SHERMAN, Texas — A Sherman, Texas, homeowner defended his property on Monday, June 17, 2024, by shooting an alleged burglar who reportedly charged at him with a screwdriver.
The incident occurred around 5 p.m. in the 1300 block of East Ida Road. The Sherman Police Department received a call from the homeowner reporting a burglary and subsequent shooting. Officers arrived swiftly and detained the suspect, 36-year-old Jose Menjivar, less than a block away from the scene.
According to the police, Menjivar was found breaking into the homeowner’s shed. When confronted, he allegedly charged at the homeowner with a screwdriver. In response, the homeowner fired his gun, striking Menjivar in the hand.
Lieutenant Sam Boyle of the Sherman Police Department stated, “To this point in our investigation, it appears that the firearms discharge was justified according to state law.” Boyle also mentioned that burglary tools were found at the scene, supporting the homeowner’s claim of self-defense.
Menjivar was transported to a local hospital with non-life-threatening injuries. After receiving medical treatment, he was arrested and charged with burglary of a building. The investigation is ongoing, and further details will be provided as they become available.

We’ve a lot of those invaders here in west central.Florida where I live. They mostly keep a low profile. Because they understand “F*ck around and find out!”
I didn’t go to lawyer college so this is just my opinion – the shooter was NOT ‘protecting his property’ – he was protecting his own life and limb. The dynamics of the situation changed dramatically when the burglar/thief attacked him.
