FPC WIN: Federal Judge Blocks California’s SB2 Handgun Carry Bans, iStock-697763642

Firearms Policy Coalition (FPC) announced that Federal District Judge Cormac J. Carney issued a preliminary injunction in its Carralero v. Bonta lawsuit, blocking enforcement of California’s newest ban on firearm carry. The opinion can be viewed at FPCLegal.org.

“SB2’s coverage is sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court,” Judge Carney wrote in his opinion. “ SB2 turns nearly every public place in California into a ‘sensitive place,’ effectively abolishing the Second Amendment rights of law-abiding and exceptionally qualified citizens to be armed and to defend themselves in public.”

“This is a great day for Californians and human liberty,” said FPC President Brandon Combs. “Today’s decision is yet another FPC win preventing tyrants like Attorney General Bonta from putting you in prison for exercising your fundamental rights. The court’s decision is both well-reasoned and the required result under the Constitution and binding Supreme Court precedent. As an aside, we hope Governor Hair Gel is getting used to losing so much and look forward to hearing him cry harder as we dismantle California’s immoral and unconstitutional gun control regime.”

This significant victory follows similar FPC wins in New York, New Jersey, and Maryland. FPC will continue our important work to free individuals from authoritarian bondage in California and other repressive states across the nation.

Challengers in the case include FPC, Orange County Gun Owners PAC, San Diego County Gun Owners PAC, California Gun Rights Foundation, and three individuals. They are represented by Bradley Benbrook and Stephen Duvernay of Benbrook Law Group.

The injunction prevents enforcement of California’s carry bans in the following locations:

  1. Hospitals, mental health facilities, nursing homes, medical offices, urgent care facilities, and other places where medical services are customarily provided
  2. Public transportation
  3. Establishments where intoxicating liquor is sold for consumption on the premises
  4. Public gatherings and special events
  5. Playgrounds and private youth centers
  6. Parks and athletic facilities
  7. Department of Parks and Recreation and Department of Fish and Wildlife property, except hunting areas
  8. Casinos and gambling establishments
  9. Stadiums and arenas
  10. Public libraries
  11. Amusement parks
  12. Zoos and museums
  13. Churches, synagogues, mosques, and other places of worship
  14. Financial institutions
  15. Any other privately owned commercial establishment that is open to the public, unless the operator clearly and conspicuously posts a sign indicating that license holders are permitted to carry firearms on the property.
  16. Parking areas as they pertain to California Penal Code § 26230

By the time the appeals process runs out the state will have new infringement laws written.

FPC is a (c)4 but the Firearms Policy Coalition Action Foundation, https://www.fpcactionfoundation.org/ is a 501(c)3 for those who prefer a tax deduction. If you are over 70-1/2 you can give directly from your traditional IRA without paying taxes on the withdrawal and still claim the deduction. It also reduces your future RMD.

I believe I will be signing up for the FPC. Yuuuuge win… Governor ‘Hair Gel’ WANTS citizens unarmed, vulnerable and unable to defend themselves against the crazy CIA/FBI-groomed shooters who do and will bring guns to all the spots mentioned. ‘Hair Gel’ wants you to live in fear…you are more controllable in fear and less likely to recognize the real monsters like him who are deliberately destroying the country.

Another court decision (among others), that the democrat leadership in California. Will simply ignore, by enacting new legislation with slightly different wording. Denying the same rights, while waiting for the case to pass through the court system.

hey, if they don’t know, they don’t know. i would rather be a hard target than an easy one. i carry where ever there is not a magnetometer forcing me to go through it. i avoid going those places.
wouldn’t it be easier to say where you can carry a firearm in commiefornia?
