Manasquan, NJ –-(Ammoland.com)- Remember all those who denied that firearms confiscation as a result of New York's new gun laws was too “insane” to even consider?

That it was strictly in the realm of paranoid conspiracy theorists and the “it cant happen here crowd”?

Those were and remain some of the standard replies to anyone who even thought about the possibility, let alone gave voice to it, despite the fact that Gov Cuomo and numerous other officials made public comments about such a plan, as I discussed in my article “Feinstein & Cuomo Admit Planning Australian Style Government Gun Buy Back” .

Elected Officials, the media, various Gun Control Groups and their zealous forced disarmament supporters, even some firearms owners themselves all insisted it was to crazy to even consider.

There's just one huge problem it is happening now in New York State!
It seems those that tried desperately to warn of such an insidious plot had hit the bullseye with their warnings after all. News came from multiple NY State based firearms enthusiast websites late Friday that confiscations of Pistol Owner ID Cards, as well as firearms and accessories has commenced in NY under the provisions of the horribly flawed, draconian and blatantly unconstitutional NY SAFE Act.

Those folks having their weapons and FID cards confiscated  have been discovered to have been prescribed multiple different types of psychotropic drugs, such as those for Depression or Anxiety. These are known as SSRI ( Selective Serotonin Reuptake Inhibitors) class drugs and have the potential to cause serious and adverse side effects, something I wrote about extensively last week in an article that went viral in days and caused multiple Anti Gun and Progressive News Groups to initiate a concentrated denial of service hacker attack against Ammoland Shooting Sports News (see Daily KOS ” Keeping Track Of The RKBA Crowd” http://tiny.cc/ug67uw),  in an effort to keep the information from the public.

“John Doe, an upstanding professional with no outstanding criminal convictions and no history of violent action received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history. The New York State Department of Health is apparently conducting a search of medical records to determine who is being treated for anxiety drugs and using this as a basis for handgun license revocation.

Those are the facts. Nothing more, nothing less.
Now, before anyone trots out the old saw about how this is nothing more then a paranoid, unsubstantiated rumor on a “gun nuts” internet forum. I spoke to the Attorney of Record in this matter on the phone this morning and he confirmed that the above snippet is accurate and these cases are happening!

James Tresmond Esq confirmed in our conversation that the above mentioned case is occurring in Erie County NY, it is his client that has been effected, and as yet unknown sources have seen fit to take it upon themselves to share confidential medical records with NY State Officials without authorization, a massive HIPPA violation.

It seems these supposedly confidential records are then compared against a list of known NY pistol license holders and letters are sent out demanding their Pistol Owner ID Cards be surrendered, as well as any firearms and accessories.

This is an unprecedented violation of a Citizens 2nd, 4th, and 5th Amendment RIGHTS, brought to fruition by power and control hungry tyrants holding elected office who swore an Oath to uphold and defend the very rights they are now actively stripping from their constituents.

Moreover, the confiscation efforts underway in NY State have had another, albeit unintended effect. By undertaking this course of action, those in power have inadvertently pulled back the curtain on something they have suppressed from the Citizens for far to long, leaving them with precious little wiggle room to explain away their actions.

  • Either they are acknowledging that there is in fact some sort of little reported link between the prescribing of psychotropic drugs and violent behavior, thus they are somehow, at least in their own minds “justified” in their actions to preempt someone from violence.
  • Or, this is nothing more then a backdoor confiscation effort and massive abuse of governmental power unleashed on innocent Citizens.

Those are the only two possible explanations.

    Don’t worry folks – this is just a federal test to see how people are going to react when the nation wide confiscation begins. If you beleive otherwise then give up your guns and see how well the government will take care of you.

    You missed an amendment there.
    The 8th enumerates the rights of the people against cruel and unusual punishment.

    Now, it may be a stretch, but taking away private property that was legally purchased without any form of fair market value compensation is, in my book at least, cruel and unusual punishment.

    This an outrage I have a buddy a former soldier of mine he was my 240 gunner in Iraq he lives in the Bronx. He was also not born in America he Fought for his Citizenship two tours. And yes he and I have both been treated for anxiety, where he lives he would be arrested for only exercising his 2nd Amendmant rights. I live in the deep south and firearms are normal here but my buddy in the bronx doesn’t even get the chance to defend the one life GOD has given him????

    They had fair warning that it would happen and they still allowed the state to write and pass this unconstitutional law that relies upon information illegally obtained by the state and local governments in order to take this action. Do NOT say it can not happen here because NY is just a glimpse of what the Federal government has planned. Keep in mind that this administration has shown time and time again that it has no hesitation about breaking laws or trampling on the Constitution.

    This story is two months old. Why are you putting it out now? To the best of my knowledge, the state police admit they made a mistake of identity. I still do not think the law is right and I sincerely hope it gets repealed. I just hate seeing old stories put out as being “news”.

    HIPAA does not apply to law enforcement: “To a law enforcement official reasonably able to prevent or lessen a serious and imminent threat to the health or safety of an individual or the public (45 CFR 164.512(j)(1)(i))” Administrative requests to pharmacies (i.e. a letter on official letterhead) is all it takes to get the names and addresses of people on certain medications. Why do you think there is a great push for computerized medical records? Wake up.

    Anti-anxiety med’s are also used for other purposes that have nothing to do with one’s mental state, as they also relieve muscle spasms, and other medical problems. I don’t think a bad back is a good reason to take a persons firearms. Is it legal to take action against against someone because you think they might possibly do something? If my neighbor likes to get drunk, can I call the authorities and have his car taken away, because he might drive it and kill someone while he is under the influence?     Because of job stress,there are many leos who have or are taking these “nerve drugs” prescribed by their doctor. There are records of who is taking what in the doctor’s records,in the pharmacies, and now probably somewhere in a central location in Albany. If They are going to go after the citizen and not Themselves…we have a real problem.

    Check Yahoo news from this past week. Headline re: Unknown victory for gun grabbers. Give your bank hell…better yet cut up GE backed credit cards and send them back with a note telling them why. Chevron gas cards are under GE for one.     I read a national gun owner work stoppage it will shut down the country no shooting needed. I agree it is worth 4 or 5 days salery to keep my guns. Best solution I have seen so far.

    Ok Cal, care to elaborate precisely why you find it so hard to believe that I have spoken to the Attorney ? More then once in fact at this point. Its not difficult to find someones phone number, particularly an Attorney whose name is associated with the case. So I called, explained who I was, what I did, asked if he minded me asking some questions about the case and confirming it, which he obviously did, and I wrote the story. Whats so unbelievable ? Thats how journalists get information to write.

    I live in NY and a persons Pistol permit and weapons were stripped due to him supposedly taking anti anxiety medicine. The problem is the state police made a mistake and named the wrong man.     Hate to break it to you Owen Johnston, but it IS happening, the Attorney involved has confirmed it multiple times , including on a radio interview ( link is embedded in the article ) and now an Albany NY Area TV station has reported it as well, including on camera comments from the Erie County Clerk and a terse, short statement from someone in the NY State Police which amounts to The County Clerk and the State Police pointing the finger at each other.

    There is no such provision in the law. The law does require mental health professionals to submit a report if they believe a patient is likely to physically harm themselves or others, for example if the patient has made violent threats. There is no evidence that the State of New York is covertly receiving medical information on mental patients. I encourage you to update your article to correct these factual errors. The NY SAFE Act has not resulted in the government snooping people’s medical records, and there is no provision in the law prohibiting people prescribed certain drugs from owning… Read more »

    It’s UNLAWFUL for the government to restrict ANYONE’S 2nd amendment rights; either by “adjudication” or anything else.

    “SHALL NOT BE INFRINGED” makes no exception for criminals and crazies.

    I don’t understand how it is legal to infringe/restrict a person’s 2nd Amendment right without adjudication or due process of the law?

    Why aren’t we concentrating on the obsession of the “gun control” community to restrict our rights without adjudication (judge, due process, lawyers, experts, defense, appeal, etc.)? They are trying to set a dangerous precedent!
