ATF Agents Showing Up At Homes of Unfinished 80% Gun Frame Dealers

BALTIMORE, MD-(Ammoland.com)-The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Agents from the Baltimore Field Office have been visiting the homes of buyers of large quantities of Polymer80 frames and kits.

Five special agents and Detective EE Schwartz of the Anne Arundel County Police Department showed up at the door of one of the co-owners of 2A Builds. 2A Builds is a company that sells unfinished 80% kits at gun shows in the mid-Atlantic region of the country. They recently purchased 65 frames from U.S. Patriot Armory.

The agents wanted to search the owner’s house, and the owner agreed because he had nothing illegal. The agents didn’t find anything against the law in the home but did want to take the owner’s legally owned firearms. The owner refused then the agents said they were just going to take a finished P80, a single kit, and two MCK stabilizers. The company’s owner once again refused the request and asked the law enforcement officials to leave his home.

The ATF agents said they would wait there until they could secure a search warrant if the owner refused to turn over the items. The owner started to call an attorney, at which point the officials said they decided not to seek a warrant that day but would in the future and then left. The only contact they left him was Detective EE Schwartz’s business card (badge: 1665) of the Anne Arundel County Police Department. Before they left, the agents took pictures of all the firearms and serial numbers to run checks.

AmmoLand News has learned of two other visits by ATF agents to dealers’ homes that sell unfinished frames. Although in their case, they told the ATF agents to leave if they did not have a search warrant. The agents threatened to wait there until a judge issued a search warrant but once again left without executing a search of the properties. Both dealers purchased items from U.S. Patriot Armory.

AmmoLand discovered that U.S. Patriot Armory did not turn over any customer information to the ATF or other law enforcement agencies through our sources. It isn’t clear how the ATF received information about the customers, although everyone visited paid for the unfinished frames via credit card, and U.S. Patriot Armory uses Authorize.net.

Authorize.net is one of the only payment processing companies that will process firearm sales. Almost every other payment processor blocks the sale of firearms and unfinished frames. Although we have no evidence that says Authorize.net turned over customer information in this case, the company did turn over data of customers that purchased kits from other companies in the past.

AmmoLand News reached out to the ATF for comment on the ongoing visit. Public Information Officer Amanda Hill said the ATF cannot confirm or deny the existence of an investigation and will not be providing any further comment.

Anti-gun politicians have made a significant push to ban unfinished frames and receivers at the behest of anti-gun groups such Giffords, Everytown, and Brady. The groups call these items the fake and misleading “Ghost Guns.” Pennsylvania Attorney General Josh Shapiro has made it his crusade for these non-guns to be banned. New Jersey has been suing sellers of unfinished frames, and California has sued the ATF for not considering these frames to be firearms.

Detective EE Schwartz did not return AmmoLand News’s call for comment.

In a true 2A-sanctuary state, the detective would have been along to inform victim of their rights and observe to insure ATF does not violate any. You only have the rights you insist on, and knowing your legal rights is a big step in the correct direction. So having a detective telling you “you have a legal right to say no” would be incredibly frustrating for ATF agents. There are some COPS who when a subject is extremely cooperative will take advantage of the situation and will act with a “heavy badge” and will
treat the person harshly. I was always aware of a subjects Constitutional rights, because if you don’t, it will always come back to haunt you. The majority of Cops follow the Constitution, there are just a few bad apples, that have no business being in positions of authority.

I’ve been saying for YEARS they aren’t registering firearms per se, they are registering firearms owners. This is also why they want to do away with cash. Used to work pretty well, but the new LED lamps use so little current that game is no longer very useful. What one CAN do is suddenly start drying a lot of clothes with an electric dryer, let them come round and cneck, see nothing, then commence yuor grow op. Also great to be foind growing lots of tomatis, zucchinis, letuces,indoors in yuor new aquaponics garden. After comging round a few time to find nothing but grocery store produce growing, they may well give up thinking they ave a false lead.

This article reminds me of the case of Albert Kwan, which I wrote about back in 2009. Albert had purchased an aftermarket barrel for a Makarov pistol, then some 10 years later, had federal agents at his door asking to look at his guns. Albert obeyed his attorney’s instructions and said “No.” The feds went on to destroy his life and career.
I’m working now to try and help Albert, as he’s virtually destitute and dealing with serious health issues. Stand by for more on this tragic case.

When the author says that the payment processor “turned over” records, I expect what happened was that they responded to federal subpoenas requesting business records. Unfortunately, mere suspicion that business records “may” have information that “may” lead to evidence of a crime is all that is needed to support a subpoena. Federal Judges virtually never quash a subpoena issued by a federal agency. It sucks, but it’s the reality.

First, you need to have a crime. If there is no crime, there should not be a subpoena. To use financial records to see if there is a crime should be ruled as unlawful. If the original subpoena is fought and turned out to be unlawful from the outset then the “fruits of the poisonous tree” takes place and all evidence found after that point is thrown out.

I have a lot of friends who are cops. I have a lot of friends who are in federal law enforcement. I count as close personal friends a few senior members of our Intelligence Community. Friends are friends. But when they come to my door in an official capacity that all ends. My standard response to all law enforcement on all issues is simple: get a warrant. Never, ever, ever consent to a search. Never. Ever. You have nothing to prove. It is up to the government to prove its case. Period.

Not a good idea to curse or abuse any officer of the law. If they ask to come in, the answer is always no thank you Sir. unless you call them first.. You may actually need an officers help some day. I support the police. They have a job to do just as you and I do but you needn’t let anyone overstep their bounds or authority. Never threaten or curse any officer of the law. I promise you it will not look good when you are sitting in front of the judge.

It is not my place to put an Officer in their place. That is their supervisors job. I have made that happen before and will do so again if necessary. Generally talking to them in a considerate, coherent fashion gets the job done.

If you are involved in anything but a routine traffic stop, like speeding or expired plates refuse any search and do not say anything without a lawyer. If they come to your house same thing, no talking lawyer. If your are in involved in any form of self defense don’t talk and get a lawyer.
