Washington, D.C.- Representative Thomas Massie (R-KY) announces the introduction of H.R. 645, the National Constitutional Carry Act. Massie’s constitutional carry legislation will ensure Americans’ Second Amendment right to carry firearms in public spaces is protected throughout the country.
“I’m fortunate to live in a state where people are free to exercise their right to keep and bear arms without begging the government or paying a fee,” said Rep. Thomas Massie. “Unfortunately, not every American enjoys the same right to carry firearms in public because some states and localities infringe upon this right through a variety of criminal, civil, and regulatory penalties. By prohibiting state or local restrictions on the right to bear arms, H.R. 645 upholds the original purpose of the Second Amendment—to ensure the security of a free state—while safeguarding individual liberties against government infringement.”
Massie’s legislation is composed of two major provisions.
- The first provision prohibits any state or political subdivision from imposing criminal or civil penalties on eligible individuals carrying firearms in public.
- The second provision invalidates any existing state or local laws, statutes, regulations, or local restrictions that criminalize, penalize, or otherwise dissuade the carrying of firearms in public.
In addition to covering all fifty states, H.R. 645 includes the District of Columbia, the Commonwealth of Puerto Rico, and other territories of the United States within its scope to ensure that residents of all U.S. jurisdictions enjoy consistent protection of their Second Amendment rights.
Rep. Massie’s National Constitutional Carry Act is endorsed by prominent gun rights organizations, including the National Association for Gun Rights (NAGR) and the American Firearms Association (AFA). Representatives of these organizations offer the following statements of support:
“Currently, 29 states have adopted constitutional carry laws, yet contrary to the warnings of gun control advocates, there’s no evidence of rampant violence or ‘wild west’ scenarios. Instead, crime rates either remain stable or show a decline. With numerous states affirming citizens’ rights to bear arms without excessive government regulation, it’s about time Congress follows suit,” said Hunter King, Director of Political Affairs, National Association for Gun Rights.
“For the past 15 years, anti-gun liberals have told everyone that states passing constitutional carry would experience violence like we haven’t seen since the ‘wild west’ days. Twenty-nine states have proven them wrong, all while gun-control strongholds like DC, Chicago, and California have descended into violence and deadly chaos. A good start to nation wide permit-less carry
Constitutional Carry is nothing new it has been in place for a very long time what was not present is the ability of law makers to follow the US Constitution.
We saw slow Joe who laid claim to the 28 amendment then we laughed and enjoyed the first week of watching our President take the war to the democrats. what would make sense is a law that would criminalize infringements of rights, give bor teeth
I don’t like it. I fear it is like many other pro-gun laws by well-intentioned people that weakens the supremacy of the constitution and the second amendment. By passing this law we’re relinquishing our Constitutional God-given rights to the whims of congress and it is subject to repeal. It’s a law that says “the constitution means what it says and must be followed “. We don’t need that, we need judicial action and yes, repealing or voiding of all the unconstitutional laws, ceasing enforcement for unconstitutional laws, but I don’t think we should need a law to protect the constitution.… Read more »
It shames me no end that none of the “Representatives” from South Carolina are on our list of sponsors. I will attempt to contact my pseudo-conservative Representative and ask that he rectify this matter.
This no-brainer bill tells the states they cannot infringe and must abide the 2nd prohibition on their authority over arms. Next, Congress must recognize their own lack of authority over arms, invalidating and abolishing every statute that violates the 2nd, such as the NFA, GCA, Hughes amendment, etc.
This one I can get behind. Not that “reciprocity” BS.

This act reinforces the gubmints right to harass gun owners. They can stop and question you and, if you don’t have the requisite papers, arrest you. And as we all know, the more interactions you have with police the more accidents are likely to happen. This is also unconstitutional. Why are we supporting unconstitutional laws?? This is why I left the NRA when they sold us out in California. I will NOT support any gun rights organization who supports unconstitutional laws or any politician.
