Trump’s Judicial Appointments Continue to Shape the Fight for the Second Amendment

A major win for President Donald Trump — and for every American who values the Second Amendment — just unfolded in Washington. The U.S. Senate has officially confirmed Professor Jennifer Mascott to the Third Circuit Court of Appeals, marking another crucial step in Trump’s long-term effort to restore an originalist interpretation of the U.S. Constitution to the federal judiciary.

This development, highlighted by constitutional attorney and Second Amendment advocate Mark W. Smith of Four Boxes Diner, could have immediate consequences for pending gun rights cases in New Jersey, Pennsylvania, and Delaware.

A Victory for Originalism and the Constitution

Professor Mascott’s confirmation represents far more than a routine judicial appointment. She is a scholar deeply rooted in constitutional originalism — the judicial philosophy that interprets the Constitution as it was understood by the Founders. Mascott studied under two of the Supreme Court’s strongest originalists, Justices Clarence Thomas and Brett Kavanaugh, and her work has consistently reinforced the importance of limited government and separation of powers.

Mark Smith summed it up best in his video:

“So, ultimately, I think this is a huge win for President Trump, and I’m hoping this is a big win for originalism, a big win for the Second Amendment, a big win for the original understanding of the Constitution, including the original understanding of the Second Amendment. But again, you know, we will see.”

At a time when activist judges have sought to rewrite the Constitution from the bench, Trump’s appointments have been critical in re-anchoring the courts to their constitutional foundations.

Why This Appointment Matters Right Now

Mascott’s confirmation comes just days before the Third Circuit is set to hear an en banc challenge to New Jersey’s bans on AR-15 rifles and standard-capacity magazines — laws that gun owners nationwide recognize as blatant infringements on the right to keep and bear arms.

Before Mascott’s appointment, the Third Circuit’s active bench stood at eight Republican-appointed judges and six Democrat-appointed judges. Her addition shifts that balance further, making it nine to six for the October 15 hearing in Cheeseman v. Platkin and Association of New Jersey Rifle & Pistol Clubs v. Platkin.

That one seat could make the difference between upholding unconstitutional gun bans or restoring the full protection of the Second Amendment in one of America’s most anti-gun jurisdictions.

As Smith explained:

“With the elevation of Jennifer Mascott to the third circuit. It will become 9 to 6 right in favor of the Republicans for the en banc panel… 9-6 for the Cheeseman case.”

The Trump Legacy: Rebuilding the Federal Bench

This confirmation underscores why Trump’s presidency remains one of the most consequential in modern history when it comes to judicial appointments. During his first term, Trump — with the help of Senate leaders like Chuck Grassley and Mitch McConnell — successfully filled over 230 federal judicial seats, including three Supreme Court Justices.

Those appointments created a generation of judges who interpret the Constitution as written — not as “living” or malleable to modern politics. That approach has already produced landmark victories for gun owners, from New York State Rifle & Pistol Association v. Bruen to Cargill v. Garland and beyond.

Now, with Trump back in the White House and his second wave of judicial nominees taking the bench, the foundation for defending constitutional rights — especially the right to keep and bear arms — has never been stronger.

Final Steps: Trump’s Signature and Swearing In

While the Senate’s confirmation marks a major milestone, Professor Mascott officially becomes a federal judge once President Trump signs her commission and she is sworn in — a process expected to happen swiftly, ahead of the October 15 hearing.

Smith speculated that the swearing-in could be conducted by none other than Justice Clarence Thomas or Justice Brett Kavanaugh, both of whom have mentored Mascott and share her dedication to constitutional fidelity.

Why It Matters for Gun Owners

For gun owners across the country, this isn’t just about one court or one case. It’s about the long game — ensuring that the federal judiciary is staffed with judges who respect the Second Amendment as a fundamental right, not a privilege to be regulated out of existence.

Every appointment like Mascott’s helps secure the legal ground on which future cases will stand. As anti-gun states push increasingly radical restrictions, it’s the judges who adhere to the Founders’ intent who will determine whether those laws stand or fall.

Trump’s judicial strategy is working — and the confirmation of Jennifer Mascott proves it.

It’s also worth noting that Karin Immergut, the District Judge in Oregon, is Trump’s appointee. She ruled the horrible Ballot Measure 114 is perfectly “Constitutional” and has endeavored to stop Trump from fulfilling his Commander in Chief authority with regard to National Guard deployment.

Justice Clarence Thomas is without a doubt, the strongest Constitutionalist on the US Supreme Court. I wish we could make several clones of him. Calling Kavanaugh an Originalist is at best, laughable. Kavanaugh will do whatever turncoat Roberts tells him to do in any given situation.

Excellent that’s a very strong possibility of a circuit split in the so called assault weapons ban cases. Commie Connecticut needs this!!! I think the numbers was 8 to 6 instead 9 to 6 but hey, I’ll take those numbers if they’re true!!! Time will tell.

The big question now is Did Trump sign Mascott’s commission (senate judicial confirmation) before he flew off to the middle east? If not, she might not be sworn in before the Cheeseman hearing on Wednesday. He is scheduled to return at 00:05 Tuesday morning so there is still time but it will be tight.

I fail to understand the motivation behind the slavish rapture of Mr. Trump’s followers. His own appointments (to the judiciary) have gone against him and his policies repeatedly. When this appointee actually does something meaningful, then that is the time to praise Trump’s judgement. I have voted for this man three times but I don’t think he is God incarnate. Please reserve your joy over any appointments until they prove helpful to our nation. After all he is guided by advisors who have an agenda too.

Personally they couldn’t find just as qualified man.
