“Red Flag” ERPO Bill Passes the Colorado State Senate by ONE VOTE! 18-17

Colorado – -(AmmoLand.com)- With opposition from over 40 county sheriffs, dozens of city police chiefs, and the Denver and Aurora Police Unions, this bill still passed. All Republicans and one Democrat voted against it in the Senate. It has already passed the House with all Republicans and two Democrats voting NO. Because it does have Senate amendments, so it will go back to the house to vote on those amendments before making it's way to the governor's desk.

From here, We will be working with law enforcement across the state to put pressure on Governor Polis to either veto the bill, or send it back to the legislature for re-consideration.

This effort will be BIG! If you or someone you know would like to sign on to a letter or be part of this effort, please contact me by replying to this email ([email protected]) or contacting me here. How privileged are those lawmakers to pass law they will never have to enforce, while those who will have to enforce it are saying NO. I will also be working with the sheriffs to request an injunction that would prevent it from becoming law (if signed, it would officially become law on Jan 1, 2020). Just like all of you, I'm furious. This piece of legislation is unbelievably bad. Although I will say in this current hyper-partisan body of government, I am proud of how far we have pushed this narrative, that votes were tough to get, and that Democrats crossed party lines in opposition, right down to it passing by a single vote. We are setting brushfires and this vote has only fueled those fires. We're just getting started.

    Guess what folks? One vote in this case carries the full weight of the win in a democracy. That’s the way the founding fathers planned it and that’s exactly how it worked in this case. I don’t like the outcome either, but a victory by one vote carries the exact same weight a purely unanimous vote.

    How can any of these “Red Flag” bills not wind up as arbitrary and capriciously applied? The very nature/wording of the bills leave them open for abuse and that is the danger. If you are friends with the court (judge, lawyers, cops), they won’t be applied to you, but if you piss off one of the above, then they will apply the law to you. There is no standard of fairness or objectivity inherent within any of these bills and are a, in effect, a license for abuse.

    When this bill was proposed, even if a falsely accused wins in Court (confiscation first, due process second) and is found innocent (after spending thousands of dollars to prove such), confiscated weapons will still not be returned to the accused for a year, was this the version which has passed both chambers?

    The “kid gloves” are off. Last election, the deluded “imports” from CA allowed my adopted Silver State to go cobalt blue. Now there are the expected 2nd amendment attacks being waged here in the form of proposed gun bills. What has just happened in Colorado ought to mean “Defcon 2” to all gun owners. Even larger loads of Horse**** now face us.

    RE: The kid gloves are off. What does that mean in terms of action? Assuming you voted “red” exactly how are you taking the gloves off in a more demonstrative manner? Inquiring minds want to know. Additionally, please explain in detail how to implement “Defcon 2”. How can i tell when a voter does that so i can do the same; so we all can do the same? Write letters? Make urgent comments? Kick the dog? Exactly what actions should I emulate?

    I am 100% with you Robert!!! This cannot stand, and should be brought in front of the SCOTUS. This law violates at least half of the Bill Of Rights of the Constitution. I mean if they have struck down California’s magazine ban as UnConstitutional, then this should also qualify!!! I hated the day Colorado voted to legalize the “Hippy Lettuce” as well!!!

    I am confident that protective orders will be used for the safety of those who reside in the state of Colorado, and not be abused. Protection from a potential suicide or a harmful threat from a perp. As time passes on, we can now verify how valuable a tool the ERPO will be. While enabling our right to own a gun for law abiding citizens. A good way to end the week.

    SHALL NOT BE INFRINGED! What part of that don’t you understand?! And it sure as hell doesn’t say anything about only law-abiding citizens having that right! It’s a creator given, constitutionally protected right. NEWS FLASH, suicidal people don’t need guns to commit suicide, and the best protection from a gun wielding crook, is A GUN!     You obviously have NOT read the bill, nor do you understand or care about its ramifications.
    No matter what you are told by its supporters, the person who calls the police can remain anonymous, not even 2a relative and maybe just have a difference of opinion with you over something mundane like you drove over his petunias when backing out of your driveway.
    These laws violate the First, Second, Fourth, Fifth Amendments of the US Constitution as well as several parts of the Colorado State Constitution.
    I am not a lawyer but I believe that this is actually legalized SWATTING!!

Green Weenie Dog you are replying to just made a few more bucks because you answered him.
