Judge Rules You Have Less Rights Than Retired Gov. Employees

Sacramento, CA -(AmmoLand.com)- A federal judge ruled that some California gun owners have more rights than others.

And we don’t think that’s okay.

Garcia v. Harris, our civil rights challenge to the special exemptions granted to retired law enforcement officers in SB 707, which bans concealed carry on school grounds for most individuals, was dismissed by Judge Beverly Reid O’Connell.

In her decision, Judge O’Connell declared that:

“[T]he government interest here is one of private protection and self-defense” for retired government employees on school property and “[t]herefore, allowing retired peace officers an exemption from the general ban of carrying concealed weapons on school property is rationally related to the legitimate state interest of ensuring their protection.”

That decision is a slap in the face to the thousands of people who go through the process of becoming a concealed carry permit holder.

Judge O’Connell is telling them that their training, their permits, their rights and their lives are not as valuable as those of a retired government employee.

It was as if the decision was taken from the pages of Orwell’s Animal Farm: “All animals are equal, but some animals are more equal than others…”

BE A PART OF THE BATTLE AT THE NINTH CIRCUIT

Which is exactly why we are appealing to the Ninth Circuit Court of Appeals.

The Ninth Circuit ruled in Silveira v. Lockyer, on nearly identical facts, that favoring retired peace officers over similarly-situated civilians violated the Equal Protection Clause of the United States Constitution. If that same logic is applied in Garcia v. Harris, we will prevail – and there will no longer be two classes of gun owners in California.

Judge O’Connell’s ruling means we will be taking the long road to restore civil rights in California. And we can’t do it alone.

Now that we have to appeal the decision at the Ninth Circuit, it will take even more valuable resources.

Retired law enforcement officers have much more training, experience, and vetting than some guy with a CCW permit. The law and the ruling make perfect sense.

@Skipping,you’re an idiot ! Statistics in every state that has CCW has shown LE officers active/retired commit more firearm related crimes than CCW holders. Police officers are civilians too and their lives are no more/no less important than anyone else’s. If that makes perfect sense to you than you are a total and complete idiot !

What about our recently retired local police chief, who after twenty six years on the force did the unthinkable and shot his wife to death in the parking lot of QFC. Or how about a local sheriff deputy that held his family hostage and subsequently murdered two of his three kids along with his wife and himself. You are wrong. I have a CW and I train weekly. I train for general gun competence and I truing for combat conditions. Our group gets 10X more training than the average police officer. We have competition against the police 4 times a year and we have always won and outperformed them. Police typically do not get as much training as you think mules they are SWAT or another special unit.

Many of my friends are retired Navy personnel and living in California because that’s where they married and reared their families. They include combat marines from Korea the Middle East. I’d judge their experience, skill and peacefulness to be at least equal to the precinct clerk who never pulled his piece. Perhaps you forgot about them because you never served. That would explain your immature comment.

We Civilian gun owners in Connecticut challenged a Local Police Dept to a Combat Tactical shoot at a local range! Bet you can’t guess who won can you? The Veterans and Civilian NRA members put the snookers to the PRIS! So that comment by the Judge doesn’t hold any truths, he must be a Democrat with Hillary ties!

The judge is also saying that retired police officers have more rights than retired veterans who have a firearms permit. I guess if you are not a police officer you do not count in California.

Why all the fuss? When Hillary was excused for her felonies by the FBI, it should have told you that there were two sets of laws. One for the rich or connected, and one set for everyone else. So please stop this useless pursuit of equal justice under the law, and get ready to go stand in line at your local neighborhood security center to get your identity tracking implant.

John. Sure, cut and run; to where? The liberal turds are pushing this same garbage all over the country.

Stay and FIGHT. The Second Amendment is in jeopardy unless we take a stand and stop this kind of garbage.

There is NO justification for doing this. Just because a police officer “carried a firearm” doesn’t make them any safer than someone who has as much or more experience. Their lives are no more “valuable” than any other citizen.
