What Anti-Gun Candidates Introduced: The Freedom from Assault Weapons Act

United States – -(AmmoLand.com)- If there is one development from the 2020 presidential primaries that Second Amendment supporters should view with concern, it is the fact that confiscation of modern multi-purpose semiautomatic firearms was not an immediate non-starter for those running for national office. If anything, it is, if not embraced, tolerated among one of the major political parties in the United States.

The candidate responsible for this was Representative Eric Swalwell (D-CA), whose presidential campaign didn’t even make it to Iowa. The idea of an Australia-style ban on modern multi-purpose semiautomatic firearms was picked up by Beto O’Rourke, now designated as Joe Biden’s gun-control czar should Biden win the White House, after the El Paso shooting.

His agenda went further than the ban, but he has backed up his campaign trail talk with the action of filing a bill, HR 2959, the Freedom from Assault Weapons Act. Swalwell began to push an Australia-style gun ban in 2018. However, he did not introduce legislation until the 116th Congress, which was controlled by Democrats.

That tactic is not unusual. Representative Bobby Rush has sporadically introduced the Blair Holt Firearm Owner Licensing and Record of Sale Act, usually when Democrats had control of at least one house of Congress. The only exception was in 2018, in the wake of the Parkland shooting.

Swalwell’s intentions may have been known, but the text of his legislation gives us an idea of how he intended to implement the ban. There is a lengthy list of firearms banned by name – and it goes far beyond the AR-15. Among the banned semiautomatics are copies of the famous Thompson submachine gun, Hi-Point’s affordable pistol-caliber carbines, and even Kel-Tec’s collapsible SUB-2000 rifle. Even if the semiauto in question is in .22 long rifle, it is banned.

In addition to the named firearms, there are generic characteristics that will put the firearm on the banned list. This is not like 1994 – if it even has one item on a list of features, you will have to turn it in if the bill becomes law and is upheld. A lot of standard-capacity magazines will also be banned if Swalwell’s bill is enacted.

Swalwell’s bill does list a number of firearms that are exempted – but it should be noted no handguns whatsoever are on that list. How generous of the Congressman, he’s not completely stripping away our rights.

Three months after the bill is enacted, BATF is to start a buyback program that will last for two years. At which point, you get back the retail price of the firearms you have to turn in. This is supposed to expiate the injustice of being punished for crimes and acts of madness Americans who exercised their Second Amendment rights did not commit.

Second Amendment supporters instinctively understand no amount of money can make such an injustice right. This is a bill that can only be opposed, and when they contact their Senators and Representative, Second Amendment supporters should politely but firmly impress upon them that this is one bill on which no compromise or middle ground exists. The only correct course is for this bill to be voted down, or filibustered.

@ buck – Pray that you are correct. Majority of voter support are not single issue voters, and many consider gun rights to be a minor issue. With SARS-Cov-2019 dominating the news (because it is dominating viewers minds) election is a toss up. I suspect we’ll see landslides in many states, not clear where we’ll fall as a nation. SAF, FPC, and GOA will need to be well funded for legal battles if B wins, but let’s focus on the political battle first – then fallback to the courts if necessary. One thing we all seem to forget is a tactic Hitler used very effectively. The snitches laced within communities and organizations were huge in providing information so that he could wisk out the possible threats before anything could possibly rise up. USA & WB, As was pointed out to me by a relative who wouldn’t be more specific, “Given your history and what you’re doing on-line, assume that you’re being observed.” It came up because I mentioned that trade-craft was slipping. I came home after a long day of prearranged appts to find things subtly out of place and safe keys out of order. if I was paranoid, I’d think that someone took pictures so they’d know where things went, but didn’t notice how far back things were on shelves of other subtle differences.

– Suppose I might comply eventually, but I value life and freedom far to much to do so. My morals, though some might say squeamishness, would make complying virtually impossible for me even if I had the skills.

Not referring to the letter of the law, but to deeper requirements as it is really a call to assassinate supporting politicians.

Their death threats are no less offensive for being phrased as legalities.

@SEMPAI – I remain resistant to the subtext of these bills, which is the call for proactive violence. I remain committed to achieving political solutions while engaging in nonviolent opposition as long as necessary. I see these bills as a call to assassinate the bills authors, I won’t comply with that call. They push this in hope that freedom lovers will engage in active violence first as that would dramatically strengthen their hand – possibly allowing to unleash all governmental powers in their quest for tyranny. Finnky, I can appreciate your desire to maintain civil order and act through non-violent means to oppose the actions of unconstitutional laws and their makers. For example: see a politician and his family in the restaurant, kill as many of them as you can, on the spot, with a steak knife; see a politician out for his morning jog, run him down and cave in his head with a rock; recognize a politician on the GW bridge, use your truck to disable his car and your tire iron to beat him to death. @OV – I hope not. Just paranoid, and recognizing that I’m not likely to bring Grendel on a road trip to meet O’Rourke, Biden or bloomy. I suck with names and faces (well people in general ). I suppose it would be too much to ask the writers/legislators of their own treasonous laws show up at MY house first. @WF – previous service to our great nation left @DB disabled. I read his post as willingness to serve again if called upon. However I also think he’s done his share, so it is only fair for the rest of us to take our turn. I doubt he would complain as long as the work get some done.

Wow, thanks Finnky. I didn’t know DB was disabled. (Filing that away for future reference.) I’m disabled somewhat as well, but disability can run on a spectrum. Some being more than others. I’m just thankful I can walk nowadays. 8 years ago I was literally on heavy painkillers just to be able to tolerate simply being, and going to the can was an absolute nightmare. I still have chronic pain but I’ve regained some mobility so I’m very thankful. We’ll all do what we can when we can as best as we can.

@W.F. I know. I absolutely believe things are very likely to go sideways. Basic food stores are drying up. Ammo for sale is difficult to find. There are entire states on lock down. I hope everybody already has a good supply of beans, beacon and bullets. I saw guys out on the range who had obviously never held a firearm in their life. I was able to help a late stage 3 guy qualify for the security detail. He used a 380 Smith believe it or not.

@DiF – Yeah I had one of those when I was a strapping young man. It said “POLICE – OFFICIAL BUSINESS” on it and I’d throw it on the dash whenever I had to pull up somewhere and duck inside for something. To be honest, I can’t say I miss it.

I too, am a disabled vet from Desert Storm. Like DB, I am willing to serve again if called upon. Will probably be leading the charge. This, just as sure as I served on President Trump’s security team on 10 OCT 2019 at the Target Center in Minneapolis, MN. All night long ANTIFA this and ANTIFA that.

Death doesn’t scare me, I’ve faced it down many times in my life. What scares me is not being able to confront these left wing assholes with the ferocity they deserve. Stay frosty.

@DB – unfortunately they would never show up in person. They will send a coordinated squad when you least expect it. Could almost feel sorry for the mislead goons – but too many have expressed excitement at being given legal cover for their murderous desires.
