title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- First, the good news: Fox News is reporting that due to an amazing outpouring of opposition, the vote on the so-called anti-piracy legislation <em>&#8211; which could muzzle websites like GOA’s &#8211;</em> has been postponed.</p><p>Thank you all for your activism … and please stay tuned to further updates on this issue.</p><p>Now for the bad news: You know what they say about Friday the 13th.</p><p>Well, this past Friday, the U.S. District Court for the District of Columbia issued a setback to gun owners. The issue involved a lawsuit challenging <a
title="AmmoLand Reports" href="http://www.ammoland.com/2012/01/18/nssf-files-appeal-in-multiple-sales-reporting-lawsuit/">Barack Obama’s illegal multiple sales regulation</a>s. [NSSF v. Jones, Acting Director, BATFE.]</p><p>Through those regulations, Obama has demanded, by regulatory fiat, that firearms licensees in four southwestern states report multiple sales of certain long guns to the federal government.</p><p>In upholding this action, Judge Rosemary Collyer <em>-– a Bush appointee! –</em>- ignored the Constitution, the Supreme Court’s decision in the Heller case, and the clear language of federal law.</p><p>Of course, this once again underscores the danger of putting all our eggs in the <em>“court basket.”</em> It’s not a bad idea to challenge unconstitutional measures in the courts, but it’s problematic if we look to them as being the ultimate defenders of our gun rights. Clearly, they are not.</p><p>Among other things, Judge Collyer ignored the obvious language of the 1986 McClure-Volkmer Act, which prohibits the ATF from demanding any information on gun owners other than information explicitly allowed by statute.</p><p>Specifically, the section states: <em>“Such [licensees] shall not be required to submit to the Attorney General reports and information with respect to such records and the contents thereof, except as expressly required by this section.” (18 U.S.C. 923(g)(1))</em></p><p>Paragraph<em> (g)(5)</em> allows the Attorney General to demand information by issuing a <em>“demand letter,”</em> but participants in the drafting of McClure-Volkmer affirm that this was not intended to trump the paragraph (1) limitation, in order to statutorily mandate reporting requirements.</p><p>To interpret paragraph <em>(g)(5)</em>, as Obama and Attorney General Holder have interpreted it, is to say that there are NO limits on the information the Attorney General can demand<em> -– up to and including every 4473 in the country.</em></p><p>In opening this door, Collyer cited much narrower decisions in the Fourth and the liberal Ninth Circuit, but expanded them beyond any judicial precedent. Citing a test that looked at whether the ATF’s action constituted a <em>“clear error of judgment”</em> or was <em>“arbitrary or capricious,”</em></p><blockquote><p><em>Collyer gave all of the benefit of the doubt to Obama -– and none to the Second Amendment, which wasn’t even considered in her 21-page opinion.</em></p></blockquote><p>The decision will presumably be appealed to the D.C. Circuit Court of Appeals -– a supposedly<em> “conservative”</em> circuit that nevertheless upheld ObamaCare.</p><p><strong>But the larger issue is this:</strong> Congress can block these regulations by simply cutting off the money to implement them. Last fall, we demanded that the House include such a prohibition in its giant money bill. But congressional leaders ignored the Second Amendment community on this and a variety of other pro-gun issues, including defunding ObamaCare.</p><p>It is late in the game. But there is still an opportunity to prohibit funding for the multiple sales regulations on the annual Department of Justice Appropriations bill and the <em>“continuing resolution</em>” which will inevitably follow around September 30.</p><p>True, a lot of damage will have been done by that point. But we cannot allow to stand the precedent that the Attorney General can seize any and all gun-related information, simply by saying he wants it.</p><blockquote><p><strong>ACTION:</strong><a

title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- Senator Rand Paul (R-KY) has been doing a yeoman’s job of trying to rein in the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and protecting the privacy of gun owners.</p><p>But now, according to senate insiders, the Republican leadership is trying to undermine these efforts by urging fellow Republicans to oppose Paul’s<em> “no gun registration”</em> amendment.</p><p>Paul’s amendment would exempt gun records <em>&#8211; including 4473’s (the form all purchasers fill out when they buy a firearm from a licensed dealer) &#8212; </em>from the blanket information demands which the ATF can make under the 9/11 legislation.</p><p>We have known for weeks that Senate Majority Leader Harry Reid would oppose Rand Paul. But now, Senate Minority Leader Mitch McConnell is also helping <em>“Dirty Harry” </em>Reid by encouraging other Senate Republicans to oppose the Paul language.</p><p>All gun owners need to take action right now. Time is short, as the PATRIOT Act extension will become a done deal sometime tomorrow (Friday).</p><p>So please use the Talking Points below TO CALL Senate Minority Leader Mitch McConnell today! Please urge Senator McConnell to support the Paul “<em>no gun registration”</em> amendment and to use his leadership position to urge other Republicans to do the same.</p><p>2. Without the Paul <em>“no gun registration” </em>amendment, it is possible that the ATF could go to a secret (FISA) court and demand every 4473 in the country, ostensibly because a “terrorism investigation” requires it. If such an action were taken, the government would have a list of every gun buyer in the country going back decades.</p><p>3. If Senator McConnell allows Harry Reid to successfully shut out gun amendments, then gun owners will hold him (McConnell) personally responsible for enabling the Majority Leader. And if the Democrats retain the control of the Senate in 2012, the Republicans will only have themselves to blame.</p><p>4. ANSWERS TO POSSIBLE OBJECTION. Senators have been trying to tell Senator Paul (and Senator McConnell will probably tell you) that the PATRIOT Act does not allow the ATF to get every 4473 in the country. Well, there are two answers to this:</p><p
style="padding-left: 30px;">a.       First, if the PATRIOT Act does not, in fact, allow the ATF to go on fishing expeditions, then what is the harm in passing the Paul amendment? Why not just pass the Paul provision so that we can have an extra ounce of prevention specifically prohibiting the ATF from using the PATRIOT Act to fish for people’s gun sale records.</p><p
style="padding-left: 30px;">b.      Second, the very language that some Senators are claiming will protect us is the very language that the ATF is currently violating! Senators like McConnell want us to think that the 1986 McClure-Volkmer law (which outlaws gun owner registration) is good enough to protect us from fishing expeditions under the PATRIOT Act.</p><p>But as any law school student and judge in the country knows, more recent laws<em> (like the PATRIOT Act)</em> ALWAYS TRUMP older laws <em>(like the 1986 Act which prohibits gun owner registration)</em>. If there is a conflict, the more recent law governs. Hence, it’s not surprising that we are currently witnessing the ATF violate the 1986 McClure-Volkmer law, as the agency recently issued new proposed rules to require registration of those persons who purchase multiple semi-autos &#8212; and all of this in the name of fighting gun smuggling in the Southwest.</p> <address>Gun Owners of America<br

title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- Remember the corrupt tactics used by Senate Majority Leader Harry Reid to pass ObamaCare? The secret meetings? The refusal to let the American people see the language?</p><p>Well, he’s at it again. This time, Reid is abusing his role as Majority Leader of the Senate to block a pro-gun amendment that Sen. Rand Paul (R-KY) is attempting to add to the so-called Patriot Act.</p><p>In order to circumvent Sen. Paul’s efforts to protect gun rights, Reid scuttled the Senate version of the 9/11 extension and instead tacked it onto an unrelated House-passed small business bill. He then employed a procedural scheme to lock out ALL Republican amendments, including Paul’s pro-gun amendment.</p><p>As you know, Rand Paul’s amendment would exempt 4473’s<em> (the form all purchasers fill out when they buy a firearm from a licensed dealer</em>) and other gun records from the blanket information demands which Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) can make under the 9/11 legislation.</p><p>Without Paul’s exemption, it is possible that the BATFE could go to a secret (FISA) court, and, in a one-party (ex parte) proceeding, obtain an order to produce every 4473 in the country, ostensibly because a “terrorism investigation” requires it. If such an action were taken, the government would have a list of every gun buyer in the country going back decades.</p><p>This is unacceptable and it is a violation of gun owner protections enacted in 1986 as part of the McClure-Volkmer Firearms Owners Protection Act. The McClure-Volkmer Act spells out the purposes for which gun records can be obtained by a law enforcement agency: as part of a bona fide criminal investigation, a trace, or a routine annual inspection. Sen. Paul’s amendment will simply keep the 1986 law’s provisions in place.</p><p>It should also be noted that the records in question deal with persons who already underwent the (unconstitutional) background check and were allowed to purchase a firearm. Once again, the dangers of a background check system (which presumes a person is a criminal until proven otherwise) are highlighted, as efforts must constantly be made to keep the government’s hands off the list of honest gun owners.</p><p>Sen. Paul’s amendment to protect gun owners would have tremendous support in the Senate, and Reid knows it—which is why he has gone through such great lengths to keep it of the floor. Now is the time to insist that the Paul amendment be allowed to come up for a vote and that gun dealer records be protected</p><p><strong>ACTION: </strong>Contact your Senators. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- S. 570 &#8212; <em>&#8220;a bill to prohibit the Department of Justice from tracking and cataloging the purchases of multiple rifles and shotguns.&#8221; </em></p><p>The bill would prohibit the use of federal funds for a <a
title="AmmoLand Reports" href="http://www.ammoland.com/2010/12/19/atf-to-require-multiple-sales-reports-for-long-guns/" target="_self">multiple sales reporting scheme </a>proposed by the Bureau of Alcohol, Tobacco, Firearms and Explosives.   Last month, the U.S. House of Representatives adopted an amendment with similar language.  That amendment to an omnibus spending bill, offered by Representatives Dan Boren (D-Okla.) and Denny Rehberg (R-Mont.), passed the chamber (277-149) with broad bipartisan support.</p><p>The BATFE is demanding the authority to require all of the 8,500 firearm dealers in California, Arizona, New Mexico and Texas to report all sales of two or more semiautomatic rifles within five consecutive business days, if the rifles are larger than .22 caliber and use detachable magazines. Yet, under existing law, the bureau has full access to every record of every firearm transaction by every licensed dealer, whether during a bona fide criminal investigation or simply to enforce compliance with record keeping requirements. This reporting scheme would create a registry of owners of many of today&#8217;s most popular rifles&#8211;firearms owned by millions of Americans for self-defense, hunting and other lawful purposes.</p><p>Please contact your U.S. Senators and ask them to cosponsor and support S. 570. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- Within the next 90 days, Congress will vote on whether to reauthorize legislation to specifically allow the government potential access to millions of gun records (4473’s).</p><p>Section 215 of the PATRIOT Act, which must be reauthorized soon, is of particular concern.</p><p>This section allows the FBI to seize business records &#8212; including the 4473 forms that gun buyers fill out.  The only significant caveat is that the FBI must claim that the seizure of records is needed pursuant to “<em>an authorized investigation.”</em></p><p>But since a secret court is required to rubber-stamp the government’s request<em> (unless it fails to make even a specious case)</em>, the FBI can easily abuse its authority.  The Inspector General found that, between 2003 and 2006, the FBI may have violated the law over 6,000 times with respect to their authority under various provisions of the PATRIOT Act.</p><p>So just imagine that it’s your gun records that have been seized.  Under such circumstances, the gun dealer is specifically prohibited, under penalty of law, from telling you that the FBI has confiscated the records of your firearms purchases.  Under the PATRIOT Act, any limitations on the use of the seized records shall be at the sole discretion of the Department of Justice.</p><blockquote><p><em>Talk about the fox guarding the hen house!</em></p></blockquote><p>It is imperative that Congress protect gun owners from rogue government agents who would abuse their authority to register gun owners.</p><p>We’ve already seen the Bureau of Alcohol, Tobacco, Firearms and Explosives <a
title="AmmoLand Reports" href="http://www.ammoland.com/2010/12/19/atf-to-require-multiple-sales-reports-for-long-guns/" target="_self">attempt to register gun owners</a> recently when they tried to require certain gun dealers to report anyone who, within a five day period, tried to purchase two or more semi-automatic rifles <em>(that are .22 caliber or greater and can accept a detachable magazine).</em></p><p>Historically, gun registration has been a prelude to gun confiscation, as documented by the Jews for the Preservation of Firearms Ownership almost 20 years ago.  They showed how several foreign governments in the Twentieth Century had used gun control &#8212; and quite often gun registration &#8212; to confiscate firearms.  In each case, such confiscation was a prelude to genocide.</p><p><strong>ACTION: </strong>Contact your two senators and insist that any language to reauthorize Section 215 also contain language to protect 4473’s from the Obama administration’s scrutiny. That quote is becoming popular because it is undeniably true.</p><p>They never stop finding ways to curb our liberties. They want you reported and tracked anyway they can get it.</p><p>The gun-grabbers are scheming again. But this time they are sneaking through the back door. They don&#8217;t want you to see them coming.</p><p>The BATFE has recently begun to connive<em> &#8220;emergency powers&#8221; </em>from President Obama to <a
title="AmmoLand Reports" href="http://www.ammoland.com/2010/12/21/atf-announces-demand-letters-for-multiple-sales-of-long-guns-in-border-states/" target="_self">monitor purchases from gun stores</a>.</p><p>They don&#8217;t want you buying more than one rifle without you being reported to Washington over so-called <em>&#8220;terrorism concerns&#8221;.</em> More importantly, they&#8217;re using <em>&#8220;emergency powers&#8221;</em> so they can steal away what they want without a vote.</p><p>They&#8217;ve been monitoring citizens for decades with handgun sales, and now they&#8217;re trying it with rifles.</p><p>Of course, you and I both know that they&#8217;re plotting to stop you from buying any guns without them recording it. But this is how they start down that path.</p><p><strong>Emergency Powers.</strong><br
/> The BATFE is using their favorite bogey man of terrorism and drug-related violence in other countries to trump the charge that your purchase of rifles is to blame. They are stealing powers away from your elected representatives and into their own hands to spy on and record your purchases if you buy more than one gun in a week.</p><p>If this is starting to sound all too familiar, that&#8217;s because it is.</p><p>Remember Mayor Bloomberg? One of the wealthiest and most powerful anti-gunners out there?</p><p>This was Bloomberg&#8217;s plan. And it&#8217;s blatantly against the law.</p><p>The Firearm Owners&#8217; Protection Act was designed specifically to prevent this perversion of freedom from happening.</p><p>In fact, this act also requires that any changes be given a public hearing no less than 90 days in advance <em>(the BATFE is attempting this power-grab with just 30 days notice).</em></p><blockquote><p><em>In other words, existing Federal law stops this move specifically, and the speed in which it is being attempted&#8230;</em></p><p><em>&#8230;And they are rolling right over it like it wasn&#8217;t even there.</em></p></blockquote><p>Even schoolchildren know that it is the legislature&#8217;s job to write law in the United States, not the President or some power-hungry law enforcement agency, bent on crafting their own rules. But with so many distractions out there, some of your Congressmen and Senators don&#8217;t even know what&#8217;s going on with this story or how it will impact the average gun owner.</p><p>That&#8217;s why I am writing to you now. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)-  Edwing Ronal Morales, a former Metropolitan Nashville police officer, was found guilty on December 15, 2010 by a jury, after a two day trial in U.S. District Court in Nashville, of two counts of making false statements to a firearms dealer during two attempted purchases of handguns in 2009.</p><p>Announced Jerry E. Martin, U.S. Attorney for the Middle District of Tennessee; Glenn N. Anderson, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Nashville Field Division; Jon Ruttencutter, Resident Agent in Charge of the Department of Homeland Security, Homeland Security Investigations (HSI), Nashville Field Office; and Steve Anderson, Interim Chief of Police, Metropolitan Nashville Police Department.</p><p>According to the trial testimony, Morales went to Guns and Leather, a federal firearms licensee, located in Greenbrier, Tennessee on two occasions in May and July of 2009. Morales attempted to purchase handguns for a friend and co-defendant in the case, Julio Rojas-Lopez. During the attempted purchases, Morales, a Nashville police officer since September 2007, falsely represented on a Firearms Transaction Record, commonly known as a 4473 Form, that he was the actual buyer of handguns that were actually intended for Rojas-Lopez, who was illegally transporting guns to Guatemala.</p><p>Morales was terminated from the police department in September 2009.</p>Tags: <a

As a result errors were common and often resulting in the revocation of FFL licensees. class="wp-caption-text">BATFE</p></div><p><strong>Washington, DC -</strong> -(AmmoLand.com)-  The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), pursuant to the Gun Control Act (GCA) and the Federal firearms regulations, is responsible for licensing persons engaging in a firearms business. With certain exceptions, the GCA allows ATF to conduct one warrantless, annual compliance inspection of a federal firearms licensee (FFL). The purpose of the inspection program is to educate the licensee about regulatory responsibilities and to evaluate the level of compliance. Compliance inspections also serve to protect the public in that they promote voluntary internal controls to prevent and detect diversion of firearms from lawful commerce to the illegal market.</p><p>During inspections, ATF industry operations investigators (IOI) review records, inventory, and the licensee’s conduct of business. To assist in meeting and maintaining compliance, investigators also provide instructional and educational materials about the requirements of the law and regulations and best business practices.</p><p>Compliance failures, which constitute violations of law and regulation, commonly disclosed during the inspection process include failure to verify purchaser eligibility; inability to account for firearms received and disposed; failure to ensure firearms traceability due to improper recordation of firearms receipt and disposition; failure to properly document firearms transfers; and failure to report multiple sales of handguns. These types of violations, among others, can hinder the FFL’s ability to support law enforcement criminal investigation efforts.</p><p>Proper and timely recordkeeping by FFLs is critical to the success of a crime gun trace and is required for all firearms acquired and transferred by licensees. Failing to account for firearms is a serious public safety concern because unaccounted firearms cannot be traced. During compliance inspections conducted in 2007, ATF investigators identified nearly 130,000 firearms that FFLs could not locate in inventory or account for by sale or other disposition. By working with industry members, IOIs reduced this number to approximately 31,000 firearms that FFLs could not account for. As such, ATF investigators improved the success rate of potential firearms traces of previously unaccounted firearms by 76 percent. Although this is a significant improvement, over 30,000 firearms remained missing and pose a threat to public safety.</p><p>When violations of the law and regulations are disclosed during an inspection, a Report of Violations is issued to the licensee that outlines the discrepancy and the requirements for corrective action. ATF also works to gain cooperation and compliance from FFLs by issuing warning letters and holding warning conferences. Despite these remedial actions, on rare occasions ATF encounters a licensee who fails to comply with the law and regulations and demonstrates a lack of commitment to improving his or her business practices. In such cases where willfulness is demonstrated, ATF’s obligation to protect pubic safety may require revocation of the federal firearms license.</p><p>In Fiscal Year 2007, ATF conducted approximately 10,000 compliance inspections. More than 40 percent of the licensees inspected were determined to be in full compliance with the law and regulations and no violations were cited. Approximately 100 federal firearms licenses were revoked or were denied renewal due to willful violations of the GCA. This figure is approximately 1 percent of the number of licensees inspected.</p><p>ATF investigators assist licensees in developing corrective actions when violations are identified and encourage licensees to constructively engage in the remediation process. In this way, ATF attempts to bring licensees into compliance before it becomes necessary to take administrative action against the licensee. When an ATF inspection results in a warning conference or potential revocation, the licensee is provided an opportunity to develop a written plan that details the steps taken to correct the problems identified and measures implemented to ensure future compliance.</p><p>To assist licensees in achieving and maintaining compliance, ATF conducts recall inspections on all licensees who have committed violations that warranted a warning conference. In 2007, recall inspections resulted in an overall 85-percent reduction in the total instances of violations. Recall inspections also resulted in a 78-percent reduction in disclosed prohibited sales and a 90-percent decrease in inventory discrepancies.</p><p>ATF’s focus is to help licensees avoid violations of the law and its implementing regulations. The Bureau prides itself on partnering with the firearms industry, especially regarding voluntary internal controls, to better protect the public. To that end, ATF continues to work closely with the firearms industry at all levels to ensure compliance, understand concerns, and help resolve perceived obstacles to compliance. ATF strives to educate licensees concerning their obligations under the law through open letters mailed to FFLs, information posted on ATF’s Web site, quarterly FFL newsletters, industry seminars, attendance at trade shows, and partnerships with industry associations. Licensees are provided the “Federal Firearms Regulations Reference Guide,” which includes laws, regulations, and other information about conducting a firearms business under federal law, and other publications such as the “Safety and Security Information for Federal Firearms Licensees.”</p><p><strong>About:</strong><br

class="wp-caption-text">BATFE</p></div><p><strong>Washington, DC -</strong> -(AmmoLand.com)-  The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is responsible for licensing persons engaged in the business of manufacturing, importing and dealing in firearms. ATF’s jurisdiction and the regulatory requirements applicable to federal firearms licensees (FFL) are derived from the Gun Control Act of 1968 (GCA).</p><p>In 1993, the overall number of FFLs was approximately 284,000. By 2007, that number had declined to 109,000 total active licenses, indicating a decrease of 175,000 licensees. These numbers include licenses held for business purposes as well as those held by collectors of curios and relics.</p><p>A number of factors appear to have contributed to this decrease. The Brady Handgun Violence Prevention Act of 1993, known as the “Brady Bill,” increased the fees for federal firearms licenses from $10 per year to $200 for the first 3 years, and $90 for each 3-year renewal period. The Violent Crime Control and Law Enforcement Act of 1994, referred to as the “Crime Bill,” enacted requirements that applicants engaging in firearms businesses notify the chief of their local law enforcement agency of their intent to apply for a license, submit their responsible persons’ photographs and fingerprints with their applications, and certify that their businesses would be in compliance with state and local laws, including zoning regulations. Following enactment of the new law, many federal firearms licensees who were not in compliance with local zoning ordinances chose to voluntarily surrender or not renew their licenses.</p><p>Additionally, in 2004, ATF implemented an in-person application inspection program. ATF industry operations investigators now conduct in-person application inspections with all new firearms business applicants. Through the inspection process, investigators verify the identity of the applicant, ensure the qualification of the person(s) intending to conduct business, verify the business premises, and review the recordkeeping and conduct of business requirements to assist the applicant in complying with the law and regulations. In addition to educating the applicant about regulatory responsibilities, these efforts encourage voluntary business practices that can prevent diversion of firearms from lawful commerce to the illegal market.</p><p>ATF conducted over 5,000 application inspections in 2007, of which less than 15% were withdrawn or abandoned by the applicant or denied by ATF.</p><p>It is also instructive to note the transitory nature of FFL numbers. Each year, a significant number of licensees choose to voluntarily cease operations or fail to renew their licenses. For example, during fiscal year 2007, over 13,000 new firearms licenses were issued. However, during that same time period, the total number of licenses increased by just over 1,600 licenses.</p><p>Revocation actions taken against licensees who willfully fail to comply with the law and regulations have been an insignificant factor in the decrease of the FFLs. During the 7-year period from 1993 through 1999, ATF revoked or denied the renewal of approximately 860 firearms licenses. During the 8-year period from 2000 through 2007, ATF revoked or denied renewal of approximately 890 FFLs.</p><p>The overall number of FFLs revoked (1,750) represents 1% of the 175,000 total decrease in the number of FFLs. While the number of FFL revocations and denials of renewals has fluctuated in years past, the effect of these adverse actions on the numbers of FFLs is insignificant. Since 2005, revocation actions against federal firearms licensees have translated to only 1-2% of the FFL inspections conducted and 0.1% – 0.2% of all active licenses, excluding collector (of curio and relic) licenses.</p><p><strong>About:</strong><br

/> 3/2/09</p><p>This notice serves as a follow up to the January 6, 2009, Notice to All Federal Firearms Licensees (FFLs) regarding ATF Form 4473 availability. The January 6th notice provided authorization to FFLs to copy the ATF Forms 4473 for a limited time due delays in printing and shipping.</p><p>Now, due to the limited supply of booklet-form canary yellow paper, the ATF Form 4473 will be distributed on white booklet-form paper. FFLs may continue to photocopy the Form 4473 in its entirety (including instructions) until they receive any backorders from the Distribution Center.</p><p>Additionally, due to the limited availability of the newly revised ATF Form 4473 Part I &#8211; Firearms Transaction Record Part I-Over-the-Counter (5300.9) (2008 Spanish Version), FFLs may photocopy this form as necessary.</p><p>The licensee must ensure that any photocopies are of good quality and obtain all of the required information on the printed forms. All completed forms must be maintained in accordance with the provisions of 27 CFR Part 478.129. All 6 pages of the form, including the instructions, must be stapled and maintained together. class="serendipity_imageComment_txt">Bureau of Alcohol, Tobacco, Firearms and Explosives</div></div><p><strong>U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives -</strong> Recently, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) released the revised version of the Firearms Transaction Record (ATF Form 4473) with a revision date of August 2008. By open letter dated October 3, 2008, ATF advised that all FFLs must begin to use the new Form 4473 no later than November 15, 2008. ATF realizes that this date is during hunting season and that this is a very busy time of year for the firearms industry. As Federal firearms licensees (FFLs), you play a significant role in the transfer of firearms to consumers. ATF recognizes the shared obligation to ensure that persons ineligible under the law do not acquire firearms. Therefore, in an effort to prevent undue burden on you the FFL, and to allow for proper training of employees, ATF will extend the mandatory must-use date of the new Form 4473 to January 15, 2009.</p><p>This extension will allow you to review the entire revised Form 4473, including the definitions, instructions, and the Important Notices to the Transferor/Seller. This will ensure timely implementation of the Form 4473 and a better understanding of the significant changes.</p><p>The mandatory must-use date for all FFLs for ATF Form 4473 has been changed from November 15, 2008, to January 15, 2009. All FFLs may begin to use the revised Form 4473 upon receipt but by no later than January 15, 2009. You may no longer use the previous edition of the Form 4473 after January 15, 2009 or as soon as you begin using the revised edition.</p><p>Please contact your local ATF office with any questions you may have about the revised Form 4473.
