At first glance, it might look like they’re dodging the fight over “non-violent felons” and their Second Amendment rights. But read closely, and you’ll see something different: this is a calculated move to protect gun rights from being undermined by bad precedent.

What the Case Is About

Melynda Vincent, the petitioner, was convicted of bank fraud back in 2008. Her crime? Passing a bad check for under $500 and admitting to more check fraud as part of a plea deal. Importantly, she never committed violence, never harmed anyone, and served no prison time. Yet under 18 U.S.C. § 922(g)(1), the federal “felon-in-possession” law, she is barred for life from owning a firearm.

Vincent argues this ban violates the Second Amendment because she is not—and never has been—a danger to herself or others. The question her case raises is straightforward: Can the government permanently disarm non-violent offenders with old convictions, even when there’s no history of violence?

In other words, the Trump DOJ is telling the Court: there’s no need to spend one of your limited case slots here, because the system is already working to return Second Amendment rights to people like Vincent.

In other words, instead of asking the Supreme Court to take Vincent’s case, the DOJ told the Court to step aside—for now. Here’s why:

There are NO provisions in the second amendment for the government to limit or deny any free American citizen of his right to keep and bear arms, in fact, it says the opposite, it says that right, “Shall not be infringed.” Look it up and read it for yourself. It limits government not the citizen. To my knowledge the atf has NEVER granted anyone their rights back. One is only a “felon” while serving a sentence for commission of a felony-level crime. Once sentence is served one is once again a free person and no longer a “felon”. Any law that uses “felon” in place of “ex-felon” isn’t worth the paper it’s written on.

One can only be a “felon-in-possession” if one has a gun while in prison or while on parole or probation for a felony crime, i.e. while serving sentence.

I’ll be sending this to some folks I know. Everything is a “felony” these days. Some things that used to be a felony are normal now like marijuana use and possession.

Not mentioned but another consideration is with the limited cases that SCOTUS hears, there are more worthwhile subjects to be addressed such as “assault weapon” bans and magazine limitations. And if the cases can be rushed through the lower courts in just a couple years, nullifying the presence of suppressors, sbrs, sbss, and aows from the NFA. A sad note on that subject: the language in the SHORT, HPA and HUSH acts did not properly clean up 26 USC Chapter 53 or 18 USC Chapter 44. At one time, a majority of people in the United States were basically honest God-fearing individuals and did not want to take a chance on losing a right “privilege” which directed them to being honest. Today, people just don’t care because penalty of breaking laws is so lax.
