Debunking 60 Minutes Segment On Colorado’s Red Flag Law

Debunking 60 Minutes Segment On Colorado's Red Flag Law
Debunking 60 Minutes Segment On Colorado’s Red Flag Law

CBS recently aired a 60 Minutes segment on Colorado’s “Red Flag” ERPO law and the debate surrounding it. As you can imagine, it needs debunking. You can watch the full segment at the CBS website here. It is 14 minutes long and free to watch. A big thank you to Weld County Sheriff Steve Reams for being a much-needed part of the conversation.

Here’s our take on the episode:

1.) They begin by stating that there have been 366 mass shootings this year. There have not been and we’ve already debunked that. Learn more: www.rallyforourrights.com/we-are-being-lied-to-about-mass-shootings-again

2.) California passed their Red Flag law in 2014, not 2016. Now, this is a minor discrepancy, but something 60 Minutes absolutely should have gotten correct. If they are going to flub on such a simple fact, what else will they get wrong? Do they not know how to use Google?

3.) Connecticut had a Red Flag law in place when Sandy Hook happened. Theirs was enacted in 1999. Sandy Hook happened in 2012 and was NOT the catalyst to write the law as the segment implies.

4.) Law enforcement is not the only entity who can petition the courts. Spouses, ex-spouses, roommates, former roommates, any relative or step-relative, a Tinder date gone wrong, or someone you had an affair with are all also people who can petition the courts for a Red Flag ERPO. If you don’t fall in to the insanely broad range of people the law defines as “family members”, you can then simply go to a law enforcement officer and have them file the petition for you.

5.) The temporary orders are granted based on a preponderance of evidence – even when law enforcement files the petition. Preponderance quite literally means the more convincing evidence, yet the person being accused is not present at the hearing and doesn’t know it’s taking place, therefore cannot present any evidence at all. The accuser will ALWAYS present more convincing evidence. How will any of these ever be denied?

5.) It’s despicable how Sheriff Tony Spurlock said “this is a tool to take away guns” then turns around and says “this isn’t about taking away guns, it’s about getting people the help they need” when there is absolutely NO mental health component to the Colorado law.

6.) Watching the Zackari Parrish footage has us wondering how that is any different than serving a Red Flag warrant? How would the outcome change? Also, if they just left him alone that night, what would have happened? Why did Spurlock send his deputies into what he knew could be a gunfight with soft body armor?

7.) Sheriff Steve Reams was thoughtful, reasonable and great in pointing out that we need to be helping people, not simply removing the tool that could do harm. We are thankful for him.

8.) They omit the fact that more than 50 of Colorado’s 64 sheriffs oppose the law as written, as does the Denver Police Union and the Aurora Police Union. More than half of Colorado’s counties have passed Second Amendment Sanctuary resolutions.

Deplorable Bill

Ye shall KNOW the TRUTH and the TRUTH shall set you free. Anyone, ANYONE can call in a complaint on anyone else and they get swatted. All of this with no legal ramifications to the complainer. Why is that? The complainer is literally risking the lives of the complainee, anyone else in the house and the enforcement personnel sent to kill — opps — deprive/rob a citizen of his/her equipment and their constitutionally protected, GOD given right to keep and bare arms. Out in Phoenix there is/was a group of home invaders who dressed in police uniforms, badges and weapons.… Read more »

For the RED FLAG crap, just remember one thing SPEED is your friend,as in VELOCITY,it can make up for numbers.

First of all ANYTHING reported by “60 Minutes” is either a lie or the story is so tainted touching it requires a “hazard device handling policy”. Personally I only have direct knowledge of two stories they ever aired that I know of during the last 50+ years. Both were filled with lies and innuendos and I was backed up by a person who was actually there and witnessed one of them. CBS as with most news outlets are biased and liars.

Deg4u

All but one I agree with you on, Fox is the only one of these so far I’ve seen tell it like i is.

Vern

Local gun clubs are joining in in various ways to support the action in Denver by pro 2A groups for those who can’t make it to Denver.

Doszap

Excuse me but WHY are we getting notified of this ON the 7th?.

TheRevelator

Some feelings were hurt here because their ideas were rejected after considering their merit. Let this concern everyone, It does not matter if you are new to the site or an old-timer. If in the delivery of your thoughts and opinions you happen to say something foolish or support an idea which is factually wrong, do not be surprised to be called out for it and for it to seem as though everyone is against you. If caught, own up to it and be willing to say “You know, I didn’t even think about that.” and chances are you’ll get… Read more »

Update: Over three weeks after making a foolish comment, an individual known as “Foe Pa” has chosen to come back and attack those who called attention to the factual inaccuracies in his statements, both on legal matters, and the nature of the event in the article. Perhaps in some vain hope that 19 days after the last comment was placed here, or over 28 days since his last comment was made here, he returned to seek written revenge against those he felt made him look like a fool(not understanding he did that quite well enough to himself) while perhaps avoiding… Read more »

Just a sidebar note: There is no such thing as the Denver Police Union. There is no union for the Denver Police.

UncleT

I think these two issues should have separate threads. Unless you’re in CO, you won’t being interested to see the 60 Minute read because you won’t know it’s there. .

Laddyboy

Uncle T: It IS relevant to EVERYONE across America who has “skin in the game”. These ANTI-gunner NAZIS, like ‘bloomberg’ and sycophants co-conspirators, are funding and trying to INFRINGE Americans’ gun RIGHTS across America. IF these NAZIS can succeed in one State, THEY (‘soros’ and sycophants) will fund the PUSH for the same INFRINGEMENTS in another State.

Doszap

Bloomberg is buying the races in SIX other key swing states, and he said MONEY is no object. When you’re worth 50+ Billion and take in 8+ billion a year what’s throwing a couple of billion to BUY a FRIGGING election, this was never meant to be and the short little Yankee SOB HE must be stopped.
I am sick and tired of Cali and NYC trying to RUN(BUY) the damn government and tell Texans and Oklahoman’s and the rest of America HOW we’re going to live.

Foe Pa

The horse is already out of the barn. People need to understand that while a show of opposition can have political benefits down the road it isn’t going to alter the law or the way the law was written which provides for little impact by local law enforcement. In fact it renders local opposition and the cries for “sanctuary counties” little more than political posturing. People still don’t seem to understand the potential ramifications of this bill. I would suggest that the people of Colorado who oppose what is happening in Colorado make a concerted effort to identify areas within… Read more »

Foe Pa

Just what exactly don’t you like about what I wrote? I am not criticizing these folks for demonstrating but I am telling you that it wont change the law. To say that you wont comply is simply not understanding this law that is going into effect. You wont know that you have been adjudicated a “mental defective” or a danger to someone (anyone?). You will have been adjudicated a mental defective by a “judge” in an ex parte hearing that you have no knowledge of, and where you have no advocate, and where the outcome will be decided by a… Read more »

Buddy, you HAVE to prepared at 3 a.m. or any other time. Get up to speed regarding the rapidly deteriorating USA.

Finnky

@ClarkKent – You may personally be able to be up and running at 100% – 24 hours a day. The rest of us humans are not super human beings and must rest at times. We also hold jobs and spend the majority of our time doing productive tasks – other than wasting time posting to this website 🙂

Finnky

@Foe Pa – There is a herd of group thinkers romping through this website. They flock together to down vote reasonable posts – just to tick off reasonable people. Pay them no heed.
Your second post sounds a lot like a few I’ve put out – requesting what it is that people object to…
Personally, I’d be happy to down vote what you say. You are right, but I object to the reality you point out.

Doszap

Excuse me, if you have to ask what it is that people object to, go back to sleep.

RED FLAG LAWS are UNCONSTITUTIONAL.
The law is clear the BOR’s is clear on what WILL BE and HAS been violated, 1st-2nd-4th-5th and 14th Amendments have been thrown in a dumpster.
WE must fight back not with limp wristed meetings, put feet on your words if they come.If you can for small units of YOUR best like minded friends.
Remember, ANY law,or SO called law, is of NO EFFECT and is not to be OBEYED if it does not go back to the ORIGINAL INTENT of the Const and BOR’s and Amendments.

Considerthis

A new poster here is treated like the new kid in the neighborhood. If you come here thinking you will be treated like an equal and be respected, it is not like that. If you think it is an forum open to a different perspective, if you have a new idea it would make no difference. This is more like being jumped into a gang. They will join together to beat the crap out of you. There is a pecking order here . If you are attacked by one but it looks like you might survive, others will join in… Read more »

TheRevelator

@Considerthis It is an open forum, and ammoland has worked very hard to make sure it stays that way. The difference between that and what you are expressing is the difference between having the right to speak openly, and demanding that others treat what you say and accept it as valid. The latter is not a right. It is unfortunate that some people attempt to correlate their opinions with fact as this is not the case. It is the human psyche which does this, often linked to ego, and therefore will often blame every other person under the sun for… Read more »

I regret that I could only give you one thumbs up rather than the one thousand that you deserved.

Revelator, I thank for the time and attention you gave to formulate your lengthy response. I apologize for the delay in answering, however I wanted to comply with your demand that I weigh every word and think before posting. I hope you will be pleased to know that I will go above and beyond your demand by also weighing every one of your words and thinking about them. Since you say opinion must not be argued, then certainly I must not argue against any opinion that you offer, and I must not cry and whine that you are intelligent and… Read more »

TheRevelator

@Considerthis. I want to ask you an honest question. Where exactly did I demand that all must agree with my opinions, or paint a picture of you being in a diaper? My initial response was concerning an explanation of why the criticism FoePa received was brought on by the content of his comment, and that your defense of that content was not born out by fact. So let me point to your two main accusations. 1.”Since you say opinion must not be argued, then certainly I must not argue against any opinion that you offer” 2.”you skillfully painted an image… Read more »

Considerthis

Revelator, again I thank you for taking the time to respond to my comments. I have no concern about harm done to myself. I do have concern about how this dust up between you and I appears to others. As I have said, I did not come here to fuss and argue. I had already decided to stop posting here when I saw my messages were disturbing some people and giving the whole rights community a black eye because of the rancor they caused. It has become obvious to me that I am just not good enough to be posting… Read more »

TheRevelator

@Considerthis “It has become obvious to me that I am just not good enough to be posting here.” You have a right to be here, and there is no bar of “good enough” when it comes to Rights. Expect what you say and the context of it to be examined to see if it passes muster though. “Since you make so many decisions for so many people, it only follows that it will be you that decides what is evidence, and what is not.” I do not decide what facts or evidence are. All evidence must be weighed, and it… Read more »

Foe Pa

Well it appears to me that you and some others missed my point entirely. I was not and and am not wrong about the law that was passed. YOU are putting words in my responses and assigning intent that is not there. I never told people to get over it. I understand that the law violates our Constitutional rights and I have never supported the law. What we like or dislike doesn’t change the FACT that the law is in effect. The bill was passed and signed into law by Colorado’s liberal governor. There is no provision in the law… Read more »

TheRevelator

@Foe Pa No, it was not missing your point. You made a comment attempting to dismiss and criticize a viewpoint that you did not agree with, for reasons you did not have evidence to back up your statements. Your statement that “its too late, the law is passed, the horse is already out” was criticized correctly, noting that state law cannot supersede the Constitution. It was an incredibly dumb argument for you to try to make for the very fact that Article 6 Section 2 of the Constitution is evidence anyone should be familiar with. “I understand that the law… Read more »

You won’t mind then if I laugh at your reply. I didn’t get on this board to trade insults and I can’t fix stupid. You want to appear “in the know” but your reply is B.S.. You don’t want to discuss facts. You want to assert your opinion which as I stated is B.S.. You formed an opinion about what I said that is not based on facts and you have attempted to twist what I said and fabricate the rest. If you can’t read what I wrote then get someone to read it to you. I am disappointed that… Read more »

@Foe Pa “I didn’t get on this board to trade insults and I can’t fix stupid.” I love when hypocrites try to argue. 🙂 Love it. So you are not here to trade insults, but the first thing you want to do is insult anyone who can actually tear apart your original argument. “You want to assert your opinion which as I stated is B.S.. ” Your statement is an opinion. What I did was cite the Constitution. So you are saying Article 6 Section 2 is just a B.S. opinion? lol “You formed an opinion about what I said… Read more »

@Foe Pa You want to know what was wrong with your original post, or what was objectionable, so here it is. “People need to understand that while a show of opposition can have political benefits down the road it isn’t going to alter the law or the way the law was written which provides for little impact by local law enforcement.” What you just told people was they need to sit down and shut up. Get used to what the left does. I’d like to provide you with a factual, reasoned response to explain why you are wrong. It starts… Read more »

Very astute and absolutely correct on all points Revelator. I might add, I do believe unfortunately, that we are beyond the point of no return concerning civil war. I would like to be proven wrong on this, but it seems as though the communist left will stop at nothing short of complete control of every aspect of our lives. I do wish people would stop calling the leftists “democrats” as they are in reality fascist – communists. I believe we can save our nation as it was meant to be, but it’s going to be one hell of a fight.… Read more »

I also believe it to be foregone at this point, and like you I do not wish for it. I am preparing however.

Foe Pa

I am not talking down to the voters in Colorado. I didn’t tell them to sit down and shut up so quit putting words in my mouth. I am frustrated that they are not spending their money and energy in a way that can achieve necessary results. You can pontificate about our Constitution superseding laws but that doesn’t stop the results of bad or unconstitutional laws. Assuming that you are a victim do YOU have the financial means to combat Colorado and the Federal Government all the way to the Supreme Court of the United States? Very few people have… Read more »

So the fact that they are not spending their own money in a way which only you have predetermined to be best for them, that is why you are talking down to them(but claiming not to). So when did Colorado ever appoint you as the person qualified to tell other people how their money needs to be spent for their own uses? Now, again, since you want everyone here to know how stupid anyone disagreeing with you is(because you are not talking down to them), no matter what evidence they have or if they talk about that pesky little US… Read more »
