Virginia - -(AmmoLand.com)- As we reported earlier Sussex County VA was to Voting On Restricting Shooting Ranges. About 25 gun owners showed up at the Sussex Board of Supervisors meeting last night.

Everyone who spoke, spoke in opposition to the proposed ordinance that would require special use permits for shooting ranges.

Many of the Board did not seem enthusiastic about the ordinance. In the end they rejected the wording defining what a pistol range was and sent the issue back to the planning commission.

We may have to go out there one more time in the future for the whole concept to be put to rest, but I think if we keep the pressure up, the proposed ordinance will be defeated.

Sussex County Va Backs Down On Shooting Range Infringement For Now

Bellevue, WA - -(AmmoLand.com)-We are very excited to see the Second Amendment Foundation joined by the Illinois State Rifle Assocciation on the behalf of four Chicago residents submitted its brief in the U.S. Supreme Court case McDonald vs Chicago.

The brief was prepared by attorney Alan Gura who was also the attorney for the widely known Heller case which successfully challenged the Washington D.C. handgun ban last year.

The brief is available for viewing and downloading at ChicagoGunCase.com. The brief presents an excellent and compelling argument as to why the Second Amendment should be incorporated into the states. Many Second Amendment supporters will find the brief easy to read and comprehend. It has been said by some IllinoisCarry members who have read it to cause “goosebumps” in its scope, clarity, and purpose.

Oral arguments are expected to be heard early next year and perhaps a ruling by mid-year. The restoration of the Second Amendment rights of Illinois citizens will be greatly affected by the ruling in this case and we shall continue to watch future developments very closely.

Supreme Court Brief Filed In Lawsuit Against Handgun Ban

Medford , Oregon --(AmmoLand.com)- In a case funded by the Oregon FIrearms Educational Foundation, Jane Doe Vs Medford School District, the court ruled that Oregon’s preemption statute does not protect employees from gun restrictions imposed on them by state employers.

This case, which got international attention, pitted a Medford school teacher against her employer. When it was learned that the teacher, Shirley Katz, possessed a concealed handgun license, her school and school district began a campaign of abuse and threats against her. We agreed to take her case to court.

After the Circuit Court ruled that the school could, in fact, create rules to prevent her from possessing a self-defense firearm, we appealed. The Court’s decision can be seen here.

It’s interesting that the Court continues to use and misunderstand the case of Starrett vs City of Portland, another case funded by OFEF. In their decision they state “In Starrett, the City of Portland leased Pioneer Square to a privately owned company, Entercom, which owned and operated a number of radio stations in the area. Id. at 536. Entercom leased the property in order to host a New Year’s Eve celebration. ”

This is exactly the opposite of what happened. In fact, Entercom radio did not “lease” space from the city. The city PAID Entercom radio to run a City party on City property with taxpayer money. So once again, the Courts reach a conclusion based on incorrect former conclusions.

Oregon Appeals Court Rules Against Gun Owners…Again

NEWTOWN, Conn --(AmmoLand.com)- A move by conservative members of the Canadian Parliament to end the nation’s long-gun registry has been welcomed by Canadian firearms retailers.

One retailer noted, “I think common sense has prevailed. The objective to eliminate crime in Canada has not been met.

It’s been too costly. I believe that the money that could be saved here would be better used by putting police on the streets where we do have problems with crime.”

Much like in the United States, gun control in Canada has pitted urban representatives against rural representatives.

Canadian Gun Registry’s Looming Demise Welcomed By Retailers

Trenton, NJ --(AmmoLand.com)- In testimony before the Firearms and Advisory Task Force this September, NSSF testified that the pending one-gun-a-month law, signed into law by outgoing New Jersey Gov. Jon Corzine, restricts law-abiding dealers from obtaining inventory.

“Retail Dealers will only be able to obtain one handgun a month from any source except another Retail Dealer (who is not likely to sell any of their dwindling inventory to another dealer.) As dealer inventories sell out, they will not be able to replace it except at the worthless pace of one gun a month. In a short time, there will be no handguns left for dealers to sell.”

In the Star Ledger last week, Task Force Chairman Robert Bernardi, Burlington County Prosecutor, addressed the need to amend the law.

“As it stands now, retailers would be prohibited from purchasing guns from their suppliers. I think that was an oversight when the legislation was passed.”

Prospects for passage of the retailer exemption legislation remain relatively strong, and NSSF will continue to push for this change.

NSSF Testifies On One-Gun-A-Month Law In New Jersey

Ohioans For Concealed Carry

Ohio --(AmmoLand.com)- The 8th Ohio District Court of Appeals has overturned the trial court’s decision and ruled that Ohio Revised Code 9.68, which provided for statewide preemption of gun laws, to be unconstitutional as it pertains to rifles and shotguns and open carry. The 8th District court feels it applies only to concealed carry licensing laws.

Cleveland sued the State in March 2007 alleging that the preemption law violated home rule and that they should be able to ban “assault weapons,” prohibit open carry of firearms, maintain a gun registration scheme, and pass any such gun ordinance they wished. Ohioans For Concealed Carry and the National Rifle Association filed a joint motion to intervene, but that motion was denied and Cleveland lost at the trial court level on the strength of the Ohioans For Concealed Carry v. City of Clyde case where the Ohio Supreme Court ruled that R.C. 9.68 was constitutional because it was a “general law that is part of a comprehensive statewide legislative enactment.” Cleveland appealed their loss, and OFCC and the NRA appealed the denial to intervene.

In this ruling, the 8th District found that R.C. 9.68 was unconstitutional partially on the grounds of the 1993 Ohio Supreme Court case Arnold v. Cleveland which upheld an assault weapons ban, a case decided thirteen years before R.C. 9.68 was passed preempting such laws.

The Court agreed with Cleveland’s assertion that R.C. 9.68 violated the Home Rule provision of the Ohio Constitution which states:

Municipalities shall have authority to exercise all powers of local self-government and to adopt and enforce within their limits such local police, sanitary and other similar regulations, as are not in conflict with general laws.

Cleveland argued that R.C. 9.68 is unconstitutional because it is not a general law, despite the findings of the Ohio Supreme Court, and attempts to curtail the City’s police powers in matters other than the concealed carry of firearms.

In particular, they were concerned about Cleveland Codified Ordinance (C.C.O.) 627.08, possession of firearms by minors; C.C.O. 627.09, possessing deadly weapons on public property; C.C.O. 627.10, possessing certain weapons at or about public places; C.C.O. 627A.02, access to firearms, prohibiting children access to firearms; C.C.O. 628.03, unlawful conduct, prohibiting possession and sale of assault weapons; and C.C.O. 674.05, registration of handguns.

The State of Ohio countered that R.C. 9.68 read in conjunction with Substitute House Bill 347 did in fact demonstrate a comprehensive scheme to regulate firearms, as previously ruled in the OFCC v. Clyde case. The 8th District Court disagreed, saying that the OSC ruling only applies to concealed carry and that the Clyde case only referred to Section 9 of H.B. 12 (the original concealed carry bill) and not R.C. 9.68., though admitted that “the Clyde court impliedly upheld R.C. 9.68 as it relates to handguns.”

Therefore, the 8th District Court felt comfortable ignoring the Clyde ruling and applied R.C. 9.68 only to concealed carry laws because it was not “comprehensive” enough to be a General Law in their opinion because it “leaves unregulated: (1) the discharge of firearms, (2) the possession and sale of assault weapons, (3) the open carry of firearms on public property and public places, (4) the possession and use of firearms by minors, (5) the registration of handguns as required by the City, (6) the registrations and licensure of firearms dealers, (7) permit or licensing requirements before an individual purchases a handgun, and (8) background checks before the purchase or transfer of firearms.”

O.R.C. 9.68 reads:

The individual right to keep and bear arms, being a fundamental individual right that predates the United States Constitution and Ohio Constitution, and being a constitutionally protected right in every part of Ohio, the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition. Except as specifically provided by the United States Constitution, Ohio Constitution, state law, or federal law, a person, without further license, permission, restriction, delay, or process, may own, possess, purchase, sell, transfer, transport, store, or keep any firearm, part of a firearm, its components, and its ammunition.

The 8th District ignored “the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition” and only focused on the next sentence which left off the word “carrying.” The Court does not believe that “possess” and “transport” applies to carrying a firearm, therefore found that the City prohibiting open carry is legal.

The 8th District also found that “R.C. 9.68 does not establish police regulations but instead limits legislative power of municipal corporations” and “attempts to curtail the City’s home-rule police powers without enacting legislation to remedy the purported ill of a confusing ‘patchwork’ of municipal regulations involving firearms.” Citing this shortfall, the Court found that 9.68 is not comprehensive and does “little to fill in the gaps” in what they see for laws regarding “firearm possession, use, transfer, and ownership” and “does not prescribe a rule of conduct upon citizens generally.”

Taking all of that into account, the 8th District ruled that “R.C. 9.68 fails to satisfy the general law test” and “that it is not a general law.” In another section, they ruled that it was an abuse of legislative power because it awarded attorney fees to any citizen who challenged a City ordinance if that ordinance was found to be violation of R.C. 9.68.

Ohioans For Concealed Carry strongly believes that the 8th District used flawed logic in determining that R.C. 9.68 is unconstitutional and that the Ohio legislature rightfully and legally passed R.C. 9.68 with the intention of not only preempting local laws regarding concealed carry, but all firearms laws in the state while lawfully granting municipalities the ability to regulate firearms discharges and zoning laws for commercial firearms sales.

The Ohio legislature was quite explicit that carrying firearms is a protected right as noted in the Ohio Constitution which states in Article 1 Section 4 that “the people have the right to bear arms for their defense and security.”

OFCC expects that Ohio Attorney General Richard Cordray will appeal the 8th District’s faulty decision to the Ohio Supreme Court and that the OSC will correctly rule that Statewide Preemption is a Constitutional and General law and halt the attempts of anti-gun administrations from denying gun rights to their citizens. OFCC will also continue our fight to not be shut out in our attempts to intervene and defend the gun rights of Ohio citizens.

Cleveland Wins Appeal To Ban Assault Weapons

Virginia - -(AmmoLand.com)-These days, our soldiers aren’t even safe here at home stationed on secure military bases.

On November 5th, a lone gunman murdered 13 fully-trained, ready to deploy soldiers, and wounded 29 more, in the most shocking terrorist attack on American soil since 9/11.

How was Nidal Hasan, a psychologist, able to take down so many trained soldiers? Because the government thinks its better to keep it’s armed service members unarmed . . .

That’s right. Our military men and woman are banned from carrying the weapons they are trained and trusted to use in the heat of combat.

President Clinton authored this asinine policy back in 1993 when he declared all military bases “Gun Free Zones.”

As you know, “Gun Free Zones” do nothing but assure criminals, and now terrorists, that they will find unarmed victims defenseless against a homicidal rampage.

Maybe I’m crazy, but I’d rather the soldiers delivered a barrage of bullet to end Hasan’s attack the second he opened fire.

I’d rather Hasan was dead and the heroes he murdered were still alive.

But because of Clinton’s ingenious policy of an unarmed armed forces, this psychopath methodically executed soldier after soldier before a local traffic cop could arrive on the scene.

If we didn’t have “Gun Free Zones” and our armed forces were . . . I don’t know . . . ARMED, Nadir Hasan would have met bullet s instead of bodies.

On this Veteran’s Day, remember that the safety of our armed forces is of paramount importance whether it’s on the battlefield or here at home.

Another ‘Gun Free Zone’ Tragedy

Mineola, NY –-(AmmoLand.com)- The Nassau County local law banning the possession of handguns mislabeled “deceptively colored” remains on hold indefinitely pending the outcome of a legal challenge by gun-rights activists.

In June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of “deceptively colored handguns” as a supposed danger to law enforcement. The law originally banned all handguns except for those that are “black, grey, silver, steel, nickel or army green.” It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.

Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court (Index #: 013564/2008) to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.

The action sought a ruling that Nassau’s local law is invalid because it is “preempted” by New York State’s extensive gun control laws, which already ban “disguised guns.” Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.

The proceeding was brought on the day the law was to go into effect, and sought a temporary restraining order and an injunction to stay enforcement of the law. That led to Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. Further, filing of the action alone resulted in the Nassau County legislature amending the law to remove the prohibitions against gold plated, blued, and brown handguns.

The action is currently on appeal to the New York Supreme Court, Appellate Division, Second Department (Docket No. 2009-1468). The petitioners have retained attorney Robert Firriolo, a litigation partner in the New York office of Duane Morris LLP.

The local law challenged affects not only Nassau pistol licensees, but all New York gun owners and visitors to Nassau County. Anybody found with a banned handgun is subject to arrest and prosecution. The law is particularly hazardous to the many shooters who come into, or pass through, Nassau to participate in shooting events and have no way of knowing about this law. The suit was brought to protect the interests of all of law-abiding gun owners and dealers, most of whom are still unaware that many ordinary, popular and valuable handguns are banned. The law imposes a penalty of one year in jail and a $1000 fine.

The petitioners continue to express their gratitude to SCOPE, the Freeport R&R Association Junior Club, SAFE, SASI, NCF&G, and to all those individuals who have donated to help us succeed in this important appeal. The petitioners, though, are still seeking donations to help with the appeal of Chwick v. Mulvey, as we have requested 15minutes of Oral Argument time..

Please remember that a victory in this appeal may well be the springboard for challenging other burdensome and senseless New York gun control laws. In fact, Chwick v. Mulvey has already been cited in Albany County Appellate Division, Second Department, and the cite was positive on our points 3 & 4 (Cites to Heller and NYS Civil Liberties, Second Amendment). Additionally, Chwick v. Mulvey, may be another doorway for incorporation of the Second Amendment by NYS. Lawsuit Derails Nassau NY Handgun Ban

Rockford, IL --(AmmoLand.com)- Gun ownership is increasing at an unheard of rate in the US this year.

The largest contributing factor to this is the fear that the Obama administration will attempt to pass new sweeping legislation that would ban certain types of guns based on their cosmetic appearances, like the so-called Assault Weapons ban that expired in 2004.

With 48 states having adopted concealed carry legislation, and the vast majority of those – 40 – have what is referred to as shall-issue licensing, meaning anyone who qualifies for a license or permit MUST be issued one. 8 states still have discretionary or more accurately discriminatory issue, it’s easy to see where this trend is headed.

The Supreme Court has ruled that individuals DO have the right to own and carry (keep and bear) arms for self-defense and other uses. The Supreme Court is also set to rule next year on whether or not, or to what extent, states can restrict this right. If the highest court follows the intentions of the founders of this country, “that every man be armed,” then we should see even more drastic reduction of the approx. 30,000+ gun laws on the books that have been completely ineffective at reducing crime, since criminals readily ignore the laws and illegally obtain and use guns in crimes regardless.

Truth is finally prevailing, and the right to protect yourself and your family is on a major comeback! With minimal training and practice, the average person can protect themselves very effectively. It’s time for all of us to step up to the plate and take advantage of this trend. There’s simply no need to let gun control get you down anymore!!!

A lot is happening at ICarry.org. After a short leave due to my personal obligations, I have now been able to dedicate myself to this cause full time. By using the Internet, our website, and these simple newsletters in addition to other marketing, we’ve been able to come a long way in a short time. I’m very thankful to the volunteers who have been helping with these tasks, and to the many people who have stepped up to help support what we’re doing with donations.

Right now we’re getting our store running. In the next week it should be fully functional, and we will have a lot of neat things to offer. The store will also help us bring in the revenue needed to keep going! By popular demand, high-quality car window stickers are being printed. These stickers will look fantastic, last a lifetime, and they’re easily removable and re-stickable without leaving any residue. It took some work, but I found the best ones I could, and you’ll see them start popping up on cars everywhere very soon.

We’ve also partnered with Gun Owners of America to help defend the right to keep and bear arms in a no-compromise fashion on the state and federal level. Larry Pratt, the executive director of GOA, put it this way: “Illinois [and Wisconsin] has needed a take-no-prisoners group to defend the right to keep and bear arms. ICarry.org is that group.” We’re thankful for the kind words and look forward to working together to see that no new restrictions are placed on the ownership of firearms and remove as many of the unneeded current restrictions as possible.

ICarry.org & Expanded Gun Rights On The Move

Seattle, Washington --(AmmoLand.com)- On October 28, NRA filed a complaint in the Superior Court of Washington State against the City of Seattle, asking the court to enjoin and declare invalid a recently enacted parks and recreation administrative policy that prohibits firearms in parks, community centers and other city-owned buildings.

Other plaintiffs in the case include state correctional officers and private citizens.

“NRA members are outraged that the City of Seattle has ignored and defied state law and an opinion of Washington Attorney General Rob McKenna,” said NRA-ILA Executive Director Chris W. Cox. “The NRA will continue to fight this senseless infringement on the rights of law-abiding Seattle gun owners.”

The city is in violation of Washington’s preemption statute, which forbids localities from enacting this type of ban. In October 2008, Attorney General Rob McKenna issued an opinion, which put the City of Seattle and Mayor Nickels on further notice that Washington cities may not enact local laws prohibiting possession of firearms on city property or in city-owned facilities.

“Law-abiding Seattle gun owners should be allowed to protect themselves when they go about their business, even in a park or other recreation facility,” concluded Cox.

The Second Amendment Foundation, the Citizens Committee for the Right to Keep and Bear Arms and the Washington Arms Collectors, Inc. are working in conjunction with the NRA and are co-plaintiffs in the lawsuit against the city.

NRA Sues Seattle Over Illegal Gun Ban

Washington, DC --(AmmoLand.com)-What a perfect day for a protest! The weather was not too cold, not too hot and overcast most of the day but it did not rain on our parade. I heard estimates throughout the day of numbers in attendance ranging from 1.5 to 2.5 million. Our local news reported thousands on one channel and tens of thousands on another. I was told that MSNBC reported 2 million!

We filled up 3 busses leaving from Beaverdam, VA with a total of 146 passengers. The trip up was uneventful, with only minor traffic delays beginning at Springfield and continuing for the rest of the way into DC. We disembarked at 6th and Constitution at about 10:30 and the march was already well under way with massive amounts of people filling Pennsylvania Avenue for as far as the eye could see. We fell in with the marchers and headed for the Capital.

My first encounter with law enforcement was when I left my family sitting on a wall and went around a corner to get a better vantage point for my pictures. I entered a cordoned off area thru a gate and was taking pictures when a Capital Police Officer approached me and said that he noticed the empty holster I was wearing and asked if I had a weapon to go with it. I responded that I didn’t, since guns were not allowed in DC and he thanked me and left me alone.

My next exchange with LE was at the National Museum of Art; we had gone inside to use the restrooms and were told that our flags and signs were not allowed in the building and our bags must be inspected. It was obvious that this was a temporary checkpoint, as the “guard station” consisted of two folding tables and no permanent structures.

We carried our things outside and some of us waited there with the bags, signs and flags while the rest of the group went in to the restrooms. When the others returned, my husband and I went back in and questioned the guard about the policy on the signs. We were told that the flags were not allowed because they had points on them.these are the small 4 x 6 inch flags on a stick maybe 12 inches long with a little wooden or plastic tip at the top. The guard informed us that non-folding umbrellas were not allowed either and that the points could damage the artwork! Then I asked about the reason for not allowing signs and the response was that they did not want to support any one opinion, so they ban all signs. We asked about the buttons and stickers on our shirts and were told that they were permissible!

Later on, I walked away from the demonstration to meet a friend and fellow Second Amendment Sister a few blocks away. While we were standing on the sidewalk taking, two LEOs approached me, one of them, I think a DHS officer, was bending over sideways to look at my holster. He asked me to come over to where he was so he could “talk to me” so our whole group moved closer to him.

He didn’t like that much, but he asked me if I had a weapon and I responded that I was aware of the prohibition on guns in DC. I explained that the holster was a “silent protest” to the gun ban in DC. He then said that he would have to ask me to remove my holster and I got the distinct feeling that he intended to confiscate it. When my husband pulled the video camera out of the bag, he changed his tone only slightly and asked me again to remove the holster, this time saying that I needed to “put it away”. I asked him why and he told me that it was illegal to have “gun paraphernalia”. I told him that I had no guns, no ammunition and no magazines and that the holster was only a piece of leather and not against the law. He again insisted that I take the holster off, this time stating that it made it look like I had a gun.

He said that he was pro-gun but still insisted that I need to take the holster off. I asked him why, since it was not against the law and he said that someone might see it and, thinking I had a gun, shoot me! One of my companions asked him how that could happen, since guns were not allowed in DC! As the situation progressed, the other LEO, either DC or Capital police, pulled out his cell phone and took my picture or videotaped portions of the incident.

By then, we were drawing a small crowd of people wondering why these two cops were having this exchange with us. The crowd was telling the DC cop that they should quit harassing us and he told them that I was a “threat”! In the mean time, my friend from SAS had pulled out her camera and was blatant about recording the encounter. The DHS officer asked her to [sic] get that camera out of his face, which of course she did not comply with. As time progressed, the officer gradually backed down from demanding to requesting that I remove my holster until he was “advising” me that it was in my best interest to comply.

Finally he conceded that he could not make me remove my holster but warned me that if I persisted that I *would* be detained and possibly arrested or shot, that not every LEO was “pro-gun” like he was! I will upload the video when I get it from my friend in SAS. Until then, stay safe!

Second Amendment Sisters, Washington DC Police and Empty Holsters

Washington, DC --(AmmoLand.com)- Senate Finance Committee Chairman Max Baucus has something to say to gun owners: “Own a gun; lose your coverage!”

Baucus’ socialized health care bill comes up for a Finance Committee vote on Tuesday. We have waited and waited and waited for the shifty Baucus to release legislative language. But he has refused to release anything but a summary — and we will never have a Congressional Budget Office cost assessment based on actual legislation. Even the summary was kept secret for a long time.

But, on the basis of the summary, the Baucus bill (which is still unnumbered) tells us virtually nothing about what kind of policy Americans will be required to purchase under penalty of law — nor the consequences.

It simply says:

• “all U.S. citizens and legal residents would be required to purchase coverage through (1) the individual market…”;
• “individuals would be required to report on their federal income tax return the months for which they maintain the required minimum health coverage…”;
• in addition to an extensive list of statutorily mandated coverage, HHS Secretary Kathleen Sebelius would be empowered to “define and update the categories of treatments, items, and services…” within an insurance plan which would be covered in a policy constituting “required minimum health coverage.”

ObamaCare and Gun Control
It is nearly certain that coverage prescribed by the administration will, to control costs, exclude coverage for what it regards as excessively dangerous activities. And, given Sebelius’ well-established antipathy to the Second Amendment — she vetoed concealed carry legislation as governor of Kansas — we presume she will define these dangerous activities to include hunting and self-defense using a firearm. It is even possible that the Obama-prescribed policy could preclude reimbursement of any kind in a household which keeps a loaded firearm for self-defense.

The ObamaCare bill already contains language that will punish Americans who engage in unhealthy behavior by allowing insurers to charge them higher insurance premiums. (What constitutes an unhealthy lifestyle is, of course, to be defined by legislators.) Don’t be surprised if an anti-gun nut like Sebelius uses this line of thinking to impose ObamaCare policies which result in a back-door gun ban on any American who owns “dangerous” firearms.

After all, insurers already (and routinely) drop homeowners from their policies for owning certain types of guns or for refusing to use trigger locks (that is, for keeping their guns ready for self-defense!). While not all insurers practice this anti-gun behavior, Gun Owners of America has documented that some do — Prudential and State Farm being two of the most well-known.

The good news is that because homeowner insurance is private (and is still subject to the free market) you can go to another company if one drops you. But what are you going to do under nationalized ObamaCare when the regulations written by Secretary Sebelius suspend the applicability of your government-mandated policy because of your gun ownership?

All of this is in addition to something that GOA has been warning you about for several months … the certainty that minimum acceptable policies will dump your gun information into a federal database … a certainty that is reinforced by language in the summary providing for a study to “encourage increased meaningful use of electronic health records.”

Remember, the federal government has already denied more than 150,000 military veterans the right to own guns, without their being convicted of a crime or receiving any due process of law. They were denied because of medical information (such as PTSD) that the FBI later determined disqualified these veterans to own guns.

Is this what we need on a national level being applied to every gun owner in America?

Incidentally, failure to comply would subject the average family to $1,500 in fines — and possibly more for a household with older teens. And, although a Schumer amendment purports to exempt Americans from prison sentences for non-purchase of an ObamaPolicy — something which was never at issue — it doesn’t prohibit them from being sent to prison for a year and fined an additional $25,000 under the Internal Revenue Code for non-payment of the initial fines.

ACTION: Contact your two U.S. Senators. Ask him or her, in the strongest terms, to vote against the phony Baucus bill.

The Maryland State Police (MSP) have apparently still not issued a formal written bulletin to the firearms dealers informing them of this new requirement.

It is entirely possible for a dealer and/or buyer to be arrested, charged, and prosecuted for violating an unwritten policy established in secret by Maryland State Police Licensing Division.

If the MSP policy is overturned by the courts, it is becomes an open question whether or not the MSP will purge their data base of these firearms and their owners. Don’t hold your breath.

Maryland State Police Define .22 Rimfire Rifles as Assault Weapons Part 2

Virginia - -(AmmoLand.com)-I talked to the Alexandria City Attorney in early summer and told him that Alexandria had some preempted firearms ordinances on the books and that the City needed to remove them. I was told that the City Council was on hiatus over the summer, but that the City Attorney would bring the issue up when they reconvened.

Meanwhile VCDL member Ed Levine, using the services of VCDL member and attorney Mark Matthews, was preparing a lawsuit over that same issue.

I told Ed that the City Attorney was planning on bringing up the illegal ordinances and they should get struck off the books. However, it seemed prudent for Ed to proceed just in case Alexandria decided to play games.

As it turned out, and to the City’s credit, they indeed had just voted to remove the offending ordinances as Mark was getting some FOIA information together for the suit.

Thanks to Ed and Mark for being in a quick fall back position had it been needed.

Alexandria VA Drops Illegal Gun Ordinances as A VCDL Prepares To Sue

Illinois --(AmmoLand.com)-Today the U.S. Supreme Court announced it will hear an appeal of the case of the McDonald vs Chicago lawsuit concerning Chicago’s ban on handguns . The lawsuit was filed over a year ago on June 26, 2008 on the heels of a favorable ruling by SCOTUS in the Washington, DC vs Heller case . In that case the Court ruled the Washington, DC handgun ban unconstitutional.

The Illinois State Rifle Association and the Second Amendment Foundation filed the lawsuit on behalf of four Chicago residents, Otis McDonald, Adam Orlov, and Colleen and David Lawson. The U.S. 7th Circuit Court of Appeals upheld the ban and the case was appealed to the U.S. Supreme Court.

The case, now known as McDonald vs Chicago, is being viewed by many Second Amendment supporters as a possible historic landmark in the battle for the right to keep and bear arms. The Second Amendment is the only amendment listed in the Bill of Rights that the Court has not applied to the states or what is known as “incorporated” to the states. States and local governments have interpreted that lack of incorporation to mean they can issue any restrictions on the right to keep and bear arms they deem appropriate – up to and including outright bans on whole classes of firearms such as handguns.

McDonald vs Chicago offers the U.S. Supreme Court the opportunity to not only strike down the Chicago handgun ban but also makes it possible for the Court to incorporate the Second Amendment to the states. The Heller case didn’t call for a ruling on the issue of incorporation because that case involved a federal entity, Washington, DC, and did not involve a state or local government.

If incorporation takes place, state and local governments will be called to recognize the Second Amendment and law-abiding citizens will then begin to have a reasonable expectation of exercising their right to keep and bear arms.

Nassau Handgun Ban Lawsuit is Moving Forward

Chicago , IL --(AmmoLand.com)-We have just received word that the U.S. Supreme Court will hear another case on the individual rights of gun owners.

A group of Chicago gun owners is challenging a lower appeals court ruling that while the Second Amendment guarantees individual rights on the federal level, it does not bar state or city governments from passing restrictions or outright bans on guns.

Chicago imposes a handgun ban similar to the one the Supreme Court struck down last year for Washington D.C. In that case, District of Columbia v. Heller, the court declared what we have all known: that the Second Amendment guarantees an individual right to firearms for self-defense and does not merely refer to a state “militia.”

However, the 5-4 decision did not address one important question:

Does the Second Amendment also apply to states and municipalities?

The new case is called McDonald v. City of Chicago and will probably come before the court as early as this coming January, 2010. The decision may come sometime in June.

We will have more details in the coming days and weeks.

NOTE: Buckeye Firearms Association may be involved in this case as we were in last year’s case. We played a part in winning that decision by preparing and submitting a brief for the court. Supreme Court Agrees To Hear New Second Amendment Case

Washington, DC - -(AmmoLand.com)-Supreme Court will hear the Chicago gun ban case to determine if the Heller decision is incorporated to the states.

The Supreme Court has agreed to decide whether strict local and state gun control laws violate the Second Amendment, ensuring another high-profile battle over the rights of gun owners.

The court said Wednesday it will review a lower court ruling that upheld a handgun ban in Chicago.

The Supreme Court last year struck down Washington D.C.’s gun ban, but the question remains whether states and local governments fall under the same requirements.

Cases against Chicago challenge several gun laws, including the city’s ban on handguns. After the Supreme Court ruled in the D-C case, suburban Morton Grove, Wilmette, Evanston and Winnetka dropped their gun bans.

Supreme Court Agrees To Hear Chicago Gun Ban Case

NSSF engaged in a prolonged battle in the California Legislature, but unfortunately on the final day of session, three anti-gun bills narrowly passed. The bills include: ammunition registration (AB 962), added retailer paperwork (SB 41) and prohibitions on firearm and ammunition sales at the Cow Palace exhibition center (SB 585).

NSSF and the California Association of Firearms Retailers (CAFR) urge all gun owners in the state to contact the governor’s office and respectfully urge him to veto these anti-gun bills.

Once again, the business environment in California will become more difficult for retailers during a time when the state is in desperate need of revenue.

More information on the bills:

AB 962 – Would require that firearms dealers and other vendors of ammunition keep a registry of all buyers of handgun ammunition. The bill would also ban all mail order and Internet sales of handgun ammunition and reloading components.

SB 41– Would further burden firearms retailers by requiring additional paperwork and documentation on the date of delivery of all firearms to a buyer. This bill equally affects consumers of firearms as the increased dealer costs would be passed along to the purchaser.

The bill also requires dealers to sign and to obtain the signature of the buyer or other transferee of a handgun on the Department of Justice Dealers Record of Sale (DROS) form indicating that the handgun has been delivered and the date upon which the delivery was made. It would further require dealers to date and sign a form stating that the buyer of a rifle or shotgun had taken possession of the gun.

SB 585 – Would prohibit the lawful sale of firearms and ammunition at the Cow Palace exhibition facility near San Francisco, located in Agricultural District 1-A, and would make a violation of that prohibition a crime. Its purpose is to ban gun shows at the Cow Palace and to set a precedent for the banning of all gun shows at other state-owned facilities where many sportsmen buy firearms and ammunition.

In California all firearms bought and sold at gun shows must be transferred through a federally licensed firearms retailer who is required under federal and state law to run a background check on the prospective buyer.

Three Anti-Gun Bills on Governor’s Desk – Urge Governor to Veto Bills

My friend Paul Valone at the Charlotte Gun Rights Examiner gives one of the best answers I have seen.

He points out that the British Medical Association is working with police to “tag” medical records of gun licensees. The same thing will happen here in America if Obama Care in the form of HR 3200 becomes law.

You see, HR 2640, the latest NRA sellout that disarmed thousands of veterans in 2007, ”Created the mechanism for centralizing mental health records.” So, for Americans, the process has already begun.

The Obama Care Bill in the form of HR 3200 would enable the government to use medical data however it pleases, including barring from gun ownership tens of thousands of people treated for anger management, depression, post traumatic stress disorder, and other ailments.

Is A Vote For Health Care Reform A Vote Against Gun Rights?

Washington, DC – -(AmmoLand.com)- This week, another radical extremist joined the ranks of the Obama administration.

Cass Sunstein, who is an old friend of Barack Obama, is now our new Regulatory Czar. You will recall that he is the guy who wants animals to sue hunters and other Americans.

He also supports gun control.

While his nomination as head of the Office of Information and Regulatory Affairs passed the Senate by a 57-40 vote yesterday, the REAL vote was actually much closer — losing only by three votes.

That vote occurred on Wednesday, when Republicans tried to kill his nomination using a filibuster — a procedure which required Democrats to muster 60 votes. Every Democrat (except for three) voted for Sunstein. The three Senators who voted against Sunstein on the filibuster were Blanche Lincoln (D-AR), Mark Pryor (D-AR) and James Webb (D-VA).

Unfortunately, a handful of Republicans crossed party lines to help Sunstein overcome the procedural roadblock. The Republican traitors who crossed party lines on Wednesday were Senators Bob Bennett (UT), Sue Collins (ME), Judd Gregg (NH), Orrin Hatch (R-UT), Richard Lugar (IN) and Olympia Snowe (ME).

Dishonorable mention goes to Republican-turned-Democrat Senator Arlen Specter (PA) who voted for Sunstein — as well as Senator Mark Pryor (D-AR), who waited until the end of the voting period to finally cast his ballot against Sunstein.

Regarding Pryor, you will remember that in August, he waited until the last minute to cast his vote in favor of the concealed carry reciprocity amendment. When it became clear the anti-gunners had a comfortable margin of victory, Sen. Pryor actually switched his vote at the last minute.

As the Regulatory Czar, Sunstein will provide the final touches on new federal regulations. No firearm or ammunition needs to be banned outright — that would be too transparent. As the coauthor of Nudge (2008), Sunstein has already laid out how “choice architects” should carefully guide (or nudge) Americans into making better choices.

So with a little regulation here… a little regulation there… Sunstein can strengthen the iron fist of the federal gun police (otherwise known as the BATFE). Or, he can implement additional federal requirements which will result in firearm and ammunition manufacturers paying more for their merchandise.

Of course, these costs will be passed on to the consumer as new “taxes” that will “nudge” Americans away from purchasing firearms or engaging in the shooting sports.

In short, be prepared for more “change” from Washington and less spare change in your pockets.

Be vigilant about BATFE spying!

GOA has received a report from a very well-known journalist at a big newspaper that the FBI and BATFE are teaming up together to get off-the-record information on gun owners. The project, known as Vigilant Eagle, involves federal agents going to gun stores and doing “meet and greets” with shop owners in the hopes of obtaining informal information on people buying guns.

Radical ‘Regulatory Czar’ Could Pose Problems for Gun Owners

WRONG!! Gun Safety Legislation is a sneaky new tactic by the gun banning politicians and Brady loving gun banners to take the buzz word “Gun Control” and replace it with the seemingly wholesome word play “Gun Safety Legislation”

Gun Safety Legislation is often seen paired up with other gun control politician’s safe words like, “illegal guns“, “curbing gun violence“, “sensible measures” or even “common sense“.

Who would not be in favor of Common Sense Gun Safety Legislation. We gun owners must be irresponsible assholes or worse yet, gun toting psychopaths, if we cannot be for Gun Safety Legislation.

Instead gun owners are smarter than that and are willing to take on those who think that they can fool the pro gun majority of the US population, that know that they have the right to keep and bear arms, by changing a few words.

Cemetery’s Gun Blob said, “I’ve noticed the term *gun control* being morphed into *gun safety legislation* on NJ Governor Jon Corzine’s website, referring to his press release regarding NJ’s One Gun a Month bill that is the beginning of his latest gun control *gun safety* package. *CORZINE AND DEMOCRATIC LEADERS CALL FOR ADDITIONAL GUN SAFETY LAWS.*  Is it just me? Has this type of flim-flam switch-a-roo been going on for sometime?

Apparently it has. Congresswomen Carolyn McCarthy (D – NY) can’t get enough of the word. Her page on “Gun Safety Accomplishments – 111th Congress” uses the words Gun Safety Legislation over and over again in all kinds of variations.

It should be noted that Mrs McCarthy is a constitutional hating gun banner from NY, the home state of MAIG, and in no uncertain words states that she is in support of all the following Gun Safety Legislation.

• Gun Store Employee Background Checks
• The NICS Improvement Amendments Act
• Closing the Gun Show Loophole
• HR 2401, the “No Fly, No Buy” Act

• Legislation permitting access to certain information in the Firearms Trace System database.

We have seen this tactic before.  Take the case of Safebackyards.com another attempt by anti hunting group, NJARA, to take a pending NJ bill, Assembly Bill A 595, that would reduced the current bow safety buffer zone surrounding homes and other occupied dwellings to a safe 150 feet, and spin it into an issue of death, destruction and human safety to rally support for their cause from unsuspecting NJ home owners.  Again, were talking about safe backyards how could they be wrong? Well they are!

So this is a heads up to the stupid word smiths that think they can fool smart law abiding gun owners with a few nice words to disguise the true intent of all their speak which is banning all guns, gun rights and all rights to self defense.

AB 962 -HANDGUN AMMUNITION REGISTRATION

CRPA Urges the Governor to VETO AB 962 for the following reasons:

Through the collection of personal information, AB 962 creates a privacy rights issue and creates a real potential for identity theft. The detailed personal information collected includes: name, residential address, date of birth, phone number, drivers license number, signature and thumb print of ammunition purchasers. There is no requirement for secure handling or eventual disposal of the personal records of purchases by vendors. Customers could be targeted for identity theft and burglaries, including theft of firearms.

AB 962 will potentially limit smallbore rifle youth programs, including 4-H, ROTC, Scouts, and high school and college programs, due to increased costs. Youth shooting sports programs depend on discounted and specialized ammunition obtained through government subsidized programs and out of state discount vendors that supply ammunition in bulk. Big box stores don’t stock specialized .22 target ammunition and typically won’t or can’t order it for youth programs.

AB 962 will negatively impact hunter education training and safe handling programs for juniors.

AB 962 will not provide any funding source for monitoring and regulatory enforcement of this proposed new law. Local law enforcement will be saddled with enforcement of this law. In light of current cutbacks in local law enforcement, it is not reasonable to expect local jurisdictions to expend limited resources on an unnecessary law.
AB 962 is an unnecessary measure. It is already unlawful for persons prohibited from possessing firearms to obtain or possess ammunition.

SB 585 – COW PALACE GUN SHOW BAN

CRPA URGES the Governor to VETO SB 585 for the following reasons:

Supporters of SB 585 have tried to link illegal activity to gun shows at the Cow Palace; however, there is no documented evidence from law enforcement of any criminal activity associated with the Cow Palace gun shows.

Gun shows are safe; promoters are mandated to provide law enforcement to police gun shows.

Under existing laws gun shows are regulated through the Calif. Dept. of Justice (DOJ) and through the Federal Bureau of Alcohol, Tobacco and Firearms (ATF).

Guns and ammunition sold at any show are sold by licensed dealers and are subject to the same state and federal laws and waiting periods as those sold at retail establishments or through private transfers.

Gun shows provide a well regulated venue for legitimate hunters, members of the shooting sports and gun collectors.

Hunters, sport shooters and gun collectors should be able to maintain the ability to assemble in a public facility for the purpose of viewing and purchasing firearms, ammunition and sporting accessories.

California Has Two Anti-Gun Bills Heading To The Governor’s Desk Need Your Action

Sacramento, California --(AmmoLand.com)- Yesterday, the Senate gave final approval to Senate Bill 585 by a 21-18 vote. SB585 now heads to the desk of Governor Arnold Schwarzenegger (R) for his consideration.

SB585 is a stepping-stone to banning gun shows on all publicly-owned property in California. Introduced by State Senator Mark Leno (D-3), SB585 would prohibit the sale of firearms and ammunition on the property or inside the buildings that comprise the Cow Palace in Daly City, just outside of San Francisco.

The Senate also passed Assembly Bill 962 yesterday by a 21-18 vote. AB962 will now return to the Assembly for concurrence.

As we reported earlier this week, AB962 was amended by the Senate in an effort to make the bill easier to pass. It remains, however, a serious threat to our rights.

The Senate removed a requirement that ammunition retailers be licensed to sell ammunition. In addition, the bill would no longer prohibit the private transfer of more than 50 rounds of ammunition during a 30 day period.

Despite these changes to the bill, AB962 is still unacceptable and represents a dire threat to our ability to exercise our Second Amendment rights. Ammunition retailers would still have to store ammunition in such a manner that it would be inaccessible to purchasers. The bill still requires that individuals purchasing ammunition be fingerprinted at the time of sale, mandates that dealers keep these records and make them available for inspection by the Department of Justice.

Finally, mail order ammunition sales are still prohibited under AB962.

Ammunition Sales Restrictions, Gun Show Ban Moving Forward in California

Maryland --(AmmoLand.com)- In its infinite wisdom, the licensing division of the Maryland State Police has determined that certain .22 caliber rimfire rifles are “assault weapons” based solely upon there cosmetic resemblance to some firearms that are defined by Maryland law as “assault weapons.”

In a letter to attorney Frank D. Boston, III, Captain Laura Lu Herman (Commander of the MSP licensing division) wrote in part:

“The Annotated Code of Maryland, Public Safety Article 5-101, defines a regulated firearm as “a firearm that is any of the following specific assault weapons or their copies, regardless of which company produced and manufactured that assault weapon…” The precise meaning of the words “copy” or “replica” are not included in the statute suggesting that a copy or replica may be interpreted as cosmetically copied or replicated or perhaps require more similar functional qualities.”

I will take into consideration the points you have identified in your letter and will forward a request for a formal opinion from the State of Maryland Attorney General on the precise meaning of “copy” and replica” as used in Public Safety Article 5-101.

Until the opinion of the Attorney General is published relating to this matter, the Maryland State Police Licensing Division believes it is in the best interest of the public in general to continue to process the purchases of the .22 caliber Rimfire Rifles in accordance to the statutory requirements for purchases of regulated firearms.”

The real problem is: The Maryland State Police have apparently not issued a formal written bulletin to the firearms dealers informing them of this new requirement. It is entirely possible for a dealer and/or buyer to be arrested, charged, and prosecuted for violating an unwritten policy established in secret by Maryland State Police Licensing Division.

Maryland State Police Define .22 Rimfire Rifles as Assault Weapons

Virginia - -(AmmoLand.com)- About the time of the Republican Convention, the Richmond Coliseum changed its “no weapons” policy to allow for lawful carry of handguns, openly or concealed, as per state law.

About a month or so ago the policy was changed to once again say “no weapons of any sort”

In frustration, the Board voted to begin the process of taking Richmond to court in order to end the violation of state law by the City and the Coliseum.

Accordingly I met with a Richmond area attorney last week.

I also contacted City attorneys to put them on notice that if this problem isn’t fixed, we are going to court. (If the City simply fixes the problem, VCDL would be happy to let the issue drop.) I was told to talk to the Richmond Redevelopment and Housing Authority (RRHA), who actually owns property, The RRHA attorney said that Richmond leases the property and sets the rules, pointing me back at the City as the one to sue.

And now a member tells me that the policy has just been changed to say that “ILLEGAL weapons” are banned! Upon checking sure enough:

There are some localities that have used that same wording. Note: I am not a lawyer and can’t give legal advice. My law understanding of the law indicates that the wording is valid as it allows for the otherwise lawful open or concealed carry of a handgun as per Virginia law. The wording simply states the obvious – illegal things are not allowed in the Coliseum. Hopefully the Richmond Coliseum staff understands the law and their own rules if they encounter a gun owner lawfully carrying a gun.

I am hoping that the City got the message that VCDL was tired of playing games. Anyway, we will keep an eye on their firearms policy in case it changes yet again. We also want to hear first-hand reports from any of you attending events at the Coliseum who choose to carry as to what you experience there.

Virgina’s Richmond Coliseum Changes Gun Policy Again

California – -(AmmoLand.com)- Despite California’s bans on “assault weapons,” “unsafe” handguns, private gun sales, and sales of two handguns in a 30-day period; its 10-day waiting period on all gun sales; and its denial of carry permits to people who don’t have the right connections, the Golden State’s murder and robbery rates are 12 and 20 percent higher, respectively, than in the rest of the country.

Nevertheless, the Brady Campaign calls California’s “assault weapon” ban “a model for the nation,” and gives the state a high “grade” just for having more gun control than other states. Washington, D.C.’s city council adopted California’s “assault weapon” ban and “unsafe handgun” ban whole cloth in January, backtracking on handguns this summer only in the face of court challenges.

And then there’s Garen Wintemute, of the University of California (Davis), who in September released another of his “studies” in favor of gun control. His new piece is called “Inside Gun Shows: What Goes On When Everybody Thinks Nobody’s Watching.”

“Gun shows” are just the hook, however. While repeating gun control supporters’ mantra about the need to run instant background checks on people who buy guns from private parties at gun shows, Wintemute admits important factors that undercut his goal.

First, he notes that straw purchases—the very purpose of which is to thwart the background checks he pretends to be concerned about—”are a major source of crime guns.” Second, he admits that “The proportion of all gun sales nationwide that occurs at gun shows is relatively small” and that “most sales at gun shows involve licensed retailers,” who are already required to perform background checks.

As you probably have already deduced, Wintemute has his sights on something more than just requiring background checks on all gun sales at shows. Eventually getting to the bottom line, he concludes that

“Regulating private party sales just at gun shows will not end the problems associated with these anonymous and undocumented transactions. Most of them occur elsewhere already. … It would be preferable to regulate private party gun sales generally.”

That’s the law in California, where private sales are prohibited, transfers of firearms are delayed by a 10-day waiting period, and sales are permanently recorded by the government.

If you think you’ve heard it before, you’re right. In 1976, the Brady Campaign, then named National Council to Control Handguns, advocated delaying handgun sales and registering handguns, before banning the possession of handguns altogether. Let’s hope Wintemute is as successful today as the Brady Campaign was a generation ago.

National Gun Registration And Waiting Period Are Goals Of Misleading “Gun Show” Study

Indiana – -(AmmoLand.com)- For the umpteenth time. HR 45 is going no where. I got a call yesterday and I was hit with questions about this moments ago at our West Side Sportsman’s Club.

HR 45 called the Blair Holt amendment was introduced by Illinois U.S. Rep. Bobby Rush (D) who represents half of the south side of Chicago. He served time in prison for an illegal weapons possession back in 1969 I believe it was.

Now he writes gun laws.

His bill that was introduced early this year has, no co-sponsors, and has not moved since it was introduced. At least it has not moved in Congress, but it sure has circled the globe via e-mail.

I don’t know of any legislation that has received so much notoriety, but maybe a close second would be the perpetual alerts about SB 2099. There is no such animal. The US Senate designates their bills with just an S. in front of the bill number.

Back in 2000 Senator Jack Reid a Democrat from R.I. introduced S.2099 during the 106 Congress. It was to amend the Internal Revenue Code of 1986 to require the registration of handguns for the purpose of taxing them.

It was cited as the Handgun Safety and Registration Act of 2000. There was no action taken on this bill.

Again, I’m asking that folks not get caught up in reading too much hype on the Internet. There are people who just live to get rumors started.

I’d rather our folks, if they have the time, to go on the Internet to make use of it by writing letters to the editors of newspapers promoting our cause.

I do hope that this e-mail would get passed around and maybe lay to rest some of these unnecessary worries. I’m kind of wearing down writing about them. I wouldn’t mind getting a letter back from someone telling me they read this letter. I’d like to think somebody is.

HR 45 Is Going No Where Stop The Internet Rumor

Information Ammunition On Allowing Continued Rifle Shooting In Suffolk VA

Suffolk, VA --(AmmoLand.com)- On September 2, 2009, the Suffolk City Council will meet. On the agenda is discussion of new regulations related to discharge of a rifle.

Prior to this year, the use of rifles was prohibited in the western portion of the city, but allowed under certain circumstances in the eastern portion of the city.

According to the Suffolk News-Hearld, the two halves are separated by the “Dismal Swamp line,” which starts at the intersection of Desert Road and the state line and goes northbound on Desert Road, through downtown and along Route 10 to the Isle of Wight County line.

Hunting with rifles east of the swamp line is allowed during hunting season as long as the hunter is on a stand at least 15 feet above the ground. It is not, however, allowed anywhere in the city within 100 yards of any structure used as a residence, business or storage facility without the permission of the owner; within 100 yards of any public street, except at a permitted firing range; or in a densely populated area.

Early this year, Suffolk petitioned the game department to allow the city to make its own regulations regarding rifles. The department agreed, but did not take up the issue of the exception east of the swamp line.

The city could have more in-depth talks with the department on that issue next year, but it has been recommended that the council enact an ordinance similar to last year’s before hunting season starts. A youth deer-hunting day is scheduled for Sept. 26, and hunting season starts soon after, so council should put new regulations in place before then.

The Council is seeking the input of residents, farmers, hunt clubs and other interested people before creating the more comprehensive ordinance.

In his time in the Senate, he sponsored or pushed to make law virtually every piece of anti-gun legislation introduced.

But the fact is that Ted Kennedy has not even been buried yet and anti-gun zealots are already seizing upon his death and demanding that the anti-gun Kennedy Health Care Rationing Bill be passed to “honor Ted Kennedy.”

I expect a major push as soon as Congress re-convenes in September.

That’s why I need you to contact your senators below and send a message that Ted Kennedy’s efforts to harm our 2nd Amendment rights not continue after his death.

Ted Kennedy unashamedly fought for what he believed in without compromise.
That is the ONLY thing I admired about Ted Kennedy.

Don’t allow President Obama to reinvigorate his plan to control and ration health care by the passing the anti-gun Kennedy Health Care Bill. It is a 10,000 page bill that very few have even read.

Those of us who have realize what Kennedy wanted to foist upon America — it is deceptive and dangerous.

IT WILL DESTROY OUR GUN RIGHTS!

You see, at the center of the plan is what’s called a “universal mandate.” What this means is that you — and virtually everyone in the country — will have to buy as much health insurance as the government demands, and that insurance plan will actually have to be approved by the government.

If you work for a small business, the business will buy the insurance on your behalf. But you may be saddled with an enormous part of the cost. And, if the employer’s contribution is too large, you will be fired.

If you fail to buy health care insurance, as the government orders you to do, the IRS will fine you, garnish your wages, put a lien on your house, and, ultimately, put you in prison.

How much will you have to spend on your insurance? Mr. Obama is not saying.

The portion of your paycheck that will have to be forked over to Obama’s dangerous social experiment will be revealed ONLY AFTER THE MASSIVE HEALTH CARE BILL IS SIGNED INTO LAW.

This should set off alarm bells in your brain, because, for instance, the average family policy is currently $12,700.

If you’re a welfare mother, the government will pay for your rationed health care, and it would pay for it — the first time — by taxing employer-provided health benefits of working Americans. But if you a “working Joe” your subsidy will be a microscopic fraction of the cost of your mandated insurance policy.

Okay, all of this sounds ominous… but why is this a gun issue?

The answer is that government rationed health care will allow radical left Health and Human Services Secretary Kathleen Sebelius to determine all of the fine print in every policy — which you will be required to buy under penalty of imprisonment.

Currently, as a result of the stimulus bill and a whole lot of other factors, the government is rapidly moving in the direction of computerizing all of your most confidential medical records and putting them into a federal database.

So remember when your son was asked by his pediatrician about your gun collection? That would be in the federal database.

Or remember when your wife told her gynecologist that she had regularly smoked marijuana ten years ago — thereby potentially barring both her and you from ever owning a gun again? That would be in the database.

Or if a military veteran complains to his psychiatrist that he’s had emotional stress since coming back to the States, that would be in the database.

Or remember when gramps was diagnosed with Alzheimer’s, thereby making him a “mental defective” who would have to relinquish his life-long gun collection? That’s in there too.

And, while we are dangerously close to allowing BATFE to troll all of that information, the Kennedy Heath Care Rationing bill would allow Sebelius to put EVERYONE’S private data in a database with a stroke of a pen.

When we say “everyone,” we don’t mean quite everyone.

Mr. Obama’s and Mr. Kennedy’s left wing radicals who wrote the bill conveniently excluded Washington bureaucrats from this new mandate.

Also, Obama and his friends in the media don’t want you to hear about the details until after the bill is passed. That’s why they tried to slam it through before anyone had a chance to read or debate it.

But the American people did not buy it and have stood up and said “NO”. That is why it is so critical that we don’t allow the death of Ted Kennedy to become an excuse to honor him in death with the passing of bill that was dangerous while he lived.

ACTION: Urge your two U.S. Senators to oppose Sen. Ted Kennedy’s mandate that will result in the registration of all your gun information.

Don’t Allow the Dead to Harm the Living

Sacramento, Ca --(AmmoLand.com)- SB 585 may be brought up for a floor vote in the Assembly any day during this week. If it does pass out of the Assembly it will need go back the the Senate for a final vote on the floor. Please urge our members to contact their representatives in the Assembly and the Senate and ask for a NO VOTE.

SB585 (Leno) GUN SHOW BAN This bill would prohibit the sale of firearms and ammunition at the Cow Palace and would thereby make a violation of that prohibition a misdemeanor. This bill would ban having a gun show at the Cow Palace, which is a state owned facility in the South San Francisco area. If it passes, it will likely be expanded to ban gun shows on any public property, such as fairgrounds, throughout the State. It is a major attack on the right of sportsmen and other firearms owners to assemble, communicate with each other, and to purchase new, used and collectible firearms, accessories and sporting supplies.

STATUS: SB585 is now on the Assembly Floor and can be voted on at any time.

Facts regarding SB585:

• Law enforcement fears that the lack of the gun show would drive firearms sales underground due to the lack of a the gun show as a regulated location for such sales to take place.
• The unfair lack of access to this publicly-owned venue restricts the First Amendment Rights of many thousands of attendees who have done nothing wrong and should not have to endure such censorship.
• The gun show promoters, including Crossroads of the West (who produce the show at the Cow Palace) worked with law enforcement, the state fair board and others, in support of AB295 several years ago. AB295 provided protections, including event operation under the strict scrutiny of law enforcement, at all gun shows in the state.
• Gun show promoters in California, including Crossroads of the West, have a close working relationship with law enforcement agencies (at all levels) due to the nature of cooperation that exists at gun shows, such as the one at the Cow Palace.
• California has the toughest gun show laws of any state in the nation. Currently, California’s gun shows are monitored by local, state, and federal enforcement agencies and all firearms transactions are required to be processed by dealers who possess federal, state, and local licenses.
• Buying a firearm at a gun show is no different than going to a firearms dealer’s store. All firearms transactions occur only after a comprehensive background check that includes a 10-day waiting period before a firearm can be delivered to the new owner. SB585 is an attempt by anti-firearms rights activists to find more creative ways to discourage people from owning firearms! Like most such bills, it would have no impact on criminals, just on lawful individuals!

California Legislative Alert: SB 585 Cow Palace Gun Show Ban

California --(AmmoLand.com)- Legislation in California (SB 41) that would mandate additional procedures for consumers purchasing firearms and require the keeping of records by licensed firearms dealers that duplicate information already retained by them on other government forms, is being vigorously opposed by pro-gun groups in the Golden State, including the California Association of Firearms Retailers and Gun Owners of California (GOC).

“This proposed law would mandate duplication of information already required on other sales transaction forms and would create different procedures for each category of firearm that no doubt would create confusion for all parties involved in a firearms sales transaction,” said Sam Paredes, executive director of GOC. NSSF issued a legislative alert on four anti-gun California bills earlier this month.

Opposition Effort Increases Against Anti-Gun Bill In California

Walton Hills, Ohio --(AmmoLand.com)- Since its creation, Mayors Against Illegal Guns (MAIG) has signed up a large number of committed anti-gun politicians to its ranks. It has also signed up some politicians who failed to realize the true anti-gun nature of MAIG. A number of those mayors have resigned their membership when they learned the truth.

This past week, yet another mayor, Village of Walton Hills, Ohio Mayor Marlene Anielski (R), has resigned her membership. Mayor Anielski informed the Buckeye Firearms Association of her decision, reporting that she had not realized the real agenda of MAIG. In fact, she reported, she and her husband are NRA life members!

With the ongoing effort by MAIG to mislead the public and even its own members on its true agenda, it is no surprise that some mayors are choosing to leave the group. How many more mayors don’t know what MAIG is really all about?

All Gun Owners should ask: Is my mayor a member of MAIG? If you do not know, check the list here.

Please Resign From Mayors Against Illegal Guns

Hello Mayor XXX:

I see you are listed as a member of the Mayors Against Illegal Guns Coalition who’s purported purpose is to combat the criminal acquisition and misuse of guns, which is a goal shared by all Americans.

Regrettably, it abundantly clear that Mayor, Michael Bloomberg and radical anti gun groups are using this coalition of mayors to advance a hidden agenda of bringing lawsuits against members of the firearms industry and spreading anti-gun propaganda.

It is simply unconscionable that in the past year MAIG, under your sponsorship, would call for a repeal of the Shelby /Tiahrt amendment that helps to safeguard criminal investigations and the lives of law enforcement officers by restricting access to firearms trace data solely to law enforcement.

How anyone, least of all a public official, could be willing to sacrifice such a law enforcement lifeline in order to gain an edge in suing the firearms industry that they have political differences with is repugnant to me.

In an editorial entitled “Setting the Record Straight,**” ATF Acting Director Sullivan repudiated Mayors Against Illegal Guns coalition’s long-held mantra that the current legislation forbids law enforcement from sharing trace data.

In clearing up this mistruth, Acting Director Sullivan stated, “Let me be clear: neither the congressional language nor ATF rules prohibit the sharing of trace data with law enforcement conducting criminal investigations, or place any restrictions on the sharing of trace data with other jurisdictions once it is in the hands of state or local law enforcement.”

According to ATF and the Department of Justice, the Mayors Against Illegal Guns coalition actions in having civilian private investigators conduct clandestine sting operations against federally licensed firearms dealers, without the knowledge of ATF actually interfered with ongoing criminal investigations, putting the lives of law enforcement officers and others at risk. The Department of Justice warned Mayors Against Illegal Guns coalition to refrain from these actions because such efforts could “interrupt or jeopardize ongoing investigations.”

You should not want the blood of a police officer on your hands or the citizens you represent so that you can advance the Mayors Against Illegal Guns coalition’s anti-gun litigation campaign.

You should instead support the Fraternal Order of Police, a group that opposes your coalition’s efforts to gain access to gun trace data for use in civil lawsuits.

If a federally licensed firearms dealer is engaged in criminal activities it is the job of law enforcement like the ATF to enforce those laws, not the MAIG.

It is very disheartening to see an elected official attach his good name to such an organization and I hope you will rethink your position and have your name immediately withdrawn from their list of participating mayors.

Washington, DC - -(AmmoLand.com)- The Senate easily confirmed the nomination of Judge Sonia Sotomayor to the U.S. Supreme Court. Only 31 Senators took seriously their oath to uphold the Constitution and voted against this radical anti-gun nominee, with 68 voting for confirmation.

All the Democrats in attendance voted for Sotomayor, while nine Republicans joined their ranks.

The Republican Senators who voted for Sotomayor were: Lamar Alexander of Tennessee, Christopher Bond of Missouri, Judd Gregg of New Hampshire, Lindsey Graham of South Carolina, Richard G. Lugar of Indiana, Mel Martinez of Florida, George Voinovich of Ohio and Susan Collins and Olympia J. Snowe of Maine.

Many Democrat Senators campaigned on a pro-Second Amendment platform, yet voted to confirm a nominee who does not believe you have a fundamental right to self defense or an individual right to possess a firearm.

Placing the prerogatives of President Obama over their constitutional “Advice and Consent” duty, many so-called pro-gun Senators reneged on their promises to voters that they would support the individual right to keep and bear arms.

The common refrain heard in the Senate before the vote was: “The President deserves his pick.”

Of course, Senator Barrack Obama did not hold that view in 2006, when he opposed President Bush’s pick of Samuel Alito to the Supreme Court. Then-Senator Obama said:

There are some who believe that the President, having won the election, should have the complete authority to appoint his nominee, and the Senate should only examine whether or not the Justice is intellectually capable and an all-around nice guy. That once you get beyond intellect and personal character, there should be no further question whether the judge should be confirmed.

I disagree with this view. I believe firmly that the Constitution calls for the Senate to advise and consent. I believe that it calls for meaningful advice and consent that includes an examination of a judge’s philosophy, ideology, and record.

Thankfully, we are seeing more and more Senators stand up to Obama’s radical agenda. You will remember that GOA encouraged you to lobby other gun groups so that gun owners across the country could speak with a unified voice in opposition to Judge Sotomayor.

We were hugely successful in this endeavor! News reports credit the gun lobby’s strong and unified opposition to Sotomayor as resulting in at least three NO votes from Senators who were previously undecided or in favor of the nominee. Even that figure is probably low, considering that 31 NO votes is a lot better than three NO votes (in the case of Justice Ginsburg) and nine NO votes (in the case of Justice Breyer).

One of the fence-sitting Senators who voted right today was Sen. Orrin Hatch of Utah. For the first time in his 33 year Senate career, Hatch voted against a Supreme Court nomination. You may remember that Hatch even supported Obama’s pick for Attorney General and voted to end the filibuster on Harold Koh, the radical choice for the State Department counsel.

But faced with mounting pressure from grassroots in his state, Sen. Hatch broke with long-standing tradition regarding his support for Supreme Court nominations. Today, he voted against Judge Sotomayor.

“I feel very badly that I have to vote negatively — it’s not what I wanted to do when this process started — but I believe that I’m doing the honorable and right thing,” Sen. Hatch was quoted as saying in Newsday.

Thank you, everyone, for putting the heat on your Senators. President Obama would do well to interpret 31 NO votes as a “shot across the bow.” With his approval ratings plummeting, the president’s next Supreme Court pick may have to be far more in the mainstream.

Trenton, NJ - -(AmmoLand.com)- Please Contact Governor Corzine Immediately! Today at 12:00 P.M., Governor Jon Corzine (D-NJ) will sign Assembly Bill 339/Senate Bill 1774 into law. The signing will take place at Trenton City Hall located at 319 East State Street in Trenton.

Simply stated, this bill would prohibit an individual from purchasing more than one handgun within a 30-day period. The state already requires an individual to first obtain a permit to purchase – a process which includes an extensive criminal background check and a minimum of 30 days to complete. This bill is just another step that anti-gun legislators are trying to take to erode our Right to Keep and Bear Arms.

This legislation gives anti-gun extremists carte blanche to further hinder your right to purchase firearms. Next it could be one rifle or shotgun per 30-day period or even one handgun per six months or year.

Governor to Sign One-Gun-A-Month Bill Tomorrow

WHEREAS, protecting the public safety and welfare is the most basic duty of government, and to this end, effective and reasonable measures must be implemented to keep citizens safe from violence; and
WHEREAS, New Jersey has taken a variety of steps to combat gun violence, including requiring prison terms for those who use firearms in crimes; regulating the sale and transfer of guns to ensure that firearms are being purchased only by law-abiding citizens; imposing restrictions on handgun purchases; and barring the sale of assault firearms; and
WHEREAS, effective limitations regarding firearms, as well as other deterrent and enforcement measures, are essential to maintaining the public safety, but necessarily impact all residents of this State, including law-abiding collectors of firearms and competitive and recreational firearms users; and
WHEREAS, in 2007, New Jersey entered into a cooperative agreement, the first of its kind in the nation, forming a partnership with the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives to allow New Jersey State Police direct access to “E-TRACE” data, to trace illegal firearms back to their source as yet another measure to uncover gun crimes and deter illegal gun trafficking; and
WHEREAS, it is appropriate to maintain a dialogue with interested parties and experts regarding the effectiveness of our State’s firearms laws in combating gun violence and the impact of these restrictions on law-abiding firearms owners;
NOW, THEREFORE, I, JON S. CORZINE, Governor of the State of New Jersey, by virtue of the authority vested in me by the Constitution and by the Statutes of this State, do hereby ORDER and DIRECT:
1. There is hereby established a Task Force to review, evaluate and make recommendations regarding New Jersey’s statutory and regulatory schemes and programmatic initiatives to curb the illegal possession, use, and trafficking of firearms and, more specifically, the anticipated passage of “one-handgun-per-month” legislation, criminal penalties for illegal transfer of guns, programmatic measures to curb illegal transfers of firearms, and the firearm permitting and regulatory processes (collectively, “firearms regulation”).
2. The Task Force recommendations shall address at a minimum the following issues: the permitting processes; the effectiveness of any statutory limitations on the sale and transfer of firearms, including the anticipated passage of one-handgun-per-month legislation and the efficacy of any exceptions contained in that legislation; and measures to deter “straw purchases” and the illegal transport of guns into New Jersey for purposes of transfer. The recommendations shall include specific suggestions to improve the effectiveness of firearms regulation in these areas and shall include any appropriate recommendations for legislative changes.
3. The Task Force shall be composed of nine members. Membership shall include the Attorney General or designee, the Superintendent of State Police or designee, and a representative of the County Prosecutors’ Association. Additionally, the Task Force shall include one member representing an association of pistol and rifle clubs operating in New Jersey and one member representing an organization that promotes gun violence prevention, which members are to be appointed by the Governor. Additionally, the Task Force shall include two member of the Senate, one of whom with experience with firearms and firearms restrictions, to be selected by the President of the Senate; and two members of the General Assembly, one of whom with experience with firearms and firearms restrictions, to be selected by the Speaker of the General Assembly. Vacancies on the Task Force shall be filled in the same manner as the original selections. The non-legislative members shall serve at the pleasure of the Governor and without compensation. The Governor shall appoint the Chair of the Task Force. The members shall select a Vice-Chair through a majority vote.
4. The Task Force members shall be appointed and convene within thirty days of the effective date of this Order. The Task Force shall complete an initial report within 90 days of its first meeting. The initial report shall be served on the Governor and Legislature so as to allow responsive action within the current legislative session. The initial report shall focus on the anticipated passage of “one-handgun-per-month” legislation in New Jersey, including its impact on firearms collectors and competitive and recreational firearms users. The initial report shall include recommendations for any appropriate legislative changes to ensure that lawful firearms collectors and competitive and recreational firearms users are not adversely affected by the legislation, including the exceptions to the one-handgun limitation contained in Section 2(i) of General Assembly Bill No. 339 (2008) (First Reprint) and Senate Bill No. 1774 (2008). The Task Force shall produce its final report no later than 18 months after delivery of its initial report. At a minimum, the report shall include an analysis of the impact of the one-handgun-per-month legislation on gun crime and the prevalence of illegal firearms in New Jersey.
5. In furtherance of its mission, the Task Force shall be authorized to call upon any department, office, division, or agency of this State to supply it with any available information, personnel, or assistance as it deems necessary to discharge its duties under this Order. Each department, office, division, or agency of this State is hereby required, to the extent not inconsistent with law, to cooperate fully with the Task Force and to furnish it with such available information, personnel, or assistance on as timely a basis as is necessary to accomplish the purposes of this Order. The Task Force may consult with experts or other knowledgeable individuals in the public or private sector on any aspect of its mission.
6. In order that the Task Force be informed of and consider a broad range of views and experiences in the course of its work, the Task Force shall convene at least one public hearing.
7. This Order shall take effect immediately.
