Oregon: How It Is Possible For People Writing Laws To Be This Painfully Stupid

Oregon – -(AmmoLand.com)- 02.22.2020

Last night the Oregon House Rules Committee passed an amended version of HB 4005A the Lock-Up all Guns Bill, to the full House Floor. The bill moved out on a straight party-line vote.

The amendment that was added last night was the “dash 12” amendment which may not be included yet in the website version of the bill but will be part of the final bill sent to the floor.

The key part of the amendment says : “‘Control’ means, in relation to a firearm: “(a) That a person is in sufficiently close proximity to the firearm to prevent another person who is not an authorized person from obtaining the firearm; or “(b) That a person is in the person’s residence with the firearm, either alone or only with authorized persons who also live in the residence and who are not minors, and the doors and windows of the residence are closed and locked.”

The amendment was requested by House Speaker Tina Kotek.

You would not be alone if you wondered how it is possible for people writing laws to be this painfully stupid.

You need to keep your doors and windows locked in the middle of the summer? If your 17-year-old daughter arrives home and has a key to her own house you are suddenly in violation? Does this now mean she cannot be an “authorized person” allowed to protect herself with a firearm if you are not home?

Clearly, no one intent on eliminating your 2nd Amendment rights gives this any thought. They don’t have to. They are in the majority and they are going to do whatever they want because they can.

All the other really bad provisions of the bill are still intact.

The bill does have the votes to pass on the House Floor because of the Democrat's supermajority and the high likelihood that “Republican” Cheri Helt will vote “yes” as well. But it cannot become law unless it also passes the Senate.

Most Senate Republicans have indicated they are willing to walk out to stop the economy crushing “Cap and Trade” bill, but they have also indicated that they are closely watching this dangerous and counterproductive gun grab.

There has also been quite a bit of talk that many of the Republican House members may walk out as well. Again, this would almost certainly not include Cheri Helt who remained on the floor on Tuesday when the other Republicans refused to attend a late-night floor session.

There are a few Democrats who may vote against this bill. Senator Betsy Johnson is virtually a sure “no” but there are indications that House Rep Jeff Barker may also oppose it.

However, given the numbers, the best bet we have to defeat this insanity is if the Republicans just stand up to the tyranny and leave.

Please take a moment to send a message to the Oregon Senate Republican Leader and the Oregon House Republican Leader thanking them for standing up for your rights this session and supporting and encouraging a walkout to put the brakes on the Democrat's efforts to destroy freedom and common sense in Oregon.

You can use this link to send a pre-written message that you can add to (if you choose) and you call your own Senators and Reps at 800.332.2313.

We are at a turning point in our battle to save Oregon and your efforts really do count.

They are not stupid, they’ve been bought. Those who would surrender their rights and freedoms for some security neither deserve nor have either. Franklin. Not an exact quote but you get the idea. The right of self defense and the right to keep and bear arms are laws that come down from GOD to all mankind. These rights and freedoms are unalienable. Our constitution, bill of rights, the amendments and even our declaration of independence acknowledges those facts. Any law that runs contrary to these unalienable rights is therefore null and void and is so legally. Anyone who legislates, judges,… Read more »

Luke 22:36 (King James Version): Then said he unto them, But now, he that hath a purse, let him take it, and likewise his scrip: and he that hath no sword, let him sell his garment, and buy one.

“The right of the people to keep and bear arms shall not be infringed.” This comes directly out of Scripture Luke 22:36, just as you have written. Our constitution, bill of rights, amendments and even our declaration of independence ALL show this nation is/was founded upon Scripture. Anyone who legislates, judges, lawyers, enforces or funds any law that is repugnant to the constitution and Scripture is, by definition, treasonous. We know what the punishment for treason is. I would add to it a PUBLIC TARRING AND FEATHERING to serve as prison clothing until sentence is carried out. Arm up, carry… Read more »

This is absolutely ridiculous! Oregon has totally lost their mind. I would ask the question: are you trying to control crime and violence, or are you trying to control guns? If the answer is “control guns,” they’ve done nothing to control crime and violence. If you control crime and violence, what need is there to control guns? Not all crime and violence requires a gun, nor does a gun require crime and violence. I’ve used this logic in the neighboring state of Washington, and there are those who say “you don’t understand…..” Yeah, I DO understand!

@Get, You have your finger on the pulse. If a statute purports to do one thing, but the legislators really intent it to do a different thing, then the statute is unconstitutional because it fails the substantive due process test.

speechless with mouth agape. This is such a terrible reminder that legislative bodies can and do make stupid law, which then requires a variety of legal challenges, & untold expence to overcome such stupidity.

Have to GET it to trial first.Any states that Pass Red Flag Laws and do not add DUE PROCESS first is asking for a Revolution.
We can never allow MAN to make law/s that are ILLEGAL under the Supremacy clause of the CONSTITUTION.
To allow it it is NOT doing our DUTY.

@DZ – Have to get it to a trial AND have reasonable-knowledgeable people on the jury. I get called up roughly once a decade and have never reached point of being questioned. Do not expect to ever serve on a jury due to history, careers and outspokenness. Whichever lawyer does not think their case can withstand scrutiny and logic – will kick me out. In many cases, I suspect both could attempt to get the judge to kick me out for obvious bias. Will need to pretend I’m talking to cops if looking at a case I’d like to sit… Read more »

ALL LAWS REPUGNANT TO THE CONSTITUTION ARE VOID – Marbury v Madison

What if we just ignored these tyrannical idiots and carry on with our lives? And if they try to deprive you of your rights by color of law, treat them like the criminals they are. There are over 110 million lawful gun owners in America; they can’t lock up all of us.

@WF, An excellent quote that every American should know before leaving grade school. And that part about ignoring them, that is what we do in East Texas. We even sell guns at yard sales.

It may be too late. Austin, Houston, Harris County, San Antonio, Dallas, El Paso. Three of the ten largest cities, and the 2nd most populous county, in the U.S. are in Texas and all are controlled by liberal Democrats. Republicans and gun owning Democrats need to wake up, get off their butts and vote Republican in every election from school districts to President. Once we’ve lost our rights, we’ll never get them back. Once they’ve confiscated our guns, they’ll soon be back for everything else.

@BowserB – Liberals ALWAYS congregate in the cities. That’s where you have the most government control over things. That’s where they accumulate political power so naturally they will fill up the cities first and then dictate to the rest of the rural state how it’s gonna be. That’s how they do it in Illinois. Chicago politicians boss the downstate Governor & legislature and dictate terms. The Left will replicate this in Texas, and Florida, and maybe a couple other states but at that point they’ll control the federal government and they’ll consolidate power so they cannot be removed from DC.… Read more »

You are certainly correct but I wonder why? Born and raised on a farm (seven and a half miles to the closest town) I learned to shoot (a single shot 22) when I was five. Got my first deer (hunting alone) at nine. Given my first 12 Ga. shotgun, by my grandfather, at the age of nine also. Furthermore, at nine each member of the family was expected to contribute to the family by doing the work of a man. We did not have electricity until I was 16. I know all about how things were back in those days… Read more »

No ,but they will bankrupt you, and seize all your property, and livelihoods. So I would rather just start shooting first.THESE UNCONSTITUTIONAL LAWS must be first come to Redress, and if ignored. The the voting booth if that doesn’t do it, all that’s left is the Cartridge box.
We know their MO, they do not know ours.
Personally I have had all this LAWLESSNESS by POLITICIANS passing UNCONSTITUTIONAL laws and codifying them I am prepared to take, making them APPEAR to be legit and using them as bludgeons on WE THE PEOPLE must stop, or we will stop them.

@Doszap – Well that’s what I’m alluding to. When they come to violate your rights and destroy your life, people need to go to WAR and wage insurgency on THEM. We have as a Republic, four boxes. The Soap Box to express our position, the Ballot Box to select those who will carry out our wishes, the Jury Box to nullify bad laws or stop the state’s targeting of innocent people, and finally the Cartridge Box when all else fails. And all else has been failing for quite some time now. It is time for us to STOP the tyrants… Read more »

The People of Oregon are…were…religious people…VERY religious. They were not aggressive nor suspicious. My family moved from Kalifornia to Oregon in 1962. The people from all over the Willamette valley came to greet us and welcome us to Oregon. I think they brought food or invited us to their homes for meals for over a month. So, when the lazy, devious communist democrat hippy scum came up from Kalifornia in the late 1960s, the naive Oregonians accepted them with open arms. Well, the scum running Oregon now, are the insane communist spawn of those hippy trash, the hippy trash that… Read more »

I was born in Portland and have lived in Oregon most my life, with the exception of 15 yrs in the great State of Montana. If it wasn’t for my family, I would still be there. I now live in Douglas County in Oregon, which is absolutely conservative, and a 2nd amendment sanctuary county. Thankfully. The only part of the State that is so liberal is The northwest corner and Willamette Valley. The rest of the State is solid RED. I am for the Jefferson movement , and also now the idea of becoming part of Idaho. The good people… Read more »
