A 62-year-old Cleveland man is recovering in a West Virginia hospital after being shot twice in the face during a burglary attempt in Fayette County, Pennsylvania.
The suspect, identified as David Luczak, was confronted by a homeowner after he illegally entered the home on Mae West Road late Saturday night.
According to reports, the homeowner discovered Luczak inside the residence around 11:20 p.m. Luczak, who had wandered through different rooms of the house, was ordered to leave but refused. After being briefly outside, Luczak attempted to re-enter the home and threatened the homeowner. In response, the homeowner, fearing for his safety, drew a pistol and fired multiple shots, striking Luczak twice in the face.
Law enforcement arrived on the scene shortly after and provided emergency medical aid to Luczak, who was later life-flighted to Ruby Memorial Hospital in Morgantown, West Virginia. He is currently in stable condition.
Fayette County District Attorney Michael Aubele announced on Monday that the homeowner would not face any charges, stating that the homeowner acted within his rights under Pennsylvania’s self-defense laws.
“The homeowner was in a life-threatening situation and made a split-second decision to protect himself,” Aubele said.
The investigation revealed that Luczak has a criminal history, including involvement in a 2013 homicide in Ohio. This history, combined with the evidence gathered at the scene, led the DA’s office to conclude that the homeowner’s actions were justified.
“This incident serves as a stark reminder of the importance of being prepared to defend one’s home,” Aubele added. “Every citizen has the absolute right to protect themselves and their loved ones in the face of danger.”
Luczak is facing charges of burglary and criminal trespass. The homeowner, who was shaken by the ordeal, has fully cooperated with authorities throughout the investigation.
The DA’s office is also looking into the possibility that mental health issues may have played a role in Luczak’s actions. Despite the frightening encounter, the homeowner expressed relief that the situation did not escalate further, highlighting the critical importance of the Second Amendment in allowing citizens to defend their homes.
As the investigation continues, the community remains vigilant, reminded of the delicate balance between safety and the quick decisions often required in self-defense situations.

What the hell did he shoot him with. Fired multiple times was struck twice in the face and is in stable condition. Huh!!! Must have been an AR15 and not one of those “9mm that will blow your lungs out” because that surely would have killed him.
We need to buy the home owner a bigger gun.
Mr Luczak is lucky he was shot in the face with a handgun and not a 12 Guage with 00 buck shot .
He didn’t use a shotgun and blast two shots through the door like Uncle Joe recommended.
I am glad the homeowner was armed and willing to use it. The homeowner gave the thief every opportunity to leave in peace but he didn’t and now he has a couple extra holes in his face to remind him of the occasion.
