Assault Victim Shoots Two Time Attacker to Death

USA –-(Ammoland.com)- Mountain News in Arrowhead, CA reports 07-18-19 a 29-year-old resident of Crestline was shot July 11 at Lake Drive and Lake Gregory Drive moments after he began to assault a 27-year-old male victim. This is according to an incident report and a press release from the San Bernardino County Sheriff’s Department.

Sheriff’s Homicide Detectives responded to a residence on Lake Gregory Drive to conduct the investigation. They learned that three men had approached the victim around 9 P.M.

The victim recognized one of the approaching men as an associate of a suspect who had beaten him up him back in January. That assault resulted in the victim being hospitalized.

As the three men approached, the victim felt threatened by them and their verbal taunts. He made his way toward his car.

The most aggressive suspect, age 29, apparently grabbed the 27-year-old victim’s shirt and punched him multiple times.

The victim was still able to retrieve his firearm from a compartment in the car. He fired the gun ending the assault around 9:15 P.M.

An off-duty nurse who was nearby, was administering medical aid to the 29-year-old when deputies arrived. The nurse informed deputies of the gunshot wound to the lateral left chest, about one inch above the pectoral muscle.

At that time, 9:22 p.m., a reporting party told a 911 dispatcher that the 29-year-old was awake and in pain. An ambulance transported him to St. Bernadine’s Hospital. He was pronounced dead at 10:12 p.m.

The investigation is ongoing. Anyone who may have information, are asked to contact Detective Eric Ogaz, (909) 387-3589. The incident will be submitted to the District Attorney’s Office for review.

Comments:

The reason for the assault is not detailed in the reports. Cleary the victim here had reason to fear great bodily harm as he was beaten badly enough to be hospitalized by associates of these men 6 or 7 months earlier.

No mention is made of the firearm in the car being permitted under CA law.

The first rule of self-defense is don’t get killed. This especially applies when you get killed because you are trying to obey the some firearm law. Only survivors get to defend themselves in court.

You gave me a flashback. In September of 1974 I was at LAX on my way back to Germany. In a restroom stall, written on the wall was: “Here I sit, my buns a flexin, fixing to give birth to another Texan.” I never forgot it and I passed it along to many folks who appreciated the well written humor.

California is the only place where victims have no right to defend themselves. Transporting a firearm unloaded in a locked box is as stupid as the politician or bureaucrat who got this to be a law, but par for California. Since the court system failed to put away or deter the attacker from repeating his crime, you can add the judge, and the district attorney to the list of accomplices.

You cannot rationally legislate away a person’s right to self-defense. Doing so places the state above the individual. In irrational states, where the individual is a subject of the state, this is easy to do. In the US, where the state operates as an agent of the citizen by construction, and derives its legitimacy solely from the citizen, the individual right is above the state. I live in crestline and the word around here is the shooter was deemed mentally unstable and wanted in another state for shooting a police officer and lied about this shooting and has been arrested after the review of survalance video not a good case for 2a rights but a good case for mentally unstable person with a gun .the person shot was said to be a very nice person. hopefully the law changes and they start looking at mentally ill. And not guns

Definitely a strange case. I also did a search. Came up with a dozen stories, all the same as the one you cited. The only new information on offer was that the previously called “victim”, Alex Opmanis, is now under arrest as the suspect, and has not posted the $1M bail(pretty excessive, which is indicative of either a weak case or an extreme danger, which the latter is not indicated by the facts here). I have no idea just who might have said that Sammy Lee Davis (the dead one…) was a “very nice person”, but his priors include a 2008 felony burglary charge that he pled guilty to, another in 2011, another felony for receiving stolen property, which he also admitted to, and various drunk, disorderly, and failure to appear charges.
Not exactly a model citizen. Are the guys saying he was “nice” all covered in gang tattoos? Or perhaps you’re mistaking the shooter for THIS Alex Opmanis from Utah?

Yes same kid from Utah but police didn’t mention his record sombody posted it on Facebook .as for Sammy .didn’t know he had a record but alot of people say he was a nice guy .Crestline is a small community word travels fast the people that say he was a nice person are all upstanding citizens. No wonder they refuse to mention his record. An illegal “no knock” warrant, filed by a lying snitch, and then the poor guy (already brain damaged from a previous beating that the police never bothered to investigate), shoot a round of 22RF #12 shot at the cop that he had every right to think was a home invader, so they arrest him for assault on a cop unlawfully invading his home, and then stick him in a mental institution and pump him full of psychoactive drugs! I’m not sure about your world, but in my world a “very nice guy” is NOT a person who 1) travels across town to intentionally confront another person, 2) requires a gang for emotional support in criminal activities, 3) physically assaults a smaller, unarmed individual, and 4) repeatedly beats the other person in the face.
