Millions of Common Firearms Could be Banned by Three Pending New Bills!

Fullerton, CA -(Ammoland.com)- The California legislature is back in session, and politicians are wasting no time seeking media attention by introducing ill-conceived gun bans that would ban millions of commonly owned firearms.

On January 14, 2016, Assembly Member David Chiu introduced AB 1663 (coauthored by Members Levine and Ting and backed by current California Attorney General and U.S. Senate candidate Kamala Harris). Immediately thereafter Assembly members Levine and Ting introduced AB 1664 (coauthored by Assembly Member Chiu).

Not to be outdone by the Assembly, State Senators Hall and Glazer introduced a similar bill, SB 880, on Friday, January 15, 2016 in the California Senate.

AB 1663 (which is a retread of vetoed SB-374 from 2013) will turn all “semiautomatic centerfire rifle[s] that do not have a fixed magazine with the capacity to accept no more than 10 rounds” into “assault weapons.” Generally speaking, if you have a semiautomatic centerfire rifle and you can remove the magazine by pushing the magazine release button or your rifle has a “bullet button,” the rifle will be considered to be an “assault weapon” and you will be required to register the rifle as an “assault weapon” with the California Department of Justice. (A “bullet button” is a magazine disconnect locking device that replaces or covers the standard magazine release mechanism. The device forces a shooter to use a tool to remove the magazine. Under current law, the use of a “bullet button” prevents certain firearms from being classified as “assault weapons.”)

AB 1664 and SB 880 do roughly the same thing. They either redefine or rephrase the current definition of “assault weapon” to include firearms that are affixed with a “bullet button.”

All of these bills have one purpose: to redefine the phrase “assault weapon” in a way that will ban millions of commonly owned and lawfully possessed firearms. The term “assault weapon” is a legal term only, it has no technical meaning in firearms parlance. That’s why the gun ban lobby loves it. It means whatever they want it to mean. So the gun ban lobby is using these bills to expand the definition of “assault weapon” to affect widely popular and lawfully owned firearms. By redefining and expanding the meaning of the legal term “assault weapon,” these bills would dramatically expand the already byzantine legal definition of “assault weapon” and would ban millions of conventional firearms used  by hunters, target shooters, boy and girl scouts, and men and women who choose to own a firearm to defend themselves and their families.

In almost all instances, any one of these bills would require those who possess firearms equipped with a “bullet button” to register the firearm as “assault weapons” or face confiscation, arrest, prosecution, and jail. In almost all situations, gun owners would never be able to sell their firearms or pass them on as an inheritance.

Under each of these bills, the process of registering the firearm will require the owner to pay a fee and provide the following information to the state:

  • A description of the firearm and unique identifiers;
  • The date the firearm was acquired;
  • The name and address of the individual from whom, or business from which the firearm was acquired;
  • The registrant’s full name, address, telephone number, date of birth, height, weight, eye color, hair color, and;
  • California driver’s license number or California identification card number.

Registered “assault weapons” may never be sold or passed down in the family in California. Those who fail to comply face having their homes searched and their all guns confiscated. They could also face arrest, prosecution, and sentencing ranging from probation to jail. These bills will make another class of accidental felons out of law abiding people who, like the DOJ’s own experts, often can’t determine what an “assault weapon” is!

If any of these bills are enacted, then unless folks realize that their guns are now considered “assault weapons,” and unless they register their guns and pay a fee (tax) to the state, millions of guns that have been owned safely for years will become illegal to possess and their unsuspecting owners would become felons at the stroke of a politician’s pen. That has happened many times in the past, because the state never allocates sufficient  funds to educate gun owners about the requirements of new laws.

Are you mad enough yet? Well, add this to the mix: Harris' support for these bills is the height of hypocrisy!  It was her very own DOJ that, in 1999, defined “detachable magazine” as it is currently defined in the California Regulations and allowed magazine disconnect locks like the “bullet button” to be used to slow down the reloading process. That definition took almost a year for DOJ experts to finalize, after considering tens of thousands of public comments, including multiple letters submitted by lawyers for the NRA and CRPA. Now, sensing an opportunity to get attention she can use in her senatorial campaign, she doesn’t like it. But if she was serious about reducing gun violence, she would clean up her own messes. Not one but two California Auditor reports confirm that Attorney General Harris has failed miserably to maintain the databases and records that she claims are critical to keeping guns out of the wrong hands. Michel.] Her support for these bills is an effort to distract attention away from her abysmal failures, rather than a legitimate effort to protect us from violent felons and determined suicidal terrorists who can get any gun they want.

Needless to say, the passage of any one of these bills would be disastrous for millions of California gun owners. Are you registered to vote and to permanently vote by mail? You will get a chance to show some politicians what you think of these bills in the June 2016 primary. The critical November election will then follow. With the stakes this high in the legislature, and with anti-gun initiatives looming, shame on any gun owner who isn’t. DEMAND that your gun owning friends register and vote!     1. I just don’t understand the fear these legislators live under. Their disregard for all the gun owners and their way of life, is tyrannical and insulting. People who want kill people will do just that with what ever is available. They don’t care. Look at the suicide bombers and the devastation they cause. I’m amaze that our leaders have grown to control our freedoms and constitutional rights based on their unfounded fear. And misinformation. Its the people who make choices to kill. Who will use anything thing to fulfill their purpose. And it’s sad. Look at the German pilot. He used a plane. We don’t have all the answers. And it will continue to happen. What we remove today will only be replaced with another weapon. But let’s not destroy the freedoms and lively hood we have from them. Gun owners are people to.

    2. As a California resident I am scared to death! Seriously I’m worried about this one. It’s extremely sad that most CA gun owners won’t even lift a finger to fight for their gun rights but they say stupid crap like..U want my guns come and get em. Really?? Get tf out of here..

      1. AMEN! As a California resident and Gun rights activist I agree! Introduce your friends and family to shooting sports, actively participate in your community. Show the liberal sycophants that gun owners are real people who care about their community and the safety of their neighbors.

    3. Someone should develop a video game depicting one or more shooters (i.e., bad guys INTENT on killing), and innocent unarmed victims. Base the game on real-world events. Let’s see how many politicians can garner a winning score, which we shall defined as no innocent persons being killed, raped, injured, etc.. THEN, add defensive weapons for the would-be victims and re-play the simulation. Better yet: A scenario in which a large gathering of unarmed people are mowed down by bad guy(s) because nobody has a CCW or they have to spend precious time screwing with a bullet button, or [fill in the blank]. Include variables for magazine capacities. Include the option for at least one surviving vicitim to successfully dial 911 with their last breath. Include a slider-bar for police response times (use actual measurements – no “Beam me up Scotty”) Include various items that the soon-to-be dead victims could throw at their attackers: desks, chairs, pencils, spitballs.. Maybe even a volume control for when they shout “Please don’t hurt me!”. (Presumably, a louder voice would give that terrorist real reason for pause?) I believe one could develop a game simulator that is firmly grounded in reality using historical real-world crime scene analysis (i.e., no finger on the scale). ONLY THEN, when these well-meaning, but woefully naive and uninformed politicans can manage a winning score on the game, would they be allowed to introduce more gun regulations.

    4. California was a really great place about thirty years ago. There was a relatively decent amount of personal freedom. No spygrid yet. You could pay cash for a plane ticket and be off to anywhere in the country, or Mexico. No questions asked. Wages were good. Work was abundant. Public schools still had woodshop, metalshop, autoshop, home-ec, and a cornicopia of other valuable vocations. Then something terrible happened. The liberals took over. Constantly offended, nosy, entitled liberals destroyed every freedom we ever had. Now they want us disarmed. They want us to be submissive and apologetic. Incapable of resisting. When they finish with us though; the rest of you will be on the menu. Please believe that we talk, we educate, we vote, but the sad fact is that we are outnumbered. Liberals believe in the fantasy that their overlords will see to their every need. The millions upon millions who receive welfare, wic, ebt cards, and countless other handouts have a bested interest in keeping that free stuff coming. That means vote democrat. Blindly. So, that’s what they do, and now here we are. The last generation of conservatives being drowned in in legislative cespool.

    6. California is quietly engaging in succession from the United States. For more than 150 years Mexico has wanted its land back. Now that the minorities are in control of the legislature they are passing laws that will cause the white people to move away. I and several other commenters (supra) did.

    7. I have to wonder who will they send to enforce these laws. When the doors are kicked in angry citizens will be waiting. Maybe the politicians who are advocating these\ gun grabbing laws had better reconsider as their safety their families safety and their very lives may be at stake. Off course they have not thought things through and are blissfully whistling past the graveyard. This very fact tells me that these elected gun grabbers are extremely stupid.

    8. If CA legislators REALLY want to stand up for what they think is right for everyone else, they MUST enact a law that makes it illegal for any movie production or media company doing business in CA to use or depict the use of any item deemed to be an “assault weapon” under CA law!

      To not create such a law should be grounds for lawsuits against the State of CA, media or production companies and actors for several things.
      1. Generally aggrandizing the use of “assault weapons” .
      2. Depicting the use of “assault weapons” as normal recourse in conflict resolution.
      3. Showing “assault weapons” in use acts a training aid for use of same.
      4. Does not accurately depict the legal climate and the actual personal legal aftermath of weapons use in conflict resolution. Thereby creating a climate of unreality of consequence for such use.
      5. Encourages impressionable minds to view use of “assault weapons” as a normal choice and option in conflict resolution.
      6. A new movie/game rating should be established to indicate the use of “assault weapons” in the production. This would be NC-17AW
      6a. Any production depicting “assault weapons” should be rated NC-17AW by The Motion Picture Association of America’s (MPAA) rating system is administered by the Classification & Ratings Administration (CARA).
      6b. Anyone wishing to view a production rated NC-17 due to depiction of “assault weapons” should be required to obtain a NC-17AW viewing permit after a suitable background check to determine if they have no record of instability or criminal history that would make viewing such material potentially encouraging to act similarly in real life.
      7. Anyone viewing or attempting to view a NC-17AW production without the required NC-17AW permit should be guilty of a gross misdemeanor on the first offense and class-3 felony on a second offense.

    9. I hear the complaints about Calf., and as an Oregonian I have a very bad taste for them , But most of the slimy POS”s are in the eastern half of the country. Where did the POS President come from? Clinton, Sanders, and the most restrictive gun control laws? I would agree with letting all the liberal Californians fall in the ocean in the next big earthquake but please make sure all the slime bag liberals from the east are there visiting when it happens!

      1. I agree 100% with you Owen. California has become this horrible crime laden, liberal land that breeds filth and corruption. Not all of us Californians are that way, but it sure sms like the vast voting majority are. Between la la land, and the huge influx of liberal east coasters into silicon valley, we have rapidly declined beyond belief. The east coast liberals have really helped destroy this state faster than anyone. I’ve lived here for almost 60 years, and my wife and I are pretty sick of it all, and are now thinking about moving out. The trouble is, where? Seems like everywhere is going liberal, and Oregonians hate us, for good reason.

There is nothing you can do there for rules and regulations and gun laws are to help the criminals and make victims of the good guys.       Or, that outlawing any certain type, or kind of firearm will make an actual difference to real life ?

      Improve the safety of the environment that real people actually live in day to day ?
      Do they really think anyone actually believes a word politicians say ?
      But mostly, I’d like to know; Do they honestly believe any of the restrictions placed on law-abiding citizens on their right to keep, and bear arms, somehow “protects” us ?
      The criminals still have their arms, in fact, not one of the way too many “gun control” laws so much as targets these guns.
      The facts in evidence tend to indicate unarmed law-abiding citizens are not protected by, or safer from one, or more armed criminals that intend to kill many of them, at their convenience.
      Further, “protection” provided will arrive an average of 17 minutes after the first 911 call.
      I’m not a killer, and so cannot think exactly what they consider when they plan. Fuck, I can’t imagine why anyone would want to go kill a bunch of people that have done nothing to harm them, or know they exist.
      I can’t imagine that “…what a reasonable person would conclude…” on the safety of this kind of legislation, and of the politicians that introduce this bullshit.
      Let’s ‘re-elect all of them….again. That will change things in Govt., and if it doesn’t, let’s ‘re-elect them all again….

      Find one government in the history of humanity that felt a need to document a “RIGHT” for it’s ARMED FORCES to possess ARMS.
      Hundreds of governments have banned their Citizens from “keeping and bearing ARMS” but NEVER has a government banned It’s TROOPS from doing so.
      The claim that the Government wrote the 2nd Amendment to give Our ARMED FORCES a “right” to carry ARMS is S-T-U-P-I-D.
      The only reason for the Second Amendment is to clearly spell-out the GOD GIVEN RIGHT of INDIVIDUALS to keep & bear ARMS.
      THE reason for the BILL(list) of RIGHTS was to codify INDIVIDUALS’ GOD GIVEN RIGHTS.
      Has there ever been a government that was not chock full of it’s “rights” up to and including declaring itself to be the Lord God Almighty?!
      Does the 1st Amendment mean the GOVERNMENT is allowed to give speeches? Try shutting up any Government.
      Anyone who tells you the 2nd Amendment applies to the Army or State Militia, is telling you they think you are STUPID.
      There has NEVER been a government that felt it had to codify it’s army’s/soldier’s “RIGHT” to “Keep and BEAR ARMS” because there has NEVER been a government that refused to allow It’s own soldiers to KEEP and BEAR ARMS!

    18. California is an okay place to visit but I sure as hell would not want to live there. Comment is not meant to disrespect my fellow Americans in California. Californians can’t seem to get a break. They’re overrun by illegal aliens and they have some of the crappiest gun laws in the country. I love the state of Missouri’s gun laws! There really is not that many gun laws here beside the traditional don’t take your gun into a police station, etc. People has been open carrying since the state was created and if you get your CCW permit you’re golden.
