Federal Judge Blocks California Ban on Non-Resident Carry Licenses

SAN DIEGO – This week, Federal District Court Judge Cathy Ann Bencivengo issued a permanent injunction siding with FPC and blocking enforcement of California laws preventing FPC’s members who reside outside of California from acquiring a carry license (commonly called a “Carry Concealed Weapons” license, or “CCW”). The injunction follows the Court’s July decision that the law was unconstitutional under the Second Amendment.

Earlier this week, the Court held a hearing to resolve a dispute over the form of the injunction.

The State of California had asked the Court to issue a complex injunction requiring applicants to submit a sworn statement declaring intent to carry in a specific county within the next 12 months and limiting applications to that county — along with five pages of additional conditions and qualifications. But the Court agreed with FPC, which asked the Court to enter a straightforward injunction simply blocking enforcement of the ban altogether.

“People do not lose their right to keep and bear arms when they visit California. With this injunction, they can finally protect themselves and their families while in the Golden State,” said FPC President Brandon Combs.

This FPC victory and others like it are especially important because the only way that most people can lawfully carry within 1,000 feet of schools is to possess a valid carry license issued by the exact state in which the person is carrying. FPC explained that the Court’s limitation of the injunction to the named plaintiffs and FPC’s members is a consequence of the Supreme Court’s Trump v. CASA, Inc. decision.

The process of a non resident obtaining a permit in CA. is almost as punitive as getting caught carrying, with out one.

Ok, so now Kommiefornia has to issue out of state permits. How about Oregoneistan and the rest of the states. This didn’t change the major problem which is making my right a privilege. I shouldn’t be required to get a permit for kommiefornia to carry in kommiefornia when I have a permit for Oregoneistan. Since Oregoneistan doesn’t honor all states permits or any at all so I think it still is, I have a permit for Utah and Nevada so I in carry in WAShington, Montana and other states I go to and will be going to. We as humans are horrible at assessing Risk. People are afraid to go into the ocean for fear of being eaten by sharks, but you are far more likely to die while driving to the beach than being killed by a shark while at the beach. . . $185 for the application, 6 hours class time, unknown issue time, no standard cap magazines…….spare me………..carry as if the constitution applies in ca.

friends who are ca cops always tell me that ca cops are good, they aren’t totalitarian nazis and won’t take guns from law abiding citizens……..it’s a lie
and even with a permit ca is a patchwork of BS “no go zones”

Obtained a carry permit in Texas, paid the money went through the class and shooting requirement. Even though it’s not required to conceal carry in Texas, did it for reciprocity with other states I travel to and through. When are we going to allow CCW permit holders fifty state access like we would for our driver’s license? Why should we have to pay CA money that we already paid for in our state? Wouldn’t this be considered a tax? Then I would have to comply with their magazine restrictions and gun restrictions. Very frustrating in a country with the Second… Read more »

There was a time during my business life I would have cheered this. I was forced to go to CA for work, I carried anyway, and took my chances. Now I don’t care. Might as well offer a carry permit for Somalia. CA is getting more like Somalia every year, and I don’t travel to either one.
