Federal Court Stays “Large-Capacity” Magazine Ruling

U.S.A.-(Ammoland.com)- Yesterday, Federal District Court Roger T. Benitez issued an order staying enforcement of the judgment in the NRA and CRPA supported case of Duncan v. Becerra. Last Friday, Judge Benitez issued a tremendous victory for gun owners, striking down California’s restrictions against the manufacture, importation, sale, transfer, receipt, and possession of magazines capable of holding more than 10 rounds.

Yesterday's ruling stays enforcement of the injunction as applied to the restrictions against the manufacture, importation, sale, transfer, and receipt of so-called “large-capacity” magazines, as of 5:00PM TODAY, April 5, 2019. In other words, those restrictions will once again be enforceable after that time. But the ruling also clarifies that the injunction against those restrictions will remain in effect “for those persons and business entities who have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds between the entry of this Court’s injunction on March 29, 2019 and 5:00 p.m., Friday, April 5, 2019.”

Additionally, the ruling also makes clear that the preliminary injunction issued in July 2017, which prohibited the enforcement of the “possession” restriction enacted by Proposition 63 and Senate Bill 1446 will remain in effect during the appeal. In other words, California residents who lawfully possess magazines capable of holding more than 10 rounds may continue to possess them while the case is appealed.

It is critical that anyone who possesses one of the magazines in California refuse to talk to law enforcement if asked about their magazine.

The decision Judge Benitez wrote is great. He outlined the 2A rights as written and justified them. The sooner we can purge the activist judges from the bench nationwide the sooner we may get some of our rights back.

The judge didn’t “take it back.” The ruling stands, but it is stayed. A stay is not the same as reversal. A stay means the ruling will not be enforced until the stay is lifted. This often happens when a ruling is being appealed, or if there is other ongoing litigation in a different jurisdiction that could affect the ruling.

If the Supreme Court Rules infringe against the Constitution , That means it can NOT be made into law and falls into a Supreme Court OPINION. Even the Supreme Court MUST adhere to the Constitution. The Springfield 1903A3 was a high capacity rifle designed for killing enemy soldiers in WW1, now make the comparison to more modern weapons. The 1903 is an excellent hunting rifle, so is the AR15 and it is not a military weapon. It is a civilian version unable to fire fully automatic. Nice cherry picking. I can do that too. FBI UCR and US Census Bureau population estimates reveal the state with the lowest per capita homicide rate with firearms is New Hampshire, which has incredibly lax gun laws.
It’s violent crime rate is so low its comparable with that of the Scandinavian countries, despite tons of guns and gun owners. And actually, these rates apply to other lax gun law states such as Vermont and Maine.

Just when I thought California had come to it’s senses. Arizona still looking good for the place to move to. Let Becerra have California with it’s millions of illegal aliens. Mexico bans guns completely but 30,000 people are murdered by criminals with guns every year there. Becerra, an anchor baby, should feel right at home in California.

I think you better do more research. Tijuana Mexico is ranked the most dangerous city in the world and the top six cities in the world are in Mexico, for gun violence and murder. Mexico’s population is no where close to the 300 million of the United States. Tijuana averages more than one murder a day by criminals with guns. Look it up, do your research.
