Firearms Industry Lawsuit Alleging Process to Pass CT Gun Regs Violated Statutes & Constitution

NEWTOWN, Conn –-(Ammoland.com)- The National Shooting Sports Foundation (NSSF), the trade association for the firearms and ammunition industry, today filed suit in federal court for the District of Connecticut alleging that Governor Dannel Malloy and the leadership of the Connecticut General Assembly misused the so-called “emergency certification” exception to circumvent the safeguards of the normal legislative process and in violation of Connecticut statutory law in order to pass Senate Bill 1160, a package of strict gun control regulations.

The suit further alleges that enactment of the new law violates fundamental due process rights guaranteed by both the Connecticut and United States Constitutions. NSSF is asking the court to declare the law invalid and issue an injunction prohibiting its enforcement.

“A 139-page bill was assembled behind closed doors, bypassing both the public hearing and committee processes, and quickly sent to floor votes on the same day in both the House and Senate where legislators did not have adequate time to even read the bill. The governor then signed the package into law the next day.

All of this is in violation of guarantees citizens are supposed to have under Connecticut State Statutes and protections in our State and U.S. Constitutions for which our forefathers fought,” said Lawrence G. Keane, senior vice president and general counsel, NSSF.

“Our suit focuses on this abuse of process that has resulted in enacted law that does nothing to improve public safety, while resulting in adverse effects on law-abiding citizens, manufacturers, retailers and sportsmen's organizations.”

    Gee it sounds like Governor Malloy did the SAME thing that Cuomo did here in NY!! We MUST put an END to this MADNESS NOW!!! Politicians who break their OATH to the Constitutions of BOTH their state AND these UNITED STATES of America MUST be removed from office IMMEDIATELY!!!

    ALL federally-mandated or State-mandated background checks as a pre-condition for the purchase of a firearm are AND HAVE ALWAYS BEEN an egregious violation of the right to due process, the right to privacy in the exercise of rights, and the right to be secure from the federal exercise of undelegated power in that it presumes the federal government has the power to issue or deny permission to exercise a right, and it most certainly does not.     Anyone in law Enforcement or any government elected or not who violates any laws like this or any other laws should be fired and or impeached, arrested, and put in Prison for at least twenty five years and lose everything they own to go toward paying for them to be kept in prison! For sure let’s apply it to Obama,Biden,Holder,Pelosie,Reid,Feinsyin and many others! That would stop the crap!

    The state of Connecticut has scores of firearms manufactures and those who manufacture accessories, etc…We have not heard much from them in regard to these new frivolous gun laws that are being slammed upon responsible gun owners in the state of Connecticut…By saying and doing nothing they have become part of the anti-gun problem…By staying in the state of Connecticut and continuing to do business as if nothing is at risk is plain stupidity….Colt, Winchester, Ruger, etc. need get their heads out of the ying-yangs and vacate that state ASAP as was done by MagPul in Colorado…By showing cowardance these… Read more »
