Senate Republicans Rebuke Colleagues for Threatening SCOTUS

Fairfax, VA – -(Ammoland.com)- On Thursday, all 53 Republican Senators signed onto a letter encouraging the Supreme Court to ignore an amicus curiae brief from five Democrat Senators that threatened the high court with restructuring if it did not rule the way those Senators wished.

The offending amicus brief, penned by Senator Sheldon Whitehouse (D-R.I.) and joined by Senators Mazie Hirono (D-Hawaii), Richard Blumenthal (D-Conn.), Richard Durbin (D-Ill.), and Kirsten Gillibrand (D-N.Y.), asked the Supreme Court to dismiss an NRA-supported challenge to New York City’s handgun transportation lawAmicus briefs by members of the legislative branch are not uncommon, but those briefs always treat the Court with the respect it deserves as a coequal branch of government. Threatening the Court if it doesn’t rule their way is certainly a new approach for amici to take in attempting to persuade the Court.

Beyond the empty nature of the threat – five Senators are a long way away from the necessary votes to change the statute governing the Court’s composition – Senator Whitehouse apparently also forgot that he isn’t an active member of the bar. This oversight, along with the disrespectful tone of the brief, led Judicial Watch to file a complaint against the Senator with the Rhode Island state bar.

The Republican Senators’ letter makes clear that they understand the need of an independent judiciary that isn’t moved by threats from the political branches.

As the Senators put it:

There is no greater example of the genius of our Constitution than its creation of an independent judiciary. Alexander Hamilton explained in Federalist No. 78 that “[t]he complete independence of the courts of justice is peculiarly essential in a limited Constitution.” Only an independent judiciary can “guard the Constitution and the rights of individuals from . . . dangerous innovation in the government, and serious oppressions of the minor party in the community.” And history has proven the wisdom of this design. Time and again, our independent federal courts have protected the constitutional rights of Americans from government overreach even when that overreach was politically popular.

Please join us in thanking these Senators for their defense of the rule of law and our constitutional rights.

Rebuke? What does that mean for the American people? Hit them where it hurts, fine them or suspend them-better yet both.

@Michael J, What part of the Constitution or US Code facilitates the fine or suspension of a U.S. Senator?

Nothing to see here. This is just more proof that ‘idiocy’ is running rampant through that DemonRAT party! Scary part for America remaining the least bit as it was just fifty-odd years ago, is the dumbing down of at least the last two generations. Too few of the “old school” Americans remain, and more are being lost daily, to continue plugging the holes in the dike of the ‘former’ Republic! Don’t think so? Just recall how many MILLIONS of people supported not just the criminal Clinton, but an avowed Socialist/Communist about four years ago – and it continues growing. We… Read more »

“Genius of the Constitution,” sad thing is the members of congress who reside on the left are no longer intelligent enough to refrain from tearing down the Constitution because it is way above their intelligence level.

Sadly, Vern, with the unavoidable approach of a second civil war… we will be forced to “meet him wherever” in our lifetime (although, I would rather do so than bequeath that struggle to my grandchildren!).

As I mentioned in my own post, those “old school” patriots ‘of the past’ are dwindling daily. We are being overrun with mushy minded, ill-educated and indoctrinated, people each and every year! Nearly half the people in the country, today, can not name who we fought in the Civil War! France?

@wagon, every old school patriot can still participate. Make ammunition, put away some extra cans of food, tell their grand children the way things should be and what is going on.

@WB & Wagon… Want to find out how much your kids or grandkids know about the civil war ? Ask something simple like
what was the Mason Dixon line . Old Native American tradition Elders taught history verbaly around campfire ! Add marshmellows and smores and as WB says fun is a great tool ! I paraphrase .

Civil wars are never short, our grand children will more than likely be caught up in it regardless. To the left, every body is expendable but themselves.
