Man Banned from Every Walmart Store for Legal Open Carry ~ VIDEOS

Opinion

Virginia – -(AmmoLand.com)- Virginia Citizens Defense League has been made aware of an incident at a Walmart in Kentucky where someone open carrying a handgun was approached by police and asked to sign a trespass document saying he acknowledges being banned for Walmart property anywhere in the U.S., indefinitely.

That contradicts the official policy as laid out by Walmart's CEO.

I have also heard from a third party that Walmart is going to post their stores “no open carry.” However, I'm not taking that as Gospel until someone actually sees such a sign.

In the meantime, I recommend that you do not open carry in Walmart for at least a week until we see if such a sign materializes or we get more definitive information from Walmart.

Concealed carry remains a safe option, as Walmart's policy specifically allows for such.

Walmart Pushing Gun Control Ala Dicks Sporting Goods

Walmart is now behaving much like Dicks Sporting Goods by pushing gun control and is going to lose a lot of business from gun owners, accordingly.

Walmart claims to be working with Moms Demand Action on lobbying Congress to look at “strengthening background checks,” to “remove weapons from those proven to pose an imminent danger,” and “the reauthorization of the assault weapon ban should be debated to determine its effectiveness.”

Lobbying Congress for more gun control crosses the line.

To hear the Walmart internal memo on gun policy read on the Guns & Gadgets podcast, click here and go to the 1-minute mark.

Clear above to watch the video of the trespass incident in the Kentucky Walmart and go here to see the follow-up video. I really don't like how the police handled this incident. So much for the Walmart CEO's claim that gun customers will be treated respectfully and non-confrontationally.

Tomorrow an alert will have more information on how to handle such an incident.

I need a “safe space” during this discussion…….
We are under attack by all anti gun people and institutions. All of us need to be smart in how we conduct ourselves when confronted by anyone regarding our mode of carry.

I always Carry concealed as I like to know I am the only one who knows I have a gun.

Element of surprise is key. But to each his own!

I carry concealed, never an issue. I understand the open carry people and their arguments, but in this age, go concealed. Stop trying to argue the laws, etc. It’s about keeping your family safe, not “I am allowed to do this, etc”.

@SG,stop trying to argue the laws ? In this day and age go concealed ? Nope ! Open Carry is legal in Texas. That’s not arguing the laws, its legal under Texas law. I don’t give a damn if some snowflake doesn’t like Open Carry,I do. Their feelings don’t trump my constitutional rights. I carried concealed for many years, and occasionally still do. Open Carry is what I prefer.

Go ahead, open carry where they don’t want you to open carry and show Open Carriers to be jerks. If a business owner says No Open Carry, state Open Carry laws do not matter. If you do not know that about the laws, leave your gun at home. We don’t need more ignorant people feeding ammunition to the AntiGunners.

Food for thought, switch out word (NRA) with the generic (lobbyist) and the word (gun’s) with (sugar) and a much better case could be made for banning something dangerous, But diabetes, obesity and many other slow killing illnesses don’t get near the news coverage. And so Walmart (and many more) sell hundreds of tons of the deadly and addictive substance yearly… P. S. I’m not for banning sugar or guns

Why is it necessary to carry a gun that everyone can see. Guns don’t save us. Guns kill us. And 120 Americans get shot to death, or commit gun suicide daily.

Ej. “People who never harmed anyone” is a pretty tone deaf comment. The gun industry and its enablers in the NRA and the GOP have diligently worked for the past 50 years to block any and all common sense gun safety legislation, block background check laws, prevent the ATF from finding gun traffickers by blocking funding for a modern computerized gun serial # registry, elected a convicted gun trafficker as its president, referred to federal security personnel as “jack booted thugs” prompting the Oklahoma City bombing, traumatized an entire generation of American school children who must practice active shooter lockdown… Read more »

They won’t be coming to your house in the way that you contemplate. They will surveil you until they know your routine. Then when you are getting out or your car at the church parking lot or grocery store parking lot, when you are not expecting it, they will nab you. Then, they disarm the victimized citizen who only wants to assure his own safety (and, incidentally, the safety of others). Upon having returned the responsible American’s firearm and loaded magazine to him, the armed criminals watch the law-abiding American reload his sidearm and turn away from him, only to return and coerce the hostage into signing acknowledgement that he’s banned from Walmart. I dream of a day where I can safely open carry anywhere without fear of being viewed by closed-minded individuals as a threat [thug/drug dealer/gang-banger]. Hi Brian G, as one of those “Right wing gun toting nut jobs” who lives in a rural area, I can tell you that I won’t be shopping at Walmart going forward and it will entail some inconvenience but as it turns out supporting what you believe in sometimes does that. Besides, there is always Amazon. I too am glad you can think for yourself, possibly you should think about how fast you are to categorize and criticize.

@BrianG, your brain is obviously eroded from the constant Essence of Jockstrap because Dick’s. Is getting dicked because of their decision! I would imagine if Dick’s remains on course they’re going to end up selling jockstraps at every off-ramp in the United States in order to turn a buck!

@BrianG You dont have a brain, you’re a libtarded commie NPC! GTHO of here and take your FAIL with you!!! Dicks is losing so much business they had to restructure, including getting out of the hunting/camping market altogether! You can make up whatever fake news you want but normal, sane, intelligent people reject your fakery and your left-wing koolaid!

Conservatives out in the country have other options – Meijer’s, Big R, and also RURAL KING, which supports the 2A and gun owners!!

Not being a “right wing gun toting nut job”, but from a rural area where there is no Wal-mart nearby. However, this Conservative now lives in a suburb of a mid-size city where there is a Wal-mart nearby. Additionally, I don’t shop at Wal-mart, and will not be in the future, either. I also do not buy Chinese products as much as possible, and do buy American as much as possible. I can afford to spend the extra money, not that it always costs more, though. You clearly not only cannot think for yourself, but based on your grammar, syntax,… Read more »

Providing signage of their policy had not been placed outside for all to see, he should have just been asked to leave the store voluntarily before any call was made. Just don’t patronize them…

If I go into Walmart at all, I carry concealed and it isn’t a problem, at least not in Snowflake, and Show Low, Arizona. Sorta like, “Don’t ask, don’t tell”.

that meme is a fake meme anyway. No, the big box stores don’t take all that money out of the community. MOST of their COGS involve the real estate where they locate, and wages paid to LOCALS to run the place. their margins are far smaller than local Mom n Pop stores, they actually leave a greater perccentage of their total revenue IN the local communityu. Do I like them? Not much. But lets be honest about the “taking money out of the community”. That false claim is a left over from the early days of liberal types hating on… Read more »

true, but still no reason to deny anyone carrying openly. The open carry folks are needed to help the general public realise that guns are norma, safe, nothing to be feared. If the general public could realise how many of us carry everywhere already, after they recover from their apoplexy they’ll again realise these guns aren’t the ones to fear… it all comes down to INTENT, and normal folks just carrying on eveyrwhere do NOT have the evil intent of the recent mass murderers. Their corporate rights stop at the Preface to our Constitiution of the United States of America, inclusive of all unrescinded Amendments.

As for not wanting to shop at Walmart, I don’t wish to support Red China’s economy anyway, leaving aside Walmart’s counter-Constitutional perspective.

I fail to see what the fuss is about. Walmart has said they don’t want open carry, so don’t open carry there. Don’t shop there if you don’t want to but, it’s a business and they can set their own policies. This guy was being an idiot by going against their policy and then acting like the victim. It seems like there are a lot of people who want their rights to be respected but don’t want to respect the rights of others.

Yes, you DO have to worry about respecting other people’s rights. They own the store, and if they don’t want you carrying openly then don’t. Just like if you say “no one is permitted to park on my yard”. If they do, you call the police for trespassing and have them towed. Your property, your rules. If we, as gun owners, don’t respect other people’s rights then why should we expect them to respect ours. You reap what you sow.

except YUOR yard is not open to public access, butWalMart’s is. And THAT makes all the difference.

Hundreds of laws that do not apply to your dirtpatch, because it is PRIVATE land, DO apply to WalMart, as their dirt is public access. And those laws demand MY rights be respected in ways YOU do not have to on your dirt.

Totally agree, just cover it up! They aren’t completely banning firearms in their stores they just don’t want them too be seen and someone uneducated about firearms to create a scare. I personally haven’t shopped at a Walmart in years and don’t plan to. I do not agree with a lot of the things that the ceo has put in writing but this point is just if you want to shop there and carry, just cover it up, you will still be armed.

Not everyone can CC. In most states one must be 21 years old or older. In my state, you are “allowed” to own and carry a handgun, but you do not have the ability to legally CC.

I don’t shop in Wal-mart, so I don’t really care what policies they have, they do not and will not get any of my money.

Heed the Call-up

Meant to state that those 18 years old and under 21 years old can legally OC a handgun, but are not legally able to CC.

An 18 year old in Virginia can be gifted or buy a handgun in a private sale, but not from a FFL. And at any age, with a legal guardian or adult supervision, is allowed to handle and fire any firearm, but again, not legally CC, except on private property.

Business are public access, thus are bound by the laws of the state wherein located. I know Texas provides the option for publicalll accseeible venues to prohibit open carry, but they CANNOT prhibit concealed carry. Specific signs must be posted at all entrances before the no open carry policy can be enforced. Kentucky, if I’m not mistaken, have firearms preeemtion laws at the state level. I know of no mechanism where the manager of a public venue can deny access on the basis of someone legally carrying a weapon. I KNOW Missouri cannot. Nor can Washington Arizona, many other states.… Read more »

As to AZ your comment is incorrect. AZ law states clearly that private property owners of any kind have ultimate authority on whether anyone can carry a firearm (concealed or open). There is no such thing as an exception for businesses which are open to the public as being fundamentally different from a residence. Private property is just that. The owner is in charge – no exceptions. They are supposed to post a sign on the entrance to a business, but even if they have not they can ask you to leave or have the police come and do it… Read more »

I have talked to the Walmart customer service center in Springdale, Arkansas twice now about this. My next step is to converse with the manager at my local supercenter. They say that concealed carry is good to go. What if my concealed carry gun is exposed because I was reaching up to the top shelf or my shirt inadvertently gets pulled up by something unbeknownst to me? It is no longer concealed and that is fine under OK law with a CCW permit. Will that pass the Walmart “concealed is OK” test? Enquiring minds want to know.

In Texas,if there is no 30.07 sign posted, you can legally Open Carry under TX State Law. There is no arbitrary way Walmart can tell anyone with a valid LTC they can’t exercise a constitutional right !

Johnny Angel

1. It’s not arbitrary. Open carry is open carry.
2. They are not saying you can’t exercise your constitutionally protected right to carry. They specifically said concealed carry is fine.
3. It is their property. They are allowed to make any rule they want as a condition of being ON their property. Do you let anyone do anything they want on your property? I think not. You have rules and expectations from visitors and guests.

@JA,you’re wrong ! I know Texas law,you don’t ! If a business doesn’t want Open Carry it has to be posted with a 30.07 sign in accordance with TX State Law. They can’t just say it,it has to be posted ! If not,you can Open Carry with a LTC all day long !

Be glad all the laws, rules, requirements, etc, that BIND on all publiccly accessible property do NOT bind on your own private hovel. I can give some advice right now. NEVER sign anything. Your signature is the most valuable thing you possess. Whenever you sign a piece of paper, you are voluntarily agreeing to something. You cannot be forced to sign. A signature under duress means nothing. Never agree to anything just because someone tells you to. Always understand first, and sign later.

just write “under duress” under your signature.

Tionico

this phoney piece of paper the local coppers FORCED him to sign is meaningless, as it was signed under duress.. they had him detained, they had guns, they likely secured his during the encouter, and the threat of keeping it (or seizing it if they had not yet done) was very real. They “made him sign”, thus he signed under duress, and his signatire may as well not even be there.

I’d ignore it. Find a different WalMart and walk on in. What, they got facial recognitioin software and scan every mug walks in the door?

Will Flatt

Actually since Walmart is partnered with DHS, they DO have facial recognition software! Whether they’re actually using it may be another matter.
