AB 736 Attempts to Tax California Gun Dealers Out of Business

Firearms Policy CoalitionSACRAMENTO, Calif. -(Ammoland.com)- On Monday, August 21, 2017 the California State Senate Appropriations Committee will hear AB 736 (Gipson), a measure which imposes civil fines on Federal Firearms Licensees (FFLs), which the Firearms Policy Coalition (FPC) believes will drive gun stores out of business.

Firearms dealers are among the most regulated small businesses in the state. They are often inspected and audited by both state (California Department of Justice) and federal (Bureau of Alcohol, Tobacco, Firearms and Explosives) agencies.

Violations discovered from these efforts are most often inadvertent record keeping or operating errors by a retailer or their employee; and while worthy of notation, notification and correction, they rarely rise to a level worthy of a fine.

“AB 736 only adds to California’s infamous anti-business and anti-second amendment climates”, stated Craig DeLuz, spokesman for FPC. “This bill will only serve to drive firearms dealers out of business, making it even more difficult for law abiding citizens to exercise their right to keep and bear arms.”

FFLs play a major role in facilitating the legal transfer of firearms in the state of California. As their numbers dwindle, it reduces that opportunity for law abiding citizens, especially in rural communities, to legally obtain or transfer their firearms.

“It’s counterproductive for the state to keep passing more and more laws for gun owners to comply with, while at the same time putting out of business those entities (FFLs) who have been designated by the state to facilitate that compliance”, noted DeLuz. “That is, of course, unless the goal is to eliminate the right to keep and bear arms by making it impossible to comply with the law.”

Firearms Policy Coalition is a 501(c)4 grassroots nonprofit organization. FPC’s mission is to protect and defend the Constitution of the United States, especially the fundamental, individual Second Amendment right to keep and bear arms.

Actually, you have it exactly right. The intent IS to disarm the state. Except for government and criminals, but pardon my redundancy Yes, just like in Chicago, NYC, DC, they… Read more »

The criminals in the Khalifornia legislature have put laws in place to ensure the DEMOCRAPS will always be in power. The state is a cesspool of DEMOCRAT FRUITS AND NUTS that rule their way. I say force the state to leave the union and maybe with a little luck North Korea will destroy it.

We all know the gang bangers and the criminal element will IGNORE any and all gun laws.

The California State Government is only enabling the predictable and inevitable black market in weapons and ammunition, legally purchased at retail elsewhere and simply driven across state lines. No different than New York organized criminals openly selling their North Carolina purchased cigarettes.

The California legislature is doing what was done in San Francisco, which has no gun stores in its boundaries, prohibits hollow point bullets, prohibits the selling of ammunition and they have gotten away with stripping away those peoples rights. Now they are working to do the same thing to the rest of the state. Ammunition purchases through FFL’s only (or other licensed seller), no out of state mail ordering, licensing fees to sell ammunition, licensing to buy ammunition. They are taking the passive approach to making firearm ownership so onerous as to get most firearms owners to simply give up.

Absolutely rediculous what you pencil pushers are doing out there!! You morons have some of the strictest gun laws but your gun violence is higher than most states that do not have such strict gun laws!! So doesn’t that tell you that it doesn’t work?!! No matter what you think you are helping with gun violence it’s proving it doesn’t work because the bad guys don’t follow laws and will never change!! You remember what Thomas Jefferson said ” All tearany needs to gain a foothold is for people of good conscience to remain silent” You are putting the innocent… Read more »

Unfortunately you are applying logic to people who simply hate guns. They will never change.

California isn’t even in the top 10. Red states with very laxed gun laws are all near the top, Alaska being #1 in gun violence. California ranks #8 in LOWEST rate of gun violence with New York being #3, the two states with some of the strictest gun laws out there. Google is your friend.

How about those gun violence stats for Chicago, smart guy? Google that, snowflake.

You better Google some more, and think for a change. Look at the demographics of the “high rate states,” look at the cities where the homicides are prevalent and then investigate the criminal activities that led to the high homicide rates. Alaska has a huge alcohol and drug problem among the native population that accounts for a disproportionate number of suicides, and these suicides sway the ranking. Take out suicides as these may be “by gun” but the gun is not a root cause for suicide; mental health issues and individual circumstances determine the need for self-destruction – a determined… Read more »
