North Carolina --(Ammoland.com)- In defending their endorsement for HEATH SHULER, NRA lashes out at a “group purporting to support the Second Amendment” claiming that the unnamed organization is ” either grossly misinformed or deliberately attempting to mislead voters in North Carolina’s eleventh congressional district about the record of Congressman Heath Shuler.”

Oh really?

They further state that “Congressman Heath Shuler tried to protect the First Amendment rights of all gun rights organizations,” and that Shuler “has consistently voted to protect our Second Amendment rights and he has earned our endorsement and support.”

Is that a fact? Well, let’s see…

DISCLOSE ACT, THE FACTS
Where do we start? After finishing scratching our heads over how much of a champion of the First Amendment (not to mention the Second Amendment on which he has a GRNC 0% voting record) — according to the NRA – Shuler is, the question occurs of why the NRA waited to remove their opposition to the DISCLOSE Act until their champion Shuler introduced an amendment with an exemption so narrow that the only Second Amendment organization that was exempted was THEM.

Of course according to their latest communication, they are the only true defenders of the Second Amendment and everyone else simply “purports” to support the Second Amendment.

So, why does a congressman with a ZERO percent voting record on the Second Amendment suddenly get a favorable rating from NRA after cutting a deal to allow them to be the only 2A organization who is allowed to speak without having to turn over their donor list to the government during an election cycle?

So, what would the DISCLOSE Act do to 2A groups not fortunate enough to have an anti-gun politician willing to go to bat for them?

Organizations such as GRNC, Gun Owners of America and CCRKBA will be effectively banned from engaging in political debate. The demand would be on such organizations to enumerate their donors any time they issue any kind of campaign advocacy ad.

Along with that it also does the following:

  • Bans political speech by government contractors and TARP recipients but not unions with collective bargaining agreements with the government or unions who receive dues from government payroll deductions.
  • Imposes legally unsound limitations on coordinated communications between federal candidates and organizations – possibly subjecting candidates to investigations and fines for activity they don’t know took place.
  • Creates highly complex reporting requirements – unlikely to impact unions – that would have high compliance costs and disproportionate effects on small businesses.
  • Places more stringent “stand by your ad” requirements on organizations than candidates by forcing organization heads and top funders to appear in ads, stating their organizations’ names up to five times.
  • Deliberately and recklessly seeks to affect the 2010 elections by taking effect in 30 days without waiting for the FEC to issue instructions and rules so people can follow the law and avoid criminal and civil punishment.

    1. Congressman Heath Shuler has “Zero Pro-Gun Votes?” This sounds like the typical deception being spread by Paul Valone.

      A quick visit online to the Library of Congress (http://thomas.loc.gov) proves otherwise and reveals that Congressman Heath Shuler:

      VOTED this year for the Protecting Gun Owners in Bankruptcy Act (H.R. 5827 in the 111th Congress), which would ensure that a person who filed for bankruptcy would not lose their firearms, thereby maintaining the fundamental right to self-defense.

      VOTED last year for (the Senate amendment to H.R. 627) allowing carry license or permit holders to carry and transport firearms for self-defense in national parks and wildlife refuges.

      VOTED (for the Altmire amendment to H.R. 2016) in 2008 to protect hunting, fishing, trapping and recreational shooting on public land under the control of the Bureau of Land Management.

      Cosponsored the Second Amendment Enforcement Act (H.R. 5162 in the 111th Congress and H.R. 6691 in the 110th Congress) and District of Columbia Personal Protection Act (H.R. 1399 in the 110th Congress) that would repeal the D.C. gun ban/registration statute and restore the right of self-defense to law-abiding residents of our nation’s capital – also VOTED for the Childers amendment to H.R. 6842 in the 110th Congress to accomplish this.

      Cosponsored legislation (H.R. 2296 in the 111th Congress and H.R. 4900 in the 110th Congress) to force much-needed reform of the federal Bureau of Alcohol, Tobacco, Firearms and Explosives.

      Cosponsored the National Right-to-Carry Reciprocity Act (H.R. 197 in the 111th Congress and H.R. 861 in the 110th Congress) that would extend federal protection of state right to carry licenses and permits across the country.

      Cosponsored the Veterans’ Heritage Firearms Act (H.R. 442 in the 111th Congress) that would provide an amnesty period during which veterans and their family members could register firearms acquired overseas between 1934 and 1968 without fear of prosecution.

      Cosponsored the Firearms Interstate Commerce Reform Act (H.R. 1074 in the 111th Congress) that would allow interstate sale of handguns subject to NICS.

      Signed the pro-gun congressional “friend of the court” brief in the 2008 Heller case supporting the Second Amendment as an individual right and striking down the gun ban in our nation’s capital.

      Signed the pro-gun congressional “friend of the court” brief in the McDonald case supporting the position that the Second Amendment is a fundamental right that protects all Americans.

      Signed a letter to Attorney General Eric Holder along with 64 other House Democrats expressing his opposition to reenactment of the failed 1994 Clinton ban on semi-automatic firearms and ammunition magazines.

      Saying Heath Shuler has “zero pro-gun votes” or “really have a voting record on a strictly gun-related bill” is both wrong and irresponsible.

    4. T&F has a point, it would be better to say that Shuler has “zero *meaningful* gun votes.” What record there is, is one of convenience that required zero guts. Of course then there’s Shuler’s involvement with DISCLOSE that infringed on the First Amendment. I guess NRA doesn’t care about the First, only the Second. How can you defend the Second without free speech? Why should we elect someone to Congress that would violate any part of the Constitution.

      Of course then there’s the issue of Shuler’s competiton, Jeff Miller. Miller is clearly pro-gun. So why attack a pro-gun candidate by supporting a questionable one? Is it because of Shuler’s role in creating an exception for the NRA in his DISCLOSE bill?
