BUDA, Texas — A Hays County grand jury has ruled that the August 5th, 2024, shooting death of 17-year-old Erick Marin was an act of justified self-defense, and no murder charges will be filed against the 21-year-old involved. The incident, which occurred in a drainage area behind a Buda neighborhood, unfolded during a confrontation between two groups of individuals, leading to a deadly exchange of gunfire.
According to Hays County District Attorney Kelly Higgins, the investigation revealed that Marin was the first to pull a gun during the fight. Video footage, reviewed by investigators, captured the events that followed. Marin fired his weapon at the 21-year-old, prompting a juvenile from the opposing group to return fire.
The 21-year-old then took the gun from the juvenile and shot Marin, killing him DRT (dead right there).
The District Attorney’s office, after thoroughly reviewing the evidence, concluded that the shooting was justified under Texas laws regarding self-defense and the defense of a third person. The grand jury agreed and voted to no-bill the case, meaning no criminal charges would be brought against the 21-year-old.
However, other individuals involved in the fight may still face charges related to their conduct during the altercation.
Marin’s mother, Anna Mendivil, expressed deep sorrow and frustration with the grand jury’s decision. She believes her son was protecting his 14-year-old sister, who she claims was in danger during the confrontation. Mendivil also shared concerns for her family’s safety, as they have been receiving threatening messages online.
While the shooting has been ruled as self-defense, the fallout from this tragedy has left a lasting impact on both families involved. Mendivil continues to push for justice for her son, while the Hays County District Attorney’s office maintains that the decision aligns with Texas law.

If there was video footage, and no mention of the 14-year-old girl, one could reasonably deduce that the mother of the slain boy was incorrect; if the video footage showed the girl, then perhaps the 17-year-old boy would have been justified (maybe). However, he would have still gone to jail because he was a minor (under 18) in unsupervised possession of a handgun.
