and pathological fear. Their complete departure from fact and reason is a clear sign they are mentally unstable to start with. Every time I see or hear one of these despicable liars touting some made up “truth” like the 90% of Americans are in favor of background checks, News flash morons we already have mandatory background checks, it churns my stomache. Their juvenile inability to read and grasp a simple paragraph is quite telling of their mental condition. In every case in the US their clarion call… Read more »

MontieR, You’re a thoughtful and intelligent person. I must, however, disagree with your understanding of the situation in California. As far as the Democrat legislators in the state, and other political jurisdictions are concerned, they’re just Democrat guppies swimming in a big Democrat Ocean. All good things, as far as they are concerned flow down from the Party Leaders, and the cash flows from big fish like Bloomberg, and Soros, If they want to keep A swimming, they are expected to be a dependable part of the School. The word flows downhill, from the Oval Office, and the Hillary Podium,… Read more »

you are far too kind and generous with Alameda County’s overlords. Not long ago they passed a new special law banning gun shows inside the county. WHY? The county hooh hahs are a bunch of hoplophobic morons that somehow think the Constitution does not apply to their activities. No, this law was carefully crafted for the express purpose of banning any further new gun stores in the county. Simple as that. There may well also have been some specific angst against the individuals involved who were trying to launch their new business venture. The county is huge, population-wise, but not… Read more »
