href="http://www.buffalonews.com/city/communities/buffalo/article260214.ece" target="_blank">recent article </a>on so called <em>“assault rifles”</em> was very misleading and biased.  The violent crime problem should not focus on<em> “too many guns on the street,”</em> but rather on too many criminals on the streets.</p><p>An automobile is dangerous only if there is an impaired, or illegal driver behind the wheel.  Guns are not dangerous unless they are in the hands of those who are irresponsible or who have a bad attitude.  Millions of Americans have guns of all types and are not a problem because they are honest, law-abiding people.</p><p>However, the article promoted a ban on guns that have only cosmetic differences than those typically used for competition, hunting and home defense.</p><p>If bans worked, Prohibition would have been the success story of the Twentieth Century.  It was the only Constitutional Amendment to be repealed.  If bans worked, we would not have a drug problem.  Gun bans also won’t work because criminals, who are the real problem, don’t obey laws.  It is more productive to focus on getting criminals off the streets.</p><p>Possession of any gun by a felon is a federal offense.  Project Exile, which has been little used in New York would automatically send a felon caught with a gun to a federal prison for five years.</p><p>Illegal purchase of a firearm is also a federal crime, including the straw purchases mentioned in the article.  To solve a problem we have to define the problem and the problem is criminals. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- Front Page columnist Budd Schroeder will debate well known political blog webmaster, Joseph Illuzzi on the subject, <em>&#8220;Should the Second Amendment be repealed?&#8221; </em>Mr. Illuzzi&#8217;s, blog is PoliticsNY.Net and he his well known for his insight on elections and political controversial issues.</p><p>He believes that civilians should not own firearms.</p><p>The program is sponsored by the Judges &amp; Police Conference where Mr. Schroeder is First Vice-President.  He is also Chairman of the Board of S.C.O.P.E. Inc. <em>(Shooter&#8217;s Committee On Political Education)</em> and a member of the Board of Directors of the National Rifle Association.</p><p>Schroeder believes that the Constitution is correct and that firearms is almost a synonym for freedom.  The differences in opinion between the two participants may stem from Mr. Illuzzi&#8217;s position that guns kill and he is against killing.</p><p>Mr. Schroeder has always taken the position that more lives are saved by guns. A gun is nothing more than a tool and murders are caused by people who are criminals.  He has often said that the problems of violence and murders are not because there are &#8220;too many guns on the street,&#8221; but rather, too many criminals on the streets.</p><p>The debate is designed to shed light without generating heat and to present the pros and cons of gun control.  The issue has a long history of having a base in religion, constitutional law, and social issues.  It is expected that these issues will be addressed during the debate.</p><p>Supreme Court Justice Frank Caruso will be the moderator for this program.  The Judges &amp; Police Conference dinners usually restricted to members and guests.  For this event, those interested in attending can make reservations without being a member. class="wp-caption-text">Second Amendment Foundation</p></div><p><strong>BELLEVUE, WA -</strong>-(Ammoland.com)-Long Island Firearms has contributed $2,000 to the Second Amendment Foundation to support its legal actions, including a lawsuit in Westchester County challenging a state law that allows carry licenses to be denied because applicants cannot show <em>“good cause.”</em></p><p>This is the second such contribution from a New York group. Earlier, the Shooters Committee On Political Education (SCOPE)<a
title="AmmoLand Reports" href="http://www.ammoland.com/2010/08/13/scope-gives-5k-to-saf-for-help-in-new-york-lawsuit/" target="_self"> contributed to the SAF legal action </a>effort.</p><blockquote><p>“SAF is very grateful for this level of support from Long Island Firearms,” said SAF Executive Vice President Alan M. Gottlieb.</p><p>“The level of support we are getting from New York gun owners clearly demonstrates their dedication to correcting the Empire State’s onerous gun laws. For far too long, officials in the Empire State have treated the Second Amendment right to keep and bear arms as a highly-regulated privilege. It is time for that to end.”</p></blockquote><p>On July 16, SAF filed a lawsuit in federal district court on behalf of Alan Kachalsky and Christina Nikolov, both Westchester County residents whose permit applications were denied. Kachalsky’s denial was because he could not <em>“demonstrate a need for self protection distinguishable from that of the general public.”</em> Nikolov’s was denied because she could not demonstrate that there was <em>“any type of threat to her own safety anywhere.”</em> In addition to Westchester County, Susan Cacace and Jeffrey Cohen, both serving at times as handgun permit licensing officers, are named as defendants. The lawsuit was filed in U.S. District Court for the Southern District of New York, White Plains Division.</p><blockquote><p>“Long Island Firearms recognizes the implications of our lawsuit,” Gottlieb noted, “and they have generously put their money on the line. We certainly appreciate the support, and we’re going to use every penny wisely in our effort to restore gun rights one lawsuit at a time.”</p></blockquote><div

class="wp-caption-text">Shooters Committee on Political Education</p></div><p>On July 16, SAF filed a lawsuit in federal district court on behalf of Alan Kachalsky and Christina Nikolov, both Westchester County residents whose permit applications were denied. Kachalsky&#8217;s denial was because he could not <em>&#8220;demonstrate a need for self protection distinguishable from that of the general public.&#8221; </em>Nikolov&#8217;s was denied because she could not demonstrate that there was <em>&#8220;any type of threat to her own safety anywhere.&#8221;</em></p><p>In addition to Westchester County, Susan Cacace and Jeffrey Cohen, both serving at times as handgun permit licensing officers, are named as defendants. The lawsuit was filed in U.S. District Court for the Southern District of New York, White Plains Division.</p><blockquote><p>&#8220;This case strikes right at the core of a problem that has existed in New York for generations,&#8221; Gottlieb said.</p><p>&#8220;For far too long, the New York bureaucracy has treated our Second Amendment right as a second-class privilege. The Senate bill is currently under consideration in the Senate Codes Committee; it has been printed and appears on their calendar for Tuesday, June 8th 2010.</p><p>Because micro-stamping technology is not yet available, (actual it does not exist) passage of this bill will result in a purchase freeze on all new semi-automatic pistols as of January 1st, 2012.</p><p>We must concentrate our efforts on stopping this bill in the Senate Codes Committee. Shooters Committee on Political Education
Albany, NY --(AmmoLand.com)- I had the honor of attending a trip to Albany, my third in less than a year.  I did notice a subtle difference in the attitude of the legislators in our Capitol on this trip Legislators were more in tuned to the unrest among voters and I believe this plays in our favor.
The day before the trip, Steve and myself handed out SCOPE brochures/applications at the Tea Party Express&#8217; rally in downtown Buffalo and it was a very, very pro gun group.
Budd Schroder, Steve Aldstadt and myself arrived early Tuesday Morning so that Budd and Steve could tape a TV show with Democratic Assemblyman Dennis Grabersak. We then met with six more legislators or their delegates.
Day two began with the Sportsman&#8217;s Breakfast.  Each legislator who attended had a minute or two in front of the microphone to state how they supported the Sportsmen of NYS.  SCOPE was mentioned by three legislators and in particular, Budd Schroeder was mentioned by legislators three times.  Budd commanded the respect of the legislators like now one else in that room.  He is considered by the legislators as the elder statesman for the 2nd Amendment.  This was evidenced by the fact that Senator William Stachowski, Senator Dale Volker, Assemblywoman Francie Delmonte, Assemblyman Mark Schroeder (no relation) and former Assemblyman Vince Graber all spent at least 30 minutes sitting at our table.
No other Sportsmens group (with the possible exception of the NWTF, the breakfast sponser) were even mentioned by the legislators.  Scope is taking a leading role in Albany.
My many thanks also the Ken Mathison whose leadership and steady hand has guided SCOPE to such a position of respect with our lawmakers.  His countless trips and phone calls have undoubtedly set the table for many years to come.
Lastly ken&#8217;s wise and reasoned recommendation for a successor will also pay dividends as I do not have to make the case for Steve Aldstadt as the person to lead us in our fight to protect our civil rights.
My sincere thanks for the patience to read my impressions of the trip and to all the Board Members who have given so much to a cause that I am honored to be a part of.

class="wp-caption-text">Shooters Committee on Political Education</p></div><p><strong>Mineola, NY –</strong> -(AmmoLand.com)- The Nassau County local law banning the possession of handguns mislabeled <em>“deceptively colored”</em> has reached the New York State Supreme Court, Appellate Division, Second Department.</p><p>The Respondents have responded to our Appellate Brief, and we are now in the process of preparing our Reply Brief.</p><p>As you may remember, in June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of &#8220;deceptively colored handguns” as a supposed danger to law enforcement.  The law originally banned all handguns except for those that are <em>&#8220;black, grey, silver, steel, nickel or army green.&#8221;</em> It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.</p><p>Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court <em>(Index #: 013564/2008)</em> to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.</p><p>The action, brought on the day the law was to go into effect, sought a ruling that Nassau’s local law is invalid because it is <em>“preempted”</em> by New York State’s extensive gun control laws, which already ban <em>“disguised guns.”</em> Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.</p><p>The filed proceeding led Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. class="wp-caption-text">Shooters Committee on Political Education</p></div><p><strong>Mineola, NY –</strong>-(AmmoLand.com)-  The Nassau County local law banning the possession of handguns mislabeled “deceptively colored” remains on hold indefinitely pending the outcome of a legal challenge by gun-rights activists.</p><p>In June 2008, Nassau passed Local Law #5, criminalizing the possession and sale of &#8220;deceptively colored handguns” as a supposed danger to law enforcement.  The law originally banned all handguns except for those that are &#8220;black, grey, silver, steel, nickel or army green.&#8221; It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.</p><p>Three New York State pistol licensees—Alan Chwick of Freeport, Edward Botsch of Franklin Square, and Thomas Fess of Rochester—filed an action on July 23rd in Nassau Supreme Court (Index #: 013564/2008) to challenge the laws. The proceeding was filed pro se, with the assistance of a New York gun-rights activist and attorney.</p><p>The action sought a ruling that Nassau’s local law is invalid because it is “preempted” by New York State’s extensive gun control laws, which already ban “disguised guns.” Under the doctrine of preemption, localities may not pass laws in areas already regulated by state law, unless state law permits such local laws. The suit also sought to overturn the law because it violates the right to keep and bear arms under both the Second Amendment to the United States Constitution and a similar provision of New York State Civil Rights Laws.</p><p>The proceeding was brought on the day the law was to go into effect, and sought a temporary restraining order and an injunction to stay enforcement of the law. That led to Nassau to enter into a binding stipulation not to enforce the law unless the court rules against the petitioners. The petitioners have retained attorney Robert Firriolo, a litigation partner in the New York office of Duane Morris LLP.</p><p>The local law challenged affects not only Nassau pistol licensees, but all New York gun owners and visitors to Nassau County. Anybody found with a banned handgun is subject to arrest and prosecution. The law is particularly hazardous to the many shooters who come into, or pass through, Nassau to participate in shooting events and have no way of knowing about this law. The suit was brought to protect the interests of all of law-abiding gun owners and dealers, most of whom are still unaware that many ordinary, popular and valuable handguns are banned. States in which lists of concealed carry holders have been published &#8211; particularly in my home state, here in TENNESSEE &#8211; take note!!!!</p><p>Probably most of us know about THE COMMERCIAL APPEAL, newspaper in MEMPHIS, TENNESSEE, publishing a list of all of the concealed carry permit holders in the state.  A stink was raised.  The Tennessee state legislature produced a bill to stop this.  Recently, I sent out an article from the CA about the fight in the state over allowing lawful carry in county and city parks.  I pointed out how the CA was still promoting their publication of the list and how it was still available.</p><p>I did not know, until I read the article <a
href="http://www.ammoland.com/2009/07/28/concealed-carry-confidentiality-across-the-fruited-plain/">Concealed Carry Confidentiality Across the Fruited Plain</a>, that the House of Representatives of Tennessee passed the bill (83-12), but the Tennessee Senate rejected Senate Bill 1126 by a 14-13 vote!!!!</p><p>I know some Tennessee state senators, and I know that some people getting this email from me know some Tennessee state senators.  I hope that you will join me in making those 13 miscreant senators wish that there were 13 thousand of them &#8211; to help diffuse the wrath!!!!</p><p>Ask yourself &#8211; why would anybody do that?  Well, you might ask why the Commercial Appeal did it in the first place.  As you will read in the link above, the Arkansas Times thought that the CA&#8217;s publication of the list was &#8220;cool&#8221; and acted like a copy cat.  The Arkansas state senate, like Tennessee, apparently has a few knuckleheads in it, too, so they and the governor who is ostensibly (but weakly) pro-gun, need an attitude readjustment.</p><p>Virginia got it right. class="wp-caption-text">Shooters Committee on Political Education</p></div><p><strong>Rochester, NY -</strong>-(AmmoLand.com)- On Thursday, September 24, 2009 at 7:00 PM the Genesee Conservation League and SCOPE will co-host a meet the candidates forum. The forum will take place at the Genesee Conservation League, 1570 Old Penfield Road, Rochester, NY 14625. This event is for the members of GCL and SCOPE to learn about candidates&#8217; positions on issues. Candidates invited are those running for the offices of Monroe County Sheriff and Legislator.</p><p>Each Candidate will be provided 3 minutes for a background statement. Questions will be presented by written cards from those members in attendance.</p><p>The Genesee Conservation League is a family oriented membership club founded by a group of Rochester conservationists in 1925. GCL has expanded now to over 1100 members. Interests served range from casual shooting to bench rest and pistol competitions. Three major areas which members enjoy are archery, pistol shooting, and rifle shooting.
