title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- MasterPiece Arms, manufacturers of the MAC 10 inspired MPA Defender Series and the MPA Protector Series subcompact pistols, gave fans and customers the opportunity to name the first series of their new MPA .22 sound suppressors.</p><p>The best name that followed in the MPA tradition of <em>“Protector”</em> and<em> “Defender”</em> product series names would win one of the first MPA 22 suppressors produced and designed entirely by MPA. The contest was to run through November 30, 2011, but due to overwhelming response, MPA alerted participants that the contest would close early on the 23rd of November. With over 280 entries, MPA set about reviewing the many impressive suggestions.</p><blockquote><p>“With so many great product names coming in for the new .22 aluminum K-baffle suppressor, we made a decision to go ahead and launch our two other new .22 suppressor designs,” Phil Cashin, President and CEO of Masterpiece Arms announced. “Now, we have three winners for these new suppressors entirely made by MPA and we are very proud to announce them: Vigilant (inspired by the submission Vigilance), Murmur and Sentinel. We had several contestants suggest the same name so any winners were the first to place their suggestion.”</p></blockquote><p>All three of the new .22 suppressors are completely made on Masterpiece Arms’ state-of-the-art CNC machinery, including a 5-axis vertical machining center for machining the exhaust ports. The units are designed to be fully serviced and cleaned by the user. A dis-assembly tool and instructions are included with every suppressor. The first of the three is the “Sentinel” named by winner Scott Wellman of Roanoke, VA. The Sentinel is a .22 suppressor in a K-baffle design with six baffles made from 7075 aircraft grade aluminum. The super-tight tolerances are held throughout the manufacturing process with respect to Total Indicated Runout (TIR) and concentricity of the outer tube to the front and rear cap. The K-baffles ensure a no point-of-impact shift. The front and rear caps, plus the outer tube are hard coated in an anodized black for anti-reflection and anti-corrosion. The Sentinel weighs just 3.1 ounces and is 5.625 inches in length and 1 inch in diameter. MSRP is $239.99</p><p>The second new .22 suppressor is the Murmur, named by winner Daniel Stinson of Shreveport, LA, and features a monocore design machined from a solid piece of 7075 aircraft grade aluminum. The Murmur is also hard coated in an anodized black and weighs 3.8 oz. and measures 6 in. length and 1 inch in diameter. MSRP is $259.99</p><p>The third and final .22 suppressor is the Vigilant, which was inspired by the submission “Vigilance” from winner Eric Walton. The Vigilant is also six K-baffle design machined from stainless steel with a polished stainless finished tube. The Vigilant weighs 5.7 oz. and measures 5.8 in. MSRP is $325.99. This suppressor is rated for semi-auto and full-auto applications in .22LR.</p><p>The new MPA suppressors are the first series in an expanding line up of MPA sound suppressors that will include center-fire and rim-fire pistol and rifle models in .22LR, .223/5.56, 9mm, .40 S&amp;W and .45 ACP. The next big wave to hit the gun industry will be those infamous &#8220;<em>tools of assassins, cop killers, and mafia thugs</em>&#8220;&#8230; or so Hollywood and those loony gun grabbers would like everyone to be manipulated into believing.</p><p>No, suppressors are not anything new to the gun industry&#8230; and many shooters are already entrenched in the splendor that is suppressor shooting, but they have yet to really go mainstream. They are legal to own in 39 states, but there has yet to be a &#8220;<em>suppressor in every home</em>&#8221; so to speak. In fact, the latest statistics tell us that suppressor sales are only in the twenty thousand per year range. When you look at the roughly estimated number of 80 million gun owners in the United States, there is a very large discrepancy between gun owners and suppressor owners.</p><p>All that being said, there seems to be a growing trend within the industry. Have you noticed that everybody and their momma are now making guns with threaded barrels? Have you noticed that even small gun companies are now getting into the mix?&#8230; some are even starting to produce their own suppressors. The NRA is now also speaking out in support of suppressors. It seems that they have finally come to the realization that suppressors are not the evil incarnation that they once felt they were, but instead are legitimate safety devises (<em>group-think and yes-men be damned!</em>).</p><blockquote><p>Things within the industry seem to be all lined up for a big push, and I personally believe that consumers <em>(and their money)</em> are ready, willing, and waiting.</p></blockquote><p>To truly get suppressors to go mainstream, we must get legislation passed to deregulate suppressors and remove the $200 tax stamp. We must end the ridiculously invasive acquisition process, and lift the complete bans in the eleven oppressive states that ignorantly think that they are keeping people safe. If we can get this to happen, then we might really see this market segment take off.</p><p>I know that for me personally the only thing that is really keeping me from buying several suppressors is that draconian $200 tax. I (<em>and my hearing</em>) would absolutely love to be able to put a suppressor on my <em>&#8220;nightstand gun&#8221;,</em> one on my carbine, one on my deer rifle, and one on my squirrel rifle. However, that $200 a pop tax stamp is a real deal breaker for me. Additionally, if we can get legislation passed to end the requirement for the tax stamp (<em>or at least get the price tag down to non-disenfranchisement levels</em>), you are <em>really</em> going to see a lot of new companies get into the suppressor game. Right now there are only a handful. Once the number of companies offering suppressors begins to significantly increase prices of suppressors themselves will plummet. Then they will be much more attainable for every gun owner who desires that extra level of hearing protection.</p><p>I really hope that this is the next legal battleground for us as gun owners. For one, I think this is a slam dunk win for our side. As the NRA recently pointed out, silencers are legally classified as firearms for regulatory purposes, but don’t meet the definition of a firearm. All of the tired old justifications for suppressor regulation just don&#8217;t hold water anymore. Each one has been thoroughly debunked in the numerous states that allow full suppressor ownership and use &#8211; including hunting. The opposition really does not have a debatable leg to stand on in this one.</p><p>Secondly, I think that the deregulation and mainstreaming of suppressors will be a great thing for the gun culture in this country. Simply put, suppressors make shooting much more enjoyable and safer. They are a great way to introduce children and new shooters to the sport of shooting and it is the neighborly way to take game animals. Deregulation would be a big win for everyone all the way around.</p><blockquote><p>So are suppressors really going to be the next big craze to hit the gun industry? Will they be the next big legal battleground for us as gun owners? Are suppressors going to be 2012&#8242;s &#8220;<em>must have item</em>&#8220;?</p></blockquote><p>I don&#8217;t really know for sure, but I do hope that they are. I wish more than anything right now that we could get rid of the ridiculous barriers to entry into the world of suppressor shooting and that we could start making them more attainable to the masses. Suppressor shooting is not what the far left has been characterizing it to be to the American public, and there is no time like the present to start changing minds and influencing our elected representatives to release suppressors from the stranglehold of government regulation.</p><p><strong>About:</strong><br

Yes! They absolutely are!”</em></p><p>SilencerCo’s <em>“Silencers Are Legal”</em> campaign was created because only a small percentage of American citizens knew that Silencers are indeed legal. Silencerco/SWR introduced the “Silencers Are Legal” campaign to expand the silencer market out of obscurity and into the mainstream general shooting sports industry.</p><p>The campaign has showed great success with its <em>“Yes, Silencers Are Legal”</em> brochure, posters, and the Silencers Are Legal website. The premier episode compares a .22 lr suppressed pistol with a slap to the face of Silencerco/SWR’s very own CEO Joshua Waldron. Interesting enough the slap to the face sound metered only 2 db quieter than the suppressed .22 pistol.</p><p>Silencerco/SWR performed a market research survey where they interviewed individuals going into different gun stores and asked them whether or not they knew that silencers were legal. To their surprise only 3% of the people interviewed knew that they were.</p><p>This is what inspired Silencerco/SWR CEO Joshua Waldron to launch the <em>“Silencers Are Legal”</em> campaign. <em>“Three percent is not acceptable”</em> Joshua Waldron expressed, <em>“how can we expect to be protected by lobby groups such as the NRA and politicians when our industry numbers are so low?”</em> With the launch of the <em>“Silencers Are Legal”</em> campaign the last year has experienced over 10% growth, and the momentum is building.</p><p>Waldron has also been lobbying the lobbyists, so to speak, by working with the NRA and other industry giants to add the silencer market to their agenda. Also, before this year, no general firearm distributor dealt with silencers at all. This made it very difficult for silencer companies to spread the market to dealers without their class III license. However, Silencerco along with other silencer dealers, were able to get the largest wholesale distributor Acusport Corporation, to add silencers to their inventory.</p><blockquote><p>“The recent acceptance of silencers by Acusport is crucial to our industry,” said Waldron, “because of our Silencers Are Legal campaign, along with Acusport’s client list, we have been able to convert a lot of title one dealers into class III dealers. This is a huge milestone for our industry.”</p></blockquote><p>The <em>“How Loud Is It”</em> video series is intended to reach out further and recruit more people into our industry. In Finland and Norway one can be purchased without paperwork at the local hardware store.</p><p>Even in the United Kingdom, their use is often encouraged for hunting and acquiring one is relatively easy.</p><p>I&#8217;m talking about suppressors, <em>&#8220;cans,&#8221;</em> or as long as one understands the name isn&#8217;t literally true, &#8220;silencers.&#8221; (In Britain, they&#8217;re known as &#8220;moderators.&#8221;) But while the United States remains the gold standard in preservation of the right to keep and bear arms, these useful accessories have been demonized beyond all reason.</p><p>Far from the modern popular and erroneous notion that suppressors were created for organized criminals and assassins, when Hiram P. Maxim <em>(son of Maxim machine gun creator Hiram Stevens Maxim)</em> patented the first suppressor in 1910 his goal was to minimize noise pollution. Ads for the product featured a character called <em>&#8220;Dr. Shush&#8221;</em> and Maxim himself imploring those at a firing range to <em>&#8220;hush,&#8221;</em> with another noting, <em>&#8220;Girls like it when there&#8217;s no nerve-ripping report.&#8221;</em> Seemingly obsessed with sound, Maxim&#8217;s company, Maxim Silencer Co., would go on to make car mufflers and offer consulting services on noise reduction.</p><p>While Maxim&#8217;s marketing may have focused on politeness, his invention&#8217;s contribution to hearing safety is of greater importance. Most shooters and almost all hunters have firsthand experience with the effects of unsuppressed gunfire and know the results can be dangerous. The average gunshot is well above 140 decibels, the level at which permanent hearing loss can occur. Every responsible shooter uses proper ear protection at the range, but it&#8217;s not an option in home defense and many hunting situations. And while a suppressed firearm is by no means silent, it does offer protection from dangerous noise levels. In light of this, suppressors should be viewed as safety devices, rather than demonized.</p><p>Unfortunately, by the early 1930s some in law enforcement came to fear their possible use by criminals. When the National Firearms Act of 1934 was enacted, <em>&#8220;silencers&#8221;</em> were included alongside machine guns and short-barreled shotguns. To make sure the average citizen couldn&#8217;t buy a suppressor, the Congress imposed a $200 tax on the accessory. Considering the average family income at the time was $1,524 per year, it was a highly prohibitive sum.</p><p>Today suppressors are legal to own in 39 states, but since they are subject to the National Firearms Act, the would-be owner must fill out a Bureau of Alcohol, Tobacco, Firearms and Explosives Form 4, acquire the signature of his or her chief local law enforcement officer, and submit a passport-size photo to the BATFE along with a set of fingerprints. This information, along with the $200 transfer tax, is sent to BATFE for a rigorous background check. All of the information is then recorded in the National Firearm Registration and Transfer Record, the BATFE database of NFA firearms.</p><p>If this process sounds onerous, that&#8217;s because it is; but despite these regulations there are also 11 states <em>(California, Delaware, Hawaii, Illinois, Iowa, Minnesota, <span
style="color: #ff6600;"><strong>New Jersey</strong></span>, New York, Massachusetts, Rhode Island and Vermont)</em> that ban the possession of suppressors outright. Still others allow possession of suppressors, but bar their use for hunting.</p><p>Such state laws are pointless, as laws governing suppressors, just as with all other firearm laws, aren&#8217;t followed by criminals. Rather than purchasing them legally, violent criminals mostly opt for crude homemade suppressors made of materials such as soda bottles and duct tape—not exactly the kind of thing those willing to be registered and pay the $200 NFA transfer tax are interested in.</p><p>The strict federal regulations are more than enough, which is why the NRA Institute for Legislative Action has been working to abolish unnecessary and restrictive state laws. In April, Washington enacted a law clearing up a peculiar situation in which suppressors were legal to possess, but illegal to use. That same month, the Kansas and Montana legislatures debated the use of suppressors for hunting, with Kansas adopting legislation allowing for their use.</p><p>The most recent blow for freedom was struck in Michigan on September 2, when <a
title="AmmoLand Reports" href="http://www.ammoland.com/2011/09/02/michigan-attorney-general-re-affirms-right-of-gun-owners-to-use-silencers/">Michigan Attorney General Bill Schuette released a formal opinion declaring</a> the possession, manufacture and sale of suppressors to be legal in the Great Lakes State.</p><p>Expressing support for the Attorney General&#8217;s sound logic were a number of Michigan law enforcement officials. Barry County Sheriff Dar Leaf noted a suppressor&#8217;s usefulness in helping <em>&#8220;keep the peace&#8221;</em> between shooters and their neighbors. title="AmmoLand Reports" href="http://www.ammoland.com/2011/09/12/firearms-sound-suppressors/">silencers have been confirmed to be allowed in Michigan</a> by a recent Attorney General&#8217;s Opinion (http://www.michigan.gov/ag/)</p><p>This week, we discuss the practical issues involved in a lawful purchase of a silencer.</p><p>Both machine guns and silencers, as well as other weapons such as SBR<em> (Short Barreled Rifles)</em> and SBS <em>(Short Barreled Shotguns)</em>, are regulated by the National Firearms Act of 1934 <em>(NFA.)</em> Silencers, like machine guns, are subject to a $200 transfer tax, and can only be legally purchased from a dealer licensed to sell them. Not all FFLs <em>(Federal Firearms Licensees)</em> are authorized to sell NFA-controlled items.</p><p>An individual who purchases a silencer must purchase only from an authorized dealer, often referred to as a Class III Dealer, and must fill out the appropriate ATF forms <em>(Form 4)</em> and two sets of fingerprint cards, provide passport photos of the prospective buyer, and collect the signature of a CLEO, or, Chief Law Enforcement officer attesting that the prospective purchaser does not possess a disqualifying criminal record and is not wanted, along with a check or money order for $200.00.</p><p>If the purchaser is a trust, corporation, or LLC, some of the above requirements are waived. However, the $200 must still be paid. It is strongly recommended that you consult with an attorney familiar with this process before proceeding with this course of action. Our office is developing a network of attorneys who can advise regarding which such entity is best for your particular needs and assist with creating it, and submitting the appropriate verification to the ATF.</p><p><strong>Michigan Class III Dealer</strong></p><p>So, the first step is to find a Michigan Class III dealer who either has the item you want in stock, or can order it for you. The second step is to decide whether you want to proceed as an individual, or create a trust or corporate entity, and then submit the required paperwork and fee to the ATF and get approval before completing the purchase. One of the advantages of using a trust or corporate entity is that if you pass away before transferring the item, it is possible to allow for successors who may legally possess it.</p><p>Moving forward, we can expect that more dealers will be offering silencers for sale after they acquire the appropriate authorization. Michigan shooters will be less likely to sustain permanent hearing loss and less likely to become involved in nuisance conflicts with neighbors. title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- &#8211; Opinion Number 7260 (available here: www.ag.state.mi.us/opinion/datafiles/2010s/op10339.htm) says, in summary:</p><blockquote><p>&#8220;The possession, manufacture, or sale of a firearm silencer is permitted in Michigan under MCL 750.224(1)(b) if the person is licensed or approved to possess, manufacture, or sell such a device by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives, as required by MCL 750.224(3)(c). Possession, manufacture, or sale of a firearm silencer by an unlicensed or unapproved person is a felony, punishable by up to five years imprisonment under MCL 750.224(2).&#8221;</p></blockquote><p>This means that Michigan residents may now follow the procedures under the National Firearms Act of 1934 (26 US Code, Chapter 23) as administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives (www.atf.gov.)</p><p>As a former US Army Infantry Sergeant and civilian volunteer trainer of Army Squad Designated Marksmen, I am aware that there is an ongoing discussion among experts regarding what the appropriate term is for a device that reduces the sound signature of a firearm. It must be noted that Michigan statutes use the terms <em>&#8220;silencer&#8221;</em> or <em>&#8220;muffler,&#8221;</em> rather than the more precise term <em>&#8220;suppressor.&#8221;</em></p><blockquote><p>MCL 750.224:</p><p>&#8220;&#8230;(4) As used in this chapter, &#8220;muffler&#8221; or &#8220;silencer&#8221; means 1 or more of the following:</p><p>(a) A device for muffling, silencing, or deadening the report of a firearm.</p><p>(b) A combination of parts, designed or redesigned, and intended for use in assembling or fabricating a muffler or silencer.</p><p>(c) A part, designed or redesigned, and intended only for use in assembling or fabricating a muffler or silencer.&#8221;</p></blockquote><p>Note that there have been no changes to Michigan statute. A Michigan Attorney General&#8217;s Opinion clarifies existing law. Essentially, General Schuette and his staff analyzed the relevant statutory law and determined that when it refers to <em>&#8220;license,&#8221;</em> it means the permission of the ATF as required under the National Firearms Act, in much the same way that former Attorney General Cox did with regard to machine guns.</p><p>The vast majority of other states have allowed silencers for quite some time. With this opinion, we join the ranks of civilized states that allow citizens to quiet the dangerous and annoying sound signature of firearms. Far from being the instruments of crime they are portrayed as in popular entertainment, suppressors are protective devices meant to preserve human hearing and cut down on nuisance issues between neighbors.</p><p>MCRGO has been at the forefront of this issue for quite some time. /> Lansing, MI</p><p>In separate requests, you have asked whether, assuming the appropriate license or approval is obtained from the federal Bureau of Alcohol, Tobacco, Firearms and explosives, a Michigan may legally possess, manufacture, or sell a firearm silencer or muffler.1</p><p>Federal law imposes restrictions and taxes on the transfer or making of certain firearms, including devices such as silencers or mufflers. 28 USC 5845(a); 18 USC 921(a)(3).2 The Department of Justice regulates firearms through the Bureau of Alcohol, Tobacco, Firearms and Explosives.3 The federal licensing or approval process is set forth in the National Firearms Act, 26 USC 5811 et seq (transfers of firearms), and 26 USC 5821 et seq (making of firearms), and promulgated regulations. See 27 CFR Part 479. Both the transfer and the making of a silencer may be approved by the Bureau upon submitting the proper application forms.</p><p>In either case, the application process involves a detailed background check to ensure that the applicant complies with federal law, including a determination that the applicant has not been charged with or been convicted of a disqualifying crime; is a lawful resident and at least 21 years of age; does not use illegal substances; has not been adjudicated mentally defective or committed to a mental institution; and has not been convicted of a crime involving domestic violence. In addition, the applicant must undergo an identification verification process and secure a certification from a local law enforcement agency having jurisdiction in the area of the applicant&#8217;s residence that the device will be used for lawful purposes, and that its possession does not violate state or local law. See 27 CFR Part 479, Subparts E and F.4</p><p>Turning to your question, the analysis begins with section 224 of the Michigan Penal Code, MCL 750.224, found in Chapter 37 relating to firearms. Public Act 33 of 1991 reorganized the section into its present structure, including four subsections: prohibitions are stated in subsection (1)(a) through (e); the penalty for violating the section is stated in subsection (2); the exceptions are stated in subsection 3(a) through (c); and subsection (4) provides a definition of the term &#8220;muffler&#8221; or &#8220;silencer.&#8221;5 Section 224 thus provides, in part:</p><p
style="padding-left: 30px;"><em>(1) A person shall not manufacture, sell, offer for sale, or possess any of the following:</em></p><p
style="padding-left: 30px;"><em>a) A machine gun or firearm that shoots or is designed to shoot automatically more than 1 shot without manual reloading, by a single function of the trigger.</em></p><p
style="padding-left: 30px;"><em>(b) A muffler or silencer.</em></p><p
style="padding-left: 30px;"><em>(c) A bomb or bombshell.</em></p><p
style="padding-left: 30px;"><em>(d) A blackjack, slugshot, billy, metallic knuckles, sand club, sand bag, or bludgeon.</em></p><p
style="padding-left: 30px;"><em>(e) A device, weapon, cartridge, container, or contrivance designed to render a person temporarily or permanently disabled by the ejection, release, or emission of a gas or other substance.</em></p><p
style="padding-left: 30px;"><em>(2) A person who violates subsection (1) is guilty of a felony, punishable by imprisonment for not more than 5 years, or a fine of not more than $2,500.00, or both.</em></p><p
style="padding-left: 30px;"><em>(3) Subsection (1) does not apply to any of the following:</em></p><p
style="padding-left: 30px;"><em>(a) A self-defense spray or foam device as defined in section 224d.[6]</em></p><p
style="padding-left: 30px;"><em>(b) A person manufacturing firearms, explosives, or munitions of war by virtue of a contract with a department of the government of the United States.</em></p><p
style="padding-left: 30px;"><em>(c) A person licensed by the [Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives] to manufacture, sell, or possess a machine gun, or a device, weapon, cartridge, container, or contrivance described in subsection (1). </em></p><p>The plain language of MCL 750.224(1) prohibits the possession, manufacture, or sale of silencers. But subsection 3 of section 224 states a number of exceptions to the general prohibition set forth in subsection (1). The question, therefore, is whether any of these exceptions apply to silencers. The first two subsections, (3)(a) and (b), do not relate to silencers. Thus, an exception to the prohibition against possessing silencers stated in subsection (1) may only be found in the language of subsection (3)(c).7</p><p>When construing a statute, the foremost obligation is to discern and effectuate the intent of the Legislature as may reasonably be inferred from the words expressed in the statute. Halloran v Bhan, 470 Mich 572, 576-578; 683 NW2d 129 (2004); Massey v Mandell, 462 Mich 375, 380-381; 614 NW2d 70 (2000). Unless defined in the statute, every word or phrase of a statute should be accorded its plain and ordinary meaning, taking into account the context in which the words are used. MCL 8.3a; Western Michigan Univ Bd of Control v Michigan, 455 Mich 531, 539; 565 NW2d 828 (1997). Both the plain meaning of the critical word or phrase as well as its placement and purpose in the statutory scheme must be considered. Sun Valley Foods Co v Ward, 460 Mich 230, 237; 596 NW2d 119 (1999). Nothing may be read into an unambiguous statute that is not within the manifest intent of the Legislature as derived from the words of the statute itself. Roberts v Mecosta County General Hosp, 466 Mich 57, 63; 642 NW2d 663 (2002). But effect must be given to every word in a statute so as to avoid an interpretation that would render any part surplusage. Jenkins v Patel, 471 Mich 158, 167; 684 NW2d 346 (2004).</p><p>The language of subsection (3)(c) of section 224 must be analyzed with these guiding principles in mind. That language states that subsection (1) does not apply to: &#8220;A person licensed by&#8221; the Bureau of Alcohol, Tobacco, Firearms and Explosives &#8220;to manufacture, sell, or possess a machine gun, or a device, weapon, cartridge, container, or contrivance described in subsection (1).&#8221; The plain text applies to a person federally licensed &#8220;to manufacture, sell, or possess a machine gun.&#8221; OAG, 2005-2006, No 7183, p 63 (December 27, 2005), examined this provision and the applicable federal licensing law and concluded that it authorized a person in Michigan to possess a machine gun if it was lawfully possessed before May 19, 1986, and was properly registered under federal law. This language does not apply to silencers, however, leaving the balance of subsection (3)(c) for review.</p><p>The remaining part of subsection (3)(c) states that subsection (1) does not apply to a person federally licensed to manufacture, sell, or possess &#8220;a device, weapon, cartridge, container, or contrivance described in subsection (1).&#8221; MCL 750.224(3)(c) (emphasis added). Answering your question requires determining the meaning of this emphasized language, which is important in several respects.</p><p>First, the language refers to specific items mentioned in subsection (1) of section 224: a machine gun, as mentioned in subsection (1)(a), and the five items mentioned in subsection (1)(e) (&#8220;device, weapon, cartridge, container, or contrivance&#8221;). But it does not incorporate the same clause used in subsection (1)(e) to limit the items listed there (&#8220;designed to render a person temporarily or permanently disabled by the ejection, release, or emission of a gas or other substance&#8221;).</p><p>Second, when qualifying the terms &#8220;device, weapon, cartridge, container, or contrivance,&#8221; the exception refers to &#8220;subsection (1)&#8221; and not the more limiting subdivision (e) of subsection (1). The question therefore arises whether the Legislature intended to authorize possession of only federally-registered machine guns and certain gas-emitting devices or whether it intended to authorize possession of all the items listed in subsection (1) if federally registered.</p><p>Again, the foremost rule is to ascertain and effectuate the intent of the Legislature. Halloran, 470 Mich at 576-578. &#8220;[I]t is the court&#8217;s duty to give effect to the intent of the Legislature as expressed in the actual language used in the statute. It is the role of the judiciary to interpret, not write the law. If the statutory language is clear and unambiguous, the statute is enforced as written. Judicial construction is neither necessary nor permitted because it is presumed that the Legislature intended the clear meaning it expressed.&#8221; People v Schaefer, 473 Mich 418, 430-431; 703 NW2d 774 (2005) (footnotes omitted).</p><p>Here, the Legislature exempted from the prohibition set forth in subsection 224(1) any federally-licensed &#8220;device . . . described in subsection (1).&#8221; MCL 750.224(3)(c). A silencer is a &#8220;device for muffling, silencing, or deadening the report of a firearm.&#8221; MCL 750.224(4)(a) (emphasis added). Had the Legislature intended to limit the exception in subsection (3)(c) of section 224 to machine guns and devices that eject, release, or emit gas or other substances, it would have limited the application of the exception to machine guns and those weapons and devices set out in subsection (1)(a) and (e). Instead, the Legislature chose neither option, electing to use statutory language indicating that any of the devices listed in &#8220;subsection (1)&#8221; qualify for the federal licensee exception to the state prohibition. Whether all of the devices listed in subsection (1) should fall within the exception for federally-registered devices is a policy determination for the Legislature alone to make; unambiguous statutes must be enforced as written. The wisdom of a statute is for the Legislature to determine and not the courts; the law must be enforced as written. Smith v Cliffs on the Bay Condo Ass&#8217;n, 463 Mich 420, 430; 617 NW2d 536 (2000).8</p><p>Moreover, since section 224 is part of the Penal Code and criminal penalties are provided for the illegal possession of a firearm silencer, specific rules of statutory construction involving criminal laws must also be considered. A fundamental rule of statutory construction is that criminal statutes must be strictly construed. People v Carlson, 466 Mich 130, 138; 644 NW2d 704 (2002). But see MCL 750.2 (requiring that the provisions of the Penal Code be construed according to the &#8220;fair import of their terms, to promote justice and to effect the objects of the law&#8221;). Any doubt whether conduct is criminal must be resolved in favor of the defendant. People v Jahner, 433 Mich 490; 446 NW2d 151 (1989). The fair and plain application of the exception set forth in MCL 750.224(3)(c) supports the conclusion that each of the devices or weapons &#8220;described in subsection (1)&#8221; of section 224 is exempted from the otherwise applicable prohibition of that subsection if possession is federally approved.</p><p>It could be argued that the Legislature&#8217;s use of the phrases &#8220;machine gun&#8221; and &#8220;device, weapon, cartridge, container, or contrivance,&#8221; which initially appear in subsection (1)(a) and (e), and then are repeated in subsection (3)(c), evidence its intent to restrict the exception to the enumerated items in (1)(a) and (e). Under this argument, the prohibition of subsection (1) would not apply based on the exception of subsection (3)(c) for a person licensed by the Department of Alcohol, Tobacco, Firearms and Explosives to possess, manufacture, or sell a &#8220;machine gun,&#8221; see (1)(a), or for a &#8220;device, weapon, cartridge, container, or contrivance designed to render a person temporarily or permanently disabled by the ejection, release, or emission of a gas or other substance,&#8221; see (1)(e) (emphasis added). A silencer does not fit either category, and thus, under this reading, would not be exempt from prohibition.</p><p>But this interpretation assumes that the Legislature mistakenly omitted from subsection 3(c) language it placed in subsection 1(e). Alternatively, it requires assuming that the Legislature intended &#8220;described in subsection (1)&#8221; to mean &#8220;described in subsection 1(e).&#8221; But under basic principles of statutory interpretation, language cannot be added to a statutory provision that the Legislature did not itself include. Empire Iron Mining Partnership v Orhanen, 455 Mich 410, 423; 565 NW2d 844 (1997); Farrington v Total Petroleum, Inc, 442 Mich 201, 210; 501 NW2d 76 (1993). Moreover, an interpretation that the Legislature intended to limit the &#8220;subsection (1)&#8221; exception to subsection 1(e) would require persons wishing to acquire any devices that disable a person through the ejection or release of a &#8220;gas or other substance&#8221; to secure a federal permit in order to qualify for the exception, which is not possible since the National Firearms Act does not generally regulate such devices, unless they are in the form of a poison gas bomb, missile, grenade, etc. 28 USC 921 and 922. A fundamental rule of statutory construction is that the Legislature did not intend to do a useless thing. Girard v Wagenmaker, 437 Mich 231, 244; 470 NW2d 372 (1991). Accordingly, the better reasoned interpretation, and the interpretation consistent with the rules of statutory construction that guide this office and the courts, is that a silencer is a &#8220;device&#8221; exempt from the prohibition of subsection 1 under the plain language of subsection 3(c).</p><p>It is my opinion, therefore, that the possession, manufacture, or sale of a firearm silencer IS PERMITTED in Michigan under MCL 750.224(1)(b) if the person is licensed or approved to possess, manufacture, or sell such a device by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives, as required by MCL 750.224(3)(c). Possession, manufacture, or sale of a firearm silencer by an unlicensed or unapproved person is a felony, punishable by up to five years imprisonment under MCL 750.224(2).</p><p>BILL SCHUETTE<br

title="AmmoLand Reports" href="http://www.ammoland.com/" target="_self">Ammoland.com</a>)- In a recent report released by the National Shooting Sports Foundation (NSSF), approved National Firearms Act transfer stamps for silencers, over seen and approved by the BATFE, has grown by 9% in the fiscal year.</p><p>The chart below represents the Bureau of Alcohol, Tobacco, Firearms and Explosives statistical records that exist on the total number of National Firearms Act transfer stamps issued by state <strong>Form 4s </strong>for approved silencers per fiscal year. States omitted from this report may not allow the sale of silencers. Number of silencers processed per Form 4 not available. *Fiscal year is defined as October 1-September 30.</p><p>Texas leads states with 3,621 approved sales, followed closely by Florida, 2,053 and Georgia at 1,153. Conspicuously missing are the anti gun nanny states of California, New Jersey and Rhode Island, who you would think would be first to encourage hearing protection and reduced noise pollution?</p><p>Silencers or Suppressors have long suffered from a negative image among the general public due to having been used and abused by gangsters, criminals, poachers, spies and assassins in both real life and in the movies. This has given them a somewhat unsavory image and an image that detracts from there value as a hearing protection device.</p><p>The general public are of the belief that silencers are illegal, when in fact they are quite legal and in general usage as a noise reduction device in much of United States. In the states where they are still illegal the Laws and Regulations on Noise Polution, Health &amp; Safety at Work etc are in direct conflict with Firearms Legislation outlawing the use of Suppressors on Firearms.</p><p><a

Wagner and Bureau of Alcohol, Tobacco, Firearms and Explosives Special Agent in Charge Stephen C. Herkins announced that Robert John Ronning, 42, of Salida, owner of Ronning Arms Inc. in Modesto, a federal firearms licensee, was arrested today on charges of illegal gun sales, including the unlawful transfers of unregistered silencers and a machine gun.</p><p>According to a criminal complaint filed earlier this week, ATF became involved in an investigation of a drug trafficking organization in approximately February 2009. As part of the investigation, quantities of methamphetamine, machine guns, and assault weapons were purchased. It appeared that some of the firearms came from Ronning Arms Inc. <a
title="Ammoland Supports CalGuns" href="http://www.calguns.net/calgunforum/showthread.php?t=148721&amp;page=1" target="_blank">More discussions about Ronning</a></p><p>Following the arrest of the initial targets of this investigation, an undercover agent and others were able to purchase two silencers, seven assault weapons, and a machine gun from Robert Ronning at his place of business, in violation of federal law.</p><blockquote><p>U.S. Attorney Wagner said, &#8220;Selling guns to unknown individuals, especially those without identification, is a dangerous business. Guns trafficked back to Mexico help fuel the cartels and perpetuate the violence over the border. Licensees who hide behind their licenses to traffic in guns violate the trust that the government bestows upon them.&#8221;</p></blockquote><blockquote><p>&#8220;ATF partners with local law enforcement agencies to aggressively pursue firearms traffickers who are diverting firearms from lawful commerce into the hands of violent criminals,&#8221; stated Special Agent in Charge Stephen C. Herkins.</p><p>&#8220;In this case, the illegal sales of several high-caliber firearms that were earmarked for the black market were purchased and intercepted by an ATF Agent acting in an undercover capacity. This is an excellent example of ATF doing what we do best, preventing criminals from possessing guns.&#8221;</p></blockquote><p>The maximum statutory penalty is 10 years in prison and a $250,000 fine for unlawfully possessing or transferring a machine gun and 10 years in prison for unlawful transfer, receipt and possession of an unregistered firearm and the related conspiracy. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.</p><p><a

American Tactical will provide a replacement shroud at no charge for each GSG 5 SD model sold or currently in inventory.</p><p>Consumers in possession of a GSG 5 SD model with the original shroud in place on the firearm are now in violation of the NFA. To avoid continued violation of the NFA, ATI asks that all persons in possession obtain a replacement shroud as soon as possible. We anticipate arrival of the new shrouds to begin by the middle of February 2010.</p><p>IMPORTANT: THE ORIGINAL SD MODEL SHROUD MUST BE RETURNED ACOMPANIED BY THE FIREARM SERIAL NUMBER BEFORE A REPLACEMENT SHROUD IS ISSUED. THE DIAMETER OF THE SD SHROUD IS 1-9/16”. DO NOT RETURN THE SMALLER CARBINE SHROUD.</p><p>WHAT TO DO:<br
/> If possible return your old shroud to the dealer where purchased and show him this notice. The shroud will be returned to ATI along with a list of serial numbers from the guns that the shrouds were removed. ATI will send replacements to the dealer for pick up at your convenience; ATI will be sending replacements as fast as logistics allow. The overall length of the suppressed weapon is significantly less than any other integral available, making this an excellent &#8220;packable&#8221; companion that won&#8217;t be left behind no matter how lightly you travel!</p><p>The OASIS consists of a replacement top end (suppressed, barreled receiver with adjustable sights) only and utilizes your grip, bolt, and magazine.
