In late January, a Colorado teacher, while traveling in NY, was arrested by local authorities at the Airport in Albany, NY (ALB) as she declared her legally-owned and correctly packaged-for-travel pistol.

Ft Collins, CO –-(Ammoland.com)- In late January, a Colorado teacher, while traveling in NY, was arrested by local authorities at the Airport in Albany, NY (ALB) as she declared her legally-owned and correctly packaged-for-travel pistol (in checked baggage) to SW Airlines for her trip home.

TSA enforces federal law, so they don’t care. But local authorities, enforcing state law (or at least their interpretation of it), made the arrest, after SW Airlines turned her in.

This is just the latest in a endless series of arrests by state authorities in NY, NJ, MD, CA, et al of hapless out-of-state gun-owners who made the mistake of trying to fly out of ALB, JFK, LGA, EWR, et al, or who voluntarily “reported” their guns to local police, naively thinking they were thus in compliance with local laws.

Even people in possession of empty magazines have been arrested!

In response, many writers have emphasized that, when traveling certain places, you must “know the law.”

Unfortunately, that provides scant protection.

As I’ve said before, “knowing the law” is probably impossible, because in reading the law, regulation, guideline, or rule, you will still not know how, where, by whom, or even if, “the law” is enforced.

What you really need to do is “know the agenda!”

Here it is.

In any state dominated by Democrats (like NY), gun-owners, local and out-of-state, will be mercilessly harassed, even thrown in jail, at every opportunity, and based on the most feeble of excuses. Cynical Democrats calculate that gun-owners don’t vote for them anyway, so they have nothing to lose in singling us out for punishment. That is their long-standing “agenda.”

Seeing innocent people rotting in jail doesn’t concern them, any more than it concerns Madura, down in Venezuela.

My advice is to stay out of NY and other states mentioned.

When you do travel out-of-state:

  • (1) Maintain a low profile
  • (2) Don’t talk about guns with anyone
  • (3) Don’t “volunteer” information about yourself, nor your business
  • (4) Don’t answer questions that weren’t asked
  • (5) Don’t approach police and ask about local gun laws
  • (6) Don’t fly-out of airports mentioned above
  • (7) Don’t enter any building, nor “attraction,” where they are “wanding” entrants
  • (8) Keep anything that could be identified as a “weapon” discreetly out of sight, out of conversation
  • (9) Stay away from crowds, particularly events with political overtones
  • (10) Don’t be “out” late at night. Conduct business during daylight hours

Remember, leftist politicians, including most Democrats, want all Americans forcibly disarmed.

When they get in positions of political power, they predictably use persecution and harassment to enforce that agenda, regardless of what “the law” supposedly says.

Don’t expect protection from our courts, nor our Constitution. Where Democrats rule (and they mean to rule), the fix is in.

The only solution is for ALL states be FORCED to abide by the constitution. Requiring a permit for a concealed weapon is a reasonable precaution for public carry as felons and psychos are unlikely to possess said permits. Open carry states should require such permits for the same reasons. I, personally, do not advise anyone to avail themselves of the open carry option, since it makes one the target of any criminal types. If they are planning anything, they’ll take YOU out first. Here in Md., We had a case of a CCW holder from Fla. Getting pulled over by toll facilities police, outside of Balto., WITHOUT A TRAFFIC VIOLATION. He and his family were en-route to a family deal in Jersey, so had no firearms or accoutrements with.them. they spent 4 hrs. Separated from each other, on the side of the hwy., While the car was torn apart in a search for a gun that wasn’t there. I suspect his Fla. Tag got ran, and flagged him as a CCW. You can always UPS/FedEx/USPS your long gun to and from a hunting trip. Not sure about handguns.
When driving through one of these states, secure all firearms, ammo AND accessories in a locked container. If stopped, say the container contains “valuables”. Then shut up.

You can get in even more trouble in a supposedly gun friendly state carrying concealed if you are unaware, for instance, that state just repealed reciprocity agreements with your state.

Most such paranoid arrest-them-and-sort-it-iut-later states require TWO separete locked hardsided containers, just like TSA do. One for ammunition, the other for the hardware. Yes, you can still send long guns via USPS legally. NO ONE but an FFL can ship handguns via USPS. And then, only FFL to FFL, never to private party non-FFL. Once an FFL has it “in inventory” (meaning it is at his place, cause he signed for it for the postman) he MUST conduct a new BGC before he can release it to you, for a fee of some ridiculous amount. I believe that if it is necessary to have your sidearm when traveling you can make contact with an FFL from your start point and make arrangements to have your pistol sent to an FFL in the state you are going to, it may be costly.

Is it a dumb law? YES, but is the law. and Ignorance of the law or disagreement with the law is not a defence in court. A simple google search will tell you that New York do not recognize other states permits, New York City do not recognize the rest of the state pistol permits to tell you more. So the article focus on the wrong aspect, why not tell every gun owner to educate themselves on the Law of the states they are visiting. Here’s the problem, the GCA of 1968 has a clause allowing the legal transportation of firearms into and out of and through the USA. This law is the supreme law of the land and supersedes all state and local laws. Problem is the democrat run courts ignore this federal protection and convict/uphold convictions, which in turn motivates the law enforcement agencies to arrest you and violate your civil rights, and profit from it.

And ANY lw that infringes upon MY right to keep and bear arms is in that category. @RR, But it may not be the law, as these states statutes offend the U.S. Constitution, and that is a defense. On another note: if people find themselves in a position that they have to pick up their checked firearms, for a variety of reasons, and the airline employees will rat them off to local cops, then the patsy should shut up and absent themselves so that the airlines can not force them to pick up their checked firearm. And THERE is the rub. Why did SW Airlines “turn her in?” If the story is accurate, she was merely attempting to check a properly prepared firearm. Do we have local employees of the airlines turning people in when they try to check a firearm?

The catch in this case is not the travel, it’s the possession. Travel is covered under federal law, sort of. The way they get these folks is illegal possession of a firearm in non-free states. So legally you can’t possess a handgun while in NJ and NY without first having a permission slip from the local state authorities. Doesn’t matter if you are legal in your own state or anywhere else in free America. Once you cross the boarder you need the freedom pass. Excellent point. WHY do SW and other airlines have anyone in their eimply who take it upon themselves to “turn in” innocent harmless individuals? SW management need to investigate this and take action. INSTRUCT their people to stop that crap. NY’s firarms law are unconstitutinoa, thus unenforceable, null, void, and of no effect. It is NOT the job of some ticket clerk to play Hero Law Enforcement and blow whistles on the people who feed her.

Nice try, and theoretically correct… except that even unconstitutional local laws damned-well ARE (for all practical, real-world purposes) “enforceable” when the Democrats – no longer answerable to voters – own the state courts and the state prison systems!! The only remedy is a complete change of government (either by voting booth or violent overthrow)… or citizens must live with the tyranny. No other options, a plain, black-and-white issue, no gray area.
