BOSTON — A Middleborough, Massachusetts man was sentenced to six days in prison for stealing and selling three firearms from FedEx packages he was responsible for delivering. The government recommended a sentence of 10 months in prison.
Frank P. O’Toole, 40, was sentenced on Feb. 2, 2024, by U.S. District Court Judge Angel Kelley to time served (six days) and three years of supervised release, during which period he must complete 250 hours of community service. On June 16, 2023, O’Toole pleaded guilty to two counts of possession or sale of a stolen firearm.
O’Toole previously worked as a FedEx delivery truck driver at a facility in Middleborough. Between October 2021 and June 2022, O’Toole stole three packages sent from out-of-state which he was responsible for delivering, each containing a firearm – specifically, two rifles and a shotgun – intended for a Federal Firearms Licensee.
O’Toole subsequently sold the three firearms to an undercover agent during two separate controlled purchases on Aug. 9, 2022, and Aug. 12, 2022.
Acting United States Attorney Joshua S. Levy; James M. Ferguson, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms & Explosives; and Middleborough Police Chief Joseph Perkins made the announcement today. Assistant U.S. Attorney Elianna J. Nuzum of the Major Crimes Unit prosecuted the case.

Huh? Are you kidding me? I thought he sold guns that he had stolen. Let me see here. When people do straw purchases I see where they have been getting 3 years or more on Ammoland when busted by the ATF. What happened here. This is worse than a straw purchase. This is theft and then he sold to an agent. If that was ok with him because he didn’t know he was an agent, then the agent might as well been a just crossed the border Obiden terrorist.

How stupid do you have to be to steal firearms, when you’ll be the only suspect? I’m surprised he had enough sense to get the job. If they pay like UPS does, he lost a very lucrative job, too.

what a joke… I read something about FedEx being the worst for “lost” packages.. USPS was the best. I guess get the insurance when they offer it.
Now it does make you wonder if the ATF was the one who originally approached the Fed Ex driver about stealing guns for them. Entrapment is one of their specialties.
I’m guessing they treated it as simple theft. Depending on the arms, value of highest priced rifle could have been as low as $100 (22LR). Pump shotguns are commonly in $200 range. Compared to California laws to not prosecute for thefts below (is it) $1000 per incident – we might see this as being “tough on crime” by comparison.
That said – I’d have been fine with seeing him hung in the street and mounted as a hood ornament on a FedEx truck to show they do not tolerate piracy by their employees.

I was almost a victim of FedEx, they are beyond worthless in my area. About two years or so ago I sent off a levergun for repairs, I sent it to the FFL by the Post office with no problem. He sent it back by FedEx, the day it was supposed to be delivered it never came, they said there was a security concern they said they will the next day. Apparently, there’s much more to this story that they’re not telling us. So much of this makes no sense at all.
