The event was held April 15 and 16 at the Downtown Marriott Hotel in Des Moines, Iowa.

Provided the firearms for which such services are rendered are: (1) not owned, in whole or in part, by the dealer-gunsmith; (2) returned by the dealer-gunsmith to the importer or manufacturer upon completion of the manufacturing processes, and not sold or distributed to any person outside the manufacturing process; and (3) already properly identified/marked by the importer or manufacturer in accordance with Federal law and regulations.

ATF Rul. 2010-10
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received inquiries from firearms industry members asking whether licensed dealer-gunsmiths who would be engaged in the business of repairing, modifying, embellishing, refurbishing, or installing parts in or on firearms for, or on behalf of a licensed importer or manufacturer are required to be licensed as manufacturers and abide by the requirements imposed on manufacturers.

In recent years, licensed firearms importers and manufacturers have contracted certain firearms manufacturing activities on their behalf to specialized licensed firearms manufacturers. Such activities include applying special coatings and treatments to firearms (e.g., bluing, anodizing, powder-coating, plating, polishing, heat/chemical treating). This has caused confusion over which importers and manufacturers are required to identify/

mark firearms and maintain permanent records of importation or manufacture. For this reason, licensed importers and manufacturers have asked whether licensed dealer-gunsmiths, who are not required to mark firearms and keep production records, may engage in such manufacturing activities on their behalf.

The Gun Control Act of 1968 (GCA), Title 18, United States Code (U.S.C.), section 923(a), provides, in part, that no person shall engage in the business of importing, manufacturing, or dealing in firearms until he has filed an application with and received a license to do so from the Attorney General. A “firearm” is defined by 18 U.S.C. 921(a)(3) to include any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive, and the frame or receiver of any such weapon. The term “manufacturer” is defined by 18 U.S.C. 921(a)(10) as any person engaged in the business of manufacturing firearms or ammunition for purposes of sale or distribution. As applied to a manufacturer of firearms, the term “engaged in the business” is defined by 18 U.S.C. 921(a)(21)(A) and 27 CFR 478.11, as a “person who devotes time, attention, and labor to manufacturing firearms as a regular course of trade or business with the principal objective of livelihood and profit through the sale or distribution of the firearms manufactured.” The term “dealer” is defined by 18 U.S.C. 921(a)(11)(B) and 27 CFR 478.11 to include “any person engaged in the business of repairing firearms or of making or fitting special barrels, stocks, or trigger mechanisms to firearms …” (i.e., a gunsmith). As applied to a gunsmith, the term “engaged in the business” is defined by 18 U.S.C. 921(a)(21)(D) and 27 CFR 478.11 as a “person who devotes time, attention, and labor to engaging in such activity as a regular course of trade or business with the principal objective of livelihood and profit …”

In Revenue Ruling 55-342 (C.B. 1955-1, 562), ATF’s predecessor agency interpreted the meaning of the terms “manufacturer” and “dealer” for the purpose of firearms licensing under the Federal Firearms Act, the precursor statute to the GCA. It was determined that a licensed dealer could assemble firearms from component parts on an individual basis, but could not engage in the business of assembling firearms from component parts in quantity lots for purposes of sale or distribution without a manufacturer’s license. Since then, ATF has similarly and consistently interpreted the term “manufacturer” under the GCA to mean any person who engages in the business of making firearms, by casting, assembly, alteration, or otherwise, for the purpose of sale or distribution. Such persons must have a manufacturer’s license under the GCA, maintain permanent records of manufacture, and submit annual manufacturing reports. The Revenue Ruling did not address whether dealer-gunsmiths who engage in the business of repairing, modifying, embellishing, refurbishing, or installing parts in or on firearms for, or on behalf of an importer or manufacturer are engaged in the business of manufacturing firearms requiring a manufacturer’s license.

Manufacturing
ATF’s long-standing position is that any activities that result in the making of firearms for sale or distribution, to include installing parts in or on firearm frames and receivers, and processes that primarily enhance a firearm’s durability, constitute firearms manufacturing that may require a manufacturer’s license. In contrast, some activities are not firearms manufacturing processes, and do not require a manufacturer’s license. For example, ATF Ruling 2009-1 (approved January 12, 2009) explained that performing a cosmetic process or activity, such as camouflaging or engraving, that primarily adds to or changes the appearance or decoration of a firearm is not manufacturing. Likewise, ATF Ruling 2009-2 (approved January 12, 2009) stated that installing “drop-in” replacement parts in or on existing, fully assembled firearms does not result in any alteration to the original firearms. Persons engaged in the business of these activities that do not constitute firearms manufacturing need only obtain a dealer’s license.

Although installing parts in or on firearms, and applying special coatings and treatments to firearms are manufacturing activities, the definition of “manufacturer” in 18 U.S.C. 921(a)(10) and 27 CFR 478.11 also requires that a person be “engaged in the business” before the manufacturer’s license requirement of section 923(a) applies. Thus, a person who manufactures a firearm will require a manufacturer’s license if he/she devotes time, attention, and labor to such manufacture as a regular course of trade or business with the principal objective of livelihood and profit through the sale or distribution of the firearms manufactured. If the person is performing such services only for a customer on firearms provided by that customer, and is not selling or distributing the firearms manufactured, the person would be a “dealer” as defined by 18 U.S.C. 921(a)(11)(B) and 27 CFR 478.11, requiring a dealer’s license, assuming the person is “engaged in the business” as defined in 18 U.S.C. 921(a)(21)(D) and 27 CFR 478.11 (i.e., “gunsmithing”).

Gunsmithing
A dealer is “engaged in the business” of gunsmithing, as defined in 18 U.S.C. 921(a)(21)(D) and 27 CFR 478.11, when he/she receives firearms (frames, receivers, or otherwise) provided by a customer for the purpose of repairing, modifying, embellishing, refurbishing, or installing parts in or on those firearms. Once the work is completed, the gunsmith returns the firearms, and charges the customer for labor and parts. As with an individual customer, a licensed dealer-gunsmith may receive firearms (properly identified with a serial number and other information required by 27 CFR 478.92) and conduct gunsmithing services for a customer who is a licensed importer or manufacturer. A dealer-gunsmith is not “engaged in the business” of manufacturing firearms because the firearms being produced are not owned by the dealer-gunsmith, and he/she does not sell or distribute the firearms manufactured. Once the work is completed, the dealer-gunsmith returns the firearms to the importer or manufacturer upon completion of the manufacturing processes, and does not sell or distribute them to any person outside the manufacturing process. Under these circumstances, the licensed dealer-gunsmith is not “engaged in the business” of manufacturing firearms requiring a manufacturer’s license.

In contrast, a dealer-gunsmith may make or acquire his/her own firearms, and repair, modify, embellish, refurbish, or install parts in or on those firearms. If the dealer-gunsmith then sells or distributes those firearms for livelihood and profit, the dealer-gunsmith is engaged in his/her own business of manufacturing firearms. A person engaged in the business of manufacturing firearms for sale or distribution is required to be licensed as a manufacturer, identify/mark all firearms manufactured, maintain permanent records of manufacture, submit annual manufacturing reports, and pay any taxes imposed on firearm manufacturers. A licensed dealer-gunsmith who becomes licensed as a manufacturer must also segregate all firearms manufactured for that business separately from firearms for which gunsmithing services are being performed.

To facilitate inspection and ensure that ATF can determine that a licensed dealer-gunsmith is not engaged in the business of manufacturing firearms for his own sale or distribution without a manufacturer’s license, licensees may take the following steps:

1. maintain a copy of the current, active license of all contracted licensees;
2. maintain a copy of the contract and all instructions for gunsmithing services rendered;
3. maintain a copy of the invoices for gunsmithing services;
4. timely and accurately reflect all firearms acquisitions and dispositions consistent with the contract for gunsmithing services rendered; and
5. in the case of a licensed dealer-gunsmith, maintain required bound acquisition and disposition records for all gunsmithing activities separate from other dealer’s records.

Unless licensees take these steps, ATF may presume that a particular dealer-gunsmith is engaged in his own business of manufacturing firearms for sale or distribution without a manufacturer’s license, and take corrective administrative or other enforcement action.

Identification of Firearms
The GCA at 18 U.S.C. 923(i) provides, in part, that licensed manufacturers and importers must “identify” each firearm manufactured or imported by a serial number in the manner prescribed by regulation. Federal regulations at 27 CFR 478.92(a)(1) further require importers and manufacturers to identify each firearm by engraving, casting, stamping (impressing), or otherwise conspicuously placing the individual serial number and certain additional information – the model (if designated), caliber/gauge, manufacturer’s name, and place of origin on the frame, receiver, or barrel – at a minimum depth. Section 478.92(a)(2) specifies that a “firearm frame or receiver that is not a component part of a complete weapon at the time it is sold, shipped, or otherwise disposed of … must be identified as required by this section.”

Because dealer-gunsmiths are not required to identify firearms manufactured, it is incumbent upon the importer or manufacturer, prior to shipping firearms to a dealer-gunsmith for gunsmithing services, to mark them with a serial number and other required information. With regard to frames and receivers shipped separately, section 478.92(a)(2) provides, in part, that the manufacturer or importer must mark all frames and receivers prior to shipment with all information required by section 478.92 (i.e., serial number, model (if designated), caliber/gauge, manufacturer’s name, and place of origin). This will ensure that the frames and receivers can be traced by ATF in the event they are lost or stolen during the manufacturing process.

Held, any person licensed as a dealer-gunsmith who repairs, modifies, embellishes, refurbishes, or installs parts in or on firearms (frames, receivers, or otherwise) for, or on behalf of a licensed importer or licensed manufacturer, is not required to be licensed as a manufacturer under the Gun Control Act, provided the firearms for which such services are rendered are: (1) not owned, in whole or in part, by the dealer-gunsmith; (2) returned by the dealer-gunsmith to the importer or manufacturer upon completion of the manufacturing processes, and not sold or distributed to any person outside the manufacturing process; and (3) already properly identified/marked by the importer or manufacturer in accordance with Federal law and regulations.

This ruling is limited to an interpretation of the requirements imposed upon importers, manufacturers, and dealer-gunsmiths under the Gun Control Act of 1968, and does not apply to persons making or manufacturing firearms subject to the National Firearms Act, 26 U.S.C. 5801 et. seq.

Revenue Ruling 55-342, C.B. 1955-1, 562, is hereby clarified. To the extent this ruling may be inconsistent with any prior letter rulings, they are hereby superseded.

The ruling will also affect licensed manufacturers and licensed importers who have contracts with specialized gunsmiths to perform a variety of processes involved in producing firearms.

The ruling holds that licensed firearms dealer-gunsmiths are not engaged in a manufacturing business, and are not required to hold a manufacturers license, under certain specified conditions.

The ruling was issued to address modern firearms manufacturing processes, which often involve a number of contractors other than the manufacturer whose name is marked on the firearm.

Rifle Bore Cleaning - Advice and Tips

Des Moines, Iowa – -(Ammoland.com)- There have been a number of claims lately, of the latest greatest goop or gunk to use in the bore of your firearm. The claims vary from greater velocity, lower pressures, easier cleaning, longer barrel life, improved accuracy and often combination’s of the above.

To me these are sales hype and can easily be refuted just by reading the instructions and disclaimers. Some require you use another un-related product to “prepare” the bore to accept their product and often those items are proven over time to work on their own, without additional compounds or supplemental work.

One thing you will see in common among these processes is the requirement that the process be repeated at certain intervals such as every 1000 rounds. While that sounds like a nice round number and easily tracked, what does that also say about the process?

Aside from the added cost of $40 or so dollars to the cost of a thousand rounds, you have gradually diminishing returns on your initial investment. It also means you have a gradual deviation in the benefits of the product you have painstakingly applied to your bore. That has to mean gradual reduction of velocity gains, higher relative pressures, a continued loss or a reduction in barrel life, etcetera. More important is the fact that you have introduced a variable into your firearm that does not allow for consistency.

Consistency is the key to repeatability and determining the point of impact from shot to shot and ultimately it is the prime determining factor for accuracy.

Granted as the bore gets dirty from firing the gun it must be cleaned and then repeated each time it is determined to be dirty. This is a fact of life in firearms and shooting in general. There are some ways around the tedious chore of cleaning each time but it involves polishing the bore to keep the copper or lead from building up as rapidly as it normally would.

The process I refer to is JB Bore paste or JB Bore Bright.

When used properly and cleaned out of the bore afterward, this is the most effective way I’ve found to condition a bore before even the first round is fired. By using VFG felt bore pellets the process is even faster and more efficient. The felt pellets hold an even amount of JB around the surface of the pellet and they conform to the land/groove configuration of the bore. Passing the combination thru the bore about 50 to 60 times each way will burnish the surface of the lands and grooves so they don’t drag the jacket of the bullet and cause transfer of the copper to the barrel interior. Shooting sessions can last longer before fouling becomes evident or accuracy begins to degrade. If you have the added benefit of access to a bore scope you can actually see the tops of the lands take on a smoother appearance. Using JB Bore paste is also a great way to remove molybdenum deposits left by moly coated bullets.

Recently I saw an article espousing the use of JB and another couple of additives to coat live rounds to fire lap bores and make them smoother. I would never recommend putting any type of liquid, paste, cream, salve or other obstruction in your gun’s bore and then firing a high pressure rifle round down the bore. If you think about it you will realize you would be flirting with possible disaster to do this type of action as it replicates having water or mud in the bore on firing.

Provo, Utah --(Ammoland.com)- 12 gauge pump shotguns have been part of the Law Enforcement arsenal for a long time, and patrol rifles are becoming more commonplace, with the AR-15, M4 or some variant being the most common.

It is no secret that I am a proponent of the patrol rifle, as anything a handgun can do, a rifle can do better, and from a longer distance.

As more and more of America’s LE Officers are being confronted with rifles (the semiauto AK-47, SKS and variants being the most common), it’s time to rethink operational priorities.

Early in my LE career, when the 12 gauge pump was the standard LE long gun, you could always tell the rookies (myself included) from the veterans. The rookies would go dashing off to the scene of a shots fired or man with a gun call, where the veterans would always take the few seconds to get to the trunk, take out the 12 gauge pump, and maybe grab a pocketful of extra buckshot or slugs.

Therein lies a lesson:

Don’t take a handgun to a long gun fight.
Now, I can hear the cyber moaning and wailing already as I type this. “My department will never allow… My Chief will never go for…. The community will be in an uproar….”, etc., etc. All I can say is, I never thought I’d see the day when fully geared up NYPD ESU Officers would be visibly present at major infrastructure locations in Manhattan, wearing M4’s, full raid vests including a Kevlar lid, but that day is here. If you don’t ask, you don’t get. I’m not making light of any department’s struggles with getting a patrol rifle program accepted and funded, as I have assisted many departments with getting their programs off the ground and know how difficult it is. My point is, more and more of America’s finest are being gunned down with a rifle chambered in 7.62 X 39 COMBLOC. When facing a rifle with a 30 round box magazine attached, even your favorite high capacity 9mm / .357 SIG / .40 S&W / .45 ACP is not “enough gun”. You need a long gun.

Maximizing Patrol Rifle Reliability:
The AR-15 / M4 (or some variant) is the most common patrol rifle, so let’s focus on it first. First, the direct gas impingement system invented by Eugene Stoner is an inherently high maintenance system. Anyone who has spent the better part of an evening attempting to scrape the last bit of carbon fouling off the bolt tail or the corresponding recesses in the bolt carrier knows what I am talking about.

Which brings up an operational question: How often & who will perform routine preventative maintenance on the issued rifles? The Stoner system also requires a fair amount of lubrication, particularly once you start firing it, as the gas blowing back onto the bolt has a tendency to burn off any lubrication on the bolt’s gas rings quickly. Here in the Southwest, where the air temperatures have been above 100 degrees F all week, the temperature inside a police cruiser’s trunk is hot enough to bake a pizza. Almost every patrol rifle that I have seen taken directly out of a cruiser’s trunk has been bone dry and badly in need of lubrication. Routine maintenance is critical if the rifle is going to function reliably.

Another area to look at closely is the patrol rifle’s magazines. I covered magazine function checks in a previous article, but suffice it to say that just previous to the last national high capacity magazine ban, anybody with aluminum sheet metal and a spot welder was cranking out AR-15 magazines. Even the original mil-spec magazines were intended to be used just a few times, then discarded. I personally run only stainless steel mags with a military phosphate or nitride finish. If a rifle magazine is not feeding properly due to a split back seam (common) or bent feed lips, take it out of inventory and destroy it.

Patrol Rifle Function Test:
Make certain that there is no live ammunition in the rifle or associated magazines. Again, I find a physical chamber check going up through the mag well faster and more accurate than a visual check.

1. Let the bolt go forward.
2. Insert a mag and lock it into the mag well.
3. Pull back smartly on the charging handle. The bolt should lock to the rear. If it does not, check the orientation of the magazine springs. Unlike most pistol magazines, the spring in most AR-15 mil-spec mags is attached to the follower and is difficult to orient backward. But, if it is humanly possible…
4. Push the charging handle forward into the locked position.
5. Push the magazine release button. The magazine should fall free under its own weight. If it does not, it could be due to either a bent magazine tube OR the magazine release catch has been screwed too far into the mag well. If you have the same problem with all of your mags, try backing off the catch arm one full turn and repeat the test.
6. Slap the bolt release. The bolt should fly forward sharply and lock up into the rear of the barrel.
7. Point the muzzle in a safe direction and put the safety on “Safe”. Pull the trigger, hard. Nothing should happen.
8. Put the safety on “Fire”. Press the trigger. You should have a normal trigger press and hammer fall. Keep the trigger depressed.
9. Rack the charging handle.
10. Let the trigger go forward slowly until you hear and feel the very loud disconnector reset.
11. Press the trigger again.
12. Attempt to put the safety on “Safe”. With the hammer down on an AR-15 and variants, the safety cannot be put on safe.
13. Repeat for all remaining magazines.

Castle Rock, CO --(Ammoland.com)- I often see articles and post explaining how to assemble an AR15 rifle. While I find many of these articles to be very informative, most don’t touch on the details that are required to build a reliable, accurate rifle.

First let’s examine what a reliable AR15 must be able to do. A reliable Ar15 must first and foremost fire every time you pull the trigger. Whether in a life or death situation, competition shooting or just plinking, your weapon needs to work properly. It must also hit what you are aiming at.

Some of the main reasons an Ar15 will miss fire, is that poor quality parts were used. Saving a few dollars on a bolt assembly can mean the difference between a reliable rifle and one that consistently has problems.

When building a rifle from scratch, you should have a sort of blue print. You should know what parts you are going to use from the outset as opposed to just buying parts as you find them on sale. This is not to say you have to buy all your parts at once. But instead, know what you going to buy and why you’re using that particular part.

I have seen several instances where someone bought a part because it was cheap. This later caused problems in the rifle. One guy bought a light weight buffer and buffer spring because it was very cheap. Upon completing the rifle, he went to the range only to find that he couldn’t get two rounds in a row through it because it was short cycling. The buffer and spring did not match the rest of the parts he was using.

You should know how and what you will be using your rifle for. This will affect what parts you use to build the rifle. For instance, if you plan to shoot steel cased ammo in your rifle, you will have much more success with a 5.56 NATO chambered rifle than a .223 chambered rifle.

You will also need a heavy duty SOPMOD style ejection spring kit. This will insure that you get a successful shell extraction each and every time you fire the weapon.

Consider Accuracy
Another thing to consider is how important accuracy is. AR15s vary in accuracy by quite a bit. They can range anywhere from ¼ MOA to 3 MOA. A lot of the accuracy obviously has a lot to do with the barrel you choose. A barrel does not have to cost $500.00 to be a good, accurate barrel. You can achieve a sub 1 MOA with a mid range cost barrel. And contrary to popular belief, a longer barrel is not a whole lot more accurate than a shorter barrel in most cases. What you may gain in accuracy will be lost in mobility and weight.

When thinking about how accurate you weapon needs to be, consider the mission of the weapon. If it is a combat or tactical competition rifle, you probably what something you can group a lot of rounds quickly in a small area as opposed to one shot at a time in a ¼ inch hole. There are several things that can help in this area. A gas piston system will help with faster target reacquisition as will a muzzle break/compensator. There are several products available to modify the receiver extension/buffer tube as well that will reduce felt recoil.

A high quality trigger and lower parts kit can also aid in requiring your target quickly. I don’t recommend a two stage trigger for a combat or tactical competition rifle. Instead, I like a short pull single stage trigger with about 4 lbs. or less of resistance.

Reliable feed is another area that needs to be addressed. There are a lot of low cost lower receivers on the market that are very good. There are a few that are only good for paper weights. A good lower should either be forged or billet. Never use a cast lower receiver. They are unreliable and weak.

A quality BCG is very important to reliable feeding. This is what is going to push the round into the chamber and lock it into place. A poorly manufactured BCG will be unreliable and possibly dangerous to the operator and other friendlies in the area.

The upper receiver may or may not have M4 style feed ramps. In today’s market, I see no reason not to have M4 feed ramps at least in the chamber. One problem we see a lot is the fit between the M4 cuts on the upper receiver and the M4 cuts on the chamber matching up. An improper fit will cause miss feeds and jams. This can be corrected a couple different ways. If you’re mechanically inclined, you may be able to fix the problem yourself. If not, take your rifle to a qualified gun smith or armorer to fix the problem.

These are just a few things that should be considered when starting to build your own AR15 rifle.

Ken passed away on August 30th after battling cancer at the age of 71.

We’re told sending emails and communications out to our industry is like “preaching to the choir”. We don’t think so – for not every person in the choir is singing. Also, no one person represents the whole choir. Each individual is but one voice. We must all pull together, not necessarily speaking with one voice but supporting one score of music. None of us can afford to sit around and watch while one gun is banned and think that as long as it does not affect me, “they’ll never go after my sport”.

Well, open your eyes. While we were all layin’ back, the EPA is gearing up to ban lead.

Check out this report from NSSF, our National Shooting Sports Foundation.  This influences all our shooting sports plus all our police. The challenge that America is throwing at our feet is for us to stand up and start to sing…start to sing about individual rights our Constitution grants us.

Among those rights is a really important one: to hold our elected representatives accountable to us, their constituents and the folks who voted for them, for their actions. To allow us to fulfill the American dream and be successful on our terms. This is the torch that Pete and I have chosen to pick up and we challenge you to pick it up as well. We must all be heading in the same direction – the right direction – and we must come together to make them listen to us.

We cannot get bothered by distracting petty internal disagreements. Frankly, the enemy is at the gate and knocking darned loudly!!

Des Moines, Iowa – -(AmmoLand.com)- Students from the 3rd year Gunsmithing program at Trinidad State Junior College – sponsored by Brownells - donated their time to help shooters at the recent Black Powder Cartridge Rifle National Silhouette Championships.

The students repaired guns during the event, held at the NRA’s Whittington Center Range near Raton, New Mexico.

The Brownells-sponsored program is designed to give advanced students real-world experience in a working gunshop. The Whittington Center experience added valuable knowledge under the time pressure of helping a shooter get back to competition.

“This is exactly the kind of things the 3rd Program was designed to do – get the students hands-on experience solving real gun repair problems,” said Brownells President, Pete Brownell.

The TSJC gunsmiths did a variety of work on almost 40 guns belonging to the 200 competitors in the event.

Common Sense BATFE Reform Gathers Steam

Charlotte, NC --(Ammoland.com)-As part of his business, Virginia firearm dealer Allan Broughman often customized rifles for customers. But in 2006, an inspector from the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) observed Broughman “assembling a barrel, a receiver and a stock for a customer.” Since federal law specifically allows dealers to engage in “making or fitting special barrels, stocks or trigger mechanisms to firearms,” Broughman was surprised when the BATFE accused him of “manufacturing” a firearm without a manufacturer`s license.

Now, Broughman is fighting the agency in court with the help of NRA-ILA.

Broughman`s difficulties stem from just one of the BATFE`s many odd legal interpretations. In another example that affects many gunsmiths, the agency says that bluing, parkerizing or Teflon-coating a firearm amounts to “manufacturing,” while camouflaging a firearm by painting or dipping does not. To say the least, navigating rulings like this can quickly become confusing.

Fortunately, a large number of members of Congress have been inspired to act on this issue. Reps. Steve King, R-Iowa, and Zack Space, D-Ohio, and Sens. Mike Crapo, R-Idaho, and Patrick Leahy, D-Vt., have introduced H.R. 2296 and S. 941, the “Bureau of Alcohol, Tobacco, Firearms, and Explosives Reform and Firearms Modernization Act,” co-sponsored by 217 members of the House and 24 members of the Senate. The bills are based upon several previous reform bills discussed in the April 2008 ILA “Political Report.”

Making clear that dealers can do routine gunsmithing work without being “manufacturers” is just one of the problems H.R. 2296 and S. 941 would correct. Another is the BATFE`s misinterpretation of what constitutes a “willful” violation of federal gun laws. The Firearms Owners` Protection Act of 1986–passed in response to a previous wave of troublesome actions by the agency–allows the BATFE to revoke a dealer`s license only if the dealer’s violations are “willful.” But over the years, the BATFE has interpreted “willful” violations to include minor clerical errors. H.R. 2296 and S. 941 would require that a dealer “knew of a legal duty, and engaged in the conduct knowingly and in intentional disregard of the duty” before his license could be revoked.

In addition to protecting gun dealers from overreach, H.R. 2296 and S. 941 would protect gun owners from unknowingly ending up in a gun registration system. The bills would permanently codify longstanding appropriations amendments that prohibit the BATFE from creating an electronic database of gun owners based on records turned in by dealers who have gone out of business or who have had their licenses revoked.

The bills would also clean up a host of lesser problems. For example, it would correct a drafting error in the federal law that currently requires a person under the age of 18 to have written permission from a parent or guardian to use a handgun for a variety of lawful purposes–;even when the parent or guardian is directly supervising the use of the handgun. (Fortunately, that provision of the law has rarely, if ever, been enforced.) And the bills would give a person taking over a firearm business (such as a family gun store) a grace period to fix problems in the business`s records, rather than punishing him for the previous owner`s mistakes.

Another provision heavily attacked by anti-gun groups, such as the Brady Campaign and Violence Policy Center, would create a 60-day grace period for ex-dealers to liquidate their inventories. Anti-gun groups denounce this as a “fire sale loophole,” even though all sales would still be subject to the usual background check and record keeping requirements. And, of course, New York City Mayor Michael Bloomberg`s group, Mayors Against Illegal Guns, has sent a letter to Congress opposing the new bills.

This just proves that the gun control crowd wants the number of dealers reduced in order to reduce the number of guns sold in America. Longtime NRA members will remember that burdensome regulations imposed during the Clinton administration cut the number of licensed gun dealers (mostly small businesses) by more than half.

With wide bipartisan support in both houses of Congress, H.R. 2296 and S. 941 could be historic victories for gun owners in the tradition of the Firearms Owners` Protection Act of 1986. But in the coming days we`ll need the support of NRA members to achieve this goal. Additional ‘Gunsmithing Business Practices’ and ‘Gunsmithing Shop Management’ modules will be taught year-round by experts directly involved in the industry. Working gunsmiths, gun shop owners and managers can choose to attend modules of particular interest to them.

“Our intent is to open and operate a real life gun shop with third-year students who will provide top quality gun repair, parts, and services for gun owners, collectors and hunting and shooting sports enthusiasts. ATF Redefines "Transfers" of Firearms

NEWTOWN, Conn --(AmmoLand.com)- Reversing an interpretation of the Gun Control Act that has been on the books for more than four decades, ATF posted a ruling declaring any shipment of a firearm by a manufacturer (FFL) to any agent or business (e.g., an engineering-design firm, patent lawyer, testing lab, gun writer, etc.) for a bona fide business purpose to be a “transfer” under the Gun Control Act of 1968.

As a consequence, legitimate business-related shipments will now require the recipient to complete a Form 4473 and undergo a Brady criminal background check. In many instances, these requirements will force shipments to a third party, thereby lengthening the process and the time that the firearm is in transit.

ATF officials have acknowledged this is a radical change from ATF’s long-standing interpretation that this was not a “transfer” under the Gun Control Act that was set forth in a 1969 ruling (“Shipment or Delivery of Firearms By Licensees to Employees, Agents, Representatives, Writers and Evaluators.”) and further clarified in a 1972 ruling.

In other words, ATF is now saying its long-standing rulings, issued shortly after the Gun Control Act was enacted, were wrong. ATF should be required to explain why it took 42 years to decide that its original understanding and interpretation of the Gun Control Act is now somehow wrong. ATF appears to be under the mistaken impression that the Brady Act of 1993 changed what constitutes a “transfer” under the Gun Control Act. Even if this were true - and it is not – then ATF should be required to explain why it took 17 years to figure this out.

ATF itself admits that neither the Gun Control Act nor the Brady Act defines “transfer.” There is simply nothing in the Brady Act or is there any other legal reason that compels ATF to now reject 40 years of precedent.

For more than four decades manufacturers have shipped firearms to agents for bona fide business purposes. ATF is unable to identify a single instance during the past 40 years where a single firearm shipped in reliance upon ATF’s rulings was used in a crime. This unwarranted reinterpretation of the law will cause significant disruption and additional costs for industry members and increase the cost of doing business, while doing nothing to advance public safety.
