Courts Put On Notice ~ Time to End California’s Sneaky Handgun Roster Gun-Ban Scheme

BELLEVUE, WA – -(AmmoLand.com)- The Second Amendment Foundation has filed a memorandum of points and authorities in support of its motion for a preliminary injunction or, alternatively, a motion for summary judgment in a case known as Renna v. Bonta, which challenges California’s novel ban on hundreds of handgun models under its “Unsafe Handgun Act” (UHA).

This ban applies to handguns commonly used for lawful purposes by millions of Americans across the U.S. The UHA maintains a “Roster” of handguns, which may be lawfully sold in California. Handguns deemed “unsafe” under the UHA’s various technical and other requirements are excluded from the Roster and, therefore, may NOT be sold in California.

SAF is joined by the Citizens Committee for the Right to Keep and Bear Arms, the Firearms Policy Coalition, PWGG, L.P., North County Shooting Center, Gunfighter Tactical LLC, San Diego Gun Owners PAC, and several private citizens. They are represented by attorneys Bradley A. Benbrook and Raymond M. DiGuiseppe.

“Ever since California adopted this Act and created its Roster,” said SAF founder and Executive Vice President Alan M. Gottlieb, “the number of approved handguns has gradually been shrinking. In 2007, the law required semi-auto pistols to have a loaded chamber indicator and magazine disconnect, rendering a pistol inoperable unless the magazine is inserted. In 2013, California added a ‘microstamping’ requirement that is not available on any commercially available pistol. So, no new pistols have been added to the Roster since 2013.

“In 2020,” he continued, “the law was changed to require the state Department of Justice to remove three ‘grandfathered’ handguns from the Roster for each new handgun added. The result has been a dramatic reduction in the number of approved handguns allowed in California.

We believe the UHA, through its Roster, is banning handguns in California that are in common use across the country, and therefore violates the Second Amendment.

This has resulted in harm to firearms dealers, individual citizens and firearms-related advocacy and public policy organizations, and it cannot be allowed to continue, especially in the wake of June’s Bruen ruling by the U.S. Supreme Court.

“There is no founding era precedent for declaring some guns ‘unsafe’ and banning their sale in California when they are in common use across the country,” Gottlieb said. “We’re asking the court to consolidate a preliminary injunction hearing with the trial on the merits scheduled in February, and issue an order declaring this handgun ban scheme unconstitutional and issue a restraining order against its further enforcement. Alternatively, we are asking the court to enter a summary judgment in our favor.”

lets hope a judge just trashes this and declares the scheme unconstitutional

While clearly unconstitutional from inception – this law has been allowed to stand for over 15 years. I suspect courts will not toss entire law, but instead attempt to limit restriction. Being used to wearing the yoke – I imagine Californians will be thrilled by newfound right to buy a gen 5 glock.

This roster systematically removes handguns that are currently on their list and requires periodic recertification if the manufacturer wants their firearms to be sold in California.
The list is dwindling and what remains are higher prices and limited availability. This has infringement written all over it.

You can bet your sweet bippi that Oregoneistan and washington are going to try the same thing as soon as the issues for requiring a permit to buy a gun are resolved.

WA and OR will never quit. Even in light of 114 and the lawsuits against it’s unconstitutionality, Inslee and AG Ferguson are crafting the same legislation here in WA.

The communists in California would love to ban all guns but the constitution stands in thier way . Glad I live in a free state exempt from the insanity of liberal clowns so far . -33 actual and -53 wind chill a couple days ago could have something to do with the panzy asses not residing here . . FJB and all Democrats !

I think it is more about the trendy social programming like we have hear in Colorado. They (the cult) love their reptilian fake reality and up-loading their daily false narrative like robots. Lot’s of them are on those big pharm mass shooter drugs, they are the ones I enjoy fuking with the most because their fake reality is an easy target. They are more into working slave status for the globalists not ranching and farming which for is good because it makes it easier for me to buy ranches and farms here. I got my hooks into a couple right… Read more »

Yeah, a HOT place they can have an excuse to defraud the taxpayers of billions of dollars under the guise of, “Global Warming”.

This is exactly why we need to heavily donate to the second amendment foundation. These actions and lawsuits to fight against these robbet barons of our liberty, freedom and sovereignty is still easier and cheaper than the last resort.

F$cking awesome.
I hope the sales in Commiefornia alone equal what the rest of the country has been buying.
I thought the numbers were lower then they should be.

The cops on the street in front of your house attacking your rights through social media as just released in the Twitter files is at least as big a problem as the ones enforcing disarmament. They spent a decade swarming back and forth in front of my house and parked in my driveway over my posts. My protected speech has been a matter of national security and specifically why I voted down more funding for my local cops even after running the entire force out of my county and replacing them. Less government equals more freedom. Just like right here… Read more »

There is no founding era precedent for gun confiscation except they couldn’t be taken into jail with us and in some cases we got disarmed for a few years for rebeling against the government. Convictions in modern times are based upon being set up by the fake governments thugs.
