Activist 4th Circuit Strikes Again, Upholds “Assault Rifle” Ban

West Virginia – -(Ammoland.com)- Less than a month ago, I updated you on a 4th Circuit of Appeals ruling that says the possession of a firearm represents a “danger” to law enforcement, and thus justifies a search of your person.

Just this week, they released an opinion that upholds Maryland’s “assault rifle” ban and magazine restrictions. It ruled that these ridiculous bans are constitutional. The 4th Circuit covers West Virginia.

The West Virginia Citizens Defense League has had astounding success for years here in West Virginia. But let this be a stark reminder that the enemies of liberty encircle us. Let this be a warning against resting on your laurels. Even pretending the fight is over can be fatal to your liberty.

Now Some Good News

WVCDL’s primary legislation for the session has been introduced, or will be introduced very shortly.

  • 1. Employer parking lot protections: Prohibit employers from having policies that keep you from locking your firearm in the car while at work.
  • 2. School drop-off/pick-up: Allowing you to drop off and pick up your child on primary and secondary schools, as long as you don’t get out of the vehicle.
  • 3. Statewide Sunday hunting: This will allow Sunday hunting on private land. (Public land is possible, but taking the temperature of the legislature, unlikely this year.)

Additional bills are in the till, including State Park preemption and county park preemption.

At present, things look really good for all five of these. The WVCDL is actively working with Wet Virginia DNR on several of these bills, and the outlook is positive. DNR has been a solid ally on hunting bills in WV for a couple of years now, as we are a pro-hunting group.

Being pro-hunting necessarily means being anti-poaching, and DNR likes that we have a very low opinion of poachers.

Lobby Day was a resounding success. West Virginia’s most important Second Amendment day is always a good time. Those of you who were there for the first time, thank you! Next time, bring friends!

Commentary from legislators was, as usual, highly positive and complimentary. West Virginia Citizens Defense League , you are a class act, and most of those legislators love you.

The ones that don’t… well, they really don’t. But that’s ok. Our goal is to fill the building with legislators that do. (I’m nearly salivating for the next election, how about you? It’s going to be a fun time.)

I`m quite sure the judges of this court value their lives, and believe they are entitled to protect them. Mine is no less valuable. My ruling is I will keep my gun and magazine, loaded at all times.

Fourth circle jerk more like it . If you sense contempt that’s because I have an abundance of it for them .

Alright… So, what and where (IF any) does the Maryland ruling affect an AR15 or it’s magazine capacity in WV. OR is the article just pointing out the people in WV cannot let their guard down because the 4th circuit court covers them ?
