Lone NJ Man Gets Second Amendment Case To the Supreme Court, Will They Hear it?

USA –  -(Ammoland.com)- On August 28, 2017, the US Supreme Court Docketed No. 17-280 a RICO case against Governor Chris Christie and included as defendants: legislators, judges and police chiefs, which understandably is a major reward for the little man for the many battles he has fought to date; but, the war for our Constitutional right of self-protection is far from over, and your help by signing our petition below is now needed.

The two enemies of the people are criminals and the government, so let us tie the second down with the chairs of the Constitution so that the second will not become the legalized version of the first.

The State of New Jersey, and the governments of a number of more progressive northeastern states, have been ideologically driven to “become that legalized version of the first” by circumventing the US Constitution and the rule of law for an untold number of years. The following is the plight of a group of patriots led by one man with a dogged determination to correct their collaborative wrongdoings.

We told him numerous times that he was spinning-his-wheels, wasting-his-time, and would offer other words of friendly-support such as: Nick, you just can’t fight Tammany Hall. They are the government, they have all the money and the power, they will wear you down, you will be forced to give up.

And, each time our counsel fell on deaf ears as he would just smile and tell us that he knew the odds were against him, saying, “I made a commitment to myself, and I truly believe that there is no expiration date to my military oath I took to defend the Constitution. And, so I defend! Besides, if not me, then who will do this.”

And so today, after countless months of research, sleepless nights staring at a computer screen for the past two plus years, as he weaved and dodged through their minefield of fictitious legal maneuvering, The Purpura vs. Christie RICO lawsuit is now under review before the United States Supreme Court.

Although, the underlying concern of this petition to the court is of significant public importance, addressing a US citizen’s unalienable right to self-protection, as stated in the Second Amendment, the main premise of this most comprehensive lawsuit is whether Federalism still exists in our Republic. Or, have we reached a point where a state (i.e. New Jersey) can fabricate and enforce unconstitutional de facto administrative laws that indisputably contradict the purpose, scope and breadth of our rights written in the United States Constitution.

The Motion to Expedite and a copy of the Brief – Petition For Writ of Certiorari – are attached below for your review, as is a link to the petition we ask that you sign and share with others.

Although we refer to him as ‘The Legal Eagle’, the aforementioned petitioner, Nicholas Purpura, is not an attorney.

And, therefore, through only his dogged determination has this million-to-one-odds-lawsuit reached this point where it is now under review by the United States Supreme Court as a pro se case, meaning filed without the assistance of legal counsel. And, as you might have imagined, the State of New Jersey has tried numerous times to ignore and ridicule Nick for his petition, based on road blocks in the form of invented technicalities, wherein the lower courts have been aided and abetted by multiple teams of lawyers to defend the state officials named in this lawsuit.

“He is not an attorney. He has no legal right to present this case. We will just stall, deny, deny and deny him until he goes away.”

Mr. Purpura’s Civil RICO case leaves no stone unturned, as he is alleging Governor Christie and the named defendants knowingly acted in concert as an organized criminal enterprise. The defendants collaborated to fabricate and enforce de facto administrative laws by converting unalienable Constitutional rights into state granted privileges. And, the argument that the 10th Amendment gives the states the right to create and enforce laws, is unfounded when such laws violate the Constitution. The 9th Amendment states that any legislative or administrative law that violates the Constitution is no law at all. This RICO case has been conclusively proven based on irrefutable law and precedents agreed to by the prior rulings of all nine Supreme Court Judges.

Over the years, Nick has self-funded this lawsuit after asking for support, and being ignored by the NRA, and surprisingly by many Second Amendment Associations, and other well known gun-rights groups. However, he is thankful to the Central Jersey Rifle and Pistol Club at: cjrpc.org, which is the only organization to offer Mr. Purpura their financial support to date.

Please allow a little poetic-licensing, to better compliment Nick’s lawsuit storyline to date:

“At first they will ignore you.. [but, he kept on coming] ..then they will ridicule you.. [but, he challenged their false words] ..then they will fight you.. [but, he stood strong with the US Constitution by his side] ..And, then.. [after all the hard work is accomplished and the barriers removed, others will join you] ..you will win!” – Mahatma Gandhi

You might consider temporarily filing that last statement under the heading of wishing and praying for he has NOT WON – YET! But today, he is pretty damn close, and needs each of you to support him by signing the petition below and then sharing/forwarding it to all your pro-Second Amendment friends and relatives.

The wisdom of our Forefathers gave us the Second Amendment for this exact moment in our nation’s history, where rarely has there been a time when our right to lawful self-protection, i.e. keep and bear arms, has been as imperative as it is this day.

The S.Ct. could use the Purpura case to put its stamp of approval on everything that the State of NJ has done, and give a green light to ever state, county, and city council in this country. There is no telling how this will turn out.

Wild Bill, I have been remiss in not responding earlier, but thank you for your comment, and please know that the 9 SC Judges will decide on Friday October 27th on whether or not to hear Nick’s case. So, please PRAY that their oath to defend and protect the US Construction allows them to know in their hearts to HEAR this case, because it is the RIGHT thing to do. You guys must think it’s all right to let them run it up your butt. You’re still there, paying them with your taxes. I got out over twenty years ago. I live in a place where I can own Class III transferables and carry concealed. You want to live in a place where the state police brag on the fact that their uniforms are modeled after the gestapo, well, have a nice life.

Yes you are lucky, I tried to get out but every time something happened to stop me. I never heard the State Police make the claim that their uniforms look like Gestapo uniforms, but they do, on occasion, behave like they are. In traveling around America I have on occasion been stopped by State Troopers in other states and they are always polite and friendly, that can not be said of NJ State Police and I believe their attitude is the cause of some of the problems that they face. Engineering and Construction was my field. That said, re the situation existent in New Jersey and several other jurisdictions or areas, I wonder as to how The Court has avoided hearing appeals for so many years, so blatant are existing situations.

As a NJ resident I think I can answer that question. We have NO Conservatives in the legislature, we have people who call them selves Republicans and they are NOT. We have people who get elected Governor as Republicans and they aren’t Republicans, they are phony liars. Well if the supreme Court refuses to hear this, we can assume that it’s ok for all state officials to be criminals, which on the face they are anyhow. They treat us as slaves and as subjects to be murdered, caged and have our labor confiscated in the form of fines for innocuous acts. The Declaration describes what a JUST government would be. He is absolutely correct the ninth amendment clearly states any law in conflict with the constitution is NO law at all. ALL gun control laws are administrative BS that CLEARLY violate the second amendment. Administrative edicts are NOT law, “regulation” of ANY of our God given constitutionally protected RIGHTS is an unconstitutional act of treason.

Excellent. Chris Christie has always supported gun control laws, assault weapons ban, opposed concealed carry laws, and supports the one gun per month law. Later claims to be for the 2nd. Amendment, and requests this case not be accepted by the court. I don’t know why Pres. Trump doesn’t distance himself from this guy. He was appointed an Opiate/Drug Czar, and as usual in his arrogance and aggression he cares nothing about people living in chronic pain under the care of a board certified pain management doctor. I understand your point about opioids. I am a disabled veteran who takes anti-inflammatories and opioids to control my pain. If I am denied my medications, I am unable to function. I am not “high” or in any way impaired by these drugs, but if I am denied them, I would be completely unable to work, and in fact, relegated to writhing in pain, unable to function in any meaningful way.
