Washington, DC --(AmmoLand.com)- Tomorrow will be as important a day as any in our lifetimes in determining whether the anti-gun health care bill moves forward.

The key vote will be on shutting down a Republican filibuster of the ObamaCare bill, HR 3590. In the Senate, we are faced with a health care bill that:

• Costs $2.5 trillion during its first ten years of full implementation (2014-2023);
• Increases insurance premiums and imposes $376 billion in tax increases — many on the middle class; and
• Cuts Medicare by $465 billion, while increasing health costs by over $100 billion.

Fox News is reporting today that the word “tax” appears 183 times in the health care bill. Is Obama serious? Is that what he and Reid want to do to us in the midst of a recession?

Of course, all this increased spending — and taxes — means that you will have less money to spend on pursuing your real passions: like providing for your family and purchasing guns and ammunition!

The strategy in the Senate is to cram this bill down the American people’s throats before we have a chance to fully read and evaluate it. And the vote on Saturday at 8:00 p.m. will determine whether, at least initially, Senate Majority Leader Harry Reid will be able to get away with this.

Gun Owners of America has already gone into several states represented by key Democrats who will be central to the Saturday vote. But this is sufficiently important that all 100 senators need to know where we stand.

Finally, as we have mentioned several times in the past, the mandates in the legislation will most likely dump your gun-related health data into a government database that was created in section 13001 of the stimulus bill. This includes any firearms-related information your doctor has gleaned… or any determination of PTSD, or something similar, that can preclude you from owning firearms.

And, the special “wellness and prevention” programs (inserted by Section 1001 of the bill as part of a new Section 2717 in the Public Health Services Act) would allow the government to offer lower premiums to employers who bribe their employees to live healthier lifestyles — and nothing within the bill would prohibit rabidly anti-gun HHS Secretary Kathleen Sebelius from decreeing that “no guns” is somehow healthier.

We all need to contact our Senators right away.

Do you want left-wing bureaucrats appointed by Barack Obama, Nancy Pelosi and Harry Reid determining whether you should own a gun via the health care system?

If not, then you need to call right away. Our gun rights — and the fate of our economy — are hanging in the balance.

ACTION: Call your two U.S. Senators. Please urge them to vote against “cloture” on the “motion to proceed” to HR 3590.

You can call your Senators toll-free at 1-877-762-8762. The phones are ringing off the hook right now on Capitol Hill. More likely than not, you will have to try several times because the circuits have been overloaded.

But don’t be discouraged… keep calling!

Also, ask your wife, your relatives, your neighbors, your church — everyone, short of your dog — to do the same. This is crunch time!

Second Amendment March

Michigan - -(AmmoLand.com)- Things are going well with the Second Amendment March. We now have 29 State Coordinators and website traffic is holding steady at 45,000 unique visitors per week. Donations were up slightly last month but still painfully short of what we’ll need to pull this event off. I hate to beg, but even five dollars per person would be a great help in organizing efforts.

Dennis Sanford, our Field Representative, will be sending out the official letters to the gun industry next week asking for monetary and logistical support. We’re hoping that during these times of record firearm and ammo sales that the gun industry will help us out. If you have any leads on corporations or businesses (large or small) who would like to support the march, please email me at skip@secondamendmentmarch.com with all the details and I’ll follow up.

Also, I’ve recently mailed letters to Chris Cox and Wayne LaPierre of the National Rifle Association officially asking for their support. They have a lot of resources at their command and it would be great to get their help. Already, many NRA members are helping us out, but it is NRA headquarters who controls the assets we need to help publicize the march. A new and improved Second Amendment March website will be up and running in a few weeks. More details will follow in next week’s newsletter.

Your Board of Directors meets every Wednesday night to discuss and organize the march. Also, your State Coordinators meet every other Thursday to share plans and concerns as they organize on a state level.

Lately we’ve been getting a lot of help from nine-twelvers and TEA party folks. This is great because they are highly motivated and organized and they’ve already done a successful march on DC. We are learning from them everyday, and we appreciate their help.

I would like to do more radio interviews to publicize the march, so please have your local radio station contact me at 269-838-5586 to set it up. No radio station is too large or too small.

We’ve been working on a new online store and that should be up and running in two weeks. Stay tuned for details in next week’s newlsetter.

Second Amendment March Update for November 20th

Editor’s Note: This article by David Woodbury is aimed toward those who have not yet reached a point of confidence to carry concealed even though they have a permit to do so. It is better to build up one’s confidence even if one has to practice carrying a concealed mock weapon (if legally permitted in your area). No need for emails about how temporarily carrying a mock or empty weapon is useless. Never carrying at all due to lack of confidence in one’s abilities is permanently useless.

USCCA - -(AmmoLand.com)- It bears repeating: Practice handling and shooting your gun before you need to use it. But if you’re going to carry concealed, practice CARRYING before you actually do it.

Always Deciding to carry concealed presents some interesting and important mental challenges. Besides always staying in practice, so you are always as safe as you can be in a crisis, there are many more demands on you, all of them preceded by the word “always”. (And there are scores of other demands preceded by “never”, but those are the ones we hear all the time.)

• ALWAYS know where your gun is, both when it’s on your body and when it’s not.
• ALWAYS know whether it’s loaded, when it’s on your body and when it’s not.
• ALWAYS know whether it’s locked (or whether the safety is on, depending what type of hardware you’re packing).
• ALWAYS know how you can sit, stand, walk, and run so it won’t bulge or “print” on you.
• ALWAYS know how close you are to other people and whether there might be someone close by who would give you a spontaneous hug or a friendly pat in the wrong place.
• ALWAYS, always, always.

These are things — and I could add many more — that you cannot forget, even for a moment.

Permit Today, Pack Tomorrow. Yes, you can get a concealed carry permit and then immediately begin carrying when you’ve never, or seldom, done it before. But to do so requires a level of mental discipline that most of us don’t possess the moment we start. You will make mistakes if you do it that way. Start packing without the mental discipline, and you will fail the ALWAYS test above. So I’m here to offer a handful of suggestions.

A. Before you ever carry a loaded firearm, carry a single cartridge
Do it before you ever get a permit. Start with one, and see whether you can say positively that you are aware every moment where it is. Where is it while you’re in the shower? While you’re at work? While you’re at the Post Office or in church? Where is it when the clothes you just wore are in the washing machine? If you slip up and someone finds out that you have it, so what? You can explain it any number of ways, and you don’t need a permit.

Then carry six at once, or whatever number would fully reload your magazine or your cylinder. This may be more important a skill than you think, because even though the idea of carrying a lone bullet is to make you accountable for carrying a firearm later, you’ll also want to figure out how to carry extra ammo once you do start to go around armed.

(I’ve found that the little Tyvek sleeve the bank gives me for my credit card holds six round of .38 or .357 neat and flat.)

B. Carry a toy gun
In the side-street toy shops you can still buy a near-life-size plastic revolver or a squirt gun shaped like a semi-automatic. Try carrying one of these concealed for a few weeks. If it’s longer than your real gun, cut it down to match. Or, if it’s just too weird to carry plastic, cut a notch out of a bush or small tree (or carve a block of wood) to something vaguely resembling the dimensions of the gun you may one day carry, and carry the piece of wood for a few weeks first. If someone finds out you have it on you, again, you can explain it any number of ways.

If it’s not your intention to carry a concealed firearm but, say, a tactical knife for personal protection, then modify this suggestion to something vaguely resembling the size and weight of that equipment.

C. Carry an empty gun
Once you are comfortable with the feel of carrying and the discipline needed to keep it concealed and safe, there’s still a quantum mental shift from concealing a piece of harmless metal to concealing something that is instantly deadly. Carrying empty gives you the complete feel, but not the feeling. Once you start carrying for real, you’re making two monumental adjustments: You need to get past the self-conscious stage with the real hardware, and you need to reckon the gravity of the choices you can now make. Notice I didn’t say you have to do both at the same time.

To get past the self-conscious stage, carry empty but on alternate days for a week or so. Do it one day, then think it over and adjust your habits the next day. Then carry empty for a week, maybe with the ammo in a pocket somewhere.

The quantum mental shift doesn’t come with the permit. It takes weeks of training in the military. Putting on the uniform the first day doesn’t do it. It’s accepting that every day, because of the choices someone else makes, you’re ready to take a life. (And, as has been said in these pages so many other ways, if you’re not ready to take a life, then you shouldn’t be packing.)

The Consequences: Even though I’m a Registered Maine Guide, even though I’ve hunted for 40 years, even though I’m an Army veteran, even though I’ve been a security manager (unarmed), even though I have long owned firearms of several types, I didn’t make the transition instantaneously once I started packing a few years ago. I was accustomed to open carry as in hunting: slipping the safety off and on as I moved about, unloading in the open before re-entering a vehicle, and so on. When I’m armed for hunting, it’s right out in front of me where I’m acutely aware of it and open to the world at the same time. And no one where I live gives any thought to seeing someone alongside the road lugging a shotgun or rifle.

But I didn’t start out doing A, B, or C. Why? I just thought I was already so handy and safe with firearms that packing heat would be natural. And because of that assumption…

Here are a few things that happened to me once I began carrying daily:

1. I forgot that the gun was on me. I had eventually found a way to carry that was so comfortable I didn’t have the slightest discomfort to remind me it was there. The day it happened, I’m sure no one saw anything, but before I was sure I had to think about everywhere I’d been for the couple of hours that I had forgotten about it.
2. I dropped it in public. The way I carried at the time, in an unbelted holster tucked in my pants at the small of my back, it left me vulnerable to slippage when I exited a vehicle. It had shifted in a way that, even though I still felt it, I didn’t realize how loose it was. Again, no one saw.
3. I left it in a desk drawer that others had access to, loaded and ready. This was really stupid, but I had to get it off me quickly and then go meet some people in another room for a time. I should have simply continued to carry it. The one person who’d have been most likely to find it never mentioned it, and would have been fine with it even if she had found it. But I wish I’d never subjected her to the awkwardness of the possibility.
4. I forgot where it was in the house after I had gone to bed. After I dressed the next morning and went to get it, it wasn’t where I expected to find it. I scrambled mentally to remember what had interfered with my routine the night before, and then I found it.
5. While it was on me, I forgot whether it was locked. I carry a Rossi knock-off of a S&W .38 Chief’s Special. It has a neat little screw in the back of the hammer that you set or release with a custom hex key. I was carrying, but sort of remembered that I had locked it the day before when I went to bed. (It’s not the night security piece.) I sort of remembered that I had unlocked it the next morning, but in the middle of the day in question, in the company of others who I couldn’t excuse myself from for at least another hour, I wanted nothing more than to check it. On the Rossi, if you can just touch the base of the hammer with a fingertip, you can tell whether it’s locked.
6. The very first day I started carrying, my employer sent me on an overnight trip. Alone in a motel room, I debated keeping it loaded and ready. I truly wondered, in fact, whether I might be a sleepwalker in an unfamiliar setting and not know it, or whether I could otherwise harm myself or others with it while not fully awake. I unloaded it to be more certain. The mental discipline for everyone here is to be sure what kind of sleeper you are before dropping off too soundly next to a loaded gun. Are you someone who does anything at all in your sleep that you’ve not been fully aware of while you’re doing it?

These are examples of common challenges in mental discipline. But there was one thing that was probably harder to get used to than overcoming any of these six glitches. It was simply the astonishing realization at first that I was armed and potentially deadly. Not as deadly as driving distracted at 70 mph. Not as deadly as when leading people into the wilderness in November where someone in your party can decide to wander off and get lost, leaving you to find him before he freezes. But deadly if someone else chooses that I must be.

Carrying concealed, it took me a long time to get over the fact that I could drop a human being in two or three seconds, power I had never had before. If I were highly skilled in the manual martial arts I might have that feeling, but I also would have spent years getting used to it as my skills improved. When your skill is with a firearm, you’re harmless one moment, deadly the next.

If you own a gun for self-defense, practice handling and shooting before the day when someone decides for you that it will matter. But if you’re going to carry, practice carrying before the day when you decide for yourself to go about armed!

Practice Carrying Concealed: An Interesting Perspective

Virginia - -(AmmoLand.com)- As we reported earlier Sussex County VA was to Voting On Restricting Shooting Ranges. About 25 gun owners showed up at the Sussex Board of Supervisors meeting last night.

Everyone who spoke, spoke in opposition to the proposed ordinance that would require special use permits for shooting ranges.

Many of the Board did not seem enthusiastic about the ordinance. In the end they rejected the wording defining what a pistol range was and sent the issue back to the planning commission.

We may have to go out there one more time in the future for the whole concept to be put to rest, but I think if we keep the pressure up, the proposed ordinance will be defeated.

Sussex County Va Backs Down On Shooting Range Infringement For Now

Virginia - -(AmmoLand.com)- I had a report that the Dickenson County Circuit Court Clerk, Richard W. Edwards, was not issuing temporary permits when permit approval exceeded the 45-day limit.

I called Mr. Edwards and we spent some time on the phone. He said that permits were typically taking 60 to 90 days to issue, due to the judge not signing off on them in a timely fashion. Mr. Edwards was not aware that he was supposed to issue temporary permits (which do not require approval by the judge, BTW) after 45 days.

I pointed him to the code section (18.2-308 D) and he said he would correct his procedures as soon as his deputy clerk returns from vacation in a week or so.

If you live in Dickenson County or have any gun owning friends that do, let me know permits are being issued on time and if not, if temporary permits are being issued on time.

Dickenson County Va Not Issuing Temporary Gun Permits

Virginia - -(AmmoLand.com)- It is with very great sadness that I must report that Mack Elliott, VCDL’s treasurer and VCDL-PAC Chairman, died Thursday morning from complications due to knee-replacement surgery.

Mack was a cornerstone of this organization, a wonderful friend, and a patriot.

To say that he will be greatly missed is a massive understatement.

Services are expected to be Monday, but I will post another alert as soon as I have the time and location of the service for those who wish to pay their final respects.

Mack Elliott, VCDL’s Treasurer – RIP

Bellevue, WA - -(AmmoLand.com)-We are very excited to see the Second Amendment Foundation joined by the Illinois State Rifle Assocciation on the behalf of four Chicago residents submitted its brief in the U.S. Supreme Court case McDonald vs Chicago.

The brief was prepared by attorney Alan Gura who was also the attorney for the widely known Heller case which successfully challenged the Washington D.C. handgun ban last year.

The brief is available for viewing and downloading at ChicagoGunCase.com. The brief presents an excellent and compelling argument as to why the Second Amendment should be incorporated into the states. Many Second Amendment supporters will find the brief easy to read and comprehend. It has been said by some IllinoisCarry members who have read it to cause “goosebumps” in its scope, clarity, and purpose.

Oral arguments are expected to be heard early next year and perhaps a ruling by mid-year. The restoration of the Second Amendment rights of Illinois citizens will be greatly affected by the ruling in this case and we shall continue to watch future developments very closely.

Medford , Oregon --(AmmoLand.com)- In a case funded by the Oregon FIrearms Educational Foundation, Jane Doe Vs Medford School District, the court ruled that Oregon’s preemption statute does not protect employees from gun restrictions imposed on them by state employers.

This case, which got international attention, pitted a Medford school teacher against her employer. When it was learned that the teacher, Shirley Katz, possessed a concealed handgun license, her school and school district began a campaign of abuse and threats against her. We agreed to take her case to court.

After the Circuit Court ruled that the school could, in fact, create rules to prevent her from possessing a self-defense firearm, we appealed. The Court’s decision can be seen here.

It’s interesting that the Court continues to use and misunderstand the case of Starrett vs City of Portland, another case funded by OFEF. In their decision they state “In Starrett, the City of Portland leased Pioneer Square to a privately owned company, Entercom, which owned and operated a number of radio stations in the area. Id. at 536. Entercom leased the property in order to host a New Year’s Eve celebration. ”

This is exactly the opposite of what happened. In fact, Entercom radio did not “lease” space from the city. The city PAID Entercom radio to run a City party on City property with taxpayer money. So once again, the Courts reach a conclusion based on incorrect former conclusions.

Oregon Appeals Court Rules Against Gun Owners…Again

Sussex County, VA --(AmmoLand.com)- Sorry for the late notice, but I just got the word on this a couple of hours ago: the Sussex County Board of Supervisors will be voting on an ordinance to require pistol and shotgun ranges in A-1 zoning areas to need a conditional use permit to operate.

The meeting is THIS Thursday, November 19 2009.

Here we go again: another locality wanting to control and restrict shooting.

That is totally unacceptable, especially for such a rural area. And just what we don’t need – more government and less freedom.

Those of you in the area – we need TURNOUT at this meeting to show we do NOT want any more “permits” to be able to exercise our Second Amendment rights.

The meeting starts at 7 PM and I will be there at 6:30 PM to handout “Guns Save Lives” stickers.

On Thursday, November 19, 2009 at 7:00 p.m. at the Sussex County Courthouse the Sussex County Board of Supervisors will vote on a recommendation to require pistol and shotgun ranges in A-1 zoning areas to apply for a conditional use permit to operate.

I am afraid that even if we (ASC and Airfield 4-H Center) are “grandfathered in” we may have to seek a permit to add on and improve our facility. This impacts Boy Scouts, 4-H, NRA events (Women on Target, Pistol Classes, etc.), gun enthusiasts, target shooters, etc. as well as our ASC members of which you are one.

Supervisor Birdsong (who opposes the change) said the best way to beat this is to fill the meeting hall with opposition to the change and with concerned citizens.

This change would mean every farmer that sets up a shooting range with a portable trap or a dirt hill with cans lined up for his son to shoot may be subject to the County’s arbitrary permit review. Your support, assistance and advice is welcome. If you can come to the meeting, I will see you there.

See ordinance amendment request below. It appears that no Supervisor has ever requested a change to the current land use. It was all the Planning Commission’s idea.

ORDINANCE AMENDMENT #2009-02 Ms. Shannon C. Drew, Assistant to the Director of Planning, presented the staff report to the Board. The Zoning Ordinance currently allows a sporting clays field and a pistol range by right in the A-1, General Agricultural District. Staff is requesting that Section 16-22, § 21 be amended to require a conditional use permit for the location of any sporting clays fields and/or pistol ranges in Sussex County. The requirement of a conditional use permit will allow proposed sites to be evaluated on a case-by-case basis to ensure that they are safe for the environment, the surrounding community and range patrons. Surrounding localities such as Prince George County, Surry County and Dinwiddie County require a Special Exception to be granted by the governing body, which is equivalent to Sussex County’s Conditional Use Permit, for the location and operation of a sporting clays field and/ or a pistol range. PLANNING COMMISSION RECOMMENDATION: The Planning Commission at their July 6, 2009 meeting voted unanimously (8-0) to send this item to the Board of Supervisors with a recommendation for approval to be read as follows: “NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Sussex County: That the Sussex County Code, Chapter 16 (Zoning), Article II (General Agricultural District), Section 16-22 (Use Regulations), § 21 is hereby amended as follows: Add the requirement of a conditional use permit to Sec. 16-22 §21. 21. Sporting clays field and/or pistol range, with a conditional use permit.”

Sussex County VA Voting On Restricting Shooting Ranges

Florida --(AmmoLand.com)-After a three-year fight, the Orlando Sentinel reports, gun rights advocates in Florida won the right to keep firearms in their cars at work.

According to a story in the Orlando Sentinel, you can take your gun to work, but there are restrictions. “Florida’s Preservation and Protection of the Right to Keep and Bear Arms in Motor Vehicles Act of 2008″ isn’t completely cut-and-dried. So don’t put your pistol in your lunchpail until you know the rules.

First, not just anyone can bring a gun to work.

Only those with a concealed weapon permit from the state of Florida are protected by the law. The NRA had pushed for this change for years, arguing that many law-abiding gun owners were left unprotected on their way to and from work because their employers prohibited firearms on their property.

The Florida Chamber of Commerce and the Florida Retail Federation fought hard against the bill. They argued it would trample businesses’ private property rights by taking away their ability to set policies for their employees.

But a federal judge upheld the law, which applies to full- and part-time employees, independent contractors, volunteers, interns and other similar positions. Employers aren’t allowed to search workers’ vehicles looking for guns — or even ask employees if they have one, according to the story in the Sentinel.

What was labeled the “guns-at-work” law really should be called the “guns-in-the-parking-lot” law, gun-rights advocates say.

“It conjured up images of people having guns in their office or in their plant. It was deliberately misleading,” NRA lobbyist Marion Hammer said.

The law doesn’t allow gun-owners to carry semi-automatics weapon into offices or supermarkets where they work. Rather, it only allows them to leave it locked up in their car outside. In effect, it prevents most employers from telling their workers to leave their weapons at home.

There are exceptions. The law doesn’t apply to schools, prisons, nuclear power plants, defense plants or businesses that have combustible or explosive materials.

The exemptions built into the law became controversial after the law was passed. Some employers, including Disney and Universal Studios, twisted themselves into odd shapes to get an exemption.

Disney claims an exemption because it has a permit for explosives — namely, fireworks used in its extensive pyrotechnic displays. Universal Orlando houses a work-study program staffed by Orange County Public Schools, so it also prohibits firearms on its property.

A Disney security guard defied the ban and sued after he was fired. Eventually, the case was dismissed.

State law also allows people to carry a gun in their vehicle even without a concealed-weapon permit, as long as it is secured and “not readily accessible for immediate use.”

So, businesses can’t kick you out for having a firearm on their property, as long as it’s locked up and not being brandished.

Floridians Retain Right to Keep Firearms in Cars

NEWTOWN, Conn --(AmmoLand.com)- A move by conservative members of the Canadian Parliament to end the nation’s long-gun registry has been welcomed by Canadian firearms retailers.

One retailer noted, “I think common sense has prevailed. The objective to eliminate crime in Canada has not been met.

It’s been too costly. I believe that the money that could be saved here would be better used by putting police on the streets where we do have problems with crime.”

Much like in the United States, gun control in Canada has pitted urban representatives against rural representatives.

Canadian Gun Registry’s Looming Demise Welcomed By Retailers

“Retail Dealers will only be able to obtain one handgun a month from any source except another Retail Dealer (who is not likely to sell any of their dwindling inventory to another dealer.) As dealer inventories sell out, they will not be able to replace it except at the worthless pace of one gun a month. In a short time, there will be no handguns left for dealers to sell.”

In the Star Ledger last week, Task Force Chairman Robert Bernardi, Burlington County Prosecutor, addressed the need to amend the law.

“As it stands now, retailers would be prohibited from purchasing guns from their suppliers. I think that was an oversight when the legislation was passed.”

Prospects for passage of the retailer exemption legislation remain relatively strong, and NSSF will continue to push for this change.

NSSF Testifies On One-Gun-A-Month Law In New Jersey

Wisconsin --(AmmoLand.com)- If you read the newspaper everyday, you can become very frightened by the future. That’s because never a day goes by that someone does not try to take away one of our freedoms in the name of safety, or political correctness, or whatever.

Opponents to our freedoms are well organized and strong. I know that “I” cannot do anything to stop them. Only a strong “WE” can serve as a defense against a strong “THEY”.

This month, I watched a club meeting at which members argued relentlessly over a relatively meaningless issue. Board members of an association to which I belong, ripped each other apart by email, including attacks on personal integrity, all over a minor issue. It’s not just me, you’ve all seen it. This is where I see our weakness. “WE” (those who pull a trigger) just can’t seem to get along with each other. It’s true at the local club level, the state level, and even the national level.

For us to succeed in this never ending battle to defend our freedoms, we must find a way to set aside petty differences of opinion and focus on the real goals.

Today WI-FORCE is an active force in Madison, and the NRA is a force in Washington, but our strength is in numbers so we must band together to succeed. It doesn’t matter if you like EVERYTHING the NRA does or what the WRPA/Wi-FORCE did in the past, now is the time to join together to make a strong “WE”.

Ask your family, friends, fellow hunters, etc., if they are members of the NRA and most importantly WI-FORCE. It is the simplest thing anyone can do to be a part of the “WE” in Wisconsin.

Can We Succeed In Our Fight To Maintain Shooting Sports, Hunting, And The Lawful Ownership Of Firearms

New York, NY --(AmmoLand.com)- Billionaire anti-gun zealot Michael Bloomberg, mayor of New York City, recently appeared on “Meet the Press.” Host David Gregory asked him, “How can you muster the clout and the power to take on the NRA?” Bloomberg raised some eyebrows with his response.

“If you look at what the real numbers are, I think that we can pull together here and raise enough money . . . to take on this issue and explain to Congress this is just an outrage,” said Bloomberg.

Having called your Second Amendment rights an “outrage,” Bloomberg went on to add, “I`m going to not only do that myself, I`m going to ask plenty of other people to do it. If you want to beat the NRA, you have to go out and get your message out. And it costs money to do that.”

But not all is well in the ranks of Bloomberg`s supporters.
His anti-gun lobbying group, “Mayors Against Illegal Guns” (MAIG), is in a state of turmoil. That may explain why Bloomberg has had to provide more than 95 percent of the funding for his anti-gun crusades from his personal fortune.

Bloomberg proudly cites the number of mayors in his group. But at least 25 members of his group are not mayors at all. Another five members have already lost their re-election campaigns or have retired.

The superstitious might wonder if joining Bloomberg`s group brings bad luck to its members. But read the rest of this column before you decide, because that`s just the beginning. There`s more. Much more.

Nine members of the group–all of them actual mayors, at least for the moment–were arrested or indicted on criminal charges. These include the perennial misdeeds of corrupt politicians at the lowest levels of government–bribery, corruption and money laundering. The list of charges hanging over Bloomberg`s members also includes conspiracy, tax fraud, possession of child pornography and sexual assault on a child.

Criminal cases involving five other members of the Bloomberg corps have already been completed, with the mayors in question convicted of the charges against them. Again, we have the garden variety of government corruption–bribery, extortion and conspiracy. But we also see charges for assault and even assaulting a police officer.

That particular ex-mayor, Kwame Kilpatrick of Detroit, faced 10 felony charges in two cases before he made a plea deal. He has been erased from MAIG`s official membership roster, but is still counted when Bloomberg proudly states that “over 450 mayors from more than 40 states have joined” his group. He doesn`t talk about how many have left his group (and political office) in disgrace.

But corruption charges and criminal trials aren`t the only reason mayors have resigned from MAIG. More than 40 other mayors have resigned from the group when they were made aware of its true legislative agenda.

Oldmans Township, N.J., Mayor Harry Moore resigned his membership in a letter to Bloomberg, which said in part, “I joined your coalition because of its purported purpose to combat the criminal acquisition and misuse of guns, which is a goal shared by all Americans. Regrettably, it has become abundantly clear to me that you are using this coalition of mayors to advance a hidden agenda of bringing lawsuits against members of the firearms industry and spreading anti-gun propaganda.”

Moore also protested Bloomberg`s illegal “sting” operations, which jeopardized the safety of actual law enforcement personnel.

“The Department of Justice warned you to refrain from these actions … I do not want the blood of a police officer on my hands so that you can advance your anti-gun litigation campaign,” wrote Moore.

Another resignation came from Mayor Marlene Anielski of Walton Hills, Ohio.

Her letter forcefully stated, “Mayor, you and your coalition of allies have misrepresented yourselves to the mayors of America and its citizens,” and closed by saying, “I can only hope that you will see my departure and the recent departure of other mayors from your coalition as a sign that things must change. We are all on the same side when it comes to stopping criminals from getting guns. Where you lose me is in your true quest–to end lawful firearms ownership and destroy a lawful American industry.”

One current MAIG member, Mayor Cory Booker of Newark, N.J., actually reinforced our point when he said,

“I`m not concerned about law-abiding citizens having access to guns. Not one shooting in my city last year was by somebody who went, had a background check, bought a gun and shot somebody in my city. Does not happen.”

Bloomberg apparently did not hear Booker`s wisdom, despite the fact that they were sitting next to each other on the same Sunday show when Booker made the comment.

Bloomberg`s Phantom Mayors Against Illegal Guns

Michigan Coalition For Responsible Gun Owners

Michigan --(AmmoLand.com)- House Bill 5474, co-sponsored by over two dozen house members, including MCRGO Board member, Joel Sheltrown, would extend firearms preemption to college campuses.

This bill, widely viewed as a simple “clean-up” to clarify law statewide, has elicited some heated opposition. The bill would amend MCL Secs. 123.1101, 123.1102, and 123.1103 by adding “Institution of Higher Education” to the list of bodies prohibited from making their own gun law. Current law prevents any “Local unit of government” from making any laws taxing, or regulating “…the ownership, registration, purchase, sale, transfer, transportation, or possession of pistols or other firearms…”

There has been some debate in the courts regarding whether a college or university would fall within the definition of “local unit of government.” There are other Michigan statutes that do include colleges and universities in the definition of “local unit of government.” But, it has not been completely clear that colleges and universities are prevented from regulating guns under the preemption statute that has been in place since 1990.

The theory behind preemption is simply the idea that it is unfair to create a crazy quilt of patchwork gun laws across the state that could easily result in criminal prosecution of a well-meaning and otherwise law-abiding citizen simply for crossing an invisible line at the border of a county, township, or city. The thought was, and is, that a uniform statewide gun policy should be set by the Michigan legislature, based on Article 1, Section 6 of the Michigan Constitution, which states, “Every person has a right to keep and bear arms for the defense of himself and the state.”

Several arguments have been raised in favor of allowing colleges and universities the right to make their own gun laws.

1. The Michigan Constitution gives colleges the right to control their own campuses and the educational environment. This argument means that the colleges feel that their authority is stronger than the counties, townships, and cities that have been prohibited from making gun law since the current preemption statute was enacted in 1990.
2. The campus police won’t know who is a ‘good guy’ and who is a ‘bad guy’ if they encounter someone with a gun. This argument came up nearly ten years ago when “shall issue” CPLs (Concealed Pistol Licenses) were debated. The rules on disclosure when an armed citizen encounters a police officer are clear and police officers across the state continue to be trained on how to deal with armed citizens. There is nothing new about this issue and no difference between the college environment and the rest of the state in this regard.
3. College campuses are unique because of the large number of young adults and the massive alcohol consumption that results. We fear alcohol-related accidents and crimes.” This argument fails because, as anyone who have ever attended college or spent time near one, knows, most alcohol is consumed off campus in bars and private residences. Those off-campus areas are already controlled by current Michigan law, not whatever rules any given college has created. The current campus regulations are of no effect off campus. No one has been heard to argue that there is a disproportionate rate of alcohol-related accidents or crimes in off-campus areas frequented by college students.

In short, the police chiefs of a few campuses, and some administrators, are rolling out the same old anti-gun arguments that have been proved wrong by nearly a decade of success with armed citizens in Michigan. Responsible gun owners, even younger ones, are simply not a threat. In fact, according to research, even a relatively small number of armed citizens tend to serve as a deterrent to criminal activity.

The Board of Trustees at Michigan State University agrees. They voted recently to allow Michigan law to apply on the campus of MSU.

During the debate, the Michigan Constitution was cited. The Trustees decided that they did not want to have any rules on campus that might conflict with the Michigan Constitution, or create a constitutional crisis by taking a position directly opposite of Michigan law. So, far, the dire predictions of the anti-gunners have not come true.

As expected, campus life continues as before, with the exception that those of us who drive through campus while lawfully armed are no longer in danger of being prosecuted under an obscure university ordinance.

Extending Firearms Preemption To College Campuses

FAIRFAX, VA –-(AmmoLand.com)- As a critical Second Amendment case goes before the United States Supreme Court, U.S. Senators Kay Bailey Hutchison (R-TX) and Jon Tester (D-MT), and Congressmen Mike Ross (D-AR) and Mark Souder (R-IN) are gathering signatures for an amicus curiae (”friend of the court”) brief by Members of Congress.

The case is McDonald v. City of Chicago, and it will answer the question of whether the Second Amendment applies to the states-as the Congress clearly intended in the 1860s, when it adopted the Fourteenth Amendment to protect constitutional rights against abuse by state and local governments.

Ask Your U.S. Senators To Sign Amicus Brief Supporting Second Amendment

Ohioans For Concealed Carry

Ohio --(AmmoLand.com)- The 8th Ohio District Court of Appeals has overturned the trial court’s decision and ruled that Ohio Revised Code 9.68, which provided for statewide preemption of gun laws, to be unconstitutional as it pertains to rifles and shotguns and open carry. The 8th District court feels it applies only to concealed carry licensing laws.

Cleveland sued the State in March 2007 alleging that the preemption law violated home rule and that they should be able to ban “assault weapons,” prohibit open carry of firearms, maintain a gun registration scheme, and pass any such gun ordinance they wished. Ohioans For Concealed Carry and the National Rifle Association filed a joint motion to intervene, but that motion was denied and Cleveland lost at the trial court level on the strength of the Ohioans For Concealed Carry v. City of Clyde case where the Ohio Supreme Court ruled that R.C. 9.68 was constitutional because it was a “general law that is part of a comprehensive statewide legislative enactment.” Cleveland appealed their loss, and OFCC and the NRA appealed the denial to intervene.

In this ruling, the 8th District found that R.C. 9.68 was unconstitutional partially on the grounds of the 1993 Ohio Supreme Court case Arnold v. Cleveland which upheld an assault weapons ban, a case decided thirteen years before R.C. 9.68 was passed preempting such laws.

The Court agreed with Cleveland’s assertion that R.C. 9.68 violated the Home Rule provision of the Ohio Constitution which states:

Municipalities shall have authority to exercise all powers of local self-government and to adopt and enforce within their limits such local police, sanitary and other similar regulations, as are not in conflict with general laws.

Cleveland argued that R.C. 9.68 is unconstitutional because it is not a general law, despite the findings of the Ohio Supreme Court, and attempts to curtail the City’s police powers in matters other than the concealed carry of firearms.

In particular, they were concerned about Cleveland Codified Ordinance (C.C.O.) 627.08, possession of firearms by minors; C.C.O. 627.09, possessing deadly weapons on public property; C.C.O. 627.10, possessing certain weapons at or about public places; C.C.O. 627A.02, access to firearms, prohibiting children access to firearms; C.C.O. 628.03, unlawful conduct, prohibiting possession and sale of assault weapons; and C.C.O. 674.05, registration of handguns.

The State of Ohio countered that R.C. 9.68 read in conjunction with Substitute House Bill 347 did in fact demonstrate a comprehensive scheme to regulate firearms, as previously ruled in the OFCC v. Clyde case. The 8th District Court disagreed, saying that the OSC ruling only applies to concealed carry and that the Clyde case only referred to Section 9 of H.B. 12 (the original concealed carry bill) and not R.C. 9.68., though admitted that “the Clyde court impliedly upheld R.C. 9.68 as it relates to handguns.”

Therefore, the 8th District Court felt comfortable ignoring the Clyde ruling and applied R.C. 9.68 only to concealed carry laws because it was not “comprehensive” enough to be a General Law in their opinion because it “leaves unregulated: (1) the discharge of firearms, (2) the possession and sale of assault weapons, (3) the open carry of firearms on public property and public places, (4) the possession and use of firearms by minors, (5) the registration of handguns as required by the City, (6) the registrations and licensure of firearms dealers, (7) permit or licensing requirements before an individual purchases a handgun, and (8) background checks before the purchase or transfer of firearms.”

O.R.C. 9.68 reads:

The individual right to keep and bear arms, being a fundamental individual right that predates the United States Constitution and Ohio Constitution, and being a constitutionally protected right in every part of Ohio, the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition. Except as specifically provided by the United States Constitution, Ohio Constitution, state law, or federal law, a person, without further license, permission, restriction, delay, or process, may own, possess, purchase, sell, transfer, transport, store, or keep any firearm, part of a firearm, its components, and its ammunition.

The 8th District ignored “the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition” and only focused on the next sentence which left off the word “carrying.” The Court does not believe that “possess” and “transport” applies to carrying a firearm, therefore found that the City prohibiting open carry is legal.

The 8th District also found that “R.C. 9.68 does not establish police regulations but instead limits legislative power of municipal corporations” and “attempts to curtail the City’s home-rule police powers without enacting legislation to remedy the purported ill of a confusing ‘patchwork’ of municipal regulations involving firearms.” Citing this shortfall, the Court found that 9.68 is not comprehensive and does “little to fill in the gaps” in what they see for laws regarding “firearm possession, use, transfer, and ownership” and “does not prescribe a rule of conduct upon citizens generally.”

Taking all of that into account, the 8th District ruled that “R.C. 9.68 fails to satisfy the general law test” and “that it is not a general law.” In another section, they ruled that it was an abuse of legislative power because it awarded attorney fees to any citizen who challenged a City ordinance if that ordinance was found to be violation of R.C. 9.68.

Ohioans For Concealed Carry strongly believes that the 8th District used flawed logic in determining that R.C. 9.68 is unconstitutional and that the Ohio legislature rightfully and legally passed R.C. 9.68 with the intention of not only preempting local laws regarding concealed carry, but all firearms laws in the state while lawfully granting municipalities the ability to regulate firearms discharges and zoning laws for commercial firearms sales.

The Ohio legislature was quite explicit that carrying firearms is a protected right as noted in the Ohio Constitution which states in Article 1 Section 4 that “the people have the right to bear arms for their defense and security.”

OFCC expects that Ohio Attorney General Richard Cordray will appeal the 8th District’s faulty decision to the Ohio Supreme Court and that the OSC will correctly rule that Statewide Preemption is a Constitutional and General law and halt the attempts of anti-gun administrations from denying gun rights to their citizens. OFCC will also continue our fight to not be shut out in our attempts to intervene and defend the gun rights of Ohio citizens.

Cleveland Wins Appeal To Ban Assault Weapons

Merlin, OR --(AmmoLand.com)- Does a modern Christian have a right to self defense? With every right there is a correlative responsibility. The ancient right to bear arms has been described in antiquity as the obligation to bear arms in defense of your community. In those ancient times if you would not arm yourself to defend your community you were often shunned if not run out of town all together.

Chuck Baldwin in and article published by NewsWithViews.com quoted the statistic that “as of 2004, 50% of the adults in the United States own one or more firearms.” My first reaction was, why so few? As someone who once wore a badge and a gun to protect the property and lives of citizens I can testify that my biggest disappointment was the apathy and even cowardice of the people I was often expected to protect.

To refuse to come to the aid of others has been considered a crime and good Samaritan laws have prosecuted citizens who failed to assist and aid people in need of assistance or protection.

Yet, I have heard many people say they would not own a gun or they did not believe in guns. On further inquiry everyone of these purveyors of pseudo-pacifism confirmed that if someone was breaking into their house they would call the police, who will come with guns. The truth is they do believe in guns, but they are either to lazy, to cheap, to cowardly, or just to irresponsible to own one.

Do Christians Have A Right To Armed Self Defense?

Manassas, VA - There has been a close association between sexually transmitted diseases and the military for as long as the two have existed, but the focus of this article is not Venereal Disease, but a different kind of VD that has shocked the military community and the nation.

The VD which currently plagues the military and puts our soldiers at grave risk is the policy of Victim Disarmament which has been increasingly prevalent even as laws in the civilian world have been moving in the opposite direction.

While some have pointed to regulation changes during the Clinton administration as the turning point, VD on military bases has been the trend since at least the 1960’s and to a lesser extent even before that. In military society, so heavily steeped in discipline and control, it is only natural that those in power would be inclined to drift in the direction of micro-management and centralized control. Commanders in the modern military seem to have gravitated toward a paternalistic role and that paternalism runs all through the chain of command and seems to apply to all subordinates regardless of their age, rank, or experience.

When a Muslim major decided he was on the wrong side in the War on Terrorism and began shooting soldiers and civilian workers in a premeditated attack at a Ft. Hood processing center, we were all shocked. Shocked that anyone in the U.S. military could turn on his brothers- and sisters-in-arms with such viciousness. Shocked that a commissioned officer could hold such radical religious views and not be recognized as a threat.

But we were especially shocked that anyone could go on a killing spree in the middle of a busy Army base and not run into any armed resistance for over 10 minutes.
The public was dumbfounded to learn that virtually everyone on all military bases outside of war zones is required to disarm while on base. Even officers and senior NCOs who are licensed to carry concealed in the state where the base is located are forbidden to have a readily accessible firearm virtually anywhere on base. Only MP’s and contract security guards may legally go about a military installation armed and even they are generally forbidden to carry when not on duty.

But who could have imagined that anyone would ever dare to attack soldiers on an Army base? Well, just as the “unimaginable” idea of using commercial aircraft as guided weapons had been widely publicized in popular novels and was officially included in national threat assessments as a likely scenario, the idea of attacking personnel on a military installation was not novel or new. A group of home-grown wannabe Muslim terrorists made elaborate plans to do just that back in 2007. After their plot was uncovered, many in the rights community pointed out the huge vulnerability created by the Army’s Victim Disarmament policies and called for changes, at least to allow qualified officers and senior NCOs to keep weapons handy. Those calls went unheeded. Some commands went in the opposite direction with commanding officers tightening restrictions on weapons in base housing units and even forbidding soldiers from legally carrying when off-base and out of uniform.

In the wake of the atrocity at Ft. Hood the Army says it – along with the other branches – will be reviewing security policies and procedures. I don’t expect to see them give up their VD policies. It is much more likely that they will conclude that they need to hire more civilian security guards and perhaps implement some sort of alert system similar to those implemented by universities, based around text messages sent to cell phones.

After all, what if the Army allowed soldiers to be armed and they used them to commit crime, or to shoot each other over traffic disputes? What about the danger of police mistaking an armed defender for the active murderer or an armed defender accidentally shooting innocent bystanders?

We’ve heard all of the “what if” arguments in every state that has ever debated concealed carry legislation or talked about extending the right to carry to college campuses. For some reason the fact that none of the dire “what ifs” have ever materialized and that armed defense is consistently demonstrated to be safe and effective, just carries no weight with paternalistic authoritarians who don’t fully trust their charges.

More than two years after the Army received a dramatic warning about the vulnerability created by their VD policies, that vulnerability has been horrifically exploited. And in the face of that experience, soldiers, sailors, airmen and marines remain helpless in the face of threats of armed attack.

Unlike Venereal Disease, Victim Disarmament can be easily eradicated, particularly in the military. All it takes is the will and a little bit of trust.

What was more shocking – that the murderer was a fellow officer or the fact that our own military, our soldiers who are trained for combat, are rendered defenseless on their own home base?

Or maybe it was more shocking to hear Mayor Daley of Chicago blame America’s love of guns for the 13 deaths and untold injuries?? How far can his sick opposition to firearms go? Is it beyond his comprehension that the carnage would have continued if not for a gun in the hands of a civilian policewoman. Is it beyond his grasp that the only way to stop a violent killer with a gun is a good guy/woman with a gun?

Mayor Daley refuses to see – it isn’t the gun – it’s the hand that wields it.

Mayor Daley thinks it’s right and necessary to disarm everyone – the innocent people of Chicago and even our military men and women. He thinks it’s okay, he has his body guards.

But it’s not okay! Call your U.S. Senator and U.S. Representative today – demand that our armed military men and women who put their lives on the line in combat be armed when they put their lives on the line at home as well.

Call your State Senator and State Representative and demand that the right to lawfully carry a firearm for self-defense be restored to the good people of Illinois – the one and only state left that does not recognize that right.

America Stunned as U.S. Military Attacked from Within

Jews For The Preservation Of Firearms Ownership

Oh, I didn’t mean that Ten Commandments. I meant “The Ten Commandments of Self-Defense.”

Commandment #1: “G-d has given you the right of self-defense, even with deadly force, when warranted.”

The murdered US soldiers, those who voluntarily trained to stand in the line of fire against our enemies in order to keep us safe, they were denied the right to defend themselves. Why? Because the US government — that same government that they are sworn to defend — took away their G-d-given rights. Gun Free Zones

Army Regulation 190-14, promulgated under Commander in Chief William Jefferson Clinton on March 12, 1993, “Limits and controls the carrying of firearms by Department of the Army military and civilian personnel (para 2-6).”

Yes, that’s right — soldiers of the United States, those in whom we entrust our safety and security, are not trusted by the Commander in Chief to carry arms: “Due to the serious responsibility imposed on persons authorized to bear or use firearms, such persons must be selected with care.” (2-2a)

Apparently selecting a soldier for active duty is not considered sufficient care. Oh, you can risk your life for our country. You’re old enough to die for our country. You can bear arms when we send you into battle — but not on base. Best be advised before you enlist: “It is DoD Policy… [t]o limit and control the carrying of firearms by DoD military and civilian personnel.” (Appendix B, DoD Directive 5210.56, Policy D.1.)

What does The Gun Rabbi say?
G-d has given us not only the right but the obligation to defend ourselves and others from aggression. G-d’s Law says that both soldier and a civilian have the right to keep and bear arms. Our Founders understood G-d’s Law and enshrined it in the Second Amendment along with other such inalienable rights.

But we live in a world today where some put themselves above even G-d’s Law. And so we have this “Man’s Law” which limits and controls the carrying of firearms by DoD military and civilian personnel.

How many soldiers would be alive or uninjured if the targets of our treasonous Mujahid had been “allowed” to protect themselves with force of arms? How many more victims of Man’s “Gun Control” do we need to count before our Commander in Chief recognizes G-d’s Law?

G-d says I can defend myself. We must all choose: G-d’s Law? Or Man’s?

Man’s Law Kills Again – The Sin of Gun Free Zones

Virginia - -(AmmoLand.com)-These days, our soldiers aren’t even safe here at home stationed on secure military bases.

On November 5th, a lone gunman murdered 13 fully-trained, ready to deploy soldiers, and wounded 29 more, in the most shocking terrorist attack on American soil since 9/11.

How was Nidal Hasan, a psychologist, able to take down so many trained soldiers? Because the government thinks its better to keep it’s armed service members unarmed . . .

That’s right. Our military men and woman are banned from carrying the weapons they are trained and trusted to use in the heat of combat.

President Clinton authored this asinine policy back in 1993 when he declared all military bases “Gun Free Zones.”

As you know, “Gun Free Zones” do nothing but assure criminals, and now terrorists, that they will find unarmed victims defenseless against a homicidal rampage.

Maybe I’m crazy, but I’d rather the soldiers delivered a barrage of bullet to end Hasan’s attack the second he opened fire.

I’d rather Hasan was dead and the heroes he murdered were still alive.

But because of Clinton’s ingenious policy of an unarmed armed forces, this psychopath methodically executed soldier after soldier before a local traffic cop could arrive on the scene.

If we didn’t have “Gun Free Zones” and our armed forces were . . . I don’t know . . . ARMED, Nadir Hasan would have met bullet s instead of bodies.

On this Veteran’s Day, remember that the safety of our armed forces is of paramount importance whether it’s on the battlefield or here at home.

Another ‘Gun Free Zone’ Tragedy

Virginia - -(AmmoLand.com)- Yesterday 24 VCDL members showed up at the Portsmouth City Hall to support VCDL urging the Mayor to drop his membership in the disgraceful Mayors Against Illegal Guns (MAIG) – a front for generic gun control run by New York Mayor Michael Bloomberg.

The first problem we had was a requirement that you sign in and show photo ID. Board member John Fenter is working to get that fixed. Under the Freedom of Information Act they cannot turn someone away from a public meeting because they didn’t bring any ID.

John and I went up to the City Hall chambers to work that issue, only to be told by a police officer that guns were not allowed in City Hall chambers!

WHAT?!?!?!! My reaction was to break into laughter and to tell John that this would be one heluva law suit. We explained 15.2-915 to the officer.

The officer, to his credit, realized that perhaps he had best check this out. He told the other officers to just wait a minute and not turn away any armed citizens.

Upon checking with the City Attorney, the officer returned in a couple of minutes and sincerely apologized for his error and he said we were more than welcome to enter the chambers.

Dennis O’Connor was also involved and approached Sheriff Watson on the issue and filed this report:

Apparently, no one had ever carried firearms to a Portsmouth city council meeting before, because the security and police seemed not to know how to handle it, and at one point a city officer was attempting to deny us entrance. This was resolved by the city attorney, but thankfully, Portsmouth Sheriff Watson was also on site and was very aggressive about ensuring no one’s rights were infringed. He was a shining example of a professional law officer who was well versed in both the law and the constitution, even making making numerous pro- second amendment statements throughout.

He stated that as an elected constitutional officer, he would not allow anyone’s right to bear arms to be violated. Sheriff Watson related to me that when someone initially approached him, excitedly exclaiming that people were coming in who had guns, he simply replied ’so do I.’

Sheriff Watson make a point of giving me his personal cell phone number, saying if any of our group were excluded or harassed in any manner for carry of firearms to call him immediately and would intervene and correct the problem.”

Thank you, Sheriff!

We had no further issues with the police or the Sheriff’s deputies and we thank them for their professional handing of the event.

Once inside 3 of us spoke, asking the Mayor to resign from MAIG.

The Mayor did not comment, nor did anyone from City Council, but I’m sure Council, and perhaps the Mayor, didn’t realize until last night the implications of the Mayor being a part of MAIG.

As far as Portsmouth’s illegal gun ban on their lakes and surrounding properties, Ken Richards got this email from the City today after contacting them about that ordinance:

Virginia - -(AmmoLand.com)- Over 45 students, faulty, and guests turned out for my talk last night at Virginia Tech. There was one anti-gunner there – a professor who teaches statistics (I wonder what the odds were of that?

The professor asked some good questions and we had a healthy discussion of issues, mostly dealing with “will more people with guns make the university safer?”

Unlike the Dark Side, we welcome debate and don’t shutdown a meeting when someone wants to challenge our facts, logic, and reason.

The event was video taped and I will let you know when I get a link to it.

And as a souvenir, Virginia Tech gave me my own personal $30 parking ticket for parking somewhere where you need a magnifying glass and a GPS to locate the “faculty only” parking sign. I am having to take it on faith that the sign really exists at all.

Good Turn Out At Virginia Tech Talk In Support of Guns

Mineola, NY –-(AmmoLand.com)- The Nassau County local law banning the possession of handguns mislabeled “deceptively colored” remains on hold indefinitely pending the outcome of a legal challenge by gun-rights activists.

In June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of “deceptively colored handguns” as a supposed danger to law enforcement. The law originally banned all handguns except for those that are “black, grey, silver, steel, nickel or army green.” It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.

Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court (Index #: 013564/2008) to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.

The action sought a ruling that Nassau’s local law is invalid because it is “preempted” by New York State’s extensive gun control laws, which already ban “disguised guns.” Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.

The proceeding was brought on the day the law was to go into effect, and sought a temporary restraining order and an injunction to stay enforcement of the law. That led to Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. Further, filing of the action alone resulted in the Nassau County legislature amending the law to remove the prohibitions against gold plated, blued, and brown handguns.

The action is currently on appeal to the New York Supreme Court, Appellate Division, Second Department (Docket No. 2009-1468). The petitioners have retained attorney Robert Firriolo, a litigation partner in the New York office of Duane Morris LLP.

The local law challenged affects not only Nassau pistol licensees, but all New York gun owners and visitors to Nassau County. Anybody found with a banned handgun is subject to arrest and prosecution. The law is particularly hazardous to the many shooters who come into, or pass through, Nassau to participate in shooting events and have no way of knowing about this law. The suit was brought to protect the interests of all of law-abiding gun owners and dealers, most of whom are still unaware that many ordinary, popular and valuable handguns are banned. The law imposes a penalty of one year in jail and a $1000 fine.

The petitioners continue to express their gratitude to SCOPE, the Freeport R&R Association Junior Club, SAFE, SASI, NCF&G, and to all those individuals who have donated to help us succeed in this important appeal. The petitioners, though, are still seeking donations to help with the appeal of Chwick v. Mulvey, as we have requested 15minutes of Oral Argument time..

Please remember that a victory in this appeal may well be the springboard for challenging other burdensome and senseless New York gun control laws. In fact, Chwick v. Lawsuit Derails Nassau NY Handgun Ban

This was not to be, however, thanks to House Democrats who campaigned as “moderates,” but in the end, danced at the end of Nancy Pelosi’s strings.

Saturday, the House passed ObamaCare by a 220-215 vote. The bill now goes to the Senate, where South Carolina Senator Lindsey Graham — hardly a staunch conservative — has pronounced it “dead on arrival.”

We remain convinced that we can and will kill ObamaCare, but only if the grassroots keep the pressure on.

End Clinton-Era Military Base Gun Ban

Ohio - -(AmmoLand.com)- Buckeye Firearms Association is a single issue, non-partisan PAC concerned with gun rights. As such, the debate on health care reform occurring across the U.S. is not something that would be within our normal sphere of coverage.

However, my good friend Chad Baus posted a story a few days ago highlighting how the Centers for Disease Control has begun researching gun violence and the impact of gun violence on health care costs. This immediately set off alarm bells in my head as the pieces fell into place.

Why, you ask?

Health care reform is a brilliant way to regulate guns without violating the Second Amendment.

As an attorney, part of my job is risk management – sit around and think big thoughts on how things could go wrong, and then plan accordingly. (Some of my less charitable friends describe it as “being paid to think of ways to screw things up.”)

Health care reform, which seems completely innocuous to gun rights at first blush, is a Trojan Horse. Of that, there can be no doubt. The only real question is whether our enemies will choose to use it as such. Given the string of court and legislative defeats the anti-gun groups have suffered, is there any doubt whether the Brady Bunch will pass up an opportunity to regulate guns in this oblique manner?

Chad’s article pointed to a Washington Times editorial taking the CDC to task for circumventing congressional orders to abstain from gun control “research.” The original reasoning behind this “research” ban was that the CDC would be using tax dollars to advance a gun control agenda, and the taxpayers rightly put an end to these shenanigans. Now, under President Obama, the CDC is defying this ban by researching “health care costs” and how guns impact health insurance and health care services. If any reader is in doubt as to what the results of this “research” will be, you might as well stop reading now.

So, sometime in the near future, a tax-payer funded study will show that gunshot wounds take up a tremendous amount of medical resources, almost all of which goes unreimbursed, because the victims are uninsured. The study, of course, will fail to mention that the majority of this care goes to criminal/gang elements injured during illegal activities. I will readily concede that the Crips, Bloods, Triad, Mongols and the Mexican Mafia have woefully deficient employee benefit plans (no 401K, dental, paid vacation etc) but is that really a basis for national health insurance policy?

Why should gun owners care that this “research result” will show such an impact on health care costs?

Underwriting.
Insurance premiums are calculated, in part, based upon your risk group. If you smoke, your premiums are higher and/or it is harder to get coverage. Why? Cigarette smoking demonstrably increases your health care costs over the long term. Have diabetes? Ditto. High blood pressure and cholesterol? Get out your wallet.

So now, armed with a “study” showing that the presence of a gun greatly increases health care costs, gun owners are now considered a high risk group and the insurance companies have Science! to back up that claim. “Owning a gun is no different than having cancer…” “No sir, we aren’t violating your civil rights. You may still own whatever guns you wish, you just are going to pay at-risk rates rather than preferred rates.”

I assure the reader that this scenario is not far-fetched or fanciful, the mechanism is already in place and is capable of operating exactly as I have outlined. The only question is whether the antis will have the political will to use it in such a manner, and to what extent. (i.e would they try to divide us by “finding” that ownership of a $5,000.00 trap gun has no impact on healthcare costs, but ownership of a handgun does and ownership of an ugly black rifle drives the costs right through the roof.)

Here is a preview of the new health insurance application forms:

Name, address, age, gender, height, weight, prior medical conditions, do you smoke, do you own guns, if so how many and what kind….

Then there is the whole issue of de facto gun registration, since this information will now be on your wonderful, portable healthcare chart that is all residing on a computer someplace. Don’t forget the new taxes on guns and ammo to help provide insurance for those poor Crips, Bloods, Triad, Mongols and Mexican Mafia members who find themselves suffering from uninsured gunshot wounds incurred during a drug deal gone wrong . The anti-gun possibilities are limited only by the imagination.

Please don’t delude yourself into thinking that this would only be part of any “public option” insurance plan. The private insurance companies are going to be in direct competition with any of the pre-existing or new government insurance plans, so if the public plans get an “upcharge” for gun ownership you know the private ones are going to demand this extra money, too. After all, they have Science! to provide the justification for the higher premiums.

These are not paranoid delusions or ramblings, just possibilities that are there for the taking should the political muscle be flexed to do so.

So what do gun owners need to do? We need to be calling our “Congress Critters” and demand, at a minimum, two things. (If you are just outright opposed to any of the health care reform going on, simply add the above objections to the pile of objections you already have when you call in, and skip over making these demands.)

First, any health care reform bill must be absolutely, affirmatively firearm neutral. The law must explicitly state that no insurer, public or private, may use ownership or use of guns as a basis for underwriting or benefit decisions.

Second, any health care reform bill needs to explicitly deny insurance benefit payments for care provided to anyone who is harmed during the commission of a violent felony, and allow hospitals/doctors to choose to refuse treatment to these same people if they feel they can ethically do so. They may ethically feel they have to treat these people, but you and I should not be subsidizing medical care to Johnny Crackhead when he finds himself shot during a robbery, nor should we be subsidizing someone’s ethics. It is time these criminals start bearing the consequence of their actions and allow natural selection to work its magic.

Manasqaun, NJ - -(AmmoLand.com)- I am glad I am not the only one to see a common trend here? Gun Free Zones are Death Zones.

Jacob G. Hornberger, founder and president of The Future of Freedom Foundation, recently wrote a good article entitled “A Gun-Free Zone at Ft. Hood” that makes my point quite well and is worth reading.

“With the massacre at Ft. Hood, we once again see the consequences of gun control.

Remember what the gun controllers say: that once gun control is imposed, would-be murderers will obey the gun-control law by resorting to some other form of murder. At least the killers won’t use a gun, the gun-controllers exclaim, because gun possession is now against the law.

Yet, once again that reasoning hasn’t panned out at Ft. Hood, any more than it panned out at Virginia Tech, Columbine High School, Luby’s Cafeteria in Killeen, Texas, or, for that matter, on the streets of Washington, D.C., the gun-control, murder capital of America.”

Time and time again Gun Free Zones have been come killing grounds where evil men can go about killing innocent people with no chance of having to face an armed citizen.

“Now, you would think that of all places where people would be armed, it would be a military base. Not so, however. There are strict gun-control laws on military bases, including a prohibition against concealed-carry, even if the state in which the base is located permits concealed-carry.

Thus, at Ft. Hood, the shooter knew that the likelihood of anyone being able to defend himself from the coming onslaught was virtually nil. He knew that since this was a federal gun-free zone, he would be able to shoot his gun and kill his victims until he ran out of ammunition or until the local police arrived and gunned him down.

Why do shooters select gun-free zones to commit their massacres rather than, say, gun shows? No doubt that question continues to befuddle the gun-control crowd.”

The greatest irony in all this is that we have the best trained military in the world and some cowardly politician who is to afraid to take on the responsibility to defend themselves and needs to feel better about this personality flaw has created policy that say no one else including the best soldiers on earth can have a weapon to defend themselves or their family’s!!?

Of all the place in the USA our Military Bases should be the last places that are Gun Free Zones.  Am I the only one outraged by this?  If you are to then email your representative and tell them you want change.  Republish this article on your blog or book mark it in your social media network and lets make a change so that the best military on earth does not have to lay down and die without the tools they are trained with to defend you and me.

End The Absurd Policy of Military Gun Free Zones

Kansas --(AmmoLand.com)- This is the time of year when Kansas State Rifle Association nominating committee is working on determining the slate of proposed Board Members to serve for the 2010/2011 election year. The proposed slate of Board Members will be presented to the Board at the January 2010 meeting where we will vote to approve the slate as presented.

The slate is then published in the April 2010 issue of the CHIPS ‘n’ RICOCHETS newsletters as per the bylaws of the association. A vote will take place at the Annual Members Meeting which will take place in Hutchinson, KS on June 12 & June 13, 2010. Term of service for Officers and Quadrant Directors is one year and term of service for Directors At Large are two years.

Our Secretary, Elizabeth Brown, has notified us that she is returning to school to obtain her Master’s Degree in Engineering and will no longer be able to serve. We will hate to see her go but certainly wish her the best in her endeavor. Elizabeth has done a wonderful job and she will be greatly missed.

In addition to needing a new Secretary, there will likely be openings for other board positions as well.

If you are interested in getting involved in the business of Kansas State Rifle Association we encourage you to contact us.

Requirements for Board positions are the willingness to work on a volunteer basis, attend quarterly Board Meetings in Salina, KS and attend the Annual Members Meeting once per year, as well as any duties relevant to a specific position. We are looking for people who are heartfelt about protecting our Second Amendment rights and preserving the shooting sports in all disciplines. Of course, membership in the KSRA is required. You must be dedicated to the cause and willing to actively serve as a member of the governing body of the KSRA.

If you have any interest in serving on the Board, please contact me by phone or email so we can discuss your area of interest and I can relate specific requirements for any position you may be interested in.

I believe that most people will find that serving on the Board of Directors is a personally gratifying experience and one that you will not regret. I hope to hear from some of you soon!

-(AmmoLand.com)- Q: What are the deadly force rules for defending myself against a dog?

A: Since a dog is not a human being, the rules of “deadly force” as such do not apply. However, there is a Michigan statute on point, MCL 287.279 (The Dog Law of 1919, as amended), which states:

“Any person including a law enforcement officer may kill any dog which he sees in the act of pursuing, worrying, or wounding any livestock or poultry or attacking persons, and there shall be no liability on such person in damages or otherwise, for such killing. Any dog that enters any field or enclosure which is owned by or leased by a person producing livestock or poultry, outside of a city, unaccompanied by his owner or his owner’s agent, shall constitute a trespass, and the owner shall be liable in damages. Except as provided in this section, it shall be unlawful for any person, other than a law enforcement officer, to kill or injure or attempt to kill or injure any dog which bears a license tag for the current year.”

So, any citizen is privileged to kill any dog that is in the act of attacking people, or other animals.

However, a properly-licensed dog may not be harmed unless it is in the act of attacking. Of course, all the rules of common sense and gun safety still apply and, if you find youself in a position where it is required to use a gun to defend a person or another animal from a vicious dog, you should be aware of the placement of your shots as you still may have liability for bullets that strike other animals, people, or property.

If your use of your gun is found to be unreasonable, in that the dog you shot, or shot at, was not in the act of attacking, you will probably face criminal charges and potential civil suits.

Defense Education Week 2009
November 9th – 14th is Defense Education Week, hosted by Students for Concealed Carry on Campus at colleges across the country. Virginia Tech is participating with week-long events, speakers, newspaper articles, and demos pertaining to the issue, conducted by Registered Student Organization Students for Concealed Carry on Campus at Virginia Tech.

We strongly believe that the ban on Virginia campuses will be lifted in the 2010 legislative session, which will start in January. Support for the cause has continued to rise as more people see that there is no good reason to deny state-permitted individuals to carry concealed firearms while on campus, just like they do everywhere else.

Jack Rumbaugh is the Virginia Staff instructor for Suarez International, a training company that offers courses around the world to teach self-defense in close-combat and armed situations. A demonstration of self-defense techniques will follow a speech from Mr. Rumbaugh on the education and training that is necessary to be able to defend yourself in an attack situation. Note that the location of this event will be off-campus as airsoft/simulated weapons may be used for demonstration purposes.

VCDL President Speaking at Students for Concealed Carry on Campus Hosted Event

Rockford, IL --(AmmoLand.com)- Gun ownership is increasing at an unheard of rate in the US this year.

The largest contributing factor to this is the fear that the Obama administration will attempt to pass new sweeping legislation that would ban certain types of guns based on their cosmetic appearances, like the so-called Assault Weapons ban that expired in 2004.

With 48 states having adopted concealed carry legislation, and the vast majority of those – 40 – have what is referred to as shall-issue licensing, meaning anyone who qualifies for a license or permit MUST be issued one. 8 states still have discretionary or more accurately discriminatory issue, it’s easy to see where this trend is headed.

The Supreme Court has ruled that individuals DO have the right to own and carry (keep and bear) arms for self-defense and other uses. The Supreme Court is also set to rule next year on whether or not, or to what extent, states can restrict this right. If the highest court follows the intentions of the founders of this country, “that every man be armed,” then we should see even more drastic reduction of the approx. 30,000+ gun laws on the books that have been completely ineffective at reducing crime, since criminals readily ignore the laws and illegally obtain and use guns in crimes regardless.

Truth is finally prevailing, and the right to protect yourself and your family is on a major comeback! With minimal training and practice, the average person can protect themselves very effectively. It’s time for all of us to step up to the plate and take advantage of this trend. There’s simply no need to let gun control get you down anymore!!!

ICarry.org Update
A lot is happening at ICarry.org. After a short leave due to my personal obligations, I have now been able to dedicate myself to this cause full time. By using the Internet, our website, and these simple newsletters in addition to other marketing, we’ve been able to come a long way in a short time. I’m very thankful to the volunteers who have been helping with these tasks, and to the many people who have stepped up to help support what we’re doing with donations.

Right now we’re getting our store running. In the next week it should be fully functional, and we will have a lot of neat things to offer. The store will also help us bring in the revenue needed to keep going! By popular demand, high-quality car window stickers are being printed. These stickers will look fantastic, last a lifetime, and they’re easily removable and re-stickable without leaving any residue. It took some work, but I found the best ones I could, and you’ll see them start popping up on cars everywhere very soon.

We’ve also partnered with Gun Owners of America to help defend the right to keep and bear arms in a no-compromise fashion on the state and federal level. Larry Pratt, the executive director of GOA, put it this way: “Illinois [and Wisconsin] has needed a take-no-prisoners group to defend the right to keep and bear arms. ICarry.org is that group.” We’re thankful for the kind words and look forward to working together to see that no new restrictions are placed on the ownership of firearms and remove as many of the unneeded current restrictions as possible.

We are also making really cool distributable business cards that everyone can use to raise awareness of the right-to-carry in Illinois and Wisconsin! Our survey showed that you wanted these, so we are putting out! These will be available as inexpensively as possible on our store in the next week or two just like the window decals.

Other than that, we’re working diligently to bring some nice new firearms for our One Gun a Month Giveaway. ICarry.org & Expanded Gun Rights On The Move

Washington, DC --(AmmoLand.com)- Make no mistake! Our Founders were onto something when they enshrined the right to keep and bear arms as the Second Amendment to our nation’s founding document, the United States Constitution.

Because the Second Amendment is part of our nation’s supreme law, attacking gun rights means attacking the very foundation of the country.

The gun grabbers know they have to deal with this supreme law at some point if they’re going to push their radical agenda through.

And so they’ve decided to rewrite the Bill of Rights to best suit their plans.

That’s right. In an attempt to circumvent our nation’s fundamental law, Barack Obama has rewritten his own version of the Bill of Rights and posted it on the White House website.

According to Obama, “The Second Amendment gives citizens the right to bear arms.”

I don’t know about you, but my right to defend myself comes from my Creator — not from government, not from some bureaucrat or politician, but from my very nature as a human being.

I’m sure I don’t have to tell you that redefining a fundamental right as a privilege is a very dangerous path to start down.

A right is inherent in our humanity and can never be taken away.

A privilege can be removed at the whim of one’s rulers.

But the President’s redefinition of our nation’s fundamental law isn’t enough for some anti-freedom zealots.

Gun grabbers in our government-run education system are now seeking to brainwash your children into accepting their anti-gun agenda — also by rewriting the Bill of Rights.

Lesson plans in Garland, Texas, (Texas?! Really?!) now teach the Second Amendment by summarizing as follows, “Amendment 2: We can get permission to own weapons to protect ourselves.”

This couldn’t be any further from what the Second Amendment clearly states!

“The right of the people to keep and bear arms shall not be infringed.”

(NOTE: The Garland Independent School District has admitted that this was a mistake and says they are taking steps to ensure proper education on the second amendment.)

I want you to call the White House and the Garland Independent School District and demand they restore the original language to the Second Amendment.

Anti-Gunners and Obama Intent on Rewriting the Bill of Rights

USCCA - -(AmmoLand.com)-Every vocal pro-gun advocate is familiar with the condescending look of so-called friends or family members who are sure we’re nothing but bloodthirsty members of the NRA cult. We’ve all been there when someone belittles our judgment by saying, “I hope you have those guns locked up so your kids won’t get them,” or asking, “Aren’t you afraid you will shoot a family member by accident?” You might even get to hear my favorite silly anti-gun statement, “You know, someone who keeps a gun in the house is 75% more likely to kill a friend of family member than an intruder.”

Personally, I have a family member who is a self-described intellectual and, based on the desire to feed his feelings of superiority, he looks down his nose at anyone who carries a gun for self-defense.

A common answer when asked, “Why do you keep a gun in the house with those kids?” is to simply say, “I have it because I love my children and value their lives.” Usually, that is followed by a nod as if the person asking the question understood my answer, and then a puzzled furrowing of their eyebrows. No reason to go any further at that point, since usually the antagonist walks away wondering if you’ve lost your mind. Jim Irvine, Buckeye Firearms Association’s Chairman, delivers the line better than anyone I’ve met, with equal parts sarcasm and scorn. His delivery is a joy to behold.

But the unfortunate reaction to the social crusaders who want to tell us how to keep our family safe is to react with anger. Nobody wins if that happens since the person spewing the misguided anti-gun propaganda is probably parroting the rhetoric heard on the latest episode of Ellen or Oprah. It only shows a lack of willingness to investigate an issue properly as opposed to true anti-gun feeling. Still, it is hard to be treated in such a condescending manner because you actually took the time to study the issue and realize having a gun is the best way to keep your family safe.

As pro-gun advocates, we have an obligation to lay out our arguments in a calculating and logical manner. To do so isn’t easy. I fail to tolerate the simple minded nature of our anti-gun adversaries on a daily basis. Like most pro-gun advocates it is beyond my ability to comprehend that people still believe in the validity of gun-control after the mounds of evidence that has disproved it over the last thirty years. Even worse is trying to educate the establishment media on how much they don’t understand about guns. Anger is never the answer, however, since it only reinforces the idea that people who own guns can’t be trusted–an ironic twist since it is backward anti-gun ravings that should incur the scorn of every day Americans.

In contrast to my so-called intellectual family member is a sister with an autistic son. There is true concern over keeping a gun in the house under those circumstances, and I have the utmost respect for their decision to not keep one. Although my nephew is a wonderful child, it is simply impossible to adequately teach him not to touch a gun. My sister’s situation teaches me that my choice to own a gun isn’t practical for everyone I come across in daily life. I actually have more respect for people who might want to keep a gun at home but have honest reasons that make it impossible compared to those who simply have their heads in the sand. The same people who think their house is utterly secure scoff at the thought that keeping a gun is akin to having a smoke detector or fire extinguisher.

Some of the people who obsess the most about picking the right car seat, the safest crib and go to great lengths to baby-proof their house don’t take simple precautions to keep their kids from becoming the victim of a gun accident. The benefits of the NRA’s Eddie Eagle program are lost on people who refuse to look at the gun issue logically and instead react out of emotion. A failure to teach your kids how to avoid becoming an accidental gun death is equivalent to not teaching them to be careful with strangers, look both ways before crossing the street, or wear a helmet while riding a bike.

Still, your well-intentioned friends at work don’t see it that way. To many of them, keeping a gun in the house is equal to child abuse because their favorite anti-gun celebrity said so. Their gullible nature has been crafted by years of anti-gun establishment media misinformation and they are also guilty of taking political advice from the likes of Rosie O’Donnell, Sean Penn or Ellen DeGeneres. Only when we succeed in changing the culture will we succeed in changing the minds of those so enamored with celebrity they would vote based on their favorite actor’s political endorsement or demonstrate in front of a Marine Corps recruiting station because their favorite celebrity said it was the right thing to do.

While we have logic, statistics, facts and even moral rightness on our side, one thing pro-gun advocates can’t account for is how hard people will resist changing long-held beliefs. That holds true whether those beliefs are based on emotion, faith, or in the case of gun control, poorly executed social policy. For millions of Americans who grew up in cities such as Chicago, Boston, New York or Washington D.C., the never-ending drumbeat of anti-gun propaganda wore down the citizen’s objectivity. The overwhelming evidence which proves that gun control led to the exact type of crime it was designed to stop leaves people even more confused. They have shut down on the issue and stick by their misguided values.

The simple fact is that the establishment media and media elites in our country are very good at their job. For years that included selling the value of gun-control with the all the gusto they could muster and an uncanny ability to drown out dissent. To overcome that bias will take time and dedication to the cause. It helps that we are right but that only goes so far. Unless all gun owners protect their right to bear arms with unwavering dedication they will one day be confiscated.

It’s our job to keep that from happening.
