class="wp-caption-text">Illinois State Rifle Association</p></div><p><strong>CHICAGO, IL &#8211; </strong>-(AmmoLand.com)-  Law-abiding African Americans and Hispanics would take it on the chin under a bill now moving through the Illinois General Assembly.</p><p>Sponsored by <strong>Rep. Harry Osterman</strong> (D-14), HB6123 would prohibit any person or entity from selling a firearm to a so-called <em>&#8220;street gang member.&#8221;</em> This prohibition applies even if the individual has passed a Brady Law FBI background check. Making a prohibited sale would result in Class 1 felony charges and possible jail time for the seller. Although the ISRA supports genuine efforts to curb criminal violence, the organization is strongly opposed to HB6123 as the bill&#8217;s provisions are arbitrary and pose an unreasonable intrusion on the rights of law-abiding Illinois citizens.</p><blockquote><p><em>&#8220;HB6123 promotes racial profiling at its worst,&#8221;</em> commented ISRA Executive Director, Richard Pearson. &#8220;Popular culture has branded urban minorities with the <em>&#8216;gangsta&#8217; </em>stereotype that is pervasive well beyond the confines of actual criminal enterprises. Today&#8217;s fashion, music, slang and lifestyle are all heavily influenced by the urban experience. Given that the provisions of HB6123 establish no test for determining <em>&#8217;street gang&#8217;</em> membership, and given the harsh penalties for violating the proposed law, it is understandable that retailers would shy away from selling firearms to persons whose speech, dress, mannerisms, or taste in music reflect the urban lifestyle.&#8221;</p></blockquote><blockquote><p>&#8220;Several Chicago nightclubs stirred considerable controversy recently when they denied entry to young men wearing baggy pants and cornrows in their hair,&#8221; continued Pearson. &#8220;The nightclub owners justified these actions by claiming that baggy pants and certain hair styles are indicative of gang membership – despite the fact that the young men had done nothing improper.</p><p>While the popular press bristled over the nightclubs&#8217; actions, the press has ignored HB6123 although the bill would bless, and even require firearm retailers to discriminate against individuals based on their appearance. This sort of cultural profiling is vile enough when persons are denied entry into a private club, but denying one&#8217;s constitutional rights based solely on their appearance flies in the face of the principles under which our nation was founded. Of course, if a gang member wished to purchase a firearm, all he would have to do is don a Brooks Brothers&#8217; suit and speak the King&#8217;s English and he&#8217;d be good to go.&#8221;</p></blockquote><blockquote><p>&#8220;The bottom line is this,&#8221; said Pearson. &#8220;If HB6123 is passed into law, the calendar on race-relations will be turned back 70 years and there will not be a gun shop in the state that will sell a firearm to an African American or Hispanic person. If that&#8217;s Rep. Osterman&#8217;s intent, then he has a lot of explaining to do.&#8221;</p></blockquote><p>The ISRA is the state&#8217;s leading advocate of safe, lawful and responsible firearms ownership. The comments for and aft have been inserted to point out some of the hard facts that Senator Frosh is attempting to spin his way around.</p><p>Senator Frosh&#8217;s email is clearly in response to the Washington Times editorial of 2-19-2010 and the Montgomery Gazette article which appeared the same day. The Times has been consistent; however, the article in the Gazette was not the liberal fluff we have seen in the past.</p><p>It appears that Senator Frosh knows that his bill is in for a rough ride. Look for him to attempt to soften the bill in an effort to get it out of committee with the hope of amending the bill to its original form on the Senate floor. We must be vigilant for similar moves in the House on the cross file version, HB 820.</p><blockquote><p><em>In a letter to Frosh stated: &#8220;Dear Friend, The legislative session is in full swing and I wanted to update you on a vital public safety issue. Earlier this month, I introduced the Firearms Safety Act of 2010, a bill aimed mainly at reining in dealers who sell to gun traffickers. Senator Frosh&#8221;</em></p></blockquote><p>Exactly what does a <em>&#8220;Firearm Safety Act&#8221; </em>have to do with gun traffickers? And don&#8217;t we already have mandatory safety training?</p><p>The original title was Firearm Accountability Act of 2010 &#8211; Why did you change it?</p><p>Which dealers are selling to gun traffickers?</p><p>Didn&#8217;t you tell us that 1 gun a month would prevent straw purchases and gun trafficking?</p><p>If this bill is aimed at dealers, why do citizens have to obtain a license / ID to exercise a Constitutional right?</p><p>Does this mean you won&#8217;t offer an amendment to remove the license / ID provision????</p><blockquote><p><em>Frosh went on to say: &#8220;Two editorials about the bill have appeared since I introduced it: one in the Washington Post, the other in the Washington Times. Together, they are a tale of two cities.  In one-the Post&#8217;s-the bill is an overdue, responsible effort to reduce murders in Maryland, where the homicide rate is third highest in the nation and over 70 percent of the deaths involve firearms.&#8221;</em></p></blockquote><p>Senator Frosh, if as you say, Maryland&#8217;s homicide rate is the third highest in the nation, how do you explain that all of the &#8220;shall issue&#8221; concealed handgun permit states contiguous to Maryland have lower homicide rates?</p><p>Is this just another case of us <em>&#8220;They&#8217;re not in touch with reality&#8221; </em>as you described those who oppose SB 645 when you were recently quoted in the February 19th edition of the <a
title="AmmoLand" href="http://www.gazette.net/stories/02192010/polinew200653_32551.php" target="_blank">Montgomery Gazette</a>?</p><blockquote><p><em>&#8220;In the other-the Times&#8217;-the bill is Satan&#8217;s spawn, an infringement on fundamental American rights, the harbinger of a coming police state.</em></p><p><em>The Times editorial contains breath-taking factual errors about the bill itself. But the two editorials together show the extreme divergence of views about firearms in Maryland, and, almost certainly, in the whole nation. They show again why this is such a difficult issue to address.  Judge for yourself:&#8221;</em></p></blockquote><p>Whoa, just a minute! Help us out here Senator, exactly where are the &#8220;breath-taking errors&#8221; in the Times editorial? class="wp-caption-text">Second Amendment Foundation</p></div><p><strong>BELLEVUE, WA -</strong>-(AmmoLand.com)-  A new Rasmussen poll has revealed that an overwhelming majority of Americans reject the notion that cities have a right to ban handguns, siding with the Second Amendment Foundation&#8217;s position in its lawsuit to overturn the Chicago ban.</p><p>Oral arguments in the SAF case were heard by the U.S. Supreme Court on Tuesday. Court observers predict the high court will overturn the Chicago ban, thus incorporating the Second Amendment to state and local governments through provisions in the 14th Amendment.</p><p>Results from Rasmussen&#8217;s national telephone survey found that 69 percent of the respondents say cities have no right to ban legal handgun ownership, while 25 percent believe cities can ban guns.</p><blockquote><p>&#8220;The Rasmussen survey clearly shows that Americans have grown weary of anti-gun municipal demagoguery,&#8221; said SAF Executive Vice President Alan M. Gottlieb. &#8220;A victory in our case before the Supreme Court should send a clear signal to gun prohibitionists like Chicago Mayor Richard Daley that arbitrarily disarming law-abiding citizens under the guise of fighting crime is an idea that has no place in this country.&#8221;</p></blockquote><p>SAF is joined in its case by the Illinois State Rifle Association and four Chicago residents, including Otis McDonald, for whom the Supreme Court case is named.</p><p>The Rasmussen poll also found very little difference between current public sentiment and earlier surveys that noted 70 percent of American adults believe the U.S. Constitution guarantees the individual right to own a firearm.</p><blockquote><p>&#8220;For years,&#8221; Gottlieb said, &#8220;the anti-gun lobby has been claiming majority support for its Draconian agenda, but polling data like this new information from Rasmussen shows that the public is not about to surrender a significant civil right. We believe the Supreme Court is on the verge of expanding the scope of that right by applying the Second Amendment to the states.&#8221;</p></blockquote><p>The Second Amendment Foundation (www.saf.org) is the nations oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms. Bush, he exposed the current plan in motion by the Obama administration to <em>&#8220;show the world how inclusive, sharing, cooperative, and international America can be&#8221; </em>by moving quietly to cede control of the Web from the United States to foreign powers like the United Nations.</p><p><strong>Why should that matter to Gun Owners?</strong><br
/> Because as we all know the the United Nations, and in particular powerful international groups like <a
title="AmmoLand" href="http://www.ammoland.com/2009/12/14/iansa-plotting-to-tear-down-the-2nd-amendment/" target="_self">IANSA</a>, would stop at nothing to ban, block, reduce access too or tear down pro gun websites.</p><blockquote><p>&#8220;[The] Obama administration [has] set off on a plan to surrender control and key management of the Internet by the U.S. Department of Commerce and its agents.</p><p>The key to the control America has over the Internet is through the management of the Domain Name System (DNS) and the giant servers that service the Internet.</p><p>Domain names are managed through an entity named IANA, the Internet Assigned Numbers Authority. The IANA, which operates on behalf of the U.S. Department of Commerce, is responsible for the global coordination of the DNS, IP addressing, and other Internet protocol resources.</p><p>In short, without an IP Address or other essential Internet protocols, a person or entity would not have access to the Internet.&#8221;</p></blockquote><p><strong>What does that mean for you and me?</strong><br

Your sustained efforts at making your voices heard have resulted in the sponsor of SB516, Senator Lenett, withdrawing the bill as of Tuesday.</p><p>We know from first hand knowledge that the incredible pressure, to the tune of several hundred emails and calls a day, brought to bear upon the sponsor of this bill was responsible for the sponsor pulling it.</p><p>We have just a little time to pat ourselves on the back for a job well done, but we mustn&#8217;t be complacent and believe that the rest of the session will be as easy.  Keep up the great work and put down the other bills that we oppose and voice your support for the others.  Remember, we are only as effective as the sum effort of our individual members.</p><p><strong>What are they really trying to do?</strong><br
/> We have to wonder if these high profile bills that are garnering our community&#8217;s attention are not a distraction on two fronts.  First, they are trying to dilute our efforts on the shall issue and civil immunity bills.  Secondly, we think that the AWB and <a
title="AmmoLand" href="http://www.ammoland.com/2010/02/10/maryland-racist-gun-safety-act-of-2010/" target="_blank">Gun Owner Licensing bills</a> are feints to cover their real intentions which are to pass bills that will make it more difficult for dealers to stay in business, create a registration list of all firearms sold in Maryland and to pass legislation that will ultimately develop into the ammunition logs that we defeated last year.</p><p>If you compare the language of SB167 with some of the language contained in HB820/SB645, you will see that it is nearly identical with regards to the record keeping requirements. class="wp-caption-text">Second Amendment Foundation</p></div><p><strong>SEATTLE, WA &#8211; </strong>-(AmmoLand.com)- A King County Superior Court judge has ruled in favor of a lawsuit filed by the Second Amendment Foundation and National Rifle Association, striking down a ban on guns in city parks because it violates Washington State&#8217;s long-standing preemption statute.</p><p>Judge Catherine Shaffer ruled from the bench that the gun ban, adopted under former Mayor Greg Nickels, violates Washington&#8217;s law, which placed sole authority for regulating firearms in the hands of the State Legislature. That law was adopted in 1983 and amended in 1985, and has served as a model for similar laws across the country.</p><p>SAF and NRA were joined in the lawsuit by the Citizens Committee for the Right to Keep and Bear Arms, the Washington Arms Collectors and five individual plaintiffs.</p><blockquote><p>&#8220;This is a great victory for the rule of law and Washington citizens,&#8221; said SAF Executive Vice President Alan M. Gottlieb. &#8220;Greg Nickels was so blinded by his personal hatred for firearms owners and his own arrogance that he imagined the city under his control could simply ignore state law. That arrogance cost Nickels his job last year. We repeatedly warned him not to push a gun ban, but he refused to listen.</p><p>&#8220;It is also a victory for the Legislature,&#8221; he observed, &#8220;because this case affirms the intent of lawmakers in 1983 to prevent cities like Seattle from creating a nightmare patchwork of conflicting and confusing firearms regulations. The ruling solidifies the legislature&#8217;s authority and sends a message to city and county governments to stop meddling with the rights of Washington citizens.&#8221;</p></blockquote><p>Gottlieb suggested a review of local ordinances may now be in order, so that city and county governments can be compelled to remove old gun regulations or face legal consequences.</p><blockquote><p>&#8220;This ruling puts anti-gun local officials on notice that legally-armed citizens have rights, too,&#8221; Gottlieb stated.</p></blockquote><p><strong>About:</strong><br

class="wp-caption-text">U.S. Sportsmen&#39;s Alliance</p></div><p><strong>Illinois -</strong>-(AmmoLand.com)-A so called <em>“assault weapon”</em> bill in Illinois will ban numerous commonly used hunting firearms.</p><p>Senate Bill 3036, introduced by Senator Antonio Munoz (D- Chicago), prohibits the manufacture, delivery, sale, purchase, or possession of <em>“semi-automatic assault weapons.”</em> Included in the bill’s definition are firearms used for hunting such as semi-automatic shotguns that have either a pistol grip or a thumbhole stock and many hunting rifles.</p><p>While the bill allows for possession of those firearms that are currently owned, it would prohibit the purchase or transfer of new firearms that are on the banned list in Illinois, even if those firearms are commonly used for target shooting or for hunting purposes.</p><p>The measure does include an exemption for the possession of these types of firearms when used for hunting, but fails to allow for target or other recreational shooting activities including sighting in.  Essentially, sportsmen could only use certain firearms for hunting if they already possess them or purchased them out of state.</p><blockquote><p>“The bill’s broad definition outlaws numerous firearms used commonly for both deer and turkey hunting and other shoot sports,” says Jeremy Rine, U.S. Sportsmen’s Alliance associate director of state services.  “There is simply no justification for this bill.”</p></blockquote><p>Take Action! class="wp-caption-text">Maryland Shall Issue.org</p></div><p><strong>Maryland -</strong>-(AmmoLand.com)- Well folks, just when you thought that there might be some hope that the anti-gun faithful members of the Maryland State Senate had learned their lesson about proposing nonsense bills like bans on so-called assault weapons, they prove otherwise.</p><p>Senator Mike Lennett (D), District 19, Montgomery County, has introduced SB516, the <strong>Maryland Assault Weapons Ban of 2010</strong>.  His co-sponsors are a veritable Who&#8217;s Who of the anti-gun wing of the Senate.</p><p>Now&#8217;s the time to head this thing off before the hearing is even scheduled and let the members of the Senate Judicial Proceedings Committee know that Maryland citizens will not tolerate such an egregious infringement on their rights in the name of political grandstanding.</p><p><strong>SB516 Facts:</strong></p><ul><li>Expands the definition of the assault pistol ban to encompass all firearms designated as assault weapons.</li><li>Anything determined to be a copycat of the named firearms would be included.  Given the Maryland State Police&#8217;s very liberal interpretation of what constitutes a copycat, we see this list encompassing any firearm that meets the required criteria of looking scary.</li><li>Includes semi-automatic pistols with detachable magazines that also have threaded barrels.</li><li>Includes semi-automatic shotguns with folding or telescoping stocks that also have a pistol grip or thumbhole stock</li><li>Bans forward pistol grips.</li><li>You must REGISTER your firearms before December 10, 2010 so that you have the luxury of being able to keep the firearms you already own.</li><li>Naturally, this bill does not apply to governmental agencies, but they do give you the option of rendering your firearm permanently inoperable.</li></ul><p><strong>Here&#8217;s what we need you to do: </strong></p><ul><li>Contact your Senator and let them know that you oppose SB516.</li><li>Contact the members of the Senate Judicial Proceedings Committee and let them know that you oppose SB516</li><li>Spread the word to your fellow gun owners.  Reinforce to them that this is not really just about &#8220;assault weapons&#8221;.  It is about launching the first strike in a continual erosion of the ability to own any firearms in Maryland. class="wp-caption-text">Maryland Shall Issue.org</p></div><p><strong>Maryland -</strong>-(AmmoLand.com)- Even if you do not own an AR15 or another firearm specifically threatened by SB516, the reality is that this is merely the first stage of the process of outlawing the possession of all guns in the state of Maryland.</p><p>We’ve witness this sort of divide and conquer strategy before and we need to continue to show them that Maryland gun owners stick together.</p><p>Maryland legislators and anti-gun lobbyists have adequately demonstrated that they will not stop until they have done away with all gun ownership here. They have already shutdown the <strong>National Capital Trap and Skeet Club</strong> for bogus claims of environmental impact and have attacked other ranges for trumped up noise and safety violations. Now they are going to try to divide us as they ban classes of firearms one by one. There are 65- 80 million gun owners in the United States, making us one of the largest voting blocks in the country. They know that they can not usurp our rights in an outright, all inclusive ban, so they are seeking to fracture us and destroy us little by little.</p><blockquote><p><em>We must support all firearm rights, regardless of our chosen discipline or they will fall, one by one. What can you do?</em></p></blockquote><p><strong>Get involved! /> The sponsors of SB516, The Maryland Assault Weapons Ban of 2010, would lead you to believe that the firearms covered by the proposed legislation are somehow different than those guns used for sporting purposes such as hunting and target shooting. This is the favorite technique of the anti-gun members of the General Assembly and the anti-gun professional lobbyists that prop them up. This BIG LIE technique assumes that if they repeat the lie enough times it will start to sound like the truth and will drive a wedge between Maryland gun owners.</p><p>The old axiom of <em>“we must hang together or we will surely hang separately”</em> has never been more true than right now.</p><p>Once they establish that assault weapons are banned in the state, they only need to expand the definition of an assault weapon to add other firearms to the prohibited list.</p><p><strong>Lie #2: AR15s have no sporting purpose</strong><br
/> That’s what they would like you to believe. The AR15 is the #1 firearm used for rifle target competitions ranging from local NRA matches to the world class Civilian Marksmanship Program matches held at Camp Perry. The .223 Remington cartridge fired by the AR15 is permissible in some areas to be used on game as large as deer.</p><p><strong>Lie #3: Assault weapons are machine guns:</strong><br
/> Another example of the BIG LIE technique. The firearms covered by SB516 are semiautomatic firearms, not machine guns. They fire one cartridge for every pull of the trigger just like all non-machine guns such as sporting arms. Machine guns are regulated heavily by legislation in existence since 1934 and 1986 and are not affected by this bill.</p><p><strong>Lie #4: SB516 only affects AR15s and other <em>“Evil Black Rifles”</em> </strong><br
/> The text of part of SB516 now says assault weapon&#8230;not rifle&#8230;.and defines an assault weapon as, <em>“the ability to accept a detachable magazine”</em> and any of a number of cosmetic features that have nothing to do with the function or power of the firearm. Attorney General Gansler, a Ceasefire MD advisory board member, will take the strictest interpretation of the law to limit your access to many firearms in addition to the AR15.</p><h3><strong>Assault Weapon Facts:</strong></h3><p><object

/> Despite the cries of “1 in 5” police officers killed with assault weapons and “blood in the streets” since the lapse of the 1994 Federal AWB, neither of these occurred. The FACT is that not one Maryland police officer was shot and killed by a rifle of any kind in the period 1980-2009. The other FACT is that in the year 2000 rifles accounted for only 3% of homicides in Maryland. The number of “assault weapons” in that 3% is even smaller.</p><p><strong>Fact #3: The FBI does not track the use of assault weapons in crimes</strong><br
/> Supporters of the AWB will affirm that the FBI tracks the use of assault weapons in the Uniform Crime Report. The simple FACT is that they do not. The LIARS simply decide that any .223 Remington cartridge recovered from a crime scene must be from an AR15.</p><p>Would recovering a .30’06 cartridge automatically mean that it was from an M1 Garand?</p><p><strong>Fact #4:The Maryland State Police has said that the AWB is a non-issue for them.</strong><br

class="wp-caption-text">CalGunLaws.com</p></div><p><strong>Oakland City, CA -</strong>-(AmmoLand.com)-  The evening of February 3ed 2010 at 6:00p.m., the full City Council of Oakland (&#8221;OCC&#8221;) will consider and vote on whether to adopt amendments to three ordinances that impact the rights of lawful gun owners in that city. <em>(See <a
title="AmmoLand Supports CalGunLaws" href="http://calgunlaws.com/images/stories/Docs/02.01.10_OaklandLetters/gunordinance.pdf" target="_blank">proposed amendments</a>)</em></p><p>The aggressive package of amendments is the Legal Community Against Violence’s <em>(&#8221;LCAV&#8221;)</em> most recent attempt at pushing its gun ban agenda locally, while pushing the <em>&#8220;envelope&#8221;</em> of the legal doctrine of preemption as outlined in the Fiscal v. City and County of San Francisco case <em>(which limits the authority of local governments to regulate firearms and ammunition</em>).</p><p>LCAV’s last attempt to push these ordinances was in San Mateo County where they failed, likely as a result of NRA/CRPA litigation threats and the enormous public outcry by pro-gun rights supporters, especially those from the Calguns community.</p><p>Despite LCAV’s biased representations of the legal soundness of these ordinances, they are clearly illegal in most instances, and are at best <em>&#8220;grey areas&#8221;</em> of the law subject to test case litigation in others. Civil rights attorneys from the law firm of Michel &amp; Associates have drafted a letter on behalf of NRA and CRPA contesting the legality of the amendments and served the OCC with the letter. (See the NRA letter).</p><p>CRPA has also weighed in separately on the Oakland amendments issue, submitting a letter to the OCC offering examples of effective, violence reducing programs that exist as alternatives to these ill-conceived, counterproductive ordinances that only serve to burden law abiding gun owners and sellers. <a

class="wp-caption-text">National Rifle Association</p></div><p><strong>Fairfax, Virginia &#8211; </strong>-(AmmoLand.com)- On Wednesday, January 20, Colorado State University (CSU) formally announced their draft proposal to prohibit firearms on all CSU campuses.</p><p>Exempt from the ban would be weapons used by law enforcement, military and the Reserve Officers&#8217; Training Corps (ROTC).</p><p>This draft policy will be brought up for consideration at the CSU Board of Governors meeting on Tuesday, February 23. A copy of the draft can be found at www.safety.colostate.edu/files/weapons_policy_draft_01_15_10.pdf.</p><p>Last year, the CSU Board of Governors drafted the policy knowing that it would violate the Colorado state firearm preemption law and the Colorado Uniform Shall-Issue Concealed Carry Law. class="wp-caption-text">Students for Concealed Carry on Campus at Virginia Tech</p></div><p><strong>Virginia Tech, VA -</strong> -(AmmoLand.com)- On Monday, February 1, 2010 the Virginia Tech University Council will have their first reading of a resolution that would effectively <strong>Ban Ammunition, including Paintball and Airsoft,</strong> on campus and in dormitories.</p><p>Being the president of Students for Concealed Carry on Campus at Virginia Tech and a member of the Pistol and Rifle Club, I recognize how the passage of this resolution could negatively affect members of these organizations.  It will also greatly affect those of you in the Airsoft Club, Paintball Club, Clay Target Team, and others. /> <em>Effective Date:</em></p><p><em>Commission on Student Affairs Resolution CSA 2009-2010C</em></p><p><em>Weapons Policy for Student Code of Conduct</em></p><ul><li><em>Whereas, the University Student Conduct System is an educational tool with two main objectives: to hold students accountable for unacceptable behavior, and to modify those behaviors deemed unacceptable by the university, and</em></li><li><em>Whereas, the University Student Conduct System strives to address unacceptable behavior in a manner that informs students and guides them toward a greater sense of personal responsibility, and more mature and ethical standards, and</em></li><li><em>Whereas, current policy (contained in the Hokie Handbook) already states that unauthorized storage, possession, and/or use of weapons is prohibited on university property, and</em></li><li><em>Whereas, the University is committed to policies and procedures that address campus safety and security, and</em></li><li><em>Whereas, the University would like to convey to students that since weapons are not allowed in on campus residential facilities that ammunition should also be prohibited, therefore let it be</em></li></ul><p><em>Resolved, that Policy # 8300, Student Code of Conduct – Weapons be amended as follows:</em></p><p><em>Student Code of Conduct – Weapons</em></p><p><em>Unauthorized possession, storage, or control of firearms, weapons, on university property, including storing weapons in vehicles on campus as well as in the residence halls. Furthermore, ammunition can not be stored in any residence halls on campus. (Note: organizational weapons of the Virginia Tech Corps of Cadets, approved by the commandant, are not prohibited by this policy.) Weapons</em></p><p><em>Firearms are defined as any gun, rifle, pistol, or handgun designed to fire any projectile including but not limited to bullets, BBs, pellets, or shots (including paint balls), regardless of the propellant used. Ammunition is defined as any material intended for use in a firearm, capable of being projected by a weapon and/or makes the weapon operational. Other weapons are defined as any instrument of combat or any object not designed as an instrument of combat but carried for the purpose of inflicting or threatening bodily injury. </em></p><p><em>Examples include but are not limited to knives with fixed blades or pocket knives with blades longer than 4 inches, razors, metal knuckles, blackjacks, hatchets, bows and arrows, nun chukkas, foils, stun weapons, or any explosive or incendiary device. Possession of realistic replicas of weapons on campus is prohibited. Stun weapon is defined as any device that emits a momentary or pulsed output, which is electrical, audible, optical or electromagnetic in nature and which is designed to temporarily incapacitate a person. </em></p><p><em>Students who store weapons in residence hall rooms, who brandish weapons, or who use a weapon in a reckless manner may face disciplinary action, which may include suspension or dismissal from the university. Students who store ammunition in the residence halls will face disciplinary action. Exceptions to possessing weapons may be made in the case of university functions or activities and for educational exhibitions or displays. Exceptions must be approved by the Vice President for Administrative Services, in consultation with appropriate university offices. </em></p><p><em>This policy does not prohibit the possession of firearms by persons, such as law enforcement officers, who are authorized by law to do so in the performance of their duties. A weapons storage program is available. The storage program applies to the weapon and ammunition. Ammunition that will not be stored includes Paintballs, BB’s, Air Soft projectiles, Nerf gun projectiles, and CO2 Cartridges. Interested persons should contact the Virginia Tech Police (Sterrett Facilities Complex, 231-6411.)</em></p></blockquote><p><strong>I want to point out a few key things:</strong></p><ul><li>Ammunition (including bullets, BBs, airsoft pellets, and paintball) would now fall under the definition of a weapon, the possession of which on campus and in dorms would be punishable (up to dismissal or suspension from VT)</li><li>The VT Police Department will begin storing CERTAIN types of ammunition (NOT airsoft or paintball) on a first come, first serve basis.  There is absolutely NO indication of how much ammunition they will be able to accommodate.</li></ul><p>Myself, Ken Stanton (VP of Students for Concealed Carry on Campus at VT), and Ethan Reed (Secretary of Pistol &amp; Rifle Club) were present at the last meeting in which this resolution was discussed (the Commission on Student Affairs meeting).</p><p>Mrs. Frances Keene, the author of this resolution, cites <em>“safety issues”(ie explosions of ammunition during a fire)</em> as her main reason for concern.</p><p>Despite Ethan citing opposing research on the issue of safety, many members of the commission chose to simply trust Mrs. Keene on the issue, mentioning perceived fears as their reason for wanting to pass the resolution.</p><blockquote><p><strong>Further, these safety issues do not explain the reasoning behind also banning paintballs and airsoft pellets. </strong></p></blockquote><p>After discussing the safety issues and concerns about how much ammunition the VTPD would or would not be able to store, several members of the commission raised concerns about not having enough information to make an informed vote on the issue.</p><p>A motion was made to resume discussion and invite representatives who were more knowledgeable on all sides of the issue, but this motion was struck down.  With <em>“encouragement”</em> from a few key members of the commission, a hasty vote was made, and the resolution passed.</p><p>I am a member of the University Council where the resolution will be heard on Monday, and I am more than willing to speak to this issue.  However, I cannot do this alone.  We need to make the council aware that there is credible research showing that safety is not an issue in ammunition storage on campus.  We also need to show them exactly who this ammunition ban would affect <em>(ie you and/or your group’s members who live on campus)</em>.</p><p>The council meets in Pamplin 1045 from 3-5pm on February 1; this resolution is one of the first things on the agenda for the meeting, so please be prompt.</p><p>Feel free to email me with any questions or comments.</p> <address>Thank you,</address> <address>S. Morrissey, allowed for automatic expungements of criminal records, but excluded misdemeanor domestic violence, which legitimatizes a bad federal law that disarms a person for life for a minor crime.</p><p>The Courts of Justice Criminal subcommittee in the House voted to pass the bill by indefinitely (PBI).</p><p>SB 268, Senator Whipple, allowed localities to pass ordinances banning guns on their property.  It died by a 6 to 9 vote in the Senate Local Government committee yesterday.</p><ul><li>Voting pro-gun: Quayle, Martin, Hanger, Reynolds, Ruff, Obenshain, Herring, Smith, Stuart</li><li>Voting anti-gun: Lucas, Marsh, Ticer, Puller, Locke, Marsden</li></ul><p>The Chief of Police for Falls Church and a captain from ***Fairfax PD*** spoke in favor of the bill! /> HB 84, introduced by Delegate Bob Marshall, wasn&#8217;t on our radar, but is now after Delegate Jackson Miller said in the House Courts of Justice Criminal subcommittee that the bill could inadvertently leave Virginia gun dealers and manufacturers open to mischief by people like New York Mayor Michael Bloomberg.</p><p>Delegate Marshall, who clearly had no intention of that potential problem, agreed to work on the bill and return to the committee with a corrected version.</p><p>Thanks for Delegate Jackson Miller for the catch and Delegate Marshall for hopefully fixing the problem.</p><ul><li>HB 681, Jackson Miller, passed out of the House Courts of Justice Criminal subcommittee by a vote of 6 to 1.  The bill allows a police officer full discretion to arrest for a class 1 or 2 misdemeanor instead of just writing a summons and letting the person go (with 7 exceptions in current law).  One problem was fixed in subcommittee (a part that actually took discretion away from an officer and *required* him to arrest somebody if they wouldn&#8217;t stop what they were doing). class="wp-caption-text">Shooters Committee on Political Education</p></div><p><strong>Mineola, NY –</strong> -(AmmoLand.com)- The Nassau County local law banning the possession of handguns mislabeled <em>“deceptively colored”</em> has reached the New York State Supreme Court, Appellate Division, Second Department.</p><p>The Respondents have responded to our Appellate Brief, and we are now in the process of preparing our Reply Brief.</p><p>As you may remember, in June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of &#8220;deceptively colored handguns” as a supposed danger to law enforcement.  The law originally banned all handguns except for those that are <em>&#8220;black, grey, silver, steel, nickel or army green.&#8221;</em> It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.</p><p>Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court <em>(Index #: 013564/2008)</em> to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.</p><p>The action, brought on the day the law was to go into effect, sought a ruling that Nassau’s local law is invalid because it is <em>“preempted”</em> by New York State’s extensive gun control laws, which already ban <em>“disguised guns.”</em> Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.</p><p>The filed proceeding led Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. Further, filing of the action alone resulted in the Nassau County legislature amending the law to remove the prohibitions against gold plated, blued, and brown handguns.</p><p>As stated, the action is currently on appeal to the NYS Appellate Division, Second Department (Docket No. 2009-1468), and the petitioners have retained attorney Robert Firriolo, a litigation partner in the New York office of Duane Morris LLP.</p><p>The petitioners continue to express their gratitude to SCOPE, the Freeport R&amp;R Association Junior Club, SAFE, SASI, NCF&amp;G, and to all those individuals who have donated to help us succeed in this important appeal. The petitioners, though, are still seeking donations to help with the appeal of Chwick v. Mulvey, as we have requested 15minutes of Oral Argument time.</p><p>Please remember that a victory in this appeal may well be the springboard for challenging other burdensome and senseless New York gun control laws. In fact, Chwick v. Mulvey has already been cited in Albany County Appellate Division, Second Department, and  the cite was positive on our points 3 &amp; 4<em> (Cites to Heller and NYS Civil Liberties, Second Amendment)</em>. Additionally, Chwick v. Mulvey, may be another doorway for incorporation of the Second Amendment by NYS. But appeals are not inexpensive, so please donate whatever you can to SCOPE, SAFE, SASI, or directly to Petitioner Chwick. Every dollar helps, and any funds leftover, will be returned. href="http://assembly.state.ny.us/leg/?bn=A00801&amp;sh=t" target="_blank">Assembly Bill  801A</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S01598&amp;sh=t" target="_blank">S 1598A</a>, would require five-year renewals on pistol licenses.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A01093&amp;sh=t" target="_blank">Assembly Bill  1093</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S01715&amp;sh=t" target="_blank">S 1715</a>, would  create liability for legal firearm retailers when criminals misuse firearms.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A01275&amp;sh=t" target="_blank">Assembly Bill  1275</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S01712&amp;sh=t" target="_blank">S 1712</a>, would  outlaw the private sale and transfer of long guns.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A01326&amp;sh=t">Assembly Bill  1326</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S05228&amp;sh=t">S 5228</a>, would  outlaw all handguns sold in the state not equipped with so-called  &#8220;child-proofing&#8221; measures.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A02881&amp;sh=t">Assembly Bill  2881</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S02379&amp;sh=t">S 2379</a>, would ban  the sale of common self-defense and hunting ammunition.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A02884">Assembly Bill  2884</a> would prohibit gun shows on public property.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A02885&amp;sh=t">Assembly Bill  2885</a> and <a
href="http://assembly.state.ny.us/leg/?bn=A02910&amp;sh=t">Assembly Bill  2910</a> would establish standards for guns sold in the state and would  allow the state police to prevent ANY firearm they deem unsafe from being  transferred into the state.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A03200&amp;sh=t">Assembly Bill  3200</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S02953&amp;sh=t">S 2953</a>, would  require ammunition coding or bullet serialization.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A03346&amp;sh=t">Assembly Bill  3346</a> would outlaw affordable handguns commonly used for self-defense.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A03477&amp;sh=t">Assembly Bill  3477</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S01188&amp;sh=t">S 1188</a>, would expand the failed 10-year-old, ballistic imaging program to include even  more firearms.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A04441&amp;sh=t">Assembly Bill  4441</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S04338&amp;sh=t">S 4338</a>, would  prohibit the manufacture, sale or transfer of handguns not equipped with  so-called &#8220;smart gun&#8221; technology.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A05844&amp;sh=t">Assembly Bill  5844</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S03098&amp;sh=t" target="_blank">S 3098</a>, would  prohibit keeping firearms available for self-defense in the home.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A06157&amp;sh=t" target="_blank">Assembly Bill  6157</a> and <a
href="http://assembly.state.ny.us/leg/?bn=A06294&amp;sh=t" target="_blank">Assembly Bill  6294</a> and their Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S04084&amp;sh=t" target="_blank">S 4084</a>, would  drastically expand the state&#8217;s ban on so-called &#8220;assault weapons&#8221; to include  virtually all semi-automatic rifles and pistols that can accept detachable  magazines.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=A06468&amp;sh=t" target="_blank">Assembly Bill  6468B</a> and  its Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S06005&amp;sh=t" target="_blank">S 6005</a>, would  outlaw the sale of all semi-automatic handguns not equipped with so-called  &#8220;microstamping&#8221; technology.</li><li><a
href="http://assembly.state.ny.us/leg/?bn=S04752&amp;sh=t" target="_blank">Senate Bill  4752</a> would ban certain firearms based upon bore diameter.</li></ul><p>On  a positive note, during one of the state&#8217;s worst fiscal crises, the NRA would  like to highlight worthwhile legislation.  <a
href="http://assembly.state.ny.us/leg/?bn=A05427&amp;sh=t" target="_blank">Assembly Bill  5427</a> and <a
href="http://assembly.state.ny.us/leg/?bn=A06388&amp;sh=t" target="_blank">Assembly Bill  6388</a> and their Senate companion, <a
href="http://assembly.state.ny.us/leg/?bn=S01152&amp;sh=t" target="_blank">S 1152</a>, seek  to eliminate the state&#8217;s ballistic imaging database (COBIS).  New  York taxpayers should be  outraged that over the last decade nearly 50 million dollars have been spent on  this supposed crime-fighting tool that has resulted in ZERO prosecutions.</p><p>Call  your lawmakers and urge them to support A 5427, A 6388 and S 1152 and do away  with this wasteful program TODAY.  Also, politely remind them that many of the  NRA-opposed bills listed above will cost millions of taxpayer dollars, and like  COBIS, without reducing crimes.</p><p>State  Assembly Members can be reached by phone at (518) 455-4100.  To find your  Assembly Member, please click <a

class="wp-caption-text">National Rifle Association</p></div><p><strong>Texas -</strong> -(AmmoLand.com)- NRA has received many inquiries about reports that the Austin, Texas Police Department and the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives tried to stop private gun sales at an Austin gun show.</p><p>It appears that these reports refer to a voluntary agreement concerning the transfer of firearms at the Austin gun show, evidently reached among law enforcement agencies, property owners and managers, and the gun show promoter in question.  This was a self-imposed regulation, not a rule from the BATFE or an ordinance of the City of Austin.</p><p>NRA and our state affiliate, the Texas State Rifle Association, continue to research and investigate this matter&#8211;including examining whether this show was unfairly targeted.</p><p>Rest assured, we will inform our members of any new developments.</p><p><strong>About:</strong><br

class="wp-caption-text">Association of New Jersey Rifle &amp; Pistol Clubs</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)-  The Association of New Jersey Rifle &amp; Pistol Clubs has filed a lawsuit in the United States District Court of New Jersey seeking nullification of the recently enacted one-gun-a-month gun rationing law.</p><p>ANJRPC’s federal lawsuit is in response to the false vow made by New Jersey’s lawmakers’ promise of new legislation exempting firearm collectors and competitive shooters from the law. The Firearms Task Force, which was created by former Governor Jon Corzine (D), promised that the one-gun-a-month reform bill would give immunity to the true gun collectors and competitors, as they were not the target of the law’s scope.</p><p>The enactment of the one-gun-a-month reform law on January 7 not only failed to alleviate the handgun rationing law, but further inhibited law-abiding citizens by making them jump through additional hoops in order to purchase more than one handgun per month.</p><p>With New Jersey’s government blatantly ignoring the Constitutional rights of its citizens, it is time that we take action and stand up against such offensive legislation.</p><p>Brought to you by - AMMO LAND.COM - Firearms & Shooting Sports News <a

class="wp-caption-text">Firearms Owners Against Crime</p></div><p><strong>Pennsylvania -</strong>-(AmmoLand.com)-  Now that the Pennsylvania elections are over it seems that every anti-gun group in this state and even some throughout the nation have targeted Pennsylvania as a battleground state.</p><p>Let&#8217;s take a look at a portion of the list of anti-gun issues that have surfaced recently.</p><p><strong>Recent Anti-gun issues in Pennsylvania:</strong></p><ul><li>17 communities are committing acts of civil disobedience and enacting their own firearms laws.</li><li>The Pennsylvania State police Commissioner issues letter of support for these communities.</li><li>The Pennsylvania State police Commissioner violates Pennsylvania law by reconfiguring how certain firearms are sold.</li><li>Rep. Caltagirone (chairman of the House Judiciary committee) and Sen. Greenleaf (chairman of the Senate Judiciary Committee) hold up both respective Castle doctrine bills in their committee (House Bill 40-Senate Bill 842).</li></ul><p>The list goes on and on and on and at the heart of this are the machinations of Cease-Fire PA, Mothers Against Guns, Mayors against Illegal Guns, and a host of smaller, insignificant anti-gun groups that like a bad record seems to be fixated on the fake cause of stopping illegal guns by putting more burden and more restrictions on law-abiding citizens.</p><p>As you&#8217;ll see there are a great many gun issues that cry out for common sense and the attention of everyone of us. Pay particular attention to very quiet attempts to classify the materials involved in manufacturing ammunition as hazardous materials.</p><p>The recent murder of a police officer in the Penn Hills community who was out on parole, had an electronic monitoring bracelet on, and was never prosecuted for a myriad of gun crimes has heightened the debate over gun control laws and their effectiveness. Of course the anti-gun groups trotted out the same old message that it&#8217;s time for reasonable gun laws, ignoring the fact that we have 126 pages of reasonable Pennsylvania gun laws that didn&#8217;t stop this miscreant from murdering a police officer, all the while protesting that they support a citizen&#8217;s right to bear arms.</p><p>Note that the West Mifflin Borough, PA Council is once again targeting gun owners by reconsidering, as some sort of ironic Christmas present, the concept of mandatory reporting of lost or stolen firearms. We are asking all gun owners in this area to consider attending this meeting so that you can express your dissatisfaction with this moronic concept.  As an interesting aside when talking with the solicitors of these communities and they are asked what they will do if a firearm turns up in a crime in their community that was not reported stolen from different community, you get this pregnant pause or a look on their face like DUH &#8220;I never thought of that&#8221;.  Clem Kadiddlehopper of Red Skelton comes to mind! class="wp-caption-text">National Rifle Association</p></div><p><strong>New York, NY -</strong>-(AmmoLand.com)- The carrying of firearms on college campuses remains hotly debated these days.  Recently, that debate has centered on two prominent Colorado universities.</p><p>Last week, the Colorado State University (CSU) Student Senate voted overwhelmingly (21-3) to continue allowing students with valid state-issued carry permits to carry concealed firearms on campus.</p><p>The local Sheriff endorsed the students&#8217; decision.  But the nine-member CSU Board of Governors overruled the decision, voting on Friday to strike down the proposal.</p><p>A final decision by CSU President Dr. Anthony A. Frank on the proposal is expected soon.  In the meantime, Frank will review recommendations from both the student government and his public safety and cabinet members.</p><p>Former Colorado Congressman Tom Tancredo (R) reportedly called the CSU decision <em>&#8220;stupid.&#8221;</em> Tancredo has proposed a 2010 ballot measure that would ask voters to recommend to Colorado&#8217;s state officials that they oppose all forms of gun restrictions.  A December 7, 2009 State Bill Colorado article reports that Tancredo said the issue is about self-defense, stopping &#8220;horrendous&#8221; incidents and protecting the Second Amendment.</p><blockquote><p>&#8220;Do you want to protect people, or do you want to be politically correct?  Which is your goal?&#8221; Tancredo asked.</p><p>&#8220;You do realize that there are about 300 million firearms in the United States in private hands.  If the opponents of concealed-carry and of private ownership of firearms were right, every city in the United States would be Beirut,&#8221; he said.</p></blockquote><p>Tancredo went on to note that statistics indicate gun violence in the United States has been going down over the last decade, as gun ownership has been increasing.</p><p>Meanwhile, the University of Colorado (UC) also took up the issue of banning firearms on campus last week when they confirmed a ban on <em>&#8220;rum roll&#8221;</em> Nerf guns!   Yes, Nerf guns!   You know, those toy guns that shoot soft spongy balls?  The ones kids play with in the family room?  Yes, those Nerf guns.</p><p>It seems that the game of <em>&#8220;humans vs. zombies&#8221;</em> has become a national craze on college campuses.  The game involves <em>&#8220;zombie&#8221;</em> students attempting to eliminate <em>&#8220;human&#8221;</em> students by pelting them with spongy Nerf balls or balled-up socks.  When campus security officials got wind of the game, they moved quickly to ban the Nerf guns.  Students using the play guns could be charged with violations of the student-conduct policy or even arrested on charges of unlawful conduct.</p><p>So, while Nerf guns may be safe to sell in <em>&#8220;Kids R Us&#8221;</em> and safe for use by children in their home, apparently they are seen as enough of a grave danger for college students that UC has banned them.</p><blockquote><p>&#8220;We told them that the violation of the weapons policy is a serious thing,&#8221; said CU spokesman Bronson Hilliard.  &#8220;If a third party happened upon this and called 911, we&#8217;d have to respond as if it were a real incident.&#8221;</p></blockquote><p><strong><br

class="wp-caption-text">California Rifle and Pistol Association</p></div><p><strong>Richmond City, CA -</strong>-(AmmoLand.com)- On Tuesday, The Richmond City Council voted to repeal its ill-advised ordinance banning the possession of magazines that hold over ten rounds.</p><p>The City opted to repeal the ordinance (initially passed in 2007 but apparently never enforced) in the face of a pre-litigation demand letter recently served on the City by lawyers for the NRA and CRPA Foundation. The letter pointed out that the City&#8217;s ordinance was preempted by state firearm laws which allow the possession of such magazines.</p><p>The City Council&#8217;s decision came after being advised by the City Attorney, who studied the authorities, cited in the demand letter, that the law was not legally defensible. A copy of his report and related documents are posted at http://www.calgunlaws.com.</p><p>The decision by the City to repeal the ordinance restores the rights of Richmond residents, as well as those traveling through the City, to possess magazines that were acquired and possessed pursuant to state law. The decision should also send a message to other municipalities considering the adoption of similar ordinances, not only those banning magazines, but also ordinances infringing on the right to keep and bear arms in general. Surrounding cities should recognize that such laws will be struck down as preempted under the landmark decision in Fiscal v. City and County of San Francisco, a successful NRA lawsuit that fortified the legal doctrine of implied preemption as a restriction on local gun control measures.</p><p>Should the City of Richmond or any other jurisdiction try to adopt alternative proposals that seek to regulate the possession of firearm magazines, the legal groundwork laid in preparation for this suit will allow for a swift challenge to those measures in court.</p><p>The repeal of the City&#8217;s ban on large-capacity magazines will become final once the City Council approves the measure on second reading. The second reading is currently scheduled to take place on Tuesday, December 15.</p><p><strong>About:</strong><br

class="wp-caption-text">New Jesery</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)- On Thursday, December 3 at 2:00 pm in State House Annex Room 12, the New Jersey Assembly Law and Public Safety Committee will hold a hearing on three bills of importance to New Jersey&#8217;s law-abiding gun owners.  It is important that members of the Assembly Law &amp; Public Safety Committee hear from you on Thursday.</p><p>A4308 and A4304  have been introduced in an effort to address serious problems in New Jersey&#8217;s gun rationing law that was passed in the middle of the night on June 26.  NRA and fellow Second Amendment advocates warned legislators that the one-gun-a-month bill as written contained many flaws and errors which would have to be fixed down the road.  A4301 is an attempt by New Jersey to comply with the grant eligibility requirements set forth in the NICS Improvement Act, passed by Congress in 2007.<br

class="wp-caption-text">a</p></div></p><p>As of this writing, lawmakers are still working on last minute language for A4308, which has emerged from the recommendations put forth by Governor Corzine&#8217;s Firearm Task Force. The Task Force was supposed to create a robust exemption for law-abiding gun owners from the one-gun-a-month law. Instead, the legislation adds insult to injury by creating an ill-conceived exemption that would force gun owners to beg for permission and show &#8220;legitimate need&#8221; every time they wish to exercise their Constitutional right to obtain more than one handgun per month. Under the legislation that is currently proposed (and subject to possible last minute change), the average gun owner would need to show why it would not be &#8220;feasible or practical&#8221; to purchase the guns separately &#8211; a standard that the State Police and the courts are likely to interpret against gun owners.  New Jersey&#8217;s judiciary has repeatedly abused &#8220;needs&#8221; standards relating to firearms and, in its own words, is blatantly biased against gun owners: &#8220;When dealing with guns, the citizen acts at his own peril,&#8221; wrote the Supreme Court when it upheld the conviction of the owner of .22 rifle as an assault firearm (State v. Pelleteri).</p><p>The notion that honest persons thoroughly investigated by the state should have to beg further permission and show why it is not &#8220;feasible or practical&#8221; to ration their Constitutional rights is offensive and insulting, and represents another promise broken by the politicians involved in the Task Force. Please immediately call the members of the Assembly Law &amp; Public Safety Committee and tell them to keep their promise to gun owners and create a robust exemption for honest gun owners who have nothing to do with illegal trafficking.</p><p>A4304 will clarify the original &#8220;one gun a month&#8221; bill by exempting the &#8220;transfer of handguns among licensed retail dealers, registered wholesale dealers and registered manufacturers; or transfers of handguns from any person to a licensed retail dealer or a registered wholesale dealer or registered manufacturer.  As it stands now, the current law exempts sales between licensed gun dealers but not purchases by licensed dealers from firearm distributors or manufacturers which under New Jersey law are classified differently.  Please contact members of the Assembly Law &amp; Public Safety Committee and urge them to support A4304.</p><p>A4301 is a good faith attempt by New Jersey to comply with the grant eligibility requirements set forth in the NICS Improvement Act, passed by Congress in 2007. The NICS Improvement Act helped strengthen the reporting of persons who are prohibited from firearm purchases because they have been adjudicated by a court as mentally defective or as a danger to themselves or others. The NRA does have some concerns over the new language that removes the county adjuster from the expungement process in favor of the county counsel. It is the adjuster who receives New Jersey&#8217;s mental health check form on the state license for NJ FID cards and NJ Handgun permits. class="wp-caption-text">National Shooting Sports Foundation</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)- As drafted and hastily signed into law by outgoing New Jersey Gov.</p><p>Jon Corzine, over NSSF&#8217;s strenuous objection, New Jersey&#8217;s one-gun-a-month legislation did not provide an exemption for federally licensed firearms retailers, who would be barred from purchasing inventory from distributors or manufacturers. This was <a
title="AmmoLand" href="http://www.ammoland.com/2009/07/13/new-one-gun-a-months-law-ends-handgun-sales-in-nj/" target="_self">reported on at length</a> before being signed by the anti-gun governor who ignored all warnings.</p><p>NSSF raised this problem in testimony before the Firearms and Advisory Task Force.</p><p>Thankfully, the task force listened and recommended corrective legislation that has been introduced in the &#8220;lame duck&#8221; session and is expected to be passed in the next week or so and be signed into law.</p><p><strong>About NSSF</strong><br

title="AmmoLand Supports Incorporation of the Second Amendment" href="http://www.ammoland.com/2009/11/20/mcdonald-v-city-of-chicago/" target="_blank">reported last week</a>, on November 16, the NRA filed its brief with the U.S. Supreme Court as Respondent in Support of Petitioner in McDonald v. City of Chicago.</p><p>The NRA brief asks the U.S. Supreme Court to hold that the Second Amendment applies to state and local governments through the Fourteenth Amendment.</p><p>The McDonald case is one of several that were filed immediately after last year&#8217;s decision in District of Columbia v. Heller, in which the Court upheld the Second Amendment as an individual right and invalidated Washington, D.C.&#8217;s ban on handgun possession, as well as the capital city&#8217;s ban on keeping loaded, operable firearms for self-defense in the home.</p><p>In September, the Supreme Court agreed to consider the McDonald case, on appeal from the U.S. Court of Appeals for the Seventh Circuit. That court incorrectly claimed that prior Supreme Court precedent prevented it from holding in favor of incorporation of the Second Amendment.</p><p>As we argued at the time, the Seventh Circuit should have followed the lead of the Ninth Circuit Court of Appeals decision in Nordyke v. King, which found that Supreme Court precedent does not prevent the Second Amendment from applying to the states through the Fourteenth Amendment&#8217;s Due Process Clause.<br

class="wp-caption-text">Gunlaws.com</p></div><p><strong>Washington, DC -</strong> -(AmmoLand.com)- Should individual states be required to honor your guarantees under the Bill of Rights?</p><p>Phoenix-based Bloomfield Press has asked the U.S. Supreme Court to say yes, in an amicus (&#8221;friend of the court&#8221;) brief just filed.</p><p>The goal is to require states to be bound by the Second Amendment right to keep and bear arms. They are not currently obligated to do so. This principle is up for review in McDonald v. Chicago, expected to be argued at the High Court in February, 2010, and decided by June. See the filing here &#8212; http://www.gunlaws.com/supreme.htm</p><p>The Bill of Rights was adopted in 1791 only to control Congress (e.g., &#8220;Congress shall make no law&#8230;&#8221;), and the High Court has only applied the Bill to the states in bits and pieces. Studies have shown most people are unaware of this.</p><p>The 14th Amendment in 1868 said states cannot abridge the privileges or immunities of the citizens, or deprive or deny the rights of the people, but it provided few details &#8212; and the High Court has been evaluating that since then.</p><p>Working piecemeal, the Court has declared states cannot deny free speech, protection against unreasonable searches, the right to counsel in a criminal trial and more. This principle is now on trial in what may be the highest-profile case of its kind &#8212; the right to arms in the Second Amendment.</p><p>Chicago has flatly banned this right, leaving its citizens defenseless, and insists it has the power to do so. The city&#8217;s ban does little to disarm hardened criminals who simply roam free, carrying guns illegally at will.</p><blockquote><p>&#8220;The core issue is whether a state has legitimate power to deny any fundamental right to its people,&#8221; says Alan Korwin, author of eight books on gun law and the publisher at Bloomfield Press, the nation&#8217;s largest producer and distributor of gun-law books. &#8220;This issue is so broad and crucial to America that pro-rights and even anti-rights people on the gun issue are aligned to overturn Chicago&#8217;s blanket denial of a fundamental right,&#8221; he says.</p></blockquote><p>The avowedly anti-gun-rights Washington Post observed that,</p><blockquote><p>&#8220;Lawyers from both the left and right of the political spectrum will present strong arguments that the Second Amendment applies to state and local governments.&#8221;</p></blockquote><p>That sentiment was echoed in the similarly anti-rights LA Times, which stated editorially,</p><blockquote><p>&#8220;It&#8217;s tempting to hope that the court will rule that states aren&#8217;t bound by the Second Amendment,&#8221; but continued, &#8220;Allowing the states and cities to ignore this part of the Bill of Rights could undermine the requirement that they abide by others&#8230; this is no time for the Court to start picking and choosing when it comes to the Bill of Rights.&#8221;</p></blockquote><p>Bloomfield Press joins 34 California DAs, eight Nevada DAs, former Arizona Sheriff Richard Mack (the hero of the successful Brady-bill case that set 10th Amendment limits on federal invasion of states&#8217; rights), several law-enforcement associations, and citizens&#8217; rights groups in Arizona, California, Texas and Virginia in the amicus filing.</p><p>Mr. Korwin&#8217;s extensive research and material appears throughout the brief, drafted by California attorney Chuck Michel of Michel and Associates.</p><p><strong>The main points argued include:</strong></p><ol><li>The right of the people to keep and bear arms is a deeply rooted &#8220;fundamental right&#8221; and thus properly applied to the states;</li><li>The Due Process clause of the 14th Amendment necessarily incorporates the Second Amendment to apply against the states;</li><li>The right to armed self defense is a fundamental right recognized repeatedly by the Supreme Court dating back to the 19th century;</li><li>The right to self defense, in addition to the right to arms, has been well established as fundamental for centuries in state constitutions, and in federal law and state law;</li><li>Firearms are and have always been recognized as essential to exercise the right to self defense, with each one reliant upon the other; and</li><li> Federalism (states rights) presents no obstacle to incorporating a fundamental right of the people.</li></ol><p>The entire brief may be downloaded here<br

/> <em>Letter to AmmoLand Editors By Ralph Rubinek</em></p><p><strong>New York, NY -</strong>-(AmmoLand.com)- It is clear NYC Mayor Bloomberg is inadvertently aiding and abetting terrorism on American soil.</p><p>Unlike Israel which has learned from the Holocaust and modern day haters of the Jewish people.</p><p>Several recent incidents has resurrected Nazi enabling legislation in the United Nations which in essence is the same laws ensuring genocide and government sanctioned democide as defined in pre-Nazi Germany.</p><p>Anti-Israel condemnation, Holocaust denial as well as hatred of the Jewish people brings back memories of the past.</p><p>Mayor Bloomberg you are dead wrong pursuing failed gun control policies. Aren&#8217;t you knowledgeable about Jewish partisans during World War II? Gun control insured Nazi control of the masses.</p><p>The very laws enacted prior to Hitler insured the Nazis rise to power. The end translated in mass murder.</p><p>Recent acts of terrorism occurred in legislatively enacted gun free zones and by individuals who by law were defined as ineligible to possess firearms is alarming as well.</p><p>Not only did these individuals disregard every federal and local ordinances designed to prevent illegal gun possession, they were further motivated by the fact no one would be able to stop them. Mayor Bloomberg, you want more of these Laws?</p><p><strong>Here are some facts:</strong></p><p>On 9/11 not one shot was fired, almost 3,000 Americans died in less than 1 hour because a 1968 gun law prevented qualified persons from possessing any weapons on American commercial air craft. Israel&#8217;s national airline, EL/AL simply arms their crews. The result not one hijacking. Gun control kills.</p><p>The Fort Hood mass killing of United States Military personnel by a suspected terrorist on a FBI terror list enrolled in our own military in the rank of Major knew his victims could be easily murdered as Military law enacted during the Clinton administration outlawed any firearms by military personnel on US bases. In fact our military had to call 911 and wait, 14 died and countless maimed by the atrocious act by a sick coward. In Israel, military personnel are armed. Gun control kills.</p><p>For decades, our law enforcement and military personnel had their hands tied trying to end illicit narcotic trade which formulation also was developed by the Nazis. This trade also funds terrorists and the illicit sale of all types of guns/bombs and violence domestic and foreign.</p><p>Here in the United States you do not have one political leader with the demeanor and bravery to stand tall against the true cause of violence&#8230; DRUGS.</p><p>Instead you have individuals like NYC Mayor Bloomberg on a pulpit trying to destroy the absolute vestige which sets apart a free society of citizens based on rational security from a lawless totalitarian nation encouraged by power to control its subjects.</p><p>My parents came to America as refugees, survivors of Hitlers final solution&#8230; They taught me along with other survivors the ideologies of the left&#8230; Mayor Bloomberg and the current atmosphere in Washington DC alarms my inner most instincts based upon my family history.</p><p>As men, women and children needlessly die because of failed policies which insure more victims and fear&#8230; I know and understand how enabling legislation brings about the end of liberty.</p><p>Mayor Bloomberg&#8217;s approach may be wrapped in benevolence but history teaches us it contains the blood of millions of innocent lives, past, present and future.</p><p>Mayor Bloomberg, I despise violence as well as hatred. href="http://abcnews.go.com/Politics/story?id=6960824&amp;page=1">Obama to Seek New Assault Weapons Ban</a>&#8221; turned an election-related spike in gun sales into a frenzy that has only recently begun to moderate.</p><p>The news of a pending push by Obama to ban many semi-automatic rifles was sparked by comments from newly-minted Attorney General Eric Holder, who told reporters that &#8220;As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons.&#8221; He went on to indicate that the administration had decided on a new angle of attack to push for the ban: the war on drugs.</p><blockquote><p><em>Holder said that putting the ban back in place would not only be a positive move by the United States, it would help cut down on the flow of guns going across the border into Mexico, which is struggling with heavy violence among drug cartels along the border.</em></p><p><em> &#8220;I think that will have a positive impact in Mexico, at a minimum.&#8221; Holder said at a news conference on the arrest of more than 700 people in a drug enforcement crackdown on Mexican drug cartels operating in the U.S.</em></p></blockquote><p><em> </em></p><p>Despite claims of a gun trafficking highway running from the U.S. the Mexico having been immediately and thoroughly debunked (see here and here and here) the president said at a press conference in Mexico City in April that he has &#8220;not backed off at all from my belief that the assault weapons ban makes sense.&#8221;</p><p>Last week, even as Holder indicated his office is &#8220;currently reviewing existing gun laws to determine how best to combat gun violence and keep guns out of the hands of criminals and others prohibited from possessing them,&#8221; echoes of the Obama administration&#8217;s calls for a gun ban became even louder.</p><p><strong>From a Washington Times article entitled Bush aide urges weapons ban to slow Mexican drug war:</strong></p><blockquote><p><em> The former head of U.S. Customs and Border Protection called Monday for the U.S. to reinstitute the ban on assault weapons and take other measures to rein in the war between Mexico and its drug cartels, saying the violence has the potential to bring down legitimate rule in that country.</em></p><p><em> Former CBP Commissioner Robert C. Bonner also called for the United States to more aggressively investigate U.S. gun sellers and tighten security along its side of the border, describing the situation as &#8220;critical&#8221; to the safety of people in both countries, whether they live near the border or not.</em></p></blockquote><p><em> </em></p><p>Mr. Bonner&#8217;s comments, which included cites to the same debunked studies on gun trafficking as the Obama administration is pushing, came just days after a bi-national panel of former government officials and scholars issued a report recommending the reinstatement of the assault weapons ban.</p><p>Bonner, a former federal judge who also headed the U.S. Customs Service and the U.S. Drug Enforcement Administration (DEA) under the Republican administrations of Presidents George W. Bush and George H.W. Bush, said the still-raging battle &#8220;will determine who controls the legitimate institutions of government.&#8221;</p><p>I agree with that statement, but not as Mr. Bonner meant it. I believe that when it comes to this administation&#8217;s push for a new gun ban, the battle will determine whether government will be controlled by We the People, or by the world&#8217;s elitist power brokers.</p><p>President Obama has loaded his administration chock full of vehement gun ban extremists (most recently to head the Occupational Safety and Health Administration). The president has has already invested $700 million under the guise of reducing the illegal flow of guns and drugs across the border, and he recently reversed U.S. policy and said it would back launching talks on a United Nations treaty to regulate arms sales.</p><p>Clearly, despite a misleading headline published by The Hill (&#8221;<a
title="AmmoLand" href="http://thehill.com/homenews/administration/67833-holder-dials-back-commitment-to-assault-weapons-ban" target="_blank">Holder dials back his commitment to pushing ban on assault weapons</a>&#8220;), the administration is still very much focused on advancing the president&#8217;s anti-gun agenda.</p> <address>Chad D. class="wp-caption-text">National Rifle Association</p></div><p><strong>Washington, DC -</strong> -(AmmoLand.com)- On November 16, the NRA filed its brief with the U.S. Supreme Court as Respondent in Support of Petitioner in McDonald v. City of Chicago. The NRA brief asks the U.S. Supreme Court to hold that the Second Amendment applies to state and local governments through the Fourteenth Amendment.</p><p>The McDonald case is one of several that were filed immediately after last year&#8217;s decision in District of Columbia v. Heller, in which the Court upheld the Second Amendment as an individual right and struck down Washington, D.C.&#8217;s ban on handgun possession, as well as the capital city&#8217;s ban on keeping loaded, operable firearms for self-defense in the home.</p><p>The follow-up cases were filed by NRA and other organizations against Chicago and several of its suburbs.  Each of these suits was aimed at the same goal: establishing that the Second Amendment applies to state and local governments as well as the federal government.</p><p>In September, the Supreme Court agreed to consider the McDonald case, on appeal from the U.S. Court of Appeals for the Seventh Circuit. That court incorrectly claimed that prior Supreme Court precedent prevented it from holding in favor of incorporation of the Second Amendment. As we argued at the time, the Seventh Circuit should have followed the lead of the Ninth Circuit Court of Appeals decision in Nordyke v. King, which found that Supreme Court precedent does not prevent the Second Amendment from applying to the states through the Fourteenth Amendment&#8217;s Due Process Clause.</p><p>As a party in McDonald, the NRA is actively involved in this case and we believe our brief makes a clear and strong case in favor of incorporation of the Second Amendment</p><p>The McDonald case will be argued in February 2010.  NRA members should be proud of our efforts to bring this issue to the court&#8217;s attention through the many lawsuits we brought to overturn local bans on gun ownership and self-defense immediately after Heller.  We are hopeful that McDonald v. Chicago will achieve another major victory for gun owners&#8217; rights.</p><p><strong>About:</strong><br

About 25 gun owners showed up at the Sussex Board of Supervisors meeting last night.</p><p>Everyone who spoke, spoke in opposition to the proposed ordinance that would require special use permits for shooting ranges.</p><p>Many of the Board did not seem enthusiastic about the ordinance.  In the end they rejected the wording defining what a pistol range was and sent the issue back to the planning commission.</p><p>We may have to go out there one more time in the future for the whole concept to be put to rest, but I think if we keep the pressure up, the proposed ordinance will be defeated.</p><p><strong>About:</strong><br

class="wp-caption-text">Oregon Firearms Federation</p></div><p><strong>Medford , Oregon -</strong>-(AmmoLand.com)- In a case funded by the Oregon FIrearms Educational Foundation, Jane Doe Vs Medford School District, the court ruled that Oregon&#8217;s preemption statute does not protect employees from gun restrictions imposed on them by state employers.</p><p>This case, which got international attention, pitted a Medford school teacher against her employer. When it was learned that the teacher, Shirley Katz, possessed a concealed handgun license, her school and school district began a campaign of abuse and threats against her.  We agreed to take her case to court.</p><p>After the Circuit Court ruled that the school could, in fact, create rules to prevent her from possessing a self-defense firearm, we appealed.  The Court&#8217;s decision can be seen here.</p><p>It&#8217;s interesting that the Court continues to use and misunderstand the case of Starrett vs City of Portland, another case funded by OFEF.  In their decision they state  &#8220;In Starrett, the City of Portland leased Pioneer Square to a privately owned company, Entercom, which owned and operated a number of radio stations in the area. Id. at 536. Entercom leased the property in order to host a New Year&#8217;s Eve celebration. &#8221;</p><p>This is exactly the opposite of what happened. In fact, Entercom radio did not &#8220;lease&#8221; space from the city. The city PAID Entercom radio to run a City party on City property with taxpayer money. So once again, the Courts reach a conclusion based on incorrect former conclusions.</p><p><strong>About:</strong><br

As dealer inventories sell out, they will not be able to replace it except at the worthless pace of one gun a month. In a short time, there will be no handguns left for dealers to sell.”</p></blockquote><p>In the <a
title="AmmoLand" href="http://www.nj.com/news/index.ssf/2009/11/task_force_chief_says_new_nj_g.html" target="_blank">Star Ledger last week</a>, Task Force Chairman Robert Bernardi, Burlington County Prosecutor, addressed the need to amend the law.</p><blockquote><p>&#8220;As it stands now, retailers would be prohibited from purchasing guns from their suppliers. class="wp-caption-text">Ohioans For Concealed Carry</p></div><p><strong>Ohio -</strong>-(AmmoLand.com)- The 8th Ohio District Court of Appeals has overturned the trial court&#8217;s decision and ruled that Ohio Revised Code 9.68, which provided for statewide preemption of gun laws, to be unconstitutional as it pertains to rifles and shotguns and open carry. The 8th District court feels it applies only to concealed carry licensing laws.</p><p>Cleveland sued the State in March 2007 alleging that the preemption law violated home rule and that they should be able to ban &#8220;assault weapons,&#8221; prohibit open carry of firearms, maintain a gun registration scheme, and pass any such gun ordinance they wished. Ohioans For Concealed Carry and the National Rifle Association filed a joint motion to intervene, but that motion was denied and Cleveland lost at the trial court level on the strength of the Ohioans For Concealed Carry v. City of Clyde case where the Ohio Supreme Court ruled that R.C. 9.68 was constitutional because it was a &#8220;general law that is part of a comprehensive statewide legislative enactment.&#8221; Cleveland appealed their loss, and OFCC and the NRA appealed the denial to intervene.</p><p>In this ruling, the 8th District found that R.C. 9.68 was unconstitutional partially on the grounds of the 1993 Ohio Supreme Court case Arnold v. Cleveland which upheld an assault weapons ban, a case decided thirteen years before R.C. 9.68 was passed preempting such laws.</p><p>The Court agreed with Cleveland&#8217;s assertion that R.C. 9.68 violated the Home Rule provision of the Ohio Constitution which states:</p><p>Municipalities shall have authority to exercise all powers of local self-government and to adopt and enforce within their limits such local police, sanitary and other similar regulations, as are not in conflict with general laws.</p><p>Cleveland argued that R.C. 9.68 is unconstitutional because it is not a general law, despite the findings of the Ohio Supreme Court, and attempts to curtail the City’s police powers in matters other than the concealed carry of firearms.</p><p>In particular, they were concerned about Cleveland Codified Ordinance (C.C.O.) 627.08, possession of firearms by minors; C.C.O. 627.09, possessing deadly weapons on public property; C.C.O. 627.10, possessing certain weapons at or about public places; C.C.O. 627A.02, access to firearms, prohibiting children access to firearms; C.C.O. 628.03, unlawful conduct, prohibiting possession and sale of assault weapons; and C.C.O. 674.05, registration of handguns.</p><p>The State of Ohio countered that R.C. 9.68 read in conjunction with Substitute House Bill 347 did in fact demonstrate a comprehensive scheme to regulate firearms, as previously ruled in the OFCC v. Clyde case. The 8th District Court disagreed, saying that the OSC ruling only applies to concealed carry and that the Clyde case only referred to Section 9 of H.B. 12 (the original concealed carry bill) and not R.C. 9.68., though admitted that &#8220;the Clyde court impliedly upheld R.C. 9.68 as it relates to handguns.&#8221;</p><p>Therefore, the 8th District Court felt comfortable ignoring the Clyde ruling and applied R.C. 9.68 only to concealed carry laws because it was not &#8220;comprehensive&#8221; enough to be a General Law in their opinion because it &#8220;leaves unregulated: (1) the discharge of firearms, (2) the possession and sale of assault weapons, (3) the open carry of firearms on public property and public places, (4) the possession and use of firearms by minors, (5) the registration of handguns as required by the City, (6) the registrations and licensure of firearms dealers, (7) permit or licensing requirements before an individual purchases a handgun, and (8) background checks before the purchase or transfer of firearms.&#8221;</p><p><strong>O.R.C. 9.68 reads:</strong></p><blockquote><p>The individual right to keep and bear arms, being a fundamental individual right that predates the United States Constitution and Ohio Constitution, and being a constitutionally protected right in every part of Ohio, the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition. Except as specifically provided by the United States Constitution, Ohio Constitution, state law, or federal law, a person, without further license, permission, restriction, delay, or process, may own, possess, purchase, sell, transfer, transport, store, or keep any firearm, part of a firearm, its components, and its ammunition.</p></blockquote><p>The 8th District ignored &#8220;the general assembly finds the need to provide uniform laws throughout the state regulating the ownership, possession, purchase, other acquisition, transport, storage, carrying, sale, or other transfer of firearms, their components, and their ammunition&#8221; and only focused on the next sentence which left off the word &#8220;carrying.&#8221; The Court does not believe that &#8220;possess&#8221; and &#8220;transport&#8221; applies to carrying a firearm, therefore found that the City prohibiting open carry is legal.</p><p>The 8th District also found that &#8220;R.C. 9.68 does not establish police regulations but instead limits legislative power of municipal corporations&#8221; and &#8220;attempts to curtail the City’s home-rule police powers without enacting legislation to remedy the purported ill of a confusing &#8216;patchwork&#8217; of municipal regulations involving firearms.&#8221; Citing this shortfall, the Court found that 9.68 is not comprehensive and does &#8220;little to fill in the gaps&#8221; in what they see for laws regarding &#8220;firearm possession, use, transfer, and ownership&#8221; and &#8220;does not prescribe a rule of conduct upon citizens generally.&#8221;</p><p>Taking all of that into account, the 8th District ruled that &#8220;R.C. 9.68 fails to satisfy the general law test&#8221; and &#8220;that it is not a general law.&#8221; In another section, they ruled that it was an abuse of legislative power because it awarded attorney fees to any citizen who challenged a City ordinance if that ordinance was found to be violation of R.C. 9.68.</p><p>Ohioans For Concealed Carry strongly believes that the 8th District used flawed logic in determining that R.C. 9.68 is unconstitutional and that the Ohio legislature rightfully and legally passed R.C. 9.68 with the intention of not only preempting local laws regarding concealed carry, but all firearms laws in the state while lawfully granting municipalities the ability to regulate firearms discharges and zoning laws for commercial firearms sales.</p><p>The Ohio legislature was quite explicit that carrying firearms is a protected right as noted in the Ohio Constitution which states in Article 1 Section 4 that &#8220;the people have the right to bear arms for their defense and security.&#8221;</p><p>OFCC expects that Ohio Attorney General Richard Cordray will appeal the 8th District&#8217;s faulty decision to the Ohio Supreme Court and that the OSC will correctly rule that Statewide Preemption is a Constitutional and General law and halt the attempts of anti-gun administrations from denying gun rights to their citizens. OFCC will also continue our fight to not be shut out in our attempts to intervene and defend the gun rights of Ohio citizens.</p><p><strong>About:</strong><br

class="wp-caption-text">National Association for Gun Rights</p></div><p><strong>Virginia -</strong> -(AmmoLand.com)-These days, our soldiers aren&#8217;t even safe here at home stationed on secure military bases.</p><p>On November 5th, a lone gunman murdered 13 fully-trained, ready to deploy soldiers, and wounded 29 more, in the most shocking terrorist attack on American soil since 9/11.</p><p>How was Nidal Hasan, a psychologist, able to take down so many trained soldiers?  Because the government thinks its better to keep it’s armed service members unarmed . . .</p><p>That’s right.  Our military men and woman are banned from carrying the weapons they are trained and trusted to use in the heat of combat.</p><p>President Clinton authored this asinine policy back in 1993 when he declared all military bases “<em><strong>Gun Free Zones</strong></em>.”</p><p>As you know, “<em><strong>Gun Free Zones</strong></em>” do nothing but assure criminals, and now terrorists, that they will find unarmed victims defenseless against a homicidal rampage.</p><p>Maybe I’m crazy, but I’d rather the soldiers delivered a barrage of bullet to end Hasan’s attack the second he opened fire.</p><p>I’d rather Hasan was dead and the heroes he murdered were still alive.</p><p>But because of Clinton’s ingenious policy of an unarmed armed forces, this psychopath methodically executed soldier after soldier before a local traffic cop could arrive on the scene.</p><p>If we didn&#8217;t have “<em><strong>Gun Free Zones</strong></em>” and our armed forces were . . . I don&#8217;t know . . . class="wp-caption-text">Shooters Committee on Political Education</p></div><p><strong>Mineola, NY –</strong>-(AmmoLand.com)-  The Nassau County local law banning the possession of handguns mislabeled “deceptively colored” remains on hold indefinitely pending the outcome of a legal challenge by gun-rights activists.</p><p>In June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of &#8220;deceptively colored handguns” as a supposed danger to law enforcement.  The law originally banned all handguns except for those that are &#8220;black, grey, silver, steel, nickel or army green.&#8221; It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.</p><p>Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court (Index #: 013564/2008) to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.</p><p>The action sought a ruling that Nassau’s local law is invalid because it is “preempted” by New York State’s extensive gun control laws, which already ban “disguised guns.” Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.</p><p>The proceeding was brought on the day the law was to go into effect, and sought a temporary restraining order and an injunction to stay enforcement of the law. That led to Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. Further, filing of the action alone resulted in the Nassau County legislature amending the law to remove the prohibitions against gold plated, blued, and brown handguns.</p><p>The action is currently on appeal to the New York Supreme Court, Appellate Division, Second Department (Docket No. 2009-1468). The petitioners have retained attorney Robert Firriolo, a litigation partner in the New York office of Duane Morris LLP.</p><p>The local law challenged affects not only Nassau pistol licensees, but all New York gun owners and visitors to Nassau County. Anybody found with a banned handgun is subject to arrest and prosecution. The law is particularly hazardous to the many shooters who come into, or pass through, Nassau to participate in shooting events and have no way of knowing about this law. The suit was brought to protect the interests of all of law-abiding gun owners and dealers, most of whom are still unaware that many ordinary, popular and valuable handguns are banned. The law imposes a penalty of one year in jail and a $1000 fine.</p><p>The petitioners continue to express their gratitude to SCOPE, the Freeport R&amp;R Association Junior Club, SAFE, SASI, NCF&amp;G, and to all those individuals who have donated to help us succeed in this important appeal. The petitioners, though, are still seeking donations to help with the appeal of Chwick v. Mulvey, as we have requested 15minutes of Oral Argument time..</p><p>Please remember that a victory in this appeal may well be the springboard for challenging other burdensome and senseless New York gun control laws. In fact, Chwick v. Mulvey has already been cited in Albany County Appellate Division, Second Department, and the cite was positive on our points 3 &amp; 4 (Cites to Heller and NYS Civil Liberties, Second Amendment). Additionally, Chwick v. Mulvey, may be another doorway for incorporation of the Second Amendment by NYS. class="wp-caption-text">ICarry.org</p></div><p><strong>Rockford, IL -</strong>-(AmmoLand.com)- Gun ownership is increasing at an unheard of rate in the US this year.</p><p>The largest contributing factor to this is the fear that the Obama administration will attempt to pass new sweeping legislation that would ban certain types of guns based on their cosmetic appearances, like the so-called Assault Weapons ban that expired in 2004.</p><p>With 48 states having adopted concealed carry legislation, and the vast majority of those &#8211; 40 &#8211; have what is referred to as shall-issue licensing, meaning anyone who qualifies for a license or permit MUST be issued one.  8 states still have discretionary or more accurately discriminatory issue, it&#8217;s easy to see where this trend is headed.</p><p>The Supreme Court has ruled that individuals DO have the right to own and carry (keep and bear) arms for self-defense and other uses. The Supreme Court is also set to rule next year on whether or not, or to what extent, states can restrict this right. If the highest court follows the intentions of the founders of this country, &#8220;that every man be armed,&#8221; then we should see even more drastic reduction of the approx. 30,000+ gun laws on the books that have been completely ineffective at reducing crime, since criminals readily ignore the laws and illegally obtain and use guns in crimes regardless.</p><p>Truth is finally prevailing, and the right to protect yourself and your family is on a major comeback! With minimal training and practice, the average person can protect themselves very effectively.  It&#8217;s time for all of us to step up to the plate and take advantage of this trend.  There&#8217;s simply no need to let gun control get you down anymore!!!</p><p><strong>ICarry.org Update</strong><br
/> A lot is happening at ICarry.org.  After a short leave due to my personal obligations, I have now been able to dedicate myself to this cause full time.  By using the Internet, our website, and these simple newsletters in addition to other marketing, we&#8217;ve been able to come a long way in a short time.  I&#8217;m very thankful to the volunteers who have been helping with these tasks, and to the many people who have stepped up to help support what we&#8217;re doing with donations.</p><p>Right now we&#8217;re getting our store running.  In the next week it should be fully functional, and we will have a lot of neat things to offer.  The store will also help us bring in the revenue needed to keep going! By popular demand, high-quality car window stickers are being printed.  These stickers will look fantastic, last a lifetime, and they&#8217;re easily removable and re-stickable without leaving any residue.  It took some work, but I found the best ones I could, and you&#8217;ll see them start popping up on cars everywhere very soon.</p><p>We&#8217;ve also partnered with Gun Owners of America to help defend the right to keep and bear arms in a no-compromise fashion on the state and federal level.  Larry Pratt, the executive director of GOA, put it this way: &#8220;Illinois [and Wisconsin] has needed a take-no-prisoners group to defend the right to keep and bear arms. ICarry.org is that group.&#8221; We&#8217;re thankful for the kind words and look forward to working together to see that no new restrictions are placed on the ownership of firearms and remove as many of the unneeded current restrictions as possible.</p><p>We are also making really cool distributable business cards that everyone can use to raise awareness of the right-to-carry in Illinois and Wisconsin! Our survey showed that you wanted these, so we are putting out! These will be available as inexpensively as possible on our store in the next week or two just like the window decals.</p><p>Other than that, we&#8217;re working diligently to bring some nice new firearms for our One Gun a Month Giveaway.
