Woman’s Arrest Underscores Need to Understand States’ Different Gun Laws

New Yorkers can breathe safer now, right? (News 10 ABC)

USA – -(Ammoland.com)- Yet another citizen is facing criminal charges for not realizing that gun laws vary from state to state.  Hayley Leach, a Colorado woman, was arrested when she attempted to check her gun in at Albany Airport for her return flight home, News 10 ABC reported.

Leach has since been free released on bail but must return to New York in February. That means in addition to facing charges, she’ll need to endure the expenses of retaining a lawyer, traveling back from Colorado, and paying fines and court costs. That she lawfully owned her gun in Colorado and that she tried to obey the federal law by declaring her firearm with TSA does not matter to those intent on making her pay. It’s reminiscent of earlier similar cases, including that of Donna Marie Gracey, the Florida woman with a concealed carry permit who was arrested last month for having it in New Jersey, or the ordeals of Shaneen Allen and others. None of them had criminal intent.

It points to the need for national reciprocity and recognition of licenses between states, as driver and marriage licenses are honored. Better yet would be so-called “Constitutional carry” as many states now enjoy, with more considering such legislation. But don’t hold your breath for that to go nationwide any time soon.

As an aside, it’s telling that the News 10 report stated:

“Customers are coming from places like Vermont or Massachusetts where they legally own their guns and have concealed carry permits.”

Vermont requires no permits and was the model for other states to follow. Before the practice became more widespread, it was generally called “Vermont carry.” One would think professional journalists would learn their subject matter before presenting their voices as authoritative, but media ignorance on guns is something we’re not likely to see rectified any time soon. Still, it does help understand the roots of the fear and hostility we see on display in so much of the mainstream press.

“Unfortunately for her it is her own fault for not checking the gun laws in the state she is traveling to,” one reader commented. He’s taken some flack for that from other readers, no doubt because the way he stated his point blamed the victim rather than the tyrannical edicts. Still, there’s truth to what he says.

“Except for NH & Vermont, the North East states are profoundly anti-gun & everyone traveling should know that,” he continued. “There are books available that list the gun laws in every state & it is the gun owner’s responsibility to know what those laws are everywhere they intend to travel. I doubt she will get jail time, but I bet it will be a hefty fine. She better be happy she wasn’t in NYC or it would have been far more costly.”

It’s tough to argue with that. And I say that as someone sympathetic to “I will not comply” and “Defy existing gun laws” sentiments.  But you need to do that with eyes open.

If you own a gun you owe it to yourself to know what the laws are so that you don’t inadvertently find yourself and those who depend on you in a world of hurt. And chances are if you’re oblivious to those laws, you haven’t been sufficiently motivated to assist in defending the right to keep and bear arms against such infringements. That means chances are you’re reaping the benefits of pro-gun efforts in the legislatures and courts while letting other gun owners carry the load.

If there’s a silver lining, it’s that on occasion the victims of such edicts turn into effective voices of reason, with an ability to expand appeal beyond the “old white man” stereotype. Ms. Allen has grown and risen to the challenge of leadership. Perhaps Ms. Gracey and/or Ms. Leach will, through their stories, help offset some of the Opposite Day “progressive feminist” rhetoric telling women their safest course is to be defenseless against abusive and predatory assailants.

Someone said there were a lot of in answered questions. Like where did she get the gun. Commonsense nonlibatard point of view. She LEGALLY brought the gun from her home state. She was trying to obey the law. New York’s ILLEGAL laws should b done away with. What was gained by her arrest no criminal action we’re taking place. If state feels it will be a pain for them they will drop it. The US Supreme court has ruled on many matters that other States marriages licenses etc. Use the gay marriage ruling as the basis for her defense.

My apologies Alan. I read it the wrong way. I took it as being accused of being apathetic regarding 2A issues. If anything, I’m too vocal! Ask Vanns40…I often get…excited…when I read or see something against our 2A rights, basically because it’s illegal. I’ve written not only my representatives but other states representatives as well. Admittedly, I’m not much of a phone person or I would have called too…but I get a little defensive if I think I’m being accused as part of the problem. I probably just need to stop commenting.

Every CCW/CCH training course, every gun store, gun range SHOULD include notification about reciprocity and the anti-gun states. The gun industry owes it to the new shooter/gun owners how to find the laws in their home state and in other states.

I hate to say it but this is one dumb lady. I mean after everything that’s happen over the years anyone who knows anything about guns knows that you shouldn’t ever attempt to carry in states like New York, New Jersey, California, Oregon, etc. Hell I rarely leave the South because I know I won’t be able to carry it with me and if I do there’s so much stacked against me, even if you are abiding by the law.

@REd – She’s not necessarily dumb, she may be like a lot of first time gun owners and not understand that laws on guns are different in other states. She might not have thought that she would be arrested for notifying the authorities that she was carrying. Couple of points re the above. 1. The lady, lacking “connections”, very likely could not have obtained a pistol permit. Fact Not Theory. 2. The attitudes of line police officers probably are markedly different from the attitudes of police executives, who are political hires, serving at the pleasure of their political patrons. The answer to your question as to why law makers aren’t arrested might well be as follows. Because law enforcement operates pretty much in the service of and or at the beck and call of the referenced politicians, rather than in the service of the populace.

I visit family in NJ Newark area several times a year, I never bring any firearms with me, I rent them at
the range, Gun for Hire. $25 is a small price to pay compared to $20K for a lawyer and incarceration.
I escaped from LI NY in 1991, I have more stuff then that gun in Vegas, all lawfully owned and operated!

If NY recognizes my out of state marriage license, drivers license and any professional licenses (if reciprocal),
then my out of state concealed permit (or license) should also be recognized at a traveler.

If you walk out of the airport in NJ or NY, you are in violation, if you spend the night inside the airport you are OK,
Port Authority police will ask you were you spent the night, if you say hotel you are arrested ON THE SPOT.

DO NOT have any empty brass or rounds in your carry on bag, you will be arrested.

@John Dunlap: Many times I say follow the law, but not when the law is wrong. This, and other similar cases, happen to fall under a class of cases where jury nullification is justified and juries need to be aware of the power they actually have despite what the law says. This would put a quick end to what I consider malicious prosecution.

I imagine that any and or all prospective jurors who made any reference to Jury Nullification would be quickly booted. I once served on a criminal trial jury. No such questions came up. This is complete BS and both states, NJ and NY are clueless about crime. I lived in both states and one only has to look at Brentwood on Long Island and see why it is necessary to have a CCW. According to the United States Election Project, an average of 59.7 % of eligible voters, voted. When you factor in that probably nearly a half of those were democrats & anti anything Republican, it’s easy to see why these anti-gun officials stay in office. TSA does not flag for guns. If the gun is declared at the ticket counter in their checked in baggage (it cant go on carryon period), then it will be ok to travel.

I’ve read multiple accounts of someone unexpectedly diverted into New York and/or New Jersey and stuck overnight there, WITH lawfully checked handguns in luggage (not carryon). Arrive at airport nxt day to fly out of a state they never intended to enter, the local gendarmes are right there like stink on soiled nappies…… to arrest and charge with multiple felonies for daring to possess what they carry every day at home, but in these cesspool jurisdictions that fail to realise that their state MUST uphold the Constitution. What if a patron was simply not available to pick up their checked luggage that contained a firearm? Would the airlines maintain control of that checked luggage if the customer could not be immediately notified. I don’t think that the airline would just set the customer’s luggage out on the curb knowing that it contained a firearm. The airline would be in big trouble with the federal and state authorities, not to mention violating the bailment with the customer.

For this very reason when I flew to San Diego in July …I opted to play the odds game and just hope to survive 7 days in California …unarmed…rather than run the risk of California’s B.S. gauntlet. Couldn’t legally carry it loaded anyway …so why go thru the TSA and prolong check-in ….

I think the article is mistaken, TSA wouldnt take or fine the woman. It had to be the airline that turned her in. TSA only discovers firearms once they enter the checkpoint in either the xray or the baggage xray. If discovered during screening and it has been declared TSA does not confiscate the weapon, so she had to be turned in by the ticket person that took the declaration. Even with this, everyone still needs to know other states rules, and certainly and most importantly, everyone needs to get congress to pass universal carry!!!

Why are they complying? Why are they declaring that they have a firearm. Just because it s a law does not me you have to comply with the law. It is her own fault for thinking the goverment is not there to help, the goverment is there to enslave and punish.

Because if they dont comply by declaring the firearm, when the bag goes through the baggage scanner and it automatically alarms that there is a firearm, and there is no declaration, THEN the trouble will trickle down with a TSA fine AND local DA office fine, among other things. You must declare or chance a very worse and extremely worse scenario. When you declare you should have NO problems…….at least with TSA.

Usually it is the first time and younger gun owners who fall for these laws because they own a gun but don’t stay up on gun ownership information.
The saddest part of this is that there are still unconstitutional laws being enforced. If the SCOTUS would do their job and stop turning down these gun law cases, they would be proven unconstitutional AND repealed. Where is the NRA and USCCA? This proves we need reciprocity for CCW/LTC license holders nationwide, just like drivers licenses. Gun ownership is a right protected constitutional amendment, driving is privilege granted. Quit buying firearms manufactured in these states, so that they might feel it in jobs lost , and disallow all the N.E. states from reciprocity carrying in other states. Start treating them like they are a foreign country , which they are from the rest of the U.S. Maybe big manufacturers of firearms will move elsewhere away from the north east.

It is sad for her, an honest citizen, caught up in the legal machine of N.Y. Her case will be processed and she will be convicted of a crime, though she had no intent to commit one, in order to steal her gun rights from her. Still, ignorance of the law is no excuse. Especially so in this case, as there has been news story after news story about this very thing.

Every time we travel as we pass through certain states my wife has to take her gun out of her purse and give it to me. Thanks to HR218 only one of us is forced to disarm. National reciprocity should have been the law years ago and there is no excuse for these rinos holing it up today.

@Scott, there is no profit in a state observing the Constitutional Civil Rights of individual persons. There is great profit in people control. States, cities, and counties refusing to recognize the Constitutionally enumerated Civil Rights of individuals know exactly what they are doing and will continue using threat of force and force of arms as long as they can get away with it.

Mandew, that is due to the fact that laws are ever changing, and can literally change over night, such when VA AG Mark Herring made CC holders felons, literally, over night. Also, NYS did the same to their firearm owners with their “SAFE” Act, again, literally, over night.

One can trust a politician only after they are deceased, before then one literally needs to stay awake 24/7 to ensure they aren’t abbrogating our rights.

There is much more to this than is being told: How did she get the weapon to NY? Where did she get the handgun in NY if she didn’t bring it with her? Did she buy it there without understanding she could not get it home? Did someone give it to her? Many questions not answered.

On a different note, National Reciprocity would give the #DCvers in Washington control over CCW (research Real ID and see the disaster that is) instead of the states where it belongs (until we change the states into Constitutional Carry).

She checked it in Colorado, which is where the gun was legal. This unfortunately allows you to bring it to a state where it may or may not be legal. When checking it in NY on the return flight is then where the problems began, as it is illegal in NY.

@js, It seems to me that she has a U.S. Constitutional Civil Right to keep a fire arm and bear a firearm everywhere within the jurisdiction of the Constitution of the United States. It occurs to me that new york, a state subject to the US Constitution, has a series of statutes that are contrary to the US Constitution and is enforcing those statutes by force and threat of violence.

It is a well-known issue that sometimes a flight from one place where you are legal to another place where you are legal can get diverted temporarily (like overnight) due to weather or other reason, into a place where you are NOT legal. All you need to do is make the mistake of claiming your luggage for the overnight at the free hotel, and you are legally screwed. TSA regs prohibit luggage being in the aiarlines’ care overnight, even if the continuing flight is already booked. If I refuse/neglect to claim my handgun containing checked bag for those forced overnight layovers, the airline cannot hold it then put it on the next flight.
