“Writ of Mandamus” Would Force Allegheny County DA to Prosecute Pittsburgh Mayor

Pittsburgh, PA – -(AmmoLand.com)- Gun Owners of America (GOA) is supporting a “writ of mandamus” petition against Allegheny County District Attorney Stephen Zappala to force him to accept private criminal complaints against Pittsburgh Mayor William Peduto and the City Council for violating the firearms preemption law.

Pennsylvania Director for GOA, Dr. Val Finnell, stated the following regarding this latest action:

“DA Zappala refused to accept private criminal complaints from several City of Pittsburgh residents who are rightly alleging criminal conduct on behalf of Mayor Peduto and six city council members for violating PA Code Title 18 §6120, the firearms preemption law. In refusing to accept the complaints, DA Zappala violated procedure cited in 234 Pa. Code Rule 506.

“The Mayor and City Council are also cited for ‘official oppression’ within the petition, a charge that is a misdemeanor of the second degree (Title 18 §5301).

“These residents are sick and tired of politicians who willfully disregard the Constitution of the Commonwealth and state law. DA Zappala failed to provide justice for these residents and has allowed criminal conduct on behalf of the Mayor and City Council to go unchecked. The ‘writ of mandamus’ petition will compel DA Zappala to accept and process the complaints.”

Article VI within the US Constitution says those in government not in good standing with the articles and rights within shall be defunded, disbarred, and discharged from office at ALL levels of government!

While in court seeking the writ why not also petition the court for an arrest warrant for the mayor et al? Name them as the offenders of a crime. How about reporting the crimes of the mayor to the police? It sounds silly, but it puts the police in an awkward position. The police will decide if a crime has been committed and have to explain their actions whatever they decide to do. Typically a district attorney is in lockstep with who’s ever in charge because politicians and bureaucrats need them in their pocket just in case.
Make no mistake, a district attorney’s job is hold government accountable to the people not the other way around.
Without this oversight the government can literally do anything they want, that is until they’re caught.
A district attorney who ignores the people is proof that collusion has taken place and that government in accountable to no one.

The Mayor and City Council knew full well what they were doing was illegal but they chose to continue on knowing that they would have free representation from city legal staff. I support the commenter below who suggests that they be hauled in and charged. Let them see how it feels to be on the wrong side of the law.

This will cause a constitutional conflict and a conflict of interest. Most states allow or require and higher authority to take over a defense or prosecution when the local DA can’t or won’t or is perceived as in a conflict. This will be an interesting awe to follow! Please keep us posted!
