South Dakota Firearms Freedom Act Passes
South Dakota –-(AmmoLand.com)- The South Dakota Legislature has passed the South Dakota Firearms Freedom Act and that bill is enroute to the Governor’s desk. Governor Michael Rounds has indicated that he’s comfortable with the SDFFA and will sign the bill when it reaches his office.
SD will make the fourth state that has enacted a clone of the Montana Firearms Freedom Act. Once the Wyoming and South Dakota governors sign their respective bills into law, they will join Montana, Tennessee and Utah with enacted laws.
The South Dakota bill that declares “exempt from federal regulation any firearm, firearm accessory, or ammunition manufactured and retained in South Dakota” was passed in the South Dakota House of Representatives today.
SB 89 was approved by a 49-19 vote. The bill had already passed the state Senate on Feb. 18 with a 29-4 vote.
The bill states it would “exempt from federal regulation any firearm, firearm accessory, or ammunition manufactured and retained in South Dakota.” The spirit of the bill hearkens to the Tenth Amendment of the U.S. Constitution which says
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
The Commerce Clause of the U.S. Constitution gives the federal government the power to regulate interstate commerce, but the firearms and ammunition covered by this bill would not be involved in interstate commerce; it specifies guns and ammo that are manufactured and kept within the state of South Dakota.
A number of states across the country have been working on “Firearms Freedom Acts” which seek to rein in our out-of-control federal government. South Dakota is joining this effort to restore federalism and strengthen our American freedoms.
Other states are likely to finish their FFA enactments soon, including Alaska and Oklahoma.

Wyoming-made firearms are exempt from all federal laws. Any firearms made in Wyoming, besides automatic weapons and or grenades, are exempt from all federal gun laws so long as the gun isn’t taken out of the state.At the same time, though, the Firearms Freedom Act means that convicted felons, mental patients and people younger than 21 are not permitted to buy buy Wyoming-made firearms
Not as written – if it crosses a state line, it's subject to federal regulations by that fact alone.
since montana, wyoming, south dakota, and utah share borders, does this new law allow guns or ammo manufactured in montana to now go to these contiguous states without federal regulation?
