SACRAMENTO, CA –-(Ammoland.com)- Firearms Policy Coalition (FPC) has confirmed that the California Department of Justice (DOJ) has withdrawn their proposed “emergency” regulations on large-capacity magazines.

A December 29, 2016 Office of Administrative Law (OAL) memo, sent to Attorney General Kamala Harris today, states that “This notice confirms that your proposed regulatory action regarding Large-Capacity Magazines was withdrawn from OAL review pursuant to Government Code section 11349.3(c).”

Section 11349(c) states that:

If an agency determines, on its own initiative, that a regulation submitted pursuant to subdivision (a) should be returned by the office prior to completion of the office’s review, it may request the return of the regulation. All requests for the return of a regulation shall be memorialized in writing by the submitting agency no later than one week following the request. Any regulation returned pursuant to this subdivision shall be resubmitted to the office for review within the one-year period specified in subdivision (b) of Section 11346.4 or shall comply with Article 5 (commencing with Section 11346) prior to resubmission.

“This is welcomed news for law-abiding gun owners and the thousands of people who stood up for common-sense in their letters opposing the DOJ’s outrageous proposed regulations,” said FPC President Brandon Combs. “But make no mistake, the DOJ isn’t done with this issue. Our policy team will continue to aggressively monitor and oppose all anti-gun regulations that DOJ might dream up next.”

As part of its grassroots lobbying program, Firearms Policy Coalition recently collected and delivered to DOJ and OAL thousands of letters sent by people who opposed the proposed regulations.

Misleading article, the “Emergency Ban” which would take effect right away will not happen, but the ban that was passed will still go into effect on July 1 2017. This is NOT a win for gun owners.

I was thinking the same thing. So they don’t have a regulation, they still have the law. California’s new magazine ban (Senate Bill 1446) goes into effect on July 1, 2017.

What we need now is for the Republican controlled congress to pass a bill that states that no state or local government can impose any restrictions; on rights given to citizens by the constitutional.( Including the bill of rights )
Trump needs to sign this bill!
With this bill we would not need a national right to carry a gun anywhere in the U.S.

Correct! The 2nd Amendment does NOT grant, give, transfer nor otherwise provide any right. Read the Preamble to the Bill of Rights. The 2A RESTRICTS the Federal Government from infringing upon a right that already existed and Pre-existed the Constitution as well as the United States….even the Colonies. I do not know how “….Shall Not be Infringed” has been infringed again and again.

you miss part of the intent of that Second. It says SHALL NOT BE INFRINGED. Thus it is the burden of FedGov to see to it that no one, nothing, no entity of any sort in any place may infringe upon the right OF THE PEOPLE to keep and bear arms, and FedGov is to take action to right such wrongs.

you need to read that US Constitutioni again. It says “shall not be infringed”, and does not lilmit the “by whom” part of that charge. Thus, since this is law at the federal level, no person, organisation, of government entity may pose any restriction on our right to arms. Such authority is thus prohibitted the States, and it remains the duty of FedGov to deal with ANY infringements of any sort. Even the standard garden variety Mother May I Cards issued by so many states as a precondition to “bearing” arms is an unlawful infringement.

Something else (worse) in the works, no doubt. Dems have a veto-proof, super-majority in the Assembly and Senate. So whatever they come up with can’t necessarily be stopped by a Governor Moonbeam veto, as unlikely as that may be.

Seeing as how they enacted Gun-pocalypse — by “gut & replace” subterfuge — it behooves us all to be very watchful.
