Attorney’s Office Said Deadly Omaha Shooting Is Classified As Self-Defense ~ VIDEO

OMAHA, Neb. — In the early hours of Tuesday morning, a homeowner in Omaha defended himself against a violent intruder, resulting in a fatal shooting that authorities have classified as self-defense.

Police were called to a home near 51st and Q Streets around 2:20 a.m. Upon arrival, they found 40-year-old Nicholas Gomez with a gunshot wound. The homeowner, who has not been named, told police that Gomez was acting erratically and he feared for his safety. After questioning, the homeowner was released from custody.

The Douglas County Attorney’s Office has indicated that, based on the current evidence, the shooting is being treated as a case of self-defense. No charges are expected to be filed against the homeowner.

Neighbors provided additional context, revealing that Gomez had a history of violent behavior. Rosanne Pickering, a neighbor, mentioned that the homeowner often rented rooms, but Gomez was not supposed to be staying there anymore.

Pickering stated, “He told me somebody got out of jail and came there to pick up some of his stuff he had there and then he wouldn’t leave. He told me he was fearful of this guy, that he’s kinda violent and he just had no idea how to get rid of him.”

Court records show that Gomez had a series of assault convictions, including an incident in 2016 where he assaulted a police officer. He most recently served 100 days in jail for a probation violation.

Josh Sidney, a lead instructor at 88 Tactical, highlighted Nebraska’s self-defense laws, noting that there is no duty to retreat in one’s own home when facing threats of death or serious bodily harm. Sidney emphasized the importance of proper training in handling high-stress situations to ensure appropriate responses.

Sheriff Aaron Hansen echoed these sentiments, stressing the value of extensive training for anyone who owns a firearm. “When you have a deadly weapon and you use it, the rest of your life and your freedom could hang in the balance,” Hansen said.
