Rocky Hill, Connecticut --(Ammoland.com)- A recent media tidal wave based on false reports and bad journalism has proven a few things about the 2013 Gun Ban: people from Connecticut and around the nation are tired of being threatened; are ready to make a stand; and the State of Connecticut does not have the stomach to enforce the edicts and laws with which they threaten gun owners.

For years, Undersecretary Michael Lawlor, the upper levels of the State Police, and Governor Dannel Malloy have sought to disarm those whom they fear.

The laws they passed show that they fear constitutionally and lawfully armed citizens.

Despite thousands of gun owners showing up at each legislative session expecting to be heard by their ‘representatives’, government officials seized upon public panic related to the Newtown Massacre, as a means to exert legislative and executive fiats intent upon disarming gun owners who have harmed no one. The Connecticut Executive and Legislative branches showed their cowardice when they installed metal detectors and armed guards at the entrances to the Legislative Office Building (LOB) only for firearms-related hearings.

Gun hating officials now have their laws on the books in Connecticut. They dreamed up those laws, in their tyrannical dystopias, but it was NOT the majority of the public that supported such laws. Despite all the severe legal language that the government passed, there is still no open discussion of enforcing those tyrannical laws, as they stand. Throughout the Legislature and the Department of Emergency Services and Public Protection (DESPP), there is only talk of “amnesty” and possibly boiling the frog at a slower rate.

It comes as no surprise that the talks of relaxing enforcement expectations go along with legislators trying to get past their re-election deadlines. If the anti-gun laws they passed are so good for everyone in this state, then why are elected officials requesting increased security, both at the LOB and at their private homes? The anti-gun legislators and officials are scared to implement their tyranny because they know that they did not have any sort of ‘consent of the governed’.

Those officials violated their oaths of office, as the Executive and Legislative branches of our Connecticut government overstepped their moral and constitutional responsibilities by passing those laws: they acted and voted contrary to our Rights and against our Constitution.

Now, State officials look down the barrel of the laws that they created, and it is very probably that they now tremble as they rethink the extremity of their folly. Connecticut Carry calls on every State official, every Senator, and every Representative, to make the singular decision: Either enforce the laws as they are written and let us fight it out in court, or else repeal the 2013 Gun Ban in its entirety.

As many media sources have pointed out, there is very little compliance with the new edicts, and there is absolutely no way for the State to know who is obeying the law or not. State officials have made their bluff, and Undersecretary Lawlor has made his position clear, that the State will enforce the laws.

We say: Bring it on. The officials of the State of Connecticut have threatened its citizens by fiat. They have roared on paper, but they have violated Principle. Now it’s time for the State to man-up: either enforce its edicts or else stand-down and return to the former laws that did not so violently threaten the citizens of this state.

There is nothing that will so completely destroy faith in those edicts faster than the State-provoked chaos and violence that will be required to enforce the 2013 anti-gun laws. Connecticut residents should not have to live in perpetual fear of “the jack boot” coming down on them. Unenforced, frequently repeated threats fall on deaf ears. By passing laws that they cannot or choose not to enforce, State officials tell the public that this State is ignorant, immoral, blind, and impotent in its legal and decision making processes. The passage of such foolishly conceived, insufferable laws is an affront to every law-abiding citizen. Every official who supports such legal foolishness mocks our State and the Constitution they swore to uphold.

If the state does not have the stomach to enforce these laws, then the legislature has until May 7th, 2014 to completely repeal these immoral edicts and let the residents of Connecticut return to their rightfully owned property and former exercise of constitutional rights and practices without any threat of State violence.

If officials of the State of Connecticut opt to get ‘froggy’ (jumping on citizens) and start to enforce the new laws (as officials have claimed a desire to do), Connecticut Carry stands ready to do whatever it takes and whatever it can do to represent and defend anyone impacted by the State’s violence.

    1. All citizens of the United States stand behind the people of Connecticut, wether we like it or not. If in even one state, our Rights are forfeit, they are surrendered in all.
      The people of Connecticut have the Right to keep and bear arms. This is not a privilege granted by the State, but a basic individual Right simply enumerated by the wisdom of the Founding Fathers in the Constitution and the Bill of Rights. The framers of the Constitution built in safeguards to allow its citizens to challenge tyranny without bloodshed. By all means, I beg everyone to use them. Elect new officials, try these unjust laws in court, speak and be heard. Only when these methods have failed can we consider other means to preserve our Rights and Freedom.
      We should hope to never need the Rights and Freedoms provided for by the Second Amendment, but if we must, We The People shall remind OUR government just why those Rights are spelled out so plainly.

God forbid we are ever forced to remind our government officials in any violent manner… but the Constitution states we must if you abuse lawful people. They don’t need to raid all the gun owner’s houses they just need to keep gun owners in fear of being caught with an illegal gun. That fear will keep them from being activists, from calling the police, & will keep them paying taxes. Anything to avoid the state’s attention. A few cases like Joseph Callahan (he called the police to report a burglary & they found his 274 guns) will suffice for them.

      Of course in any action that might be ‘characterized” as civil disobedience, one should be able to demonstrate that the government is proceeding unlawfully, and it’s the duty of the citizenry to protect their inherent rights, and secure the support of an informed public. The fact that this “legislation” is enforced through the Probate Court, could not have any other application, since it would violate the state Constitution of legislation addressing two separate subjects in one bill.

      The Probate Court system achieved a successful legislative session in 2013. Our two bills, both of which were joint proposals of the Probate Assembly and probate administration, were enacted. In addition, our budget request was fully funded, enabling us to implement much deserved raises for court employees and judges. I thank all of you who worked to develop and advocate for our bills. The material in this packet includes a summary of each bill, together with a copy of the public act. The summaries are not meant to replace the public acts and are offered only to present a general understanding of the legislation. Bracketed text in the public acts indicates deletions, and underlined text indicates additions. Please note the effective dates of each act.       Public Act 13-3 (SB 1160) An Act Concerning Gun Violence Prevention and Children’s Safety Effective Date: See individual sections SUMMARY This complex act contains several changes to laws that govern the possession, transfer and sale of firearms and addresses a variety of mental health and school safety issues. Relatively few of the act’s provisions involve the Probate Courts. Those that do are summarized below. Assault weapons and large capacity magazines Sections 23 through 31: The act prospectively prohibits the sale, transfer, and possession of assault weapons and large capacity ammunition magazines. A grandfather provision permits an individual who has legally owned assault weapons or large capacity magazines before May 4, 2013 to retain possession, provided that the owner files the necessary documents with the Department of Emergency Services and Public Protection.
      Assault weapons and large capacity magazines may not be sold or transferred to anyone in Connecticut other than a licensed gun dealer. They may, however, be passed to others by bequest or intestate succession. The executor or administrator of the estate must obtain authorization from the Probate Court for the transfer, and the heir or beneficiary must file documentation with the Department of Emergency Services and Public Protection. See Section 23 (large capacity magazines) and Section 26 (assault weapons). (Effective April 4, 2013) Ineligible persons Sections 34 and 44: Federal law prohibits an individual from purchasing or possessing firearms if he or she has been committed to an institution for treatment of a psychiatric disability or if a court has appointed a conservator for the person in an involuntary proceeding. The act codifies the same prohibitions as state law.
      In addition, the act prohibits an individual from possessing a firearm for 60 months following an involuntary commitment and for six months following a voluntary admission to a hospital for treatment of a psychiatric disability. A person who is ineligible to possess firearms or ammunition must, within two days of the event that triggered the prohibition, sell or transfer the firearms or ammunition to an eligible person or surrender them to the Department of Emergency Services and Public Protection. A person who surrenders a firearm to the Department retains the ability to sell or transfer it within one year of the surrender.
      A *conservator is obligated to transfer or surrender firearms in the possession of a conserved person and to prevent the conserved person from having access to firearms owned by others. An ineligible person who fails to transfer or surrender a firearm or ammunition may be guilty of a Class C felony. (Effective October 1, 2013) Name change Section 21: Existing law requires that the court notify the Department of Emergency Services and Public Protection when an application for a change of name is filed by a person who is required to register as a sexual offender. The commissioner has standing to object to the requested name change. The act amends C.G.S. section 45a-99 to make the same provisions applicable to individuals who are required to register as offenders convicted of committing a crime with a deadly weapon. (Effective January 1, 2014)
      Public Act 13-220 (SB 1094) An Act Concerning Revisions to the Gun Violence Prevention and Children’s Safety Act Effective date: See individual sections SUMMARY This act amends P.A. 13-3, discussed above. Again, only a few of the sections pertain to the Probate Courts. Sections 1 and 5 amend sections 23 and 26 of P.A. 13-3 to clarify that the exceptions to the law that allow large capacity magazines and assault weapons to pass to a party by bequest or intestate succession include bequests to a trust or transfers from a trust to a beneficiary under the terms of the trust. (Effective upon passage)
      Section 20 amends C.G.S. section 45a-100, which addresses applications to the Probate Courts from individuals seeking relief from federal firearms disability. Section 20 precludes the court from granting such relief if state law prohibits the petitioner from possessing firearms due to an involuntary commitment, within the preceding 60 months or a voluntary commitment within the preceding six months. (Effective October 1, 2013)

    9. So what happens in a state where they have banned these guns, and say a homeowner who has not relinquished his firearms uses a gun deemed banned to protect his home from invasion? The homeowner now would be considered more of a criminal in the eyes of the state than the home invader?

    10. The funny thing of this whole CT ban? The fact that patriot organizations from all over the United States are going to come to CT once the confiscation begins.

      I bet the CT government never thought they would have to fight 600k volunteers from all over the country who will not let this stand. I’d love to see the horror on their faces when their police are arrested, disarmed, and stripped naked for all to see, and the knowledge they the elected officials are next.

    11. Why should Connecticut enforce the laws they passed when the President and AG Eric Holder use selective enforced of federal laws. We have a corrupt federal government and followed by a corrupt state governments.

    12. SB1160 and related actions by the state are not law. Article First(Declaration of Rights), Section XV states: “Every citizen has the right to bear arms in defense of himself and the state.” It is an unalienable, inviolate, inherent, God given right that cannot be legislated from the people by the Legislative branch, it cannot be executed from the people by the Executive branch nor can it be adjudicated from the people by the Judicial branch. That fact aside, no Statute can supersede either the U.S. Constitution or any State Constitution. The action taken by the State Legislative and Executive branches on April 4, 2013 is in direct violation of Section XV and therefore is not and never has been law.

      Look; no officer acting as a thug and violating his oath to the Federal Constitution is fit to wear his uniform or carry a firearm. If such an individual is collected, I think I would relieve him of the firearm(s), strip him of his uniform (to be retained for safekeeping), and “reclothe” him in feathers a chickshit would deserve,and send him on his way home. IMHO of course.
