Pacific Patriot Network under the leadership of the Oath Keepers has set up a security mission to protect the White Hope Mine and related claims in Lewis & Clark County, MT. The immediate aim of this operation is to act as a buffer between the miners and any unlawful action by the United States Forest Service (USFS).

Mission Statement is as follows:

At the request of Intermountain Mining, owners of the White Hope Mine located in Lewis & Clark County Montana, Pacific Patriots Network, Oath Keepers and III%’s mission is to ensure the mining claim owners 4th & 5th Amendment Constitutional Right’s are not violated and to prevent further unlawful action by the United States Forest Service.

Mining claims established before 1955 fall under the Mining Law of 1872. These claims are Public Domain and are treated as private property. The USFS has no legal standing or precedence for their recent actions, but has taken it upon themselves to require unnecessary permits, enacted stalling techniques, made threats of arson, and strong arm tactics to coax a generation of older miners to submit to unlawful authority, preventing them from working their rightful mining claim. The current claim being threatened has been in constant operation since 1924, therefore is not managed under the 1955 administrative regulation, which requires an operations plan. The claims are lawfully recorded with the miners controlling the surface rights and the resources on the land for use in their mining venture. Claims are not public property. In addition, privately owned gates have been locked into an open position to allow the public access to private claims. The use of fear tactics, harassment and unlawful action by Bill Avey, Helena National Forest Supervisor, will no longer be tolerated.

Intermountain Mining LLC, owned by George Kornec a Korean veteran and Phil Nappo a Vietnam veteran, have served a Notice of No Trespass on the White Hope Mine to the United States Forest Service (USFS), it’s employees, contractors and agents. Owners of the mine and all authorized parties will respond to any unlawful entry to the full extent of the law. Our intention is to run a peaceful security operation. Our position is to protect the rights of these miners thru a open dialogue with the USFS and reach a Legal & Constitutional conclusion.

NOTICE

This is NOT a standoff with USFS. We are NOT promoting any confrontation with USFS. This is a security operation for the protection of Constitutional Rights. If you have a different agenda outside of the above peaceful mission statement, we don’t want your assistance.

Please DO NOT make any type of threatening phone calls to the local USFS as it undermines our mission, professionalism and is unwarranted.

We are requesting a 12 hour and 2 hour notice of your arrival so the staging site will be prepared to receive you and in process you. Please plan your arrival between 0800 to 1900. Please notify us of your anticipated length of stay so that we can schedule personnel rotation most effectively.

It is late summer in Montana with wide temperature swings, rain, snow & high winds are possible. Please come self-contained for the duration of your stay. This is a camping situation, so prepare for that.

1. ASK THE FOREST SERVICE TO PRODUCE IF A VALID O.M.B.
(Office of Management and Budget) NUMBER THAT APPLY S TO
THE MINERS! MUST BE CURRENT!

2. THE MINERS HAVE A STATUTORY RIGHT TO MINE BY ACTS
OF CONGRESS, TITLE 30 USC, SEC. 22-54 !

3. ONCE A MINING CLAIM HAS BEEN PROPERLY FILED, IT
BECOMES PRIVATE PROPERTY! NOT SUBJECT TO
GOVERNMENT CONTROL.

4. ANY BREACH OF THAT PRIVATE PROPERTY IS A CRIMINAL
TRESPASS, UNDER BOTH STATE AND FEDERAL LAW!

5. The miner has a possessory title, shall have the exclusive right of
possession and enjoyment of all the surface included within the lines of
their locations, and of all veins, lodes, and ledges throughout their entire
depth, the top or apex of which lies inside of such surface lines extended
downward vertically, although such veins, etc. TITLE 30 SEC. 26

Sounds like a recipe for disaster. What the ‘Oaf Keepers’ need to do is hire some good lawyers and fight the battles in court so the whole thing does not implode for them. The ‘couch commandos’ need to stay home……

I’ve known Phil, one of the mine owners, for quite a number of years. He’s a good, honest man. The Forest Service has effectively shut down their operations and are trying to remove the rights to and control of he property from George and Phil – in a manner contrary to mining law. Any help anyone can give them will be appreciated. This one needs lawyers and money.
