Despite Obama’s Sneer Its ‘Not A Plot To Take Your Guns,’ That’s Precisely What It Is

North Carolina –-(Ammoland.com)- On Tuesday January 5th 2016 we witnessed a masterful performance as Barack Obama, shedding crocodile tears, stood among victims of mass killings — whom his proposals wouldn’t help — to tell lie upon lie to the American people.

After twenty-two years as a gun rights leader, I’m accustomed to having gun control advocates trot out victims to plead for gun bans “if it will save just one life.” (Never mind that they would also cost lives.) But even I have never witnessed so cynical a manipulation of the emotions of the unwitting by a pathological liar so clearly incapable of telling the truth.

Unfortunately, even as a fawning media call his performance “powerful” and “emotional“; and even as he tugs at the heart strings of ignorant voters to shift the center of debate, some in the gun rights movement are under-estimating Obama’s power play.

Obama’s Lies

In announcing new attacks on your rights, Obama repackaged old lies, even mocking you by claiming: “A violent felon can buy the exact same weapon over the Internet with no a background check, no questions asked.” (Shipping guns to individuals other than dealers became illegal years before Al Gore invented the Internet, and selling guns to criminals is a felony.)

“we all believe in the First Amendment, the guarantee of free speech. But we accept that you cannot yell ‘fire’ in a theater.” (Law professor Obama seems ignorant of the legal concept of “prior restraint.” If we applied the gun control model to freedom of speech, you would be bound and gagged before entering the theater under the premise that you might yell “fire.”)

Or perhaps Obama’s biggest lie of all: “I believe in the Second Amendment.”

What King Obama’s fiats will actually do…

Forget the legions of BATF new agents Obama will now unleash to harass gun dealers and private sellers.

Never mind that he will now create new red tape for owners of Title II firearms regulated under the “National Firearms Act.”

Those things pale beside Obama’s real goal. Since he has been unable to mandate “universal background checks” (a/k/a “universal gun registration”) for private gun sales, he wants to incrementally end private gun sales.

How? By having the BATFE redefine what constitutes being “engaged in the business” of selling firearms.

Obama’s scheme to end private transfers.

The answer lies not in Obama’s “emotional” performance for his fawning media, but rather in what White House senior advisor Valerie Jarrett told USA Today, namely that there will be no hard definition of what “engaged in the business” of selling firearms means,only a subjective “facts and circumstances” determination.

And remember, if you are “engaged in the business,” that means you need a difficult-to-obtain Federal Firearms License (FFL), lest you be guilty of a 10-year federal felony .

And according to Jarrett, what might render you “engaged in the business” of selling guns?

  • Selling guns at a gun show;
  • Selling guns on Guns America, gunbroker.com or other Internet sites, even though you legally ship the gun to a dealer who does a background check, to complete the transfer;
  • Selling a gun soon after you bought it (better not get rid of that “dog” you just bought); or my personal favorite…
  • Selling a gun in its original packaging (never mind that the gun might be a 1950s S&W “5-screw” Model 27 for which you have carefully preserved the original box to enhance its collector value, as I have).

I don’t know about you, but even though I buy far more guns than I sell (having more is, after all, always better…), by those definitions I am “engaged in the business” many times over.

“But I only sell one or two guns per year,” you say?

Perhaps I failed to mention that there is no numerical target for what constitutes being “engaged in the business” because as our fine Attorney General, Loretta Lynch, noted:”courts have held that as few as one or two sales could trigger the requirement.”

The bottom line is that you won’t know whether you are violating the law in transferring a gun, creating a deliberate intimidating and chilling affect on private transfers.

If you liked that, you’ll love what Obama has in mind for senior citizens.

Guess who will be reported to the National Instant Background Check System so they can incur a permanent firearms disability: Buried deep in the eight page fact sheet published by the Obama administration is this little gem:

“Include information from the Social Security Administration in the background check system about beneficiaries who are prohibited from possessing a firearm…The Social Security Administration (SSA) has indicated that it will begin the rulemaking process to ensure that appropriate information in its records is reported to NICS. The reporting…[will cover people who] receive disability benefits, and are unable to manage those benefits…”

Yep. You heard it right. You can look forward to aging by having your guns confiscated once you can no longer balance your checkbook. Maybe you wanted to just leave them in your safe to pass on to the kids? Fuggedaboudit. All this, of course, in the interesting of “stopping gun violence.”

But with adversity comes opportunity…

There is an upside. In his arrogance, Obama has handed us a powerful weapon — namely, the ability to motivate voters to elect leaders who will not only rescind his unconstitutional executive orders, but allow us to continue making gains at both state and federal levels.

Weather you are in the business of or not will be up to the IRS to decide, because if it is a business you will have to register it for tax purposes. And I’ll bet you a dollar to a doughnut that they will not accept your tax returns when you are expensing all of your ammo, car, and so on. Your business will year after year be in the negative.
