Fed. Judge Permanently Enjoins Riverside County’s CCW Application Denials

BELLEVUE, WA – -(AmmoLand.com)- A senior U.S. District Court judge in California has issued a permanent injunction against the Riverside County Sheriff’s Department’s longstanding policy of “dissuading, discouraging, and preventing non-United States citizens from applying for a CCW license,” in a lawsuit brought by the Second Amendment Foundation, Calguns Foundation and Firearms Policy Coalition.

SAF, Calguns and FPC were joined by the Firearms Policy Foundation and Madison Society Foundation, and Arie Van Nieuwenhuyzen, a permanent resident alien who has lived in Riverside since 1983 and is a business owner there.

The case is known as Van Nieuwenhuyzen, et al. v. Riverside, CA Sheriff Stanley Sniff, et al.

Senior United States District Judge Dean D. Pregerson entered the order permanently enjoining Riverside County from having a policy and practice that prevented legal U.S. residents from exercising their right to apply for a carry license.

“We’re delighted with the outcome of this case,” said SAF founder and Executive Vice President Alan M. Gottlieb. “This isn’t our first experience with such a policy, and we’re happy to have had good partners in this challenge. Mr. Van Nieuwenhuyzen has been a productive, law-abiding member of his community for decades, and there is no good reason to discourage or deny someone of his background and standing the ability to apply for a carry license.”

“This coalition victory is important,” added Brandon Combs of the Firearms Policy Coalition, “because it not only helps to restore access to the fundamental right to bear arms, it also sends a crystal-clear message to carry licensing authorities that the rights of the people can and will be enforced in our courts. Anyone who stands between the People and their rights is on notice.”

The policy was carried out under former Sheriff Stanley Sniff, who lost to current Sheriff Chad Bianco in the last election. Sheriff Bianco campaigned on a promise to promote access to concealed carry licenses and reform earlier policies. Under terms of the permanent injunction, the Riverside Sheriff’s Department have 30 days to finalize all changes to their CCW policy and eliminate “any and all U.S. Citizenship requirements” from the department website that describe the application process, and from CCW application forms.

“This is just one more example of winning back firearms freedom one lawsuit at a time,” Gottlieb said.

If the man has lived in Riverside since 1983 why hasn’t he become an U.S. citizen?
Is he wanting to keep his citizenship elsewhere why making his living in the U.S..

I believe your question is fair and beggs a clear and rationale response. After a 33 yr. residence and the building of a successful business, as a resident alien, why would one not want to become a citizen of the country that has provided these blessings?
Would someone please enlighten me with a reasonable response!

Because you GIVE UP your natural Rights when you accept Congress’ corporate 14th Amendment “citizenship” through the naturalization process. Congress can revoke that citizenship at ANY time, for ANY reason, and deport you, with only the barest of ADMINISTRATIVE process, which is not the same as “due process” under Common Law. Maybe this guy knows that – since he grew up and was educated in another country, instead of attending the government brain laundries we call “public school”.. @Graystone, Some aliens that are lawfully admitted for permanent residence (LAPRs), have it in the back of their mint that they will return to the “Old Country” to retire. Some of the Old Countries that they wish to return to do not allow dual citizenship. If our hypothetical LAPR becomes an American citizen, then he will not be a citizen of the country that he came from and wants to retire to. Others do not want to be subject to the military draft. My wife is a permanent resident from Cuba. She has been here since 1995. The only thing I can find she cannot do is vote. She can own a firearm and get a concealed carry permit. She pays a ton of taxes. Now she does have to have her green card renewed every few years and it cost a few hundred dollars and is a pain. Her biggest problem is procrastination. So there is really no good reason for not becoming a citizen other than it really doesn’t change that much for her.

Here is the thing. A green card allows you to go in and out of America for a short period of time without a visa. Once you get citizenship, you will have to apply visa to visit mother country. In many cases the process sucks. I do understand this guy because I’m a green card holder too.

To answer your question – a natural born, or one who came legally after going through the process, taking then the oath of citizenship.

This gentleman, while here legally, as a PRA, and by all accounts a pillar of the community, has, for whatever reason, not obtained citizenship.

One who is NOT a 14th Amendment “citizen” (subject to Congress’ corporate jurisdiction, and whose “citizenship” can be revoked by them at their whim). A “real” American is one born in one of the fifty states of the Union, not the D.C. or any of the “several” states of the U.S. (Guam, Puerto Rico, etc.).

This should happen in L.A. I have lived in CA. all my life and it is no longer a state I am proud of. Dems can break laws and put us in danger. They are trying to destroy America. Even if you apply for a CCW here in L.A. unless you are a politician you won’t get 1. Utube has a great video on what happens when you apply and how they make sure you will never get 1 if you are just a citizen.

Too bad neighboring LA County couldn’t give two craps about anyone’s 2A rights, even less than Riverside. Nearly all the Sheriffs in SoCal counties have practically fallen over each other to prove themselves to be the most condemning of 2A rights and most welcoming of illegals into their sanctuary realms. Seems once you get north of LA county and keep going north, the sheriff’s issue. Altho, I am in the process of getting out of Californicate myself. I do have a ccw.
