New Bill to Legalize the Interstate Transportation of Magazines & Ammunition (Dave Workman photo)

USA – -(AmmoLand.com)- Gun Owners of America is proud to endorse Representative Mo Brooks’ upcoming legislation, the Lawful Interstate Transportation of Firearms Act which expands the transportation protections of the Firearm Owners’ Protection Act (FOPA).

Please ask your congressman to cosponsor this momentous legislation alongside Rep. Brooks.

Because repressive states outlawed “unlicensed guns,” Congress passed pro-gun legislation in 1986 to allow gun owners to transport firearms through these states without having to worry about being pulled over and arrested.

Currently, this provision of the Firearms Owners’ Protection Act requires:

  1. That the gun be unloaded and inaccessible to the passenger compartment
  2. That the travel through the repressive state be temporary, and
  3. That the trip originates in a state where it was lawful to possess the firearm and terminate in a state where it is also lawful.

However, it didn’t occur to the lawmakers that repressive states would begin to arrest people who traveled through those states with ammunition, but no guns.

Obviously, they underestimated the psychopathy of anti-gun crazies like New York Governor Andrew Cuomo, former Mayor Bloomberg, and so forth.

It has reached the point where someone who transits through New York while traveling from New Hampshire to Virginia—as I do—risks arrest due to state law criminalizing the possession of otherwise lawfully-owned magazines or ammunition.

Congressman Mo Brooks is about to introduce legislation to remedy that. Under the Brooks bill, ammunition and magazines would be added to the list of items protected by FOPA.

In addition, police would be prohibited from harassing transiting motorists on the basis of firearms ownership.

And even if police find some technical violation of FOPA, that nit-picking will not be enough to throw the gun owner in prison and ruin his or her life.

GOA has been looking, for some time, for a congressman who could navigate the extremely complex issues surrounding this problem. And Mo Brooks has done it.

So, we have a champion who has stuck his neck out to introduce pro-gun legislation.

And we need to recognize his efforts by reaching out to every member of Congress and by urging them to become an original cosponsor of this bill — before this legislation is officially introduced and assigned a number.

Regardless of who controls the House, it’s important to take action and to keep pushing our pro-gun agenda. You can be sure that if the tables were reversed — and if it were the GOP in control of the House — anti-gun Democrats would still be pushing their obnoxious, anti-rights agenda.

So we need to create momentum for the future pushing a pro-gun agenda now.

Blah blah blah CAMPAIGN STUNT! Personally I am already tired of reading about all these great “pro-gun” bills that are suddenly being proposed now that Republicans are worrying about being reelected. Now that they know there isn’t a snowball’s chance in hell that the bill will pass or even make it out of committee. Where was Mo Brooks in 2017 and 2018 when a bill like this could have passed? @XL, Yes, these “pro gun bills” are just a deception. All of this is already legal pursuant to our Second Amendment, enumerated civil rights. We need to force our governments to recognize that the Second Amendment obligates government and pre-empts government.

I Joined GOA first of the month.Already signed 2 letters supplied by GOA in support of Firearms Freedom. Was and still am a Life member of NRA (1 time payment decades ago) and I don’t remember 1 time they ever sent out letters for mass support of Firearms Freedom or in response to Gun Grabber Legislation.Keep Your Powder Dry

All comments regarding draconian efforts by States run by tyrants are true. The solution is to completely strip sovereign immunity from all, starting with the police officers who follow unlawful orders right up to prosecutors and judges. Not only let them be civilly sued (and attorneys fees recovered) but let them be charged with violating Federal Civil Rights laws under Color of Law. By the way, look at the communist democrat debate tonight. SEE if there are any American flags on stage. Just as there were no American flags at the 2016 DNC Convention (but, there was a communist Chinese flag on stage), I doubt to see any American flags there.

In New Jersey, the State Police are still following scum democrat Governor Florio’s directive: “Stop all persons travelling from any pro-gun state, especially if they are towing a trailer. Search their vehicle & trailer. If they have a (New Jersey) prohibited gun or magazines, arrest them, seize and sell their vehicle & trailer”. @ttj – So what do they do when traveler refuses to let them search vehicle and trailer? Law is clear that they cannot do so without a warrant or probably cause – which requires clear evidence of a crime. In fact, supreme court has placed limits on how long they can hold you waiting to get a warrant or to get a dog to sniff around your vehicle. They cannot pull you over for having out-of-state plates. Just like some gun owners are bad, some cops are bad, actually ignorant, but just like I don’t lump all gun owners as bad, don’t lump all cops as bad. a lot of us are firm believers in the 2A and constitution, and we stand up for good people all the time.

This bill is a good idea, however FOPA protections are already ignored by states like NY and NJ. Until their noncompliance with Federal law is addressed in the courts, I don’t see how extending FOPA is going to accomplish much. The same states that are now arresting and prosecuting travelers for mags and ammo will simply ignore the new provisions. Nevertheless, I will support Rep. Brooks bill.

Right now there are four (4) Supreme court justices that just might and probably would vote against that phrase as stated, so you can assume all you want, but the reality of all this is much more complex. It takes getting arrested, going thru the court process all the way to the SCOTUS and that’s IF they decide to take the case. it’s a risky proposition as it stands.
