GOA/GOF Fund Challenge to NFA in U.S. Supreme Court

Springfield, VA – -(AmmoLand.com)- Gun Owners of America (GOA) and its legal arm, Gun Owners Foundation (GOF), this week continued their defense of Jeremy Kettler, who is a disabled combat veteran. GOA/GOF submitted a petition for writ of certiorari before the U.S. Supreme Court on behalf of Kettler, after he was convicted for violating the National Firearms Act (NFA).

The Obama Justice Department brought criminal felony charges against Kettler for illegally possessing an unregistered firearm suppressor, despite the fact that Kansas’ “Second Amendment Protection Act” protected his actions.

GOA and GOF have stood with Kettler, both in his appeal to the U.S. Court of Appeals for the Tenth Circuit, and now in the U.S. Supreme Court.

GOA’s executive director, Erich Pratt, stated, “It’s time to challenge the NFA, which has long been a leviathan of unconstitutional gun control. GOA/GOF is not only proud to defend one of our nation’s disabled veterans, but also to potentially deal a significant blow to the NFA.”

GOA/GOF arguments challenge the legitimacy of the NFA as a so-called “tax,” challenge the absurd notion that the Second Amendment only applies to “bearable arms,” and raise concerns that the NFA is a tax on a constitutionally-protected right.

“GOA/GOF have stood for the right to own ‘bearable arms’ of all types, and firearms accessories as well — including suppressors and machineguns,” Pratt stated. “The arguments presented by GOA/GOF cut to the heart of the National Firearms Act.”

GOA/GOF urge the Supreme Court to take up this case and put an end to lower courts ignoring the Heller and McDonald decisions.

“Jeremy Kettler’s petition presents solid, well-argued questions important to all gun owners, and we hope the Court will grant certiorari to decide them,” Pratt concluded.

Shitting on the NRA is exactly what fellow dems want you to do. I’m goin to renew my NRA membership (I myself have been on the fence about it) and join the GOA. I think what the GOA is doing is remarkable and I hope the NRA has enough sense to follow suit. We’re all just pissed off over bumpstocks (myself as much as anyone else). The Second Amendment is protected by the First Amendment and vice-versa. Think about that a bit. I have not seen an analysis about that in this argument about unalienable gun rights or the absolute need for border control. The right of self protection (of life, liberty, and the pursuit of happiness) gives all American citizens the right to secure borders (even by means of the Second Amendment) to preserve OUR rights to “life, liberty, and the pursuit of happiness “ against those criminals who enter our country illegally and do, or try to do, us harm.

We Kansan’s knew there would some day be a challenge to our law that says what is made in Kansas, and stays in Kansas, is exempt from the feds. When Mr. Kettler was given probation, for what could have been $10K fine and ten years in prison, I was praying for this very challenge. I now pray for the SCOTUS to hear this. If they do, I believe the nfa, gca, etc. will either be eliminated, or re-written. Hopefully it’s the first.

Yup. the Constitution enumerates NO authority to FedGov over Alcohol, Tobacco, OR firearms.
Simple and straightforward. Abolish the eehtire outfit, Any authority they do have might be relative to import/export, so put those responsibioities under Treasury, the Dept that messes with tariffs and duties.

USA is our generation’s opportunity to throw off the Unconstitutional bonds forged by our very own Congress and President. Dbm: I fail to see what the article you referenced has to do with the “fact” that law abiding citizens shouldn’t be taxed to simply own something that is a firearms accessory. This is long overdue for repeal, as are all firearms laws, for a couple of important (again) facts, 1. they violate inherent Rights and attempt to turn them into privileges and 2. they don’t work.

Here’s a serious question to be asked; If the Federal Government is declaring Supremacy (as they should), how is that it doesn’t apply to “Arms that Shall Not be Infringed?”

The NFA and GCA should be thrown out on those merits alone.
