title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- The Senate just passed the repeal of One Handgun a Month by 21 to 19!</p><p>The House had already passed it.</p><p>The Governor said he would sign such a bill, so barring something truly bizarre happening, the One Handgun a Month repeal will go on to become law in the next month or so and will become effective on July 1st.</p><p>We will continue to watch the One Handgun a Month bills as they now flow through the opposite House.</p><p>The albatross is almost dead.</p><p><strong>About:</strong><br

Now, the gun ban lobby is making one final push to try and defeat the bill on the Senate floor.</p><p>There are five state senators upon which gun owners need to concentrate their efforts over the next critical hours.</p><p><strong>They are:<br

title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- <em><strong>Contact Your Senators Now:</strong></em> In a long meeting of the Senate Courts of Justice Committee today, two important pro-rights bills were reported out of the committee and are now headed to the Senate floor. Both bills are top priorities of VSSA&#8217;s legislative agenda.</p><p>First is SB 323, Senator Bill Carrico&#8217;s bill to repeal Virginia&#8217;s Handgun Rationing law. The vote was 8-7 on the GOP-controlled committee, with Sen. John S. Edwards, D-Roanoke, voting for passage with seven Republicans.</p><p>Please contact the following Senators and thank them for their vote in favor or your rights:</p><p>Edwards, Obenshain, McDougle, Stuart, Vogel, Stanley, Reeves, Garrett</p><p>Also reported out of committee was SB 4, Senator Stuart&#8217;s Castle Doctrine bill. It was reported on a party line vote of 8-7, with Senator Norment being absent and the GOP members casting a yea vote for him. It remains to be seen if Senator Norment actually supports the bill or whether he will re-refer it back to committee when it gets to the floor.</p><p>Please contact the following Senators and thank them for their vote in favor of your right to self-defense:</p><p>Norment (Chairman), Obenshain, McDougle, Stuart, Vogel, Stanley, Reeves, Garrett</p><p>Also passed by the committee was SB 67, Senator Stanley&#8217;s bill to remove the option for localities to require fingerprints for concealed handgun permit applications. A substitute bill passed the committee.</p><p><strong>Voting with gun owners were:</strong></p><p>Edwards, Obenshain, McDougle, Stuart, Vogel, Stanley, Reeves, Garrett</p><p>Please contact your senator now and urge them to support SB 323 and SB 4, and SB 67. All three bills will be on the floor for a final vote on Friday or Monday. VSSA will keep you posted before the final vote is scheduled.</p><p>Additionally, a number of bills are scheduled to be heard Thursday evening in House Militia, Police and Public Safety Subcommittee #1. Please contact members of this Subcommittee and respectfully request that they oppose HB 364 and HB 458 and support HB 20, HB 22, HB 26, HB 375 and HB 940.</p><p><span
style="text-decoration: underline;"><strong>Bills to be considered in the subcommittee Thursday:</strong></span></p><p><strong>Anti-Gun Legislation:</strong></p><ul><li>House Bill 364 would prohibit the private sales of firearms at gun shows by requiring that all sales conducted at a gun show go through a federally licensed dealer. Make no mistake, if passed, supporters of this legislation will soon be calling for a ban on all private sales in Virginia.</li><li>House Bill 458 seeks to weaken Virginia&#8217;s preemption law by allowing localities to adopt an ordinance that prohibits firearms, ammunition, or components, or a combination thereof, in libraries owned or operated by the locality.</li></ul><p><strong>Pro-Gun Legislation:</strong></p><ul><li>House Bill 20 would update Virginia&#8217;s Emergency Powers doctrine by adding lawful carrying and transportation to the list of actions that cannot be prohibited during a declaration of emergency.</li><li>House Bill 22 would establish that no locality or entity may participate in compensated consfiscation schemes (gun &#8220;buyback&#8221;) where individuals are given anything of value or money in exchange for surrendering a firearm to the locality unless the governing body first passes an ordinance authorizing the gun &#8220;buyback.&#8221; This legislation also requires that any locality holding gun &#8220;buybacks&#8221; sell the firearms to a federally licensed dealer &#8220;or be disposed of in any appropriate manner&#8221; if they could not be sold.</li><li>House Bill 26 would allow a court to waive a $25 dollar fine upon presentation of the permit to the court, if a person fails to display his concealed handgun permit when requested by a law enforcement officer.</li><li>House Bill 375 would prohibit localities from adopting any workplace rule that prevents an employee from storing a lawfully possessed firearm and ammunition in his locked motor vehicle. The firearm must be in a secured container or compartment in the vehicle.</li><li>House Bill 940 repeals Virginia&#8217;s handgun rationing which prohibits the purchase of more than one handgun in a thirty-day period.</li></ul><p><strong>About:</strong><br

href="http://www.njleg.state.nj.us/2012/Bills/A1000/857_I1.PDF" target="_blank">Assembly Bill 857</a> was introduced.</p><p>Introduced by Assemblywoman Alison Littell McHose (R-24), A 857 would repeal New Jersey’s law which allows residents to purchase only one handgun per month.</p><blockquote><p>Current law states, “A dealer shall not knowingly deliver more than one handgun to any person within any 30-day period.”</p></blockquote><p>Supporters of gun rationing claim that this law is needed to prevent criminals from buying large quantities of handguns for illegal resale.</p><p><strong>The following are three reasons why gun rationing should be repealed:</strong></p><ol><li>Criminals do not buy firearms from licensed firearm dealers (FFL’s), who are required to clear a purchaser through the National Instant Criminal Background Check System (NICS).</li><li>Firearm dealers are required to report to the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) and state or local law enforcement officials any person who buys more than one handgun in a five-day period.</li><li>Under the federal law, interstate handgun sales have been prohibited since 1968.</li></ol><p>New Jersey’s gun rationing law only affects law-abiding gun owners and does nothing to prevent criminals from breaking a law they violate anyway.</p><p>No action is needed on your part at this time, but please continue to check www.NRAILA.org, your e-mail and <a

title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- It is not that guns in the hands of law-abiding citizens can never be used to commit a crime or be involved in an accident.</p><p>Not only can those things happen, it is inevitable that they will occasionally happen. Fortunately, they are an extreme rarity, but they do happen.</p><p>That is still not an excuse to disarm the majority of law-abiding citizens who use firearms safely every day for target shooting, sporting events, hunting and most importantly self-defense.</p><p>No amount of rhetoric on the part of gun prohibitionists is going to change the fact that guns save lives. In most cases, guns save lives without a shot being fired. That is why you don’t hear about it.</p><p>When states adopt sane laws supporting the right to carry a defensive handgun, violent crime rates go down. <em><strong>This is a fact.</strong></em></p><p>Without a shot being fired, the possibility of a potential victim being armed is a serious deterrent to the would-be criminal. How can the impact of that fact be fairly evaluated when the Main Stream Media will only report on the most revolting and sensational gun related deaths they can find while virtually ignoring actual crime statistics. Statistics do not earn them an audience and thus they do not care. They also do not care when a criminal is deterred from committing a crime by the simple presentation of a firearm by the potential victim. No one got shot. There is nothing “<em>newsworthy”</em> there as far as the media are concerned. There is no other method but <em>“common sense”</em> to fairly evaluate whether or not the right to carry a firearm for self-defense is more valuable to a society than the possibility of an accident or misuse of a firearm.</p><p>Even if it was not obvious that guns save lives, we do not strip people of their cars because some people choose to drive drunk, or are careless in their use of a car. We prosecute the individual. That is the American legal system at work. A driver is not considered guilty until proven innocent just for possessing and using a car. Yet possession of a firearm in New Jersey is almost ALWAYS a crime except under some VERY specific instances<em> (such as going to or from the range or moving to or from a residence)</em>.</p><blockquote><p><em>What makes it worse is the RIGHT TO DRIVE is not a constitutionally protected right as the RIGHT TO KEEP AND BEAR ARMS *IS*!</em></p></blockquote><p>This is a backwards, BIZARRO-land approach to a very important constitutional right. As responsible United States citizens, you should support the constitutional right of your neighbor to keep and bear arms for legitimate purposes whether or not you yourself wish to possess a firearm.</p><p><strong>Would you consider it wrong for your neighbor NOT to support your right to FREE SPEECH?</strong><br
/> Please keep in mind that our founders created the Bill of Rights to protect ALL our fundamental rights. Free Speech is protected by the FIRST Amendment, and the Right to Keep and Bear Arms by the SECOND. I think it is pretty clear what they had in mind. An unarmed citizenry is vulnerable to any gang of thugs who decide to use force against them. It doesn’t matter whether that means a street gang, or a gang of politician’s intent on stripping you of your fundamental rights.</p><p>I don’t know how to state this any clearer. If the average citizen is going to allow the media or the Mayors Against Gun Owners, or the Brady Bunch, or any other of the Gun Prohibitionist Groups to dictate the creation of unconstitutional laws based on a false appeal to their emotions, this country is in for a MUCH worse situation than just the economic recession. Nappen, Attorney at Law and author of the <em>“NEW JERSEY GUN LAW GUIDE”</em> (www.evanappen.com) is offering a $5000* reward to the first person who can show to Attorney Nappen’s satisfaction the specific New Jersey gun law statutes <em>(N.J.S. 2C:39-1 through 2C:39-16 or N.J.S. 2C:58-1 through N.J.S. 58-19)</em> which authorizes the Plainfield churches to act as <em>“collection sites”</em> in which persons are paid up to $200 in cash with <em>“no-questions- asked”</em> for any type of gun from handguns to <em>“assault firearms”</em> and said guns are then destroyed without further investigation.</p><p>(For more information on this “buyback” see the following article: http://www.mycentraljersey.com/article/20110803/NJNEWS/308030028/Plainfield-religious-leaders-police-gearing-up-gun-buyback-program )</p><p>Attorney Nappen knows of no New Jersey gun law statute allowing:</p><ol><li>the anonymous surrender of firearms;</li><li>the receipt of surrendered firearms by churches;</li><li>the unlicensed transport of guns to churches; and</li><li>the destruction without investigation of guns (which may be potential criminal evidence or stolen property that should be returned to their rightful owners.</li></ol><p>He would very much like to include such laws his next edition of the <a
href="http://www.lulu.com/product/paperback/new-jersey-gun-law-guide/5505852" target="_blank">“NEW JERSEY GUN LAW GUIDE”.</a></p><p>New Jersey law provides for the voluntary surrender of firearms only when the person giving up the firearms first gives written notice to the chief of police where he resides or the state police superintendent. Anonymous surrender is simply not authorized. The same law authorizes only the local police chief or the state police superintendent to receive surrendered guns. A church is not authorized under the statute to receive surrendered firearms. (See N.J.S. 2C:39-12.) Also, there is no transportation exemption for such a surrender scheme or bringing unlicensed guns to church. (See N.J.S. 2C:39-6.)</p><p>The immunity granted under New Jersey’s voluntary surrender law is limited to unlawful possession only and nothing more. By allowing for anonymous <em>“no-questions-asked”</em> surrender, the buyback program effectively creates de facto immunity far beyond this.</p><p>The purchase of firearms in New Jersey is strictly prohibited except for licensed dealers and individuals with a Handgun Purchase Permit or Firearms Purchaser ID Card. All gun sales are recorded and include the name and address of the buyer and seller. A church is not authorized under the statute to purchase firearms, no less from anonymous sellers. The payment of cash for a firearms purchase by anyone other than a licensed dealer or a permit/FID cardholder is not permitted. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- This afternoon at 2:00 p.m. today, Monday December 6th, the Senate Law and Public Safety Committee is scheduled to hear S2190, sponsored by State Senator Fred Madden (D-4), which directs the State Police to establish a<em> “handgun purchaser identification card”</em> which would permit the sale, transfer and delivery of handguns between cardholders and retail dealers only.</p><p>This legislation is apparently Senator Madden’s effort to pander to gun owners after his late-night tie-breaking vote flip that resulted in passage of Jon Corzine’s handgun rationing law in 2009.  Unfortunately, the legislation does not go far enough and rubs salt in the wound by failing to exempt those who obtain the card from the one gun a month law.  Senator Madden has squandered an opportunity to rectify his past actions and is seeking only a partial solution to New Jersey’s antiquated and unconstitutional gun laws.</p><p>S2190 does not eliminate the current paper form of<em> “permit to purchase”</em> but creates a bifurcated system run by the State Police in which paper permits must still be issued for some transactions, including private transfers, which cannot be made with the new card.  The legislation has other troubling aspects, including use of an undefined, subjective standard to qualify for the new card <em>(applicants must somehow prove themselves to be persons “of good character and good repute in the community in which they live,” a vague standard <a

Traver</strong> would be named to fill the slot.</p><p>After being blasted before November 2&#8242;s election by the liberal New York Times for failing to beef up the ATF by appointing a director<em> &#8212; for fear of the wrath of the &#8220;gun lobby&#8221; &#8212; </em>Obama gets right past the election and, presto chango, a nominee appears. How &#8217;bout that?</p><p>And not just any nominee.</p><p>As special agent in charge of Chicago&#8217;s ATF field division, Traver had taken the lead in calling for a ban on semiautomatic firearms.</p><div

It is not surprising that Traver has also been active in the virulently anti-gun International Association of Chiefs of Police, which has worked to empower Handgun Control-type activists and has commissioned panels to:</p><ul><li>support one-gun-a-month and lock-up-your-safety laws, as well as <em>&#8220;ballistic fingerprinting&#8221;</em> files on all firearms;</li><li>espouse an <em>&#8220;effective&#8221;</em> ban on .50-caliber firearms, and a redefinition of <em>&#8220;armor-piercing&#8221;</em> ammunition that could effectively ban handgun use;</li><li>mandate gun-destruction policies for law enforcement and enhanced funding to go after guns;</li><li>prohibit all private gun sales and make<em> &#8220;prohibited persons&#8221; </em>out of a much wider variety of persons committing simple misdemeanors;</li><li>back a repeal of the Tiahrt amendment; and,</li><li>allow federal health and safety oversight of the firearms industry <em>(through agencies such as the Centers for Disease Control, the Consumer Product Safety Commission and the Food and Drug Administration)</em>.</li></ul><p>It is disconcerting that ANY organization espousing these views would be taken seriously. That an activist in such an organization would be put in charge of the ATF is truly troubling.</p><p><strong>ACTION: </strong>Contact your Senators. Deval Patrick&#8217;s one-gun-a-month bill failed to pass.</p><p>At midnight on Saturday, the Massachusetts Legislature ended formal sessions for the year under the watchful eye of the Gun Owners Action League (GOAL).</p><p>The Governor&#8217;s Lawful Citizens Imprisonment Act (H.4102) never came out of the House Ways and Means Committee for a vote due to the hard work of firearms retailers, law-abiding gun owners and GOAL.</p><p>The lawful gun owners of Massachusetts should be very proud of a job well done, especially considering H.4102 was a top priority of the governor.</p><p><strong>About NSSF</strong><br

class="wp-caption-text">Association of New Jersey Rifle &amp; Pistol Clubs</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)-  The Association of New Jersey Rifle &amp; Pistol Clubs has filed a lawsuit in the United States District Court of New Jersey seeking nullification of the recently enacted one-gun-a-month gun rationing law.</p><p>ANJRPC’s federal lawsuit is in response to the false vow made by New Jersey’s lawmakers’ promise of new legislation exempting firearm collectors and competitive shooters from the law. The Firearms Task Force, which was created by former Governor Jon Corzine (D), promised that the one-gun-a-month reform bill would give immunity to the true gun collectors and competitors, as they were not the target of the law’s scope.</p><p>The enactment of the one-gun-a-month reform law on January 7 not only failed to alleviate the handgun rationing law, but further inhibited law-abiding citizens by making them jump through additional hoops in order to purchase more than one handgun per month.</p><p>With New Jersey’s government blatantly ignoring the Constitutional rights of its citizens, it is time that we take action and stand up against such offensive legislation.</p>Tags: <a

class="wp-caption-text">National Rifle Association</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)-  Yesterday, the New Jersey Assembly voted unanimously (73-0-3) to approve S3104/A4361.</p><p>These bills were drafted in response to recommendations put forth by the Firearms Task Force created after the midnight passage of New Jersey’s gun rationing law.</p><p>S3104/A4361 now head to the desk of Governor Jon Corzine (D) for his consideration.</p><p>While NRA attempted to create a more robust exemption for gun owners, these requests fell upon deaf ears and the bill passed as written without creating changes beneficial to New Jersey’s law-abiding firearm owners as promised by the Firearms Task Force.</p><p>Proponents contend this measure would address the problems with New Jersey&#8217;s <em>&#8220;one-gun-a-month&#8221;</em> law; however, it falls far short.  While it would, in limited circumstances, allow a law-abiding person to purchase multiple handguns, an individual would only be able to do so after filing a formal application with the State Police.  In addition, the individual would need to justify their<em> &#8220;need&#8221;</em> to purchase these firearms together and why it would not be <em>“feasible or practical”</em> to purchase the firearms separately.</p><p>Thanks to all of the NRA members who contacted their legislators requesting that they broaden the exemptions to New Jersey’s <em>“one-gun-a-month”</em> law and for continuing the fight against further encroachment of our Second Amendment rights and freedoms in the Garden State.</p><p><strong>About:</strong><br

While no language is available for AJR133, this bill might seek a permanent Firearms Task Force where all firearm laws may be open to review. NRA-ILA will keep you updated as soon as language is public.</p><p>S3104/A4361 passed the full Senate in December by a vote of 38 to 0. style="font-size: 10pt; color: black; font-family: Verdana;"> moves to the  Assembly for consideration in January. </span></p><p>Since the introduction of “one-gun-a-month” legislation, we have argued that the bill was poorly drafted, ill conceived and relied upon the false premise that law-abiding New Jersey gun owners are the cause of crime.</p><p>The truth of the matter is that New Jersey residents are already some of the most heavily regulated in the nation and New Jersey&#8217;s &#8220;one-gun-a-month&#8221; law simply heaps additional complications on an already overly burdensome process. Prospective gun owners in New Jersey already have to apply for a Firearms ID card, which includes a background check, fingerprints, photographs and references.  In addition to possessing a Firearms ID Card, those wishing to purchase a handgun must obtain a Permit to Purchase from local police for each handgun purchase, which may take as long as 12 to 14 weeks.</p><p>S3068/A4304 passed 39 to 0 in the Senate and will clarify the original language of the &#8220;one-gun-a-month&#8221; law, by exempting the “transfer of handguns among licensed retail dealers, registered wholesale dealers and registered manufacturers; or transfers of handguns from any person to a licensed retail dealer or a registered wholesale dealer or registered manufacturer.”  A4304 and S3068 would exempt purchases by licensed dealers from firearm distributors or manufacturers from the law prohibiting the purchase of more than one handgun in a 30-day period.</p><p>Assembly Bill 4301/S3076 approved 36 to 0, is a good faith attempt by New Jersey to comply with the grant eligibility requirements set forth in the NICS Improvement Act, passed by Congress in 2007.</p><p>S3104, passed 38 to 0, now moves over to the Assembly Law &amp; Public Safety Committee in January. title="AmmoLand" href="http://www.njleg.state.nj.us/2008/Bills/S3500/3068_I1.HTM" target="_blank">S3068</a> (which is the Senate version of  A4304), <a
title="AmmoLand" href="http://www.njleg.state.nj.us/2008/Bills/S3500/3076_I1.PDF" target="_blank">S3076</a> (which is the Senate version of  A4301), and <a
title="AmmoLand" href="http://www.njleg.state.nj.us/2008/Bills/S3500/3104_I1.PDF" target="_blank">S3104</a>,  which  would provide  limited exemptions for those purchasing more than one  handgun per month.</p><p>Assembly Bill 4304  and S3068 would clarify the original language of the <em>&#8220;one-gun-a-month&#8221;</em> law by  exempting the <em>“transfer of handguns among licensed retail dealers, registered  wholesale dealers and registered manufacturers; or transfers of handguns from  any person to a licensed retail dealer or a registered wholesale dealer or  registered manufacturer.” </em></p><p>A4304 and  S3068 would exempt purchases by licensed dealers from firearm distributors or  manufacturers from the law prohibiting the purchase of more than one handgun in  a 30-day period.</p><p>Assembly Bill 4301/S3076, simply put, is an attempt by New  Jersey to comply with the grant eligibility requirements set forth in the NICS  Improvement Act, passed by Congress in 2007.</p><p>Proponents of S3104 claim that  it would address the problems with New  Jersey&#8217;s &#8221;one-gun-a-month&#8221; law,  however, it falls far short of doing so.  While it would, in limited  circumstances, allow a law-abiding person to purchase multiple handguns, an  individual would only be able to do so after filing a formal application with  the State Police.  In addition, the individual would need to justify why  they &#8221;need&#8221; to purchase these firearms together and why it would not be  “feasible or practical” to purchase the firearms separately.</p><p>New Jersey gun owners are already some of the most heavily  regulated in the nation and New  Jersey&#8217;s &#8220;one-gun-a-month&#8221; law simply heaps  additional complications on an already overly burdensome process. Prospective  gun owners in New  Jersey already have to apply for a Firearms ID card,  which includes a background check, fingerprints, photographs and references.  In  addition to possessing a Firearms ID Card, those wishing to purchase a handgun  must obtain a Permit to Purchase from local police for each handgun purchase,  which  may take as long as 12-14 weeks (despite New Jersey law which requires  permits to be processed within 30 days).</p><p>The  notion that honest persons, thoroughly investigated by the state, should have to  beg further permission and show why it is not “feasible or practical” to ration  their Constitutional rights is offensive and insulting, and represents another  promise broken by the politicians involved in the Firearms Task  Force.</p><p><strong>S3104 now heads to the full  Senate</strong> for a vote which is expected to take place on Thursday.  It is important  that you contact your State Senator and respectfully urge them to remove the  language forcing law-abiding citizens who have cleared a background check to  justify their multiple purchases<strong>.</strong> Contact information can be found  below.</p><p><strong>A4304/S3068 and A4301/S3076</strong> will  now go before the full Senate this Thursday.  Please contact your State  Senator and respectfully urge them to pass A4304/S3068<strong>.</strong> Contact information  for your State Senator can be found <a

class="wp-caption-text">New Jesery</p></div><p><strong>Trenton, NJ -</strong>-(AmmoLand.com)- On Thursday, December 3 at 2:00 pm in State House Annex Room 12, the New Jersey Assembly Law and Public Safety Committee will hold a hearing on three bills of importance to New Jersey&#8217;s law-abiding gun owners.  It is important that members of the Assembly Law &amp; Public Safety Committee hear from you on Thursday.</p><p>A4308 and A4304  have been introduced in an effort to address serious problems in New Jersey&#8217;s gun rationing law that was passed in the middle of the night on June 26.  NRA and fellow Second Amendment advocates warned legislators that the one-gun-a-month bill as written contained many flaws and errors which would have to be fixed down the road.  A4301 is an attempt by New Jersey to comply with the grant eligibility requirements set forth in the NICS Improvement Act, passed by Congress in 2007.<br

class="wp-caption-text">a</p></div></p><p>As of this writing, lawmakers are still working on last minute language for A4308, which has emerged from the recommendations put forth by Governor Corzine&#8217;s Firearm Task Force. The Task Force was supposed to create a robust exemption for law-abiding gun owners from the one-gun-a-month law. Instead, the legislation adds insult to injury by creating an ill-conceived exemption that would force gun owners to beg for permission and show &#8220;legitimate need&#8221; every time they wish to exercise their Constitutional right to obtain more than one handgun per month. Under the legislation that is currently proposed (and subject to possible last minute change), the average gun owner would need to show why it would not be &#8220;feasible or practical&#8221; to purchase the guns separately &#8211; a standard that the State Police and the courts are likely to interpret against gun owners.  New Jersey&#8217;s judiciary has repeatedly abused &#8220;needs&#8221; standards relating to firearms and, in its own words, is blatantly biased against gun owners: &#8220;When dealing with guns, the citizen acts at his own peril,&#8221; wrote the Supreme Court when it upheld the conviction of the owner of .22 rifle as an assault firearm (State v. Pelleteri).</p><p>The notion that honest persons thoroughly investigated by the state should have to beg further permission and show why it is not &#8220;feasible or practical&#8221; to ration their Constitutional rights is offensive and insulting, and represents another promise broken by the politicians involved in the Task Force. Please immediately call the members of the Assembly Law &amp; Public Safety Committee and tell them to keep their promise to gun owners and create a robust exemption for honest gun owners who have nothing to do with illegal trafficking.</p><p>A4304 will clarify the original &#8220;one gun a month&#8221; bill by exempting the &#8220;transfer of handguns among licensed retail dealers, registered wholesale dealers and registered manufacturers; or transfers of handguns from any person to a licensed retail dealer or a registered wholesale dealer or registered manufacturer.  As it stands now, the current law exempts sales between licensed gun dealers but not purchases by licensed dealers from firearm distributors or manufacturers which under New Jersey law are classified differently.  Please contact members of the Assembly Law &amp; Public Safety Committee and urge them to support A4304.</p><p>A4301 is a good faith attempt by New Jersey to comply with the grant eligibility requirements set forth in the NICS Improvement Act, passed by Congress in 2007. The NICS Improvement Act helped strengthen the reporting of persons who are prohibited from firearm purchases because they have been adjudicated by a court as mentally defective or as a danger to themselves or others. The NRA does have some concerns over the new language that removes the county adjuster from the expungement process in favor of the county counsel. It is the adjuster who receives New Jersey&#8217;s mental health check form on the state license for NJ FID cards and NJ Handgun permits. I&#8217;m probably not the genius you thought I was.  If you know a little about anti-gunners, you&#8217;ll know they are ALWAYS trying to pass &#8220;one gun a month&#8221; laws.  Pretty self-explanatory &#8211; you can only buy one gun, or one handgun, each month.</p><p>The excuse is to stop &#8220;gun trafficking&#8221; although everyone knows criminals don&#8217;t get their guns from gun stores and dealers.  It&#8217;s really just a foot in the door law.  Next it&#8217;s one gun a quarter, one gun a year, or one gun period.</p><p>That&#8217;s not what I want to tell you about, though.  Today I want to tell you about a man from Illinois &#8211; a very unique man &#8211; a once valuable asset to the self-defense movement.  His name is John Birch and his website was www.concealcarry.org.  Concealed Carry, Inc. to be exact.</p><p>Based in Oak Brook, surrounded by some of the most factually ignorant and sheepish people around, close to the heart of the beast of a city Chicago &#8211; famed as the murder capital of the country for some of recent years, John Birch and Concealed Carry, Inc, started a stir.</p><p>John knew how to say exactly what he thought without mincing words, and he had a talent at pissing people off on a regular basis.  His real strong suit was getting media attention.  Media attention that brought new allies to the gun rights battle.</p><p>John, with his FFL license, decided that to him One Gun a Month meant something truly more noble &#8211; finding a person in need in dangerous Chicago who could benefit the most from a FREE PISTOL.</p><p>http://web.archive.org/web/20020610082306/http://www.concealcarry.org/freegun.htm</p><p>One has to dig into the web archive to see John&#8217;s handiwork, but there it is.  Media attention galore! National and even international media attention. What did it do? Raise awareness of the issue in Illinois.</p><p>The political and legal climate wasn&#8217;t quite ready for such a move, however.  Concealed carry hadn&#8217;t made it to as many states, the Supreme Court had not yet ruled that yes the 2nd Amendment does protect an individual right to own and carry weapons for personal protection.  There wasn&#8217;t as much fannypack carry in Illinois, and certainly no Open Carry events to my knowledge up in Wisconsin.</p><p>But now, things are quite different.  In Illinois, county-by-county concealed carry is being acknowledged by county resolution.  Some counties have even pushed to get legislation passed to allow people to carry.  Police organizations and other highly-influential orgs are publicly supporting concealed carry.</p><p>Wisconsin has passed it not once, but twice! Only to fall short one and then two votes short of overriding anti-gun bigot Gov. Jim Doyle&#8217;s veto.</p><p>If you didn&#8217;t see the survey over at ICarry.org, I&#8217;ll tell you the results have come in so far exactly as I expected.  It&#8217;s time to call in the troops.  The slow-to-act gun owners across Illinois and Wisconsin needn&#8217;t be fearful of being on the &#8220;losing&#8221; team any longer.</p><p>Hopefully this was interesting to you.  Hopefully we can honor the memory of the original One Gun a Month Giveaway with our own.  If things go well, it will have to be one gun for each Wisconsin and Illinois. Today at 12:00 P.M., Governor Jon Corzine (D-NJ) will sign Assembly Bill 339/Senate Bill 1774 into law.  The signing will take place at Trenton City Hall located at 319 East State Street in Trenton.</p><p>Simply stated, this bill would prohibit an individual from purchasing more than one handgun within a 30-day period. The state already requires an individual to first obtain a permit to purchase – a process which includes an extensive criminal background check and a minimum of 30 days to complete.  This bill is just another step that anti-gun legislators are trying to take to erode our Right to Keep and Bear Arms.</p><p>This legislation gives anti-gun extremists carte blanche to further hinder your right to purchase firearms. /> Governor Jon S. Corzine </em></p><p><em>WHEREAS, protecting the public safety and welfare is the most basic duty of government, and to this end, effective and reasonable measures must be implemented to keep citizens safe from violence; and<br
/> WHEREAS, New Jersey has taken a variety of steps to combat gun violence, including requiring prison terms for those who use firearms in crimes; regulating the sale and transfer of guns to ensure that firearms are being purchased only by law-abiding citizens; imposing restrictions on handgun purchases; and barring the sale of assault firearms; and<br
/> WHEREAS, effective limitations regarding firearms, as well as other deterrent and enforcement measures, are essential to maintaining the public safety, but necessarily impact all residents of this State, including law-abiding collectors of firearms and competitive and recreational firearms users; and<br
/> WHEREAS, in 2007, New Jersey entered into a cooperative agreement, the first of its kind in the nation, forming a partnership with the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives to allow New Jersey State Police direct access to “E-TRACE” data, to trace illegal firearms back to their source as yet another measure to uncover gun crimes and deter illegal gun trafficking; and<br
/> WHEREAS, it is appropriate to maintain a dialogue with interested parties and experts regarding the effectiveness of our State’s firearms laws in combating gun violence and the impact of these restrictions on law-abiding firearms owners;<br
/> NOW, THEREFORE, I, JON S. CORZINE, Governor of the State of New Jersey, by virtue of the authority vested in me by the Constitution and by the Statutes of this State, do hereby ORDER and DIRECT:<br
/> 1.	There is hereby established a Task Force to review, evaluate and make recommendations regarding New Jersey’s statutory and regulatory schemes and programmatic initiatives to curb the illegal possession, use, and trafficking of firearms and, more specifically, the anticipated passage of “one-handgun-per-month” legislation, criminal penalties for illegal transfer of guns, programmatic measures to curb illegal transfers of firearms, and the firearm permitting and regulatory processes (collectively, “firearms regulation”).<br
/> 2.	The Task Force recommendations shall address at a minimum the following issues: the permitting processes; the effectiveness of any statutory limitations on the sale and transfer of firearms, including the anticipated passage of one-handgun-per-month legislation and the efficacy of any exceptions contained in that legislation; and measures to deter “straw purchases” and the illegal transport of guns into New Jersey for purposes of transfer. The recommendations shall include specific suggestions to improve the effectiveness of firearms regulation in these areas and shall include any appropriate recommendations for legislative changes.<br
/> 3.	The Task Force shall be composed of nine members. Membership shall include the Attorney General or designee, the Superintendent of State Police or designee, and a representative of the County Prosecutors’ Association. Additionally, the Task Force shall include one member representing an association of pistol and rifle clubs operating in New Jersey and one member representing an organization that promotes gun violence prevention, which members are to be appointed by the Governor. Additionally, the Task Force shall include two member of the Senate, one of whom with experience with firearms and firearms restrictions, to be selected by the President of the Senate; and two members of the General Assembly, one of whom with experience with firearms and firearms restrictions, to be selected by the Speaker of the General Assembly. Vacancies on the Task Force shall be filled in the same manner as the original selections. The non-legislative members shall serve at the pleasure of the Governor and without compensation. The Governor shall appoint the Chair of the Task Force. The members shall select a Vice-Chair through a majority vote.<br
/> 4.	The Task Force members shall be appointed and convene within thirty days of the effective date of this Order. The Task Force shall complete an initial report within 90 days of its first meeting. The initial report shall be served on the Governor and Legislature so as to allow responsive action within the current legislative session. The initial report shall focus on the anticipated passage of “one-handgun-per-month” legislation in New Jersey, including its impact on firearms collectors and competitive and recreational firearms users. The initial report shall include recommendations for any appropriate legislative changes to ensure that lawful firearms collectors and competitive and recreational firearms users are not adversely affected by the legislation, including the exceptions to the one-handgun limitation contained in Section 2(i) of General Assembly Bill No. 339 (2008) (First Reprint) and Senate Bill No. 1774 (2008). The Task Force shall produce its final report no later than 18 months after delivery of its initial report. At a minimum, the report shall include an analysis of the impact of the one-handgun-per-month legislation on gun crime and the prevalence of illegal firearms in New Jersey.<br
/> 5.	In furtherance of its mission, the Task Force shall be authorized to call upon any department, office, division, or agency of this State to supply it with any available information, personnel, or assistance as it deems necessary to discharge its duties under this Order. Each department, office, division, or agency of this State is hereby required, to the extent not inconsistent with law, to cooperate fully with the Task Force and to furnish it with such available information, personnel, or assistance on as timely a basis as is necessary to accomplish the purposes of this Order. The Task Force may consult with experts or other knowledgeable individuals in the public or private sector on any aspect of its mission.<br
/> 6.	In order that the Task Force be informed of and consider a broad range of views and experiences in the course of its work, the Task Force shall convene at least one public hearing.<br
/> 7.	This Order shall take effect immediately.<br

/> Prohibits individuals from purchasing more than one handgun in a calendar month.</p><p>CURRENT VERSION OF TEXT<br
/> As reported by the Assembly Law and Public Safety Committee on March 3, 2008, with amendments.</p><p>AN ACT concerning handgun sales and purchases and amending N.J.S.2C:58-2 and N.J.S.2C:58-3.</p><p> BE IT ENACTED by the Senate and General Assembly of the State of New Jersey:</p><p> 1.	N.J.S.2C:58-2 is amended to read as follows:<br
/> 2C:58-2. a. Licensing of retail dealers and their employees.  No retail dealer of firearms nor any employee of a retail dealer shall sell or expose for sale, or possess with the intent of selling, any firearm unless licensed to do so as hereinafter provided.  The superintendent shall prescribe standards and qualifications for retail dealers of firearms and their employees for the protection of the public safety, health and welfare.<br
/> Applications shall be made in the form prescribed by the superintendent, accompanied by a fee of [$50.00] $50 payable to the superintendent, and shall be made to a judge of the Superior Court in the county where the applicant maintains his place of business. The judge shall grant a license to an applicant if he finds that the applicant meets the standards and qualifications established by the superintendent and that the applicant can be permitted to engage in business as a retail dealer of firearms or employee thereof without any danger to the public safety, health and welfare.  Each license shall be valid for a period of three years from the date of issuance, and shall authorize the holder to sell firearms at retail in a specified municipality.<br
/> In addition, every retail dealer shall pay a fee of [$5.00] $5 for each employee actively engaged in the sale or purchase of firearms. The superintendent shall issue a license for each employee for whom said fee has been paid, which license shall be valid for so long as the employee remains in the employ of said retail dealer.<br
/> No license shall be granted to any retail dealer under the age of 21 years or to any employee of a retail dealer under the age of 18 or to any person who could not qualify to obtain a permit to purchase a handgun or a firearms purchaser identification card, or to any corporation, partnership or other business organization in which the actual or equitable controlling interest is held or possessed by such an ineligible person.<br
/> All licenses shall be granted subject to the following conditions, for breach of any of which the license shall be subject to revocation on the application of any law enforcement officer and after notice and hearing by the issuing court:<br
/> (1)	The business shall be carried on only in the building or buildings designated in the license, provided that repairs may be made by the dealer or his employees outside of such premises.<br
/> (2)	The license or a copy certified by the issuing authority shall be displayed at all times in a conspicuous place on the business premises where it can be easily read.<br
/> (3)	No firearm or imitation thereof shall be placed in any window or in any other part of the premises where it can be readily seen from the outside.<br
/> (4)	No rifle or shotgun, except antique rifles or shotguns, shall be delivered to any person unless such person possesses and exhibits a valid firearms purchaser identification card and furnishes the seller, on the form prescribed by the superintendent, a certification signed by him setting forth his name, permanent address, firearms purchaser identification card number and such other information as the superintendent may by rule or regulation require.  The certification shall be retained by the dealer and shall be made available for inspection by any law enforcement officer at any reasonable time.<br
/> (5)	No handgun shall be delivered to any person unless:<br
/> (a)	Such person possesses and exhibits a valid permit to purchase a firearm and at least seven days have elapsed since the date of application for the permit;<br
/> (b)	The person is personally known to the seller or presents evidence of his identity;<br
/> (c)  The handgun is unloaded and securely wrapped;<br
/> (d)	Except as otherwise provided in subparagraph (e) of this paragraph, the handgun is accompanied by a trigger lock or a locked case, gun box, container or other secure facility; provided, however, this provision shall not apply to antique handguns.  The exemption afforded under this subparagraph for antique handguns shall be narrowly construed, limited solely to the requirements set forth herein and shall not be deemed to afford or authorize any other exemption from the regulatory provisions governing firearms set forth in chapter 39 and chapter 58 of Title 2C of the New Jersey Statutes; and<br
/> (e)	On and after the first day of the sixth month following the date on which the list of personalized handguns is prepared and delivered pursuant to section 3 of P.L.2002, c.130 (C.2C:58-2.4), the handgun is identified as a personalized handgun and included on that list or is an antique handgun.  The provisions of subparagraph (d) of this section shall not apply to the delivery of a personalized handgun.<br
/> (6)	The dealer shall keep a true record of every handgun sold, given or otherwise delivered or disposed of, in accordance with the provisions of subsections b. through e. of this section and the record shall note whether a trigger lock, locked case, gun box, container or other secure facility was delivered along with the handgun.<br
/> (7)	A dealer shall not knowingly deliver more than one handgun to any person 1[in a calendar month] within any 30-day period1 .  This limitation shall not apply to:<br
/> (a)	a federal, State, or local law enforcement officer or agency purchasing handguns for use by officers in the actual performance of their law enforcement duties;<br
/> (b)	a collector of handguns as curios or relics as defined in Title 18, United States Code, section 921 (a) (13) who has in his possession a valid Collector of Curios and Relics License issued by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives; or<br
/> (c)	transfers of handguns between licensed retail dealers.<br
/> b.	Records.  Every person engaged in the retail business of selling, leasing or otherwise transferring a handgun, as a retail dealer or otherwise, shall keep a register in which shall be entered the time of the sale, lease or other transfer, the date thereof, the name, age, date of birth, complexion, occupation, residence and a physical description including distinguishing physical characteristics, if any, of the purchaser, lessee or transferee, the name and permanent home address of the person making the sale, lease or transfer, the place of the transaction, and the make, model, manufacturer&#8217;s number, caliber and other marks of identification on such handgun and such other information as the superintendent shall deem necessary for the proper enforcement of this chapter. The register shall be retained by the dealer and shall be made available at all reasonable hours for inspection by any law enforcement officer.<br
/> c.	Forms of register.  The superintendent shall prepare the form of the register as described in subsection b. of this section and furnish the same in triplicate to each person licensed to be engaged in the business of selling, leasing or otherwise transferring firearms.<br
/> d.	Signatures in register.  The purchaser, lessee or transferee of any handgun shall sign, and the dealer shall require him to sign his name to the register, in triplicate, and the person making the sale, lease or transfer shall affix his name, in triplicate, as a witness to the signature.  The signatures shall constitute a representation of the accuracy of the information contained in the register.<br
/> e.	Copies of register entries; delivery to chief of police or county clerk.  Within five days of the date of the sale, assignment or transfer, the dealer shall deliver or mail by certified mail, return receipt requested, legible copies of the register forms to the office of the chief of police of the municipality in which the purchaser resides, or to the office of the captain of the precinct of the municipality in which the purchaser resides, and to the superintendent.  If hand delivered a receipt shall be given to the dealer therefor.<br
/> Where a sale, assignment or transfer is made to a purchaser who resides in a municipality having no chief of police, the dealer shall, within five days of the transaction, mail a duplicate copy of the register sheet to the clerk of the county within which the purchaser resides.<br
/> (cf:  P.L.2002, c.130, s.6)</p><p> 2.	N.J.S.2C:58-3 is amended to read as follows:<br
/> 2C:58-3. Purchase of Firearms.<br
/> a.	Permit to purchase a handgun.  No person shall sell, give, transfer, assign or otherwise dispose of, nor receive, purchase, or otherwise acquire a handgun unless the purchaser, assignee, donee, receiver or holder is licensed as a dealer under this chapter or has first secured a permit to purchase a handgun as provided by this section.<br
/> b.	Firearms purchaser identification card.  No person shall sell, give, transfer, assign or otherwise dispose of nor receive, purchase or otherwise acquire an antique cannon or a rifle or shotgun, other than an antique rifle or shotgun, unless the purchaser, assignee, donee, receiver or holder is licensed as a dealer under this chapter or possesses a valid firearms purchaser identification card, and first exhibits said card to the seller, donor, transferor or assignor, and unless the purchaser, assignee, donee, receiver or holder signs a written certification, on a form prescribed by the superintendent, which shall indicate that he presently complies with the requirements of subsection c. of this section and shall contain his name, address and firearms purchaser identification card number or dealer&#8217;s registration number.  The said certification shall be retained by the seller, as provided in 1[section 2C:58-2a.] paragraph (4) of subsection a. of N.J.S.2C:58-21, or, in the case of a person who is not a dealer, it may be filed with the chief of police of the municipality in which he resides or with the superintendent.<br
/> c.	Who may obtain.  No person of good character and good repute in the community in which he lives, and who is not subject to any of the disabilities set forth in this section or other sections of this chapter, shall be denied a permit to purchase a handgun or a firearms purchaser identification card, except as hereinafter set forth.  No handgun purchase permit or firearms purchaser identification card shall be issued:<br
/> (1)	To any person who has been convicted of any crime, or a disorderly persons offense involving an act of domestic violence as defined in section 3 of P.L.1991,c.261(C.2C:25-19), whether or not armed with or possessing a weapon at the time of such offense;<br
/> (2)	To any drug dependent person as defined in section 2 of P.L.1970, c.226 (C.24:21-2), to any person who is confined for a mental disorder to a hospital, mental institution or sanitarium, or to any person who is presently an habitual drunkard;<br
/> (3)	To any person who suffers from a physical defect or disease which would make it unsafe for him to handle firearms, to any person who has ever been confined for a mental disorder, or to any alcoholic unless any of the foregoing persons produces a certificate of a medical doctor or psychiatrist licensed in New Jersey, or other satisfactory proof, that he is no longer suffering from that particular disability in such a manner that would interfere with or handicap him in the handling of firearms; to any person who knowingly falsifies any information on the application form for a handgun purchase permit or firearms purchaser identification card;<br
/> (4)	To any person under the age of 18 years for a firearms purchaser identification card and to any person under the age of 21 years for a permit to purchase a handgun;<br
/> (5)	To any person where the issuance would not be in the interest of the public health, safety or welfare;<br
/> (6)	To any person who is subject to a restraining order issued pursuant to the &#8220;Prevention of Domestic Violence Act of 1991,&#8221; P.L.1991, c.261 (C.2C:25-17 et seq.) prohibiting the person from possessing any firearm;<br
/> (7)	To any person who as a juvenile was adjudicated delinquent for an offense which, if committed by an adult, would constitute a crime and the offense involved the unlawful use or possession of a weapon, explosive or destructive device or is enumerated in subsection d. of section 2 of P.L.1997, c.117 (C:2C:43-7.2); or<br
/> (8)	To any person whose firearm is seized pursuant to the &#8220;Prevention of Domestic Violence Act of 1991,&#8221; P.L.1991, c.261 (C.2C:25-17 et seq.) and whose firearm has not been returned.<br
/> d.	Issuance.  The chief of police of an organized full-time police department of the municipality where the applicant resides or the superintendent, in all other cases, shall upon application, issue to any person qualified under the provisions of subsection c. of this section a permit to purchase a handgun or a firearms purchaser identification card.<br
/> Any person aggrieved by the denial of a permit or identification card may request a hearing in the Superior Court of the county in which he resides if he is a resident of New Jersey or in the Superior Court of the county in which his application was filed if he is a nonresident.  The request for a hearing shall be made in writing within 30 days of the denial of the application for a permit or identification card.  The applicant shall serve a copy of his request for a hearing upon the chief of police of the municipality in which he resides, if he is a resident of New Jersey, and upon the superintendent in all cases. The hearing shall be held and a record made thereof within 30 days of the receipt of the application for such hearing by the judge of the Superior Court.  No formal pleading and no filing fee shall be required as a preliminary to such hearing. Appeals from the results of such hearing shall be in accordance with law.<br
/> e.	Applications.  Applications for permits to purchase a handgun and for firearms purchaser identification cards shall be in the form prescribed by the superintendent and shall set forth the name, residence, place of business, age, date of birth, occupation, sex and physical description, including distinguishing physical characteristics, if any, of the applicant, and shall state whether the applicant is a citizen, whether he is an alcoholic, habitual drunkard, drug dependent person as defined in section 2 of P.L.1970, c.226 (C.24:21-2), whether he has ever been confined or committed to a mental institution or hospital for treatment or observation of a mental or psychiatric condition on a temporary, interim or permanent basis, giving the name and location of the institution or hospital and the dates of such confinement or commitment, whether he has been attended, treated or observed by any doctor or psychiatrist or at any hospital or mental institution on an inpatient or outpatient basis for any mental or psychiatric condition, giving the name and location of the doctor, psychiatrist, hospital or institution and the dates of such occurrence, whether he presently or ever has been a member of any organization which advocates or approves the commission of acts of force and violence to overthrow the Government of the United States or of this State, or which seeks to deny others their rights under the Constitution of either the United States or the State of New Jersey, whether he has ever been convicted of a crime or disorderly persons offense, whether the person is subject to a restraining order issued pursuant to the &#8220;Prevention of Domestic Violence Act of 1991,&#8221; P.L.1991, c.261 (C.2C:25-17 et. seq.) prohibiting the person from possessing any firearm, and such other information as the superintendent shall deem necessary for the proper enforcement of this chapter.  For the purpose of complying with this subsection, the applicant shall waive any statutory or other right of confidentiality relating to institutional confinement.  The application shall be signed by the applicant and shall contain as references the names and addresses of two reputable citizens personally acquainted with him.<br
/> Application blanks shall be obtainable from the superintendent, from any other officer authorized to grant such permit or identification card, and from licensed retail dealers.<br
/> The chief police officer or the superintendent shall obtain the fingerprints of the applicant and shall have them compared with any and all records of fingerprints in the municipality and county in which the applicant resides and also the records of the State Bureau of Identification and the Federal Bureau of Investigation, provided that an applicant for a handgun purchase permit who possesses a valid firearms purchaser identification card, or who has previously obtained a handgun purchase permit from the same licensing authority for which he was previously fingerprinted, and who provides other reasonably satisfactory proof of his identity, need not be fingerprinted again; however, the chief police officer or the superintendent shall proceed to investigate the application to determine whether or not the applicant has become subject to any of the disabilities set forth in this chapter.<br
/> f.	Granting of permit or identification card; fee; term; renewal; revocation.  The application for the permit to purchase a handgun together with a fee of [$2.00] $2, or the application for the firearms purchaser identification card together with a fee of [$5.00] $5, shall be delivered or forwarded to the licensing authority who shall investigate the same and, unless good cause for the denial thereof appears, shall grant the permit or the identification card, or both, if application has been made therefor, within 30 days from the date of receipt of the application for residents of this State and within 45 days for nonresident applicants.  A permit to purchase a handgun shall be valid for a period of 90 days from the date of issuance and may be renewed by the issuing authority for good cause for an additional 90 days.  A firearms purchaser identification card shall be valid until such time as the holder becomes subject to any of the disabilities set forth in subsection c. of this section, whereupon the card shall be void and shall be returned within five days by the holder to the superintendent, who shall then advise the licensing authority. Failure of the holder to return the firearms purchaser identification card to the superintendent within the said five days shall be an offense under 1[section 2C:39-10a] subsection a. of N.J.S.2C:39-101. Any firearms purchaser identification card may be revoked by the Superior Court of the county wherein the card was issued, after hearing upon notice, upon a finding that the holder thereof no longer qualifies for the issuance of such permit.  The county prosecutor of any county, the chief police officer of any municipality or any citizen may apply to such court at any time for the revocation of such card.<br
/> There shall be no conditions or requirements added to the form or content of the application, or required by the licensing authority for the issuance of a permit or identification card, other than those that are specifically set forth in this chapter.<br
/> g.	Disposition of fees.  All fees for permits shall be paid to the State Treasury if the permit is issued by the superintendent, to the municipality if issued by the chief of police, and to the county treasurer if issued by the judge of the Superior Court.<br
/> h.	Form of permit; quadruplicate; disposition of copies. The permit shall be in the form prescribed by the superintendent and shall be issued to the applicant in quadruplicate.  Prior to the time he receives the handgun from the seller, the applicant shall deliver to the seller the permit in quadruplicate and the seller shall complete all of the information required on the form.  Within five days of the date of the sale, the seller shall forward the original copy to the superintendent and the second copy to the chief of police of the municipality in which the purchaser resides, except that in a municipality having no chief of police, such copy shall be forwarded to the superintendent.  The third copy shall then be returned to the purchaser with the pistol or revolver and the fourth copy shall be kept by the seller as a permanent record.<br
/> i.	Restriction on number of firearms person may purchase. Only one handgun shall be purchased or delivered on each permit [, but a] and no more than one handgun shall be purchased 1[in] within1 any 1[calendar month] 30-day period1, but this limitation shall not apply to:<br
/> (1)	a federal, State or local law enforcement officer or agency purchasing handguns for use by officers in the actual performance of their law enforcement duties;<br
/> (2)	a collector of handguns as curios or relics as defined in Title 18, United States Code, section 921 (a) (13) who has in his possession a valid Collector of Curios and Relics License issued by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives; or<br
/> (3)	transfers of handguns between licensed retail dealers.<br
/> A person shall not be restricted as to the number of rifles or shotguns he may purchase, provided he possesses a valid firearms purchaser identification card and provided further that he signs the certification required in subsection b. of this section for each transaction.<br
/> j.	Firearms passing to heirs or legatees.  Notwithstanding any other provision of this section concerning the transfer, receipt or acquisition of a firearm, a permit to purchase or a firearms purchaser identification card shall not be required for the passing of a firearm upon the death of an owner thereof to his heir or legatee, whether the same be by testamentary bequest or by the laws of intestacy.  The person who shall so receive, or acquire said firearm shall, however, be subject to all other provisions of this chapter. If the heir or legatee of such firearm does not qualify to possess or carry it, he may retain ownership of the firearm for the purpose of sale for a period not exceeding 180 days, or for such further limited period as may be approved by the chief law enforcement officer of the municipality in which the heir or legatee resides or the superintendent, provided that such firearm is in the custody of the chief law enforcement officer of the municipality or the superintendent during such period.<br
/> k.	Sawed-off shotguns.  Nothing in this section shall be construed to authorize the purchase or possession of any sawed-off shotgun.<br
/> l.	Nothing in this section and in N.J.S.2C:58-2 shall apply to the sale or purchase of a visual distress signalling device approved by the United States Coast Guard, solely for possession on a private or commercial aircraft or any boat; provided, however, that no person under the age of 18 years shall purchase nor shall any person sell to a person under the age of 18 years such a visual distress signalling device.<br
/> (cf:  P.L.2003, c.277, s.4)</p><p> 3.	This act shall take effect on the first day of the fifth month following enactment.<br

This is because the New Jersey legislature hurriedly passed the so-called “One Gun a Month” bill (A339), which was known to be seriously flawed. The defective bill is absurd, as it address a non-existent problem. No self-respecting gun trafficker would obtain their handguns by first applying for New Jersey Handguns Permits, paying over $50 in fees, and insuring that any handgun he sells on the street was papered to him!  Notwithstanding just how idiotic the law is, it awaits the Governor Corzine’s signature and there is no reason to believe he will veto it.</p><p>However, even the Governor felt it was necessary to issue an Executive Order creating a “Task Force” to examine the law&#8217;s impact on collectors and sportsmen. No mention was made by the Governor of examining its effect on honest citizens who want to buy a particular handgun for self-protection. Also not mentioned for study is the impact on Retail Dealers, the US Armed Forces, the National Guard, recognized military organizations, nuclear power plant security, public utilities, institutional guards, widows, banks, security agencies and private detective agencies. Is the “Task Force” just window dressing or will this poorly drafted legislation actually be “fixed”? If the law is not changed it will:</p><ul><li>-         Kill Retail Dealer business by cutting them off from their primary suppliers of new and used handguns (wholesalers, manufacturers, distributors and individual private sellers), all of whom are NOT exempted from the legislation. Dealer inventories will eventually drop to nothing.</li><li>-         Virtually End the ability for a New Jersey resident to special order a new handgun from a Retail Dealer by cutting off Retail Dealers from purchasing more than one handgun, except from another Retail Dealer. (Unless you are the lucky “one” chosen by your Retail Dealer for that month’s one gun quota, you are S.O.L.)</li><li>-         Potentially Cripples Handgun Procurement by the US Armed Forces, the National Guard, recognized military organizations, nuclear power plant security, public utilities, institutional guards, banks, security agencies and private detective agencies, who are NOT covered by the bill’s “law enforcement” exemption.</li></ul><p><strong>Virtually Ends Retail Handgun Sales In NJ</strong></p><p>A339 states:</p><p>i.    Restriction on number of firearms person may purchase. Only one handgun shall be purchased or delivered on each permit and no more than one handgun shall be purchasedwithin any 30-day period, but this limitation shall not apply to:… (3) transfers of handguns between licensed retail dealers. (Emphasis added)</p><p>Special orders for particular models of handguns will be a thing of the past. Eventually, Retail Dealers will be lucky to have any inventory for sale at all. Retail Dealers will only be able to obtain one handgun a month from any source except another Retail Dealer (who is not likely to sell any of their dwindling inventory to another dealer.) As dealer inventories sell out, they will not be able to replace it except at the worthless pace of one gun a month. In a short time, there will be no handguns left for dealers to sell.</p><p>Citizens will no longer be able to sell their handguns to New Jersey Retail Dealers, unless they have the one handgun the Retail Dealer wants to buy that month. God forbid they have more than one handgun to sell! For example, a widow selling the all the deceased’s handguns in the estate to a Retail Dealer will be a thing of the past.</p><p>The Retail Dealers will be stopped cold. Forget about selling your guns to a Retail Dealer, having the Retail Dealer enter the handguns on his/her bound record books and conducting an instant background check on their future sale.   As Retail Dealers turn away private sellers in droves, there will be a boom in private sales, grey market sales and black market sales as demand and prices skyrocket!</p><p><strong>Kills The Retail Dealer Business</strong></p><p>The law contains language exempting “transfers of handguns between licensed retail dealers.”  The term “retail dealer” is defined by current law in 2C:39-1L, and essentially refers to persons engaged in the sale or repair of firearms for profit to ultimate consumers.  The definition explicitly excludes “wholesale dealers,” which are defined elsewhere in 2C:39-1S (which essentially refers to persons who sell firearms to those who are not the ultimate consumers).</p><p>Because the law only exempts transfers between licensed retail dealers, the one gun per 30 days restriction still applies to transfers from all others, including wholesale dealers, manufacturers, distributors and individual sellers.  Most firearms sold by Retail Dealers are obtained from wholesale dealers, distributors and manufacturers.  Many Retail Dealers also buy used firearms from individuals and resell them.  It is rare for a retail dealer to buy from other Retail Dealers, which is the only exempted class of transfer.</p><p>As a result, retail dealers would be cut off from their primary suppliers (wholesalers, manufacturers, distributors and individuals) and can only purchase one handgun every 30 days from these suppliers.  New Jersey’s several hundred licensed retail dealers are destroyed by this law.</p><p><strong>Cripples Handgun Procurement By Military And Security Organizations:</strong></p><p>In two places, the law contains language exempting “a federal, State or local law enforcement officer or agency purchasing handguns for use by officers in the actual performance of their law enforcement duties.”  However, the proposed exemption for “federal law enforcement” (e.g., FBI, ATF, Secret Service, US Marshalls, etc.) falls short of covering military and security organizations, which are always identified and treated separately and distinctly from law enforcement under existing exemptions from New Jersey gun law.  Recognized categories of military and security organizations that are ignored by the law include: Members of the U.S. Army, Navy, Air Force, Marines, Coast Guard, National Guard, and recognized military organizations (2C:39-6a(1), 2C:39-6a(6), and 2C:39-6c(6)); nuclear power plant security (2C:39-6a(10)); public utilities (2C:39-6c(8)); institutional guards (2C:39-6b(5)); security agencies and private detective agencies (which supply employees with firearms for their guard duties under New Jersey&#8217;s private detective law).</p><p>Because these categories were not explicitly exempted under the new law as they are elsewhere in the old law, they are not exempt and the legislation interferes with necessary procurement of handguns by these organizations.</p><p><strong>Conclusion</strong></p><p>It is a disgrace for the legislature to quickly pass such a absurd bill and then have the Governor support the law, while simultaneously issuing an Executive Order creating a “task force” to examine the law&#8217;s impact. The proper way to handle such a situation is called “VETO.” We are now dependant on post enactment amendments to stop this travesty. Anywhere other than New Jersey this bill would never have made it out of committee, no less be signed into law. Let’s hope we see some real “change” before the problems created by this flawed legal scheme causes irreparable harm.<br

class="wp-caption-text">New Jersey</p></div><p><strong>Trenton, NJ -</strong> -(AmmoLand.com)- In spring 2009, Senator Madden cast the single vote that limited the Second Amendment rights of New Jersey gun owning residents when he worked with Gun Banning Governor John Corzine to pass a gun rationing bill.</p><p>Madden who has served in the New Jersey State Senate since 2004, where he represents the 4th Legislative District was once consider a friend of the constitution but now is clearly on the side of anti gunners.</p><p>Under the direction of Governor Jon Corzine (D) and with little notice to the public to ensure that New Jersey sportsmen and gun owners were not prepared to defend their Second Amendment rights from gun rationing schemes; the New Jersey State Senator, Fred Madden, tuned his back on the state police and law abiding gun owners and voted YES to bill S1774 “One Gun-A-Month”.</p><p>As passed, this bill will prohibit an individual from purchasing more than one handgun within a 30-day period.</p><p>It is unclear at this point what Madden traded with Corzine to sell out NJ gun owners but looking at his history Senator Fred H. Madden, Jr. has repeatedly refused to provide any responses to citizens on issues through the National Political Awareness Test when asked to do so by <a

class="wp-caption-text">National Shooting Sports Foundation</p></div><p><strong>Trenton, NJ -</strong> -(AmmoLand.com)- The National Shooting Sports Foundation (NSSF) is urging all New Jersey firearms retailers and gun owners to call their state senator immediately to voice opposition to S-1774, legislation which would prohibit law-abiding citizens from purchasing more than one handgun a month.</p><p>The bill is scheduled for a floor vote tomorrow, Thursday June 25, 2009.</p><p>It is imperative that law-abiding citizens let their voices be heard on this issue. href="http://www.njleg.state.nj.us/bills/BillView.asp" target="_blank">Senate today added S1774</a> &#8220;One Gun-A-Month&#8221; to tomorrow&#8217;s voting agenda.</p><p>Simply stated, this bill would prohibit an individual from purchasing more than one handgun within a 30-day period.  The state already requires an individual to first obtain a permit to purchase – a process which includes an extensive criminal background check and a minimum of 30 days to complete.
