Virginia Attorney General Jason Miyares’s office is trying to have Virginia Citizens Defense League’s (VCDL) case against Virginia’s One Handgun a Month (OHGAM) law thrown out of court, claiming VCDL and GOA don’t have “standing” and, for the case to be valid, we need to sue the local sheriff and prosecutor, too. The last part is nonsensical as it is solely the Virginia State Police who are involved in administering the OHGAM law.
Miyares is directly involved in fighting the Virginia Citizens Defense League and Gun Owners of America, not just some underling in his office.
Further, Miyares is arguing that OHGAM is constitutional because a person can still buy more than one handgun a month if they jump through the Commonwealth’s hoops. And he claims that the enhanced background check for buying more than one handgun a month is constitutional because getting the permit to do so is “shall issue.” But that isn’t true, as the statute and regulations contain discretionary language with no limiting principles, and require multiple in-person appearances at limited locations!
What really makes it ridiculous to defend OHGAM is that the Federal Ninth Circuit Court of Appeals, which has never been a friend to gun owners, ruled 9 to 0 that California’s One Gun a Month law is unconstitutional!
My disappointment in Miyares is profound. He’s wasting VCDL’s and GOA’s time and money on indefensible laws. When it comes to Miyares defending all the various unconstitutional gun-control laws in Virginia (One Handgun a Month, Universal Background Checks, and gun bans in rest areas and ABC stores), he is doing exactly what Mark Herring would have done if he hadn’t lost the election to Miyares in 2021.
Am I a fan of Miyares’s Democrat opponent, Jay Jones? No, his record on guns is abysmal. But, Miyares hasn’t exactly put a lot of enthusiasm in me, either.
I hate holding my nose when voting for a candidate.

Let’s tell Jason Miyares to uphold his oath to the Constitution and stop defending gun laws that are clearly unconstitutional.

All the more reasons that we should buy CNC machines, learn how to use them and make our own.
